IRS Hearing On IRS
— DrewM

Lois Lerner is going to assert her 5th Amendment Right to avoid self-incrimination.

That's her right. She should also be fired immediately. She has no right to draw a paycheck from the People Of The United States Of America if, as a government employee, she is unwilling or unable to cooperate with legitimate Congressional oversight, then she is unfit to continue in her position.

It's on CSPAN-3 and some of the cable nets are breaking in and out. You can't get a livestream here.

BTW- bumping down amnesty news is part of the problem. Obviously this is hot news but amnesty is, in the words of Joe Biden, a Big F'n Deal.

UPDATE: What a smug SOB she is. She sat there like she'd done nothing wrong and was above it all. She's the perfect bureaucrat. Clean the lot of them out.

The Civil Service system doesn't prevent politicization of government, it prevents anything being done about it.

Issa dismissed her and her attorney from the hearing.

7 Jordan (R-OH) brings Benghazi in and Lynch (D-MA) has run through human rights abuses by tyrannical govts and lumped this right in there. And just tossed in the idea of a Special Prosecutor. Could be a rough day for the IRS cronies.

Jim Jordan gave a pretty good opening statement

I hope they resist the urge to make more statements and just ask questions

make them say on the record, over and over again, that they take the 5th.  Like the mafia

This isn't just the IRS.  Its all of it.  Its the state against the citizen

This whole bevy of scandals is SOP for the Obammy regime.  Since day one in office it's been common practice for this alleged administration to overwhelm the public with outrage after outrage, so that we can't focus long enough on one before being forced to address another.   I absolutely believe this IRS thing was put out there to    distract from Benghazi   AND from amnesty AND from gun control -- don't think for a minute the latter is dead, because it won't be if Obammy ahs his way.

"But why would the regime shoot itself in the foot    with this IRS   story?" you ask.  "It's stupid!   It's   cutting off yoru nose to spite your face!"

But it's also    the thing that's got everyone's attention,   from top to bottom,   with plenty of fall guys along the way to protect the     Preezy.    Not a lot of low level employees you can blame for Benghazi.   Not a lot of low level employees voting on amnesty.    Not a lot of low level employees pushing the buttons on gun control.    But there are PLENTY of LLEs in this IRS story,   and the AP/FNC story, too -- enough to keep the MFM and the LIVs occupied for months if they wish.

We have to juggle all of them.   It's hard and it sucks, but every single one of these stories has to stay in the air.

103 If you give someone immunity, they cannot plead the 5th because it becomes impossible to testify against themself.

You lost the ability to go after the person, but you do it when it means you get the bigger fish.

My worry is that they have to get the DOJ to agree to not prosecute someone so that information can be obtained that may implicate... people in or over the DOJ.

112 83 was Gowdy's point that by giving an opening statement, she was testifying and thus waived the 5th? --- Probably. As the book Casino pointed out, mob-affiliated people like Frank "Lefty" Rosenthal couldn't answer questions as innocuous as "Are you left-handed?" during Congressional hearings on the mob because it would be used to force them to answer other questions. They had to plead the Fifth for everything.

115 Reposting 'cause I worked hard dammit! --- Now I wanna tell you a story. I'm gonna ask ya'all to close your eyes while I tell you this story. I want you to listen to me. I want you to listen to yourselves. This is a story about a woman, wanting to start a group to set the country on the right path. I want you to picture this woman. Suddenly a FBI truck races up. Two men jump out and grab her. They drag her into a nearby IRS field office and they lay her records out, and they rip her tax returns from her files. Now they climb on, first the IRS, then the FBI, and ATF, auditing her, interrogating her like a criminal, shattering everything innocent and pure -- vicious questioning about her faith and political activities - in a fog of drunken breath from gin and tonics from The Palm. And when they're done, after they killed sense of 1st Amendment freedom, murdered any chance for her to organize like minded individuals for the upcoming election, to have a say in government beyond her own, they decide to use her as an example. So they start throwing accusations at her. They throw 'em so hard that it scares away other groups trying to file for tax exempt status. Now comes the House hearings. They have the media in their back pocket; they have support of the LIV crowd. Imagine the proverbial 'noose' pulling tight around the Bill of Rights. The will of Congress isn't strong enough. Can you see her? I want you to picture that woman? Now imagine she's a liberal. The defense rests your honor.

119 As I understand it, the 5th isn't a blanket thing, it's not all or nothing.

That would mean that any witness who answered any question at trial would be barred from invoking it.

I think it's been interpreted both ways.  Typically, since Congress can't send you to jail, I believe that Congress asserts it's all-or-nothing.  But I could be wrong, there.

The IRS will stonewall and Congress will grandstand. That means we lose. Again.

If Congress actually represented the people they would clean house, reform the tax code and downsize the IRS.

Instead we have a Fifth Column of government which is beyond Constitutional grasp because Congress has no balls.

