House Rejects Amendment To Kill Funding For NSAÂ’s Cell Phone Date Program
— DrewM

Representative Justin AmashÂ’s (R-MI) amendment that would have reformed and limited the NSAÂ’s collection of data from nearly every cell call in the country was defeated in a vote that crossed party lines.

A $512.5 billion Pentagon appropriations bill cleared the House Wednesday evening after the leadership narrowly beat back efforts to curb the National Security AgencyÂ’s authority to collect private call records and metadata on telephone customers in the U.S.

The pivotal 217-205 vote was the first real test of political sentiment since former National Security Agency contractor Edward Snowden leaked documents that revealed the secret program.
Â…
“Have 12 years gone by and our memories faded so badly that we forgot what happened on September 11,” asked House Intelligence Committee Chairman Mike Rogers (R-Mich.). But former House Judiciary Committee Chairman James Sensenbrenner (R-Wis.), answered as bluntly: “The time has come to stop and the way we do [that] is to approve this amendment.”

The “But September 11th!” defense for intrusive surveillance is always going to be with us. It’s a ridiculous “argument” because it isn’t one. Either the programs that are in place stand on their merits or they don’t. No one seems to be bothering to actually make the case. You’ll hear “but it’s stopped a bunch of attacks!” Which ones? How? Why didn't it stop the Boston bombing when we had advanced warning that the older brother was connected to terrorists?

Personally, “trust us” isn’t good enough. Promises that almost all of the data collected is never analyzed aren't good enough either. Distrusting the government isn’t a sign of nuttery (unless taken to an extreme of course) but rather a healthy necessity in a republic.

Former NSA and CIA director Michael Hayden comes close to making a case but he underplays the value of the data and just how intrusive it is.
Most disturbing is the reality that collecting data on EVERY call violates the terms of the PATRIOT Act no matter what the Foreign Intelligence Surveillance Court says (presumably thatÂ’s their ruling but amazingly there are secret court rulings and case law we donÂ’t know about).

Security state advocates like Andy McCarthy are reduced to arguing for a ridiculously wide reading of the PATRIOT Act section authorizing that is plainly at odds with the statute.

In fact the only check McCarthy seems to recognize on the power of the state to collect 3rd party records is the good will of the executive branch.

The problem here is not government power. It is the government officials weÂ’ve elected to wield it.

Yes, thatÂ’s exactly what the founders were worried about when they wrote the Constitution in order to limit the power any person or government agent could wield. Checking ALL power centers, ones we like and ones we donÂ’t like, is a feature not a short coming of the American system.

How off the rails is McCarty? He thinks a proper reading of the 4th Amendment would make it legal for the government to listen and record your actual phone conversations without a warrant.

The Constitution was not deemed to be violated absent some form of government trespass. That is why, under the Fourth Amendment as originally understood, it would be a violation for police, without a valid judicial warrant, to attach a GPS tracker to a personÂ’s car and monitor his movements (the situation in the Jones case). On the other hand, it would not be a violation to wiretap a personÂ’s conversations by physically attaching a monitoring device to the phone companyÂ’s line on a public street, without any entry into the personÂ’s home or trespass on his property.

(Emphasis mine)

In the age of ObamaCare coupled with Supreme Court decisions from a supposedly “conservative” court that allows massive intrusions into market place and personal freedom and an out of control politicized IRS, I’m not comfortable in trusting the good will of any President or bureaucracy. Government wants information and power. Sometimes it will be used wisely but not always. That’s why a healthy skepticism of claims of vague and open ended needs must be maintained. Again, distrusting the government is a feature, not a bug of our republican form of government.

I think it was good to have the debate on the Amash Amendment (though it got far too little attention). Even in failure it will set the stage for a more serious look at either reforming or replacing Section 215 of the Patriot Act as it currently interpreted.

We gave the government an inch and of course they took a mile. ItÂ’s time to take it back.

The answer is not more legislation when you have a lawless administration that violates existing law at every turn.

