— DrewM Representative Justin AmashÂ’s (R-MI) amendment that would have reformed and limited the NSAÂ’s collection of data from nearly every cell call in the country was defeated in a vote that crossed party lines.
A $512.5 billion Pentagon appropriations bill cleared the House Wednesday evening after the leadership narrowly beat back efforts to curb the National Security AgencyÂ’s authority to collect private call records and metadata on telephone customers in the U.S.The pivotal 217-205 vote was the first real test of political sentiment since former National Security Agency contractor Edward Snowden leaked documents that revealed the secret program.

“Have 12 years gone by and our memories faded so badly that we forgot what happened on September 11,” asked House Intelligence Committee Chairman Mike Rogers (R-Mich.). But former House Judiciary Committee Chairman James Sensenbrenner (R-Wis.), answered as bluntly: “The time has come to stop and the way we do [that] is to approve this amendment.”
The “But September 11th!” defense for intrusive surveillance is always going to be with us. It’s a ridiculous “argument” because it isn’t one. Either the programs that are in place stand on their merits or they don’t. No one seems to be bothering to actually make the case. You’ll hear “but it’s stopped a bunch of attacks!” Which ones? How? Why didn't it stop the Boston bombing when we had advanced warning that the older brother was connected to terrorists?
Personally, “trust us” isn’t good enough. Promises that almost all of the data collected is never analyzed aren't good enough either. Distrusting the government isn’t a sign of nuttery (unless taken to an extreme of course) but rather a healthy necessity in a republic.
Former NSA and CIA director Michael Hayden comes close to making a case but he underplays the value of the data and just how intrusive it is.
Most disturbing is the reality that collecting data on EVERY call violates the terms of the PATRIOT Act no matter what the Foreign Intelligence Surveillance Court says (presumably thatÂ’s their ruling but amazingly there are secret court rulings and case law we donÂ’t know about).
Security state advocates like Andy McCarthy are reduced to arguing for a ridiculously wide reading of the PATRIOT Act section authorizing that is plainly at odds with the statute.
In fact the only check McCarthy seems to recognize on the power of the state to collect 3rd party records is the good will of the executive branch.
The problem here is not government power. It is the government officials weÂ’ve elected to wield it.
Yes, thatÂ’s exactly what the founders were worried about when they wrote the Constitution in order to limit the power any person or government agent could wield. Checking ALL power centers, ones we like and ones we donÂ’t like, is a feature not a short coming of the American system.
How off the rails is McCarty? He thinks a proper reading of the 4th Amendment would make it legal for the government to listen and record your actual phone conversations without a warrant.
The Constitution was not deemed to be violated absent some form of government trespass. That is why, under the Fourth Amendment as originally understood, it would be a violation for police, without a valid judicial warrant, to attach a GPS tracker to a personÂ’s car and monitor his movements (the situation in the Jones case). On the other hand, it would not be a violation to wiretap a personÂ’s conversations by physically attaching a monitoring device to the phone companyÂ’s line on a public street, without any entry into the personÂ’s home or trespass on his property.

In the age of ObamaCare coupled with Supreme Court decisions from a supposedly “conservative” court that allows massive intrusions into market place and personal freedom and an out of control politicized IRS, I’m not comfortable in trusting the good will of any President or bureaucracy. Government wants information and power. Sometimes it will be used wisely but not always. That’s why a healthy skepticism of claims of vague and open ended needs must be maintained. Again, distrusting the government is a feature, not a bug of our republican form of government.
I think it was good to have the debate on the Amash Amendment (though it got far too little attention). Even in failure it will set the stage for a more serious look at either reforming or replacing Section 215 of the Patriot Act as it currently interpreted.
We gave the government an inch and of course they took a mile. ItÂ’s time to take it back.

I do not defend Snowden, but I do draw attention to the fact that the government is not on your side. If they were, the borders would be secure, illegals would not be living in the USA, and Muslims from Saudi Arabia would have an inordinate amount of difficulty getting into the USA. For crying out loud, a Saudi princess was enslaving Phillipine maids in Los Angelos, and others did the same in Colorado a few years back.