Immigration Reform? You're kidding- right? Here we have an issue which affects every tax-paying American and is fundamental to our freedom. Yet there are no legislative proposals?

Congress sucks and we are worse off for it.

That idea was brought up the other day.  IIRC, the objection was that, if you default on your taxes, the IRSS can seize your property and that the left would jump for joy at being able to grab that much land.

I still like the idea of telling the IRS "fuck you," but it's got to be done in a way that leaves them impotent.

Congratulations Lois. A graduation present.
- Why? I got pinched.
- Everyone does. You did it right. You told them nothing.
- I thought you'd be mad.
-I'm not mad, I'm proud of you.You took your first pinch like a man, and learned the two greatest things in life.
Look at me. Never rat on your friends...
...and always keep your mouth shut.
Here he is!
You broke your cherry!
Congratulations!

315 From White House Dossier:

With scandal swirling about the White House, First Lady Michelle Obama may be considering an extended exit from Washington this summer, fleeing for weeks to the ObamasÂ’ traditional summer haven, MarthaÂ’s Vineyard.

According to the Boston Globe, “Michelle Obama and the children may be on the island for an extended period.” But the president would hardly be suffering by comparison. He may come up on weekends and then stay for two weeks at the end of the summer, the Globe reports.

That was what I woke up to this morning. The weird part was, that was down here, and that guy was shot in a complex  where I once had friends.

The details are rather sketchy, but it would appear that the  guy was also on the FBI's Terror Watch list.

This was very weak of Issa.  She waived her right to not incriminating herself when she said she was not guilty.

You can either plead not guilty or plead the 5th.  You can't do both.

She either needs to answer or go to jail.

I guess Issa needs the Democrats to agree to put her in jail?  I don't understand why she was allowed to walk.

He did mention immunity.  Maybe she is ready to roll on the Whitehouse?

I don't know why a bunch of scapegoats can't get together and roll on the Whitehouse.  If they can bring them down the Whitehouse can't hurt them or us anymore!!!

Just to depress you a bit more at the way of the World:

In a case before the Tax Court, between the IRS and a taxpayer, the Court presumes that the IRS's determination is correct. This presumption shifts the burden of proof to the taxpayer to prove that the determination is in error.

465 Here's a blog account of Lerner/Issa:

After she reads her statement where she asserts her innocence and pleads the 5thÂ…

Issa saysÂ…OKÂ…We understand that, say would you mind just authenticating whether this IG transcript is we received last night isÂ…authenticÂ…WeÂ’d really appreciate that..if you donÂ’t mind.

All lawyer chummyÂ…very polite.

Well I havenÂ’t seen that she replies.

Issa saysÂ…Oh so sorryÂ…here hand this to her so she can authenticate it please.

She bit.

It looked to me like a cross examination and response.

Looked like a nifty trap to meÂ…and Gowdy saw that too.

MaybeÂ…Gowdy spoke out but was really talking to her lawyerÂ…Cause she screwed up her 5th pleading both in the opening statement and responding to IssaÂ’s innocuous request for authentication of evidence related to the investigation.

If I were her lawyerÂ…IÂ’d try and convince her to cut a deal and spill the beans.

***********

From same blog: "That was the smoothest, slickest and understated way to get a witness to break their 5th Amendment right not to answer that I have ever seen. Usually its just a bunch of table pounding, making points, etc., but he did it in the good old ‘could you just confirm that this is what you said to the IG?’ So nice. So sweet. That rug disappeared faster than the eye could see."

509 This was posted over at HA: To all who are upset about Issa letting go Lerner, I think Lerner got trapped. That was a very deft move by Issa asking her to authenicate her statement(s) in prior hearings. Gowdy appropriately responded that she waived her 5th amendement rights by offering a statement claiming her innocence and then her authenicating what Issa asked about trapped her in the snare. Issa closed by saying that the panel can recall her at a later time. If LernerÂ’s lawyer is worth anything, heÂ’s frantically trying to cut an immunity deal right now because Lerner compromised herself.

Any enjoying the irony...

Lois as a member of the government asserts she did nothing wrong. Yet claims her 5th ammendment silence right.

So while she did nothing wrong, she still fears some kind of illegitimate prosecution by the very government she is a high ranking number of.

And she would certainly be in a position to know if the government were capable of it.

580 Someone testifies, then asserts the Fifth. Democrats in the hearing naturally support. Yet more of the best legal tradition on the world gets jettisoned so that Progressives can redistribute money. I don't know how moderate liberals sleep with themselves, knowing that the rules will always be redefined, the standards will always lowered or changed, so that the most radical segwment of political society never has to face the same scrutiny as others. We are sacrificing everything for Progressives. Everything. And will end up with an autocracy oligarchy for our troubles. For the Progressives have only one standard--that which they can get away with. None other.