8 You’ll hear “but it’s stopped a bunch of attacks!” Which ones? How? Why didn't it stop the Boston bombing when we had advanced warning that the older brother was connected to terrorists? --- Given the leaky ship that is the Obama administration, you'd think that we would have a few concrete examples of stuff this had stopped if it was that important to them as a national defense tool. Instead, every leak regarding stopped attacks that I can think of either deals with a foreign on-ground asset, such as a British spy, or cases where the FBI et all infiltrated a group of idiots who didn't realize they were being sold dummy explosives. The Boston attack is particularly galling because the Russians pointed out these guys to us and said "Hey, we know stuff about Chechen terrorism and these guys are bad news. Keep an eye on them." and we completely ignored them.

All the guys that were in a huff about Snowden reminding the world that the NSA is spying on everybody were government types. I do not defend Snowden, but I do draw attention to the fact that the government is not on your side. If they were, the borders would be secure, illegals would not be living in the USA, and Muslims from Saudi Arabia would have an inordinate amount of difficulty getting into the USA. For crying out loud, a Saudi princess was enslaving Phillipine maids in Los Angelos, and others did the same in Colorado a few years back.

A crime syndicate should be dismantled from the top down, Vic. So Choom Boy and his enablers need to be take the fall first.

Oh, really?   Gee, I    feel so much better now!   It's   nice to know that some words written somewhere   are so solid and binding that they act as a physical blockade, keeping unsavory characters from snooping into my private business.

It's bullshit.   The fact of the matter is yes, the government CAN look at your information and listen to your phone calls and read your emails or texts and otherwise violate your privacy.   Of course they can.  They're just not    SUPPOSED to.

Hell,   I'm not supposed to eat things that    were   "processed in a facility that also processes peanuts."    But you know what?    Sometimes I do it anyway, because chocolate is     a powerful motivator.       And chocolate's got NOTHING on political power when it comes to being addictive.  So if you think our elected, appointed and bureaucratic officials WON'T misuse    the mechanisms at their command in order to solidify and maintain their sphere    of power    and influence, then you are grossly naive.

Do you want to know why we are so permanently screwed?  It isn't necesssarily liberal policies, because the so-called conservative policies are often in the same mindset.  The mindset is that every problem is the government's to solve, and    'solve' it they do, with additional legislation.  The actual problem we have is too much government.

We have reached the point (    about a decade ago, actually ) where the level of government has exceeded the carrying capacity of the economy.  Government is sometimes a necessary evil, but it is always   an evil.    By definition, every government program is a net negative economically to society.  Some we want, some we tolerate, some we do not want, but our betters     approve them anyway.  Now, we have reached the limit of what the private sector, who actually provides the profit to fund government, can afford.  Our   economy will not recover or grow until we meaningfully reduce the level    of government services - it cannot.

And contrary to who ever said that about bugging someone's home from outside without a warrant that is also illegal.  The difference in the case of the Patriot Act is there is a special court that issues those warrants.

I attended the funeral of a friend's mother over the weekend. Said friend related the story of how they made a call to their spouse earlier in the year to vent about the poor service that was rendered by the postal service. During the call, said friend told their spouse that they wanted to crash their car into the post office. Not 15 minutes later after the call to their spouse, said received a phone call from the FBI. Said friend convinced the feds that it wasn't a serious threat, but a week later the post office in question had barriers placed in front of the building. And finally, said friend has been pulled out of line for more extensive searches at the airport the last two times they have travelled on commercial airlines.

Fact is, the current GOP "leadership" has two loves: The federal government and being second fiddle. Everything they do--EVERYTHING--fits perfectly into furthering both.

If he was a leader, if he cared about anything other than smoking cigs on the putting green with the JEF, he'd be the Shadow President*--every speech the JEF gives, he gives a speech both attacking it and setting up the conservative option, every policy the JEF put forth, he throws out the opposite.

*I think that's the untold story of how W and the GOP (purposely?) failed. The Dems basically ran as the composite "Shadow President." They always made sure everything he did and said was opposed by someone prominent. Then, when 2008 rolled around, they could pick and choose all the issues they'd been "right" on (because they'd been on both sides of every issue). And public bought it.