The mindset is that every problem is the government's to solve, and 'solve' it they do, with additional legislation. The actual problem we have is too much government.
We have reached the point ( about a decade ago, actually ) where the level of government has exceeded the carrying capacity of the economy. Government is sometimes a necessary evil, but it is always an evil. By definition, every government program is a net negative economically to society. Some we want, some we tolerate, some we do not want, but our betters approve them anyway. Now, we have reached the limit of what the private sector, who actually provides the profit to fund government, can afford. Our economy will not recover or grow until we meaningfully reduce the level of government services - it cannot.

I attended the funeral of a friend's mother over the weekend. Said friend related the story of how they made a call to their spouse earlier in the year to vent about the poor service that was rendered by the postal service. During the call, said friend told their spouse that they wanted to crash their car into the post office. Not 15 minutes later after the call to their spouse, said received a phone call from the FBI. Said friend convinced the feds that it wasn't a serious threat, but a week later the post office in question had barriers placed in front of the building. And finally, said friend has been pulled out of line for more extensive searches at the airport the last two times they have travelled on commercial airlines.

If monitoring is precluded from generating an initial lead hit, then that "actively under investigation" condition would have had to come from other sources. If those exist, then getting a warrant to tap everything of the subject's wouldn't be hard and generic monitoring isn't needed.
Basically, as I understand it, the language of the bill would have made the NSA's collected data worthless as a mechanism to generate initial leads from traffic analysis (i.e. metadata), and made it harder to use for widening a net once you had an initial lead from elsewhere.
The use of "traffic analysis" for generating intel in NSA surveillance is a notion that goes back over 60 years to the 1955 US/UK agreement between USCIB and LSIB.
I've been preparing a lengthy post that unpacks that recently declassified US/UK agreement paragraph by paragraph, with observations, commentary, and some speculation based on what might be reasonably assumed an updated 2013 version might look like.

I believe it's becuase the potentially harmful bacteria reside only the surface of the meat, and are quickly destroyed when exposed to heat. When you grind it up, you mix the bacteria into the meat, and have to heat it up more to be sure you kill the bacteria. EOJ, is that about right?

Any surface contamination on a steak is destroyed by the cooking process, and bacteria cannot penetrate far enough into the steak to survive the heat of cooking.
Grinding beef mixes the surface contamination throughout, so the entire burger should be cooked to a safe temperature.
This can be minimized by grinding your own burger meat, or buying from stores that grind their own meat fresh every day.

Bacteria grow on meat from the outside, in. So whatever bacteria are on the outside of your steak will be killed when you sear it. The inside of the steak is protected, as long as no one was poking holes all through it.
When grinding meat for hamburger, salisbury steak, steak tartare, etc. any potential bacteria on the surface gets mixed around and distributed throughout the finished product. Cook to an internal temp of 160 degrees F and you're good to go. That's about medium doneness.

If my Alton brown is remembered correctly, it has to do with the proximity to the gut and processing.
If any accidental "gut stuff" (which contains e. coli) gets on your steak it stays on the surface and seared (and the bacteria killed)
But in ground beef it may have been incorporated anywhere in the final product, (requiring the cooking to completion.)
One of the fancy meat companies (I think it's Omaha Steaks) has been selling irradiated ground beef (which kills the bacteria without cooking the meat) so you could (in theory) eat a rare burger.
Me, I still like media rare on my steak no matter what our resident arugula expert says

I don't think NSA has the spare manpower to diverge off its primary mission much. ~60k employees spread worldwide doing all the tasks they do makes it a pretty lean organization.
IRS, OTOH with well over 100k domestically, could easily scrape off a few for political purposes and they'd never be missed. If the IRS doesn't get some scheduled work done due to diverted resource, all that happens is someone doesn't get audited and a few bucks are lost that nobody knows about.
If NSA diverts resource and critical stuff falls tween the cracks, really bad shit can happen

Figuring at least there a separation between "me" and "tsrblke" that (while fairly easily connectable) takes a couple of google hops to get to, so it was sort of a "anonymity through obscurity" type thing.
Then twitter started going through your cookies and comparing your log on location to other log on locations. It connected me back to the my university and started suggesting people to follow that would pretty easily connect me. Now I didn't follow them, but I realized it wouldn't be to hard to trace me back, so I gave up. I'm to lazy to make an alter ego. If someone wants to find me, so be it.
(BTW, the blogger, fired, or otherwise left. And I'm to understand she's no longer editor at that journal.)