103 Personally, “trust us” isn’t good enough. Promises that almost all of the data collected is never analyzed aren't good enough either. Distrusting the government isn’t a sign of nuttery (unless taken to an extreme of course) but rather a healthy necessity in a republic. The problem right now is that we don't know what is extreme. A few months ago saying "hey the NSA is collecting everyone's metadata and they are rulings in cases that the defendants aren't even aware took place" would have been considered tinhatty. Now it's observing the facts. As far as Andrew McCarthy, it's very simple. A prosecutor thinks he should have the ability to get any information he wants, any way he wants, any time he wants, in order to prosecute anyone he wants. Once you realize that bias, his positions are coherent. Oh, those positions still spit up and chew out the Constitution, but at least they are coherent. It's of a piece with the civil forfeiture discussion we were having below. Hell, all of this goes with Allen's comments about the state of Texas finally agreeing he's a citizen and not a subject. If we are subjects, then the State has the right to know anything it wants, any time it wants. If we are citizens, the State has only the powers of investigation which the citizens grant to it. My position on human nature being what it is has been set out ad nauseam. Of course people will abuse such power. That's what people do.

We then fight short targeted conflicts over pieces of the earth that have NEVER known long-term peace with deliberately small footprints and limited rules of engagement. Let's think for a moment how those two things lead in just a decade to snooping on everyone in just about every way to "mine" data and grant amnesty to visa overstayers or people who don't even have one in the first place. So, we're looking for a needle in a haystack and will devote no resources to actually screening the needles that were left over because we were too timid to kill them in the first place. Because both would violate basic human rights. That banging sound you hear is my head hitting the desk over and over and over.

147 Andy M sort of gets it but misses the massive risk in what he is saying. Look at the IRS behavior.Lois Lerner had contempt not just for the public but for the US Congress. We can argue all we like as to what sort of respect Congress is entitled to by civilians but not by employees of the Executive branch when called to account for their actions. The real information one should glean from her "testimony" was not her statement but the arrogance she displayed. It screamed " Not Accountable to you or anyone else" . And was correct. Does anyone think she will lose a pension? Does anyone think the person who leaked Christine O'Donnell's info is sweating it out right now? We had testimony in Congress about IRS  types shipping confidential data about conservative groups to their opposite numbers and yet we are told by investigators that they have yet to hear of any actual wrongdoing. Top men from the FBI are on it. It can only be a matter of time. or not. That's the IRS. Simple stuff, non-classified disclosures of confidential info. No sources and methods. No Top Secret data. In sum; one organization feels they can do whatever they like with impunity because they are simpatico with the current administration. Simple violations of the law. And bitchslap Congress when called on it. But if a highly classified organization decides to do the same thing they will hold themselves in abeyance because why?

If monitoring is precluded from  generating an initial lead hit, then that "actively under investigation" condition would have had to come from other sources.  If those exist, then getting a warrant to tap everything of the subject's wouldn't be hard and generic monitoring isn't needed.

Basically, as I understand it, the language of the bill would have made the NSA's collected data worthless as a mechanism to generate initial leads from traffic analysis (i.e. metadata), and made it harder to use for widening a net once you had an initial lead from elsewhere.

The use of "traffic analysis" for generating intel in NSA surveillance is a notion that goes back over  60 years to the 1955  US/UK agreement between USCIB and LSIB.

I've been preparing a lengthy post that unpacks that recently declassified US/UK agreement paragraph by paragraph, with observations, commentary, and some speculation based on what might be reasonably assumed an updated 2013 version might look like.

Lotta work transcribing photocopied PDF text and formatting for HTML though.  Might be ready some time next week

Sure that a similar book exists on how the Allies used traffic analysis in Western Europe via Ultra intercepts but haven't run across it.

NOTE: to the NSA, the American public is now an enemy to be watched.  Heck, the American people are an easier target anyway than some uptight regime like Iran or Russia.

It's that simple.

Liberalism and their handmaids, the moderate, have no intellectual force behind it.