Power corrupts, and the power to eavesdrop and look at personal things that people (in government) shouldn't, corrupts anyone. And when you start with a very low standard of man or woman (someone who believes it's their DUTY to fix this or that!), temptation will corrupt quickly.
Who was it yesterday who commented that a friend of theirs worked in a bank that had special codes on the accounts of high profile customers? And that people were frequently fired for peeking into those accounts without due cause?
That kind of peeking is "just" for the prurient thrill, and maybe to make a buck from the tabloids. Can you imagine if those people peeked into a high profile conservative's bank account not because they just wanted to snoop, but because they believed they had "a duty and a calling" to do so?
Now imagine those same people peeking into Joe Schmoe's bank account because he or she said something online that the teller doesn't agree with. There's no special tracking code on Schmoe's account. No one's going to get fired for looking at YOUR information. And if you're in the IRS office in Delaware, you can just shred or destroy the records that identified you as the one who accessed a political candidate's tax records, and no consequences will result.
This is just little, low level stuff. Now take that same kind of perverse, shallow, yet holier-than-thou attitude and apply it to the NSA.

Spareribs, Dry rub, cook over high heat, but elevated (I use my BBQ pit's Bun rack.)
Apply soaked wood chips just prior to adding the meat.
The result, delicious smoky, tender goodness. (The wet wood means your pit smokes and then has to heat back up, and the high heat but raised cooking means you get a good sear, but can keep the ribs on there for longer leading to tenderness.)

You can take almost any national issue and it is a golden opportunity for the GOP to propose an alternative, but the GOP has no alternative; they just don't see any other way of administering the country. All they can say is Obama is doing a bad job, and they could do it better.
Mark Steyn said it on the Rush Limbaugh show before this Obama Health Care catastrophe was ever passed. He said 'If this passes the argument move from whether or not it is a good policy, to who can best administer the program.'

I haven't tried any of them yet.

Under these conditions, all that needs to happen is that the govt chooses you or somebody else and they can effectively control your life without you even knowing it, you had no option to even make a 4th amendment case.
So they choose you to destroy you damn conservative you, oops that stock you just invested in dropped 50%, the irs decides you need an audit, the epa and osha get a tip that you aren't up to snuff (even if you are), the fbi decides to chat with your boss about you and if there is anything suspicious (and you never know why you are suddenly out when you were moving up), the tsa delays you long enough to miss an important flight because you 'accidentally' showed up on a no flight list..... all directed by info they captured on you with out you even knowing and certainly not consenting.

Under these conditions, all that needs to happen is that the govt chooses you or somebody else and they can effectively control your life without you even knowing it, you had no option to even make a 4th amendment case.
So they choose you to destroy you damn conservative you, oops that stock you just invested in dropped 50%, the irs decides you need an audit, the epa and osha get a tip that you aren't up to snuff (even if you are), the fbi decides to chat with your boss about you and if there is anything suspicious (and you never know why you are suddenly out when you were moving up), the tsa delays you long enough to miss an important flight because you 'accidentally' showed up on a no flight list..... all directed by info they captured on you with out you even knowing and certainly not consenting.
The potential for abuse is scary in its scope. Given that fact, I'm rather disappointed that this bill didn't pass.

Pros would use steganography, low information bandwidth schemes, OTP's and such.
Ex. If I wanted to send a short message and hide it in plain sight, I could do it with a series of 100 blog comments and misspell one or two words in each otherwise completely innocuous comment. The errant letters are the message. Time stamps provide sequencing.
To detect a scheme like that in the universe of all internet blog comments would require more processing power than every computer CPU ever manufactured has. Add a layer or two of indirections/encryption and you'd be computing until the heat death of the universe to detect it.