Sure, she'll lie and say: "I have students who challenge me all the time! I can handle the debate!"

No you can't.

Or you'd be in private practice--a trial lawyer where every day, at the least your equal--maybe your better--is putting his/her full effort into exposing your mistakes and flaws. And you have to counter, anticipate and all the while massage the ego of the judge and jury.

That's why you are a professor: Because the "debate" is less than an hour, you control the floor and everyone knows behind the curtain you control their grade.

Any surface contamination on a steak is destroyed by the cooking process, and bacteria cannot penetrate far enough into the steak to survive the heat of cooking.

Grinding beef mixes the surface contamination throughout, so the entire burger should be cooked to a safe temperature.

This can be minimized by grinding your own burger meat, or buying from stores that grind their own meat fresh every day.

Ground meat has more surface area for bacteria to breed on.

And when you cook a steak, the surfaces that could have bacteria on them get seared. While inside a hamburger the critters just go for a swim in a warm meaty soup and breed.

Bacteria  grow on meat from the outside, in.  So whatever bacteria  are on the outside of your steak will be killed when you sear it.  The inside of the steak is protected, as long as no one was poking holes all through it.

When grinding meat for hamburger, salisbury steak, steak tartare, etc.  any potential bacteria on the surface gets mixed around and distributed throughout the finished product.  Cook to an internal temp of 160 degrees F and you're good to go. That's about medium doneness.

If my Alton brown is remembered correctly, it has to do with the proximity to the gut and processing.

If any accidental "gut stuff" (which contains e. coli) gets on your steak it stays on the surface and seared (and the bacteria killed)

But in ground beef it may have been incorporated anywhere in the final product, (requiring the cooking to completion.)

One of the fancy meat companies (I think it's Omaha Steaks) has been selling irradiated ground beef (which kills the bacteria without cooking the meat) so you could (in theory) eat a rare burger.

Me, I still like media rare on my steak no matter what our resident arugula expert says .

Good mornin', unpeople.

I'd like to quote whoever it was that held up his cell phone in   one of those   investigational-type committees and asked, "Where is the probable cause to collect any  information from my personal phone?"    IIRC, that question was never answered.

What is sickening is that we already know who is most likely to carry out a terrorist attack: the overwhelming stats   show that they're muzzies. But our betters refuse to profile them because PC or racism or some other bullshit  excuse, which   contradicts the law enforcement  angle that  they themselves have committed to.  In essence, they're aiding   our enemies and reducing our freedom, just as  our enemies want them  to do.

This WOT  is being lost because of spineless politicians with security details who, as a result   of  their  station, rarely need to worry about being targeted. Hence, they simplistically   think that our enemies just need a hug and they'll leave us alone.

If we really wanted to stop these attacks, we'd start treating terrorists as  the rabid animals they are and put them out of our misery. Then, maybe we   could start being free citizens again and carry on  our daily lives without being spied on or groped in the airports for no good reason.

339 Here's a thought I had when the CBS show, "Person of Interest" came on. In the show, there's a computer database that captures everything. I mean all electronic info, including CCTV footage, and facial recognition stuff, phone calls, internet traffic, banking, etc. The premise of the show is that the NSA or some other intel shop has all this info about criminal activity being planned and executed and who the actors are, but dumps most of it saving only the ones that directly impact national security or terrorism. All the other "non-relevant" criminal data like muggings or murders are deleted. So, now we find out that the NSA has been recording EVERYTHING just like this show's database. That means the NSA has information concerning ongoing criminal investigations not related to terrorism/nat security. What's to keep DA's and such from subpoenaing the NSA to turn over potential evidence of crimes?

347 Perhaps for now, but how long do you expect that to last?

I don't think NSA has the spare manpower to diverge off its primary mission much.  ~60k employees spread worldwide doing all the tasks they do makes it a pretty lean organization.

IRS, OTOH with well over 100k domestically, could easily scrape off a few for political purposes and they'd never be missed.  If the IRS doesn't get some scheduled work done due to diverted resource, all that happens is someone doesn't get audited and a few bucks are lost that nobody knows about.