How do you deal with someone who works in a place where there is Classified material, even if they aren't supposed to have access to it?
Remember, clearance is as much about making sure you're ok around the material as it is about handling it.
Or put differently, what should the janitor at the CIA have in terms of clearance?
A lot of people will say "Zero!" but that sorta undercuts the point. Should a room have to be completely "scrubbed" just so it can be vacuumed? That seems foolish.
In some respects, hospitals are having similar problems. (But not nearly as complex).
Is the government security clearance system broken, yes. In part because the government has to many secrets.
Does pointing to a single job absent any context make that case? No. It's stupid.
(BTW, packing up submarine props would require clearance, since those are classified designs. With good measure too, prop design directly relates to detectability.)

There's no constitutional justification for what amount to warrantless searches of Americans AND having so much data on innocent Americans who are far removed from the actual terrorists makes the system dysfunctional.
But let's keep funding it!
It's unconstitutional, which means it's illegal. In the simplest of terms, the government has no right to collect any information about you unless and until it can be proven to a judge that there's a reasonable suspicion (meaning hard evidence) that a law has been broken.
Using your phone hardly rises to that level.

I still actually use sam's for my primary grocery shopping though.
Their prices on meat and milk are far better than the Aldi and my wife like name brand (which we get at sam's for roughly the same price as off brand stuff at Aldi.)
Plus, cheap gas. The Gas alone could pay for the yearly memebership.

Sure. Now technology can improve at an elevated rate to handle the time question, but so can the volume of data to be scanned. That's a given temporal restraint. But my concern was not what data would be so time-sensitive to stop an actual, dynamic terror attack, but the "repurposed" function for the "old" data that has little to do with terrorist targeting. It's a repository of info that's just too inviting even if just contracted out for anonymous research purposes. Let's call it Class One data for acute terror analysis, Class Two for social analysis, Class Three for political analysis, Class Four for research, etc. The pigeonholing could be endless. And it will be abused.

The Key to sam's is to a) factor in convenience and b) know you aren't getting a perfect price on everything.
For example, I don't buy rice at Sams.
But 90/10 ground beef usually runs $2 less/lb than my grocer and $.50 less than aldi.
Frozen Chicken, is no comparision. Sams sells it for $1.88/lb, Aldi's is over 2.
Produce is a mixed bag.
Milk has been $1 cheaper/gallon than Aldi.
Some canned goods were slightly more expensive than aldi, but again convenience. I bought a 10 pack of 15 oz cans. Aldi's had slightly cheaper cans (on a per oz basis) but they were 8 oz cans, meaning I'd have to deal with 2X as many. So I paid the extra 30 cents for the Sams pack (still cheaper than normal grocer)
Some things are just better. Sams has fresh atlantic salmon, Aldi's only has frozen Keta (which I wouldn't feed to a cat.)

Expansion of surveillance can be abused by government, but restrictions can also be exploited by our enemies.
As someone who has been on the inside I believe the current balance is just about right. Not only are there additional safeguards that the public doesn't know about, but the people that do these jobs are definitely NOT politicians. As a rule (with rare exceptions) they do their jobs for love of country and are highly patriotic. They are also people and recognize that "hey, if I am spying on a fellow citizen then THEY could be spying on ME", and they react accordingly to maintain the balance between security and freedom. Snowden is such an example. Whether you support him or not (I don't) his existence and actions prove my point.
Bottom line is that to protect ourselves we have to be right 100% of the time, but our enemies only have to be right once. The OP asks, "Why didn't it stop the Boston bombing when we had advanced warning that the older brother was connected to terrorists?" to which I ask, "How would MORE restrictions have stopped the Boston bombing?"

Just to clarify, I am only stating my opinion based on my personal experiences and what I know of the current program. Those experiences allow me to have a higher level of trust in this program than others folks. In light of all that is swirling around Obama now, I can see how most folks are a little gun shy and I respect that.