If NSA diverts resource and critical stuff falls tween the cracks, really bad shit can happen

I used to cause a little trouble then on a bioethics blog using my twitter as a log in.  Nothing serious, just mostly calling the person running it unintellectual and point out whenever she was horribly inconsistent (which was always.)

Figuring at least there a separation between "me" and "tsrblke" that (while fairly easily connectable) takes a couple of google hops to get to, so it was sort of a "anonymity through obscurity" type thing.

Then twitter started going through your cookies and comparing your log on location to other log on locations. It connected me back to the my university and started suggesting people to follow that would pretty easily connect me. Now I didn't follow them, but I realized it wouldn't be to hard to trace me back, so I gave up.  I'm to lazy to make an alter ego. If someone wants to find me, so be it.

372 McCarthy is just precious. He writes on two topics: 1. How you can't trust the Obama Adminstration and how its DOJ is off the rails; 2. That same Administration you can't trust should have unlimited access to your private and personal communications. He doesn't seem to have the intellectual honesty to see that his view of unlimited prosecutorial power leads to people like Holder and Corey. Posted by: ejo You can have the noblest and most dedicated men and women in public service, but if you tempt them with enough power, they will become corrupted. Anyone can be corrupted, which is, to some degree, what Andrew McCarthy and others that genuinely care about security and prevention of terrorist attacks fail to realize. Randy "Duke" Cunningham was a helluva man and pilot, but becoming a Congressman corrupted him and ruined his life, because he came to believe he was "owed" all those bribes and perks that Defense contractors shower on the willing. Power corrupts, and the power to eavesdrop and look at personal things that people (in government) shouldn't, corrupts anyone. And when you start with a very low standard of man or woman (someone who believes it's their DUTY to fix this or that!), temptation will corrupt quickly. The rottenness in government is exponentially related to how much more money and power the Congress has given the Executive, and how much power any given President (like our current corrupt one) is willing to grab.

Power corrupts, and the power to eavesdrop and look at personal things that people (in government) shouldn't, corrupts anyone. And when you start with a very low standard of man or woman (someone who believes it's their DUTY to fix this or that!), temptation will corrupt quickly.

Who was it yesterday who commented that a friend of theirs worked in a bank that had special codes on the accounts of high profile customers?   And that people were frequently fired for peeking into those accounts without due cause?

That kind of peeking is "just" for the prurient thrill, and maybe to make a buck from the tabloids.  Can you imagine if those people peeked into a high profile conservative's bank account    not because    they just wanted to snoop,    but   because they believed they had    "a duty and a calling" to do so?

Now imagine those same people peeking into Joe Schmoe's bank account because he or she said something online that the teller doesn't agree with.   There's no special tracking code on Schmoe's account.  No one's going to get fired for looking at YOUR information.  And if you're in the IRS office in Delaware, you can just shred or destroy the records that identified you as the one who accessed a political candidate's tax records, and no consequences will   result.

This is just little, low level stuff.     Now take that same kind of perverse, shallow,  yet holier-than-thou attitude and apply it to the NSA.

Spareribs, Dry rub, cook over high heat, but elevated (I use my BBQ pit's Bun rack.)

Apply soaked wood chips just prior to adding the meat.

The result, delicious smoky, tender goodness. (The wet wood means your pit smokes and then has to heat back up, and the high heat but raised cooking means you get a good sear, but can keep the ribs on there for longer leading to tenderness.)

=======

I had this thought the other night.

You know how all the news is from conglomerates? AP, Reuters, etc.?

What if we stated editing them? To make them both (claimed) neutral and inclusive of relevant facts?

Then, pass them off as the original? (hosted on a wikilinks or pirate bay type server)

Refuse to link to the liberal original--let the leftist rail and howl about the edits; exposing the utter dishonesty of the original.

I mean, we all follow news pretty damned closely here. Quite a few of us could do this, one article a day--"this is how is should have been written."

What'd you say?

You can take almost any national issue and it is a golden opportunity for the GOP to propose an alternative, but the GOP has no alternative; they just don't see any other way of administering the country. All they can say is Obama is doing a bad job, and they could do it better.

Mark Steyn said it on the Rush Limbaugh show before this Obama Health Care catastrophe was ever passed. He said 'If this passes the argument move from whether or not it is a good policy, to who can best administer the program.'

That's were the GOP is, and they have no credibility on any issue. So pack it in, retire, and let younger people have a shot at it.

So they choose you to destroy you damn conservative you, oops that stock you just invested in dropped 50%, the irs decides you need an audit, the epa and osha get a tip that you aren't up to snuff (even if you are), the fbi decides to chat with your boss about you and if there is anything suspicious (and you never know why you are suddenly out when you were moving up), the tsa delays you long enough to miss an important flight because you 'accidentally' showed up on a no flight list.....  all directed by info they captured on you with out you even knowing and certainly not consenting.

465 When it comes to job benefits, Matthew Barzun is about to enjoy some of the best. As the new U.S. ambassador to the U.K., he’ll live in Winfield House, a London mansion set on 12 acres with gardens second only to those in Buckingham Palace in size. He’ll be able to borrow art from museums for free and host the president as an overnight guest when he’s in town. Barzun, a 42-year-old technology entrepreneur nominated this month to the Court of St. James’s, earned those perks: He raised at least $1.2 million as finance chairman for President Barack Obama’s re-election campaign. While Obama ran in 2008 on a pledge to limit the influence of money in politics, a review of ambassadorial appointments five years into his presidency shows that big donors have landed dozens of top overseas assignments. Since the president’s November re-election alone, posts in Italy, Belgium and Spain, as well as London, among other assignments, have gone to donors. At least 26 of Obama’s current and nominated ambassadors were major Democratic campaign contributors, giving a total of at least $13.6 million to him, the Democratic Party, and congressional candidates, according to data compiled by Bloomberg. “When he talked about toughening up lobbying rules, the sense was that this is a president really committed to international engagement,” said Dan Kurtzer, a 29-year veteran of the foreign service and former ambassador to Egypt and Israel under Presidents Bill Clinton and George W. Bush. “Instead, we so devalue diplomacy that we assume anyone can walk off the street and do it.” Democrats take corruption to a new level and still blame it on Conservatives

470 Bravo to Mr. Snowden, give him a Nobel. Posted by: Bigby's Smelly Glove at July 25, 2013 11:41 AM (3ZtZW) Renegade National Security Agency contractor Edward Snowden has applied to join a group of former Russian intelligence and security officials, according to the group’s director. Participation in a union of former KGB security, intelligence, and police officials, would likely change Snowden’s status from that of a whistleblower seeking to expose wrongdoing, to an intelligence defector who has changed sides. Alexei Lobarev, chairman of the group called “Veterans of the Siloviki”—literally “men of power”—told a Russian news outlet on Monday that Snowden, who has been staying in a Moscow airport transit lounge for a month, applied for membership in the group. Some hero you got there?

471 My queston to you was why this would be an additional reason to oppose the NSA metadata collection? Posted by: polynikes at July 25, 2013 11:27 AM (m2CN7) Because Fourth Amendment. Because the government has not been granted the power or authority to act as a nationwide repository of such information. Because this will result in the Federalization of all criminal and civil law. Hell, let's look at the practicalities of it. Because I do not want federal resources diverted to responding to such requests. This is going to sound way way way bitchier than I mean it to so please take this is with the best possible reading. I do not believe that you and I will be able to have any type of effective discussion on this matter because I do not believe we are doing anything other than talking past each other. Multiple people have presented responses to your questions. You do not appear to be convinced of the concerns expressed therein. In turn, I do not find your position to be persuasive as we appear to be placing primacy on different matters. You have far less concern about privacy violations than I do. I have far greater cynicism about territorial protections and human nature than you do. I should note that all of this is fine. There is tension between security and freedom and people will differ as to where such boundaries will be drawn. At a certain point, there's not much more to say to one another. We draw the lines in different places. So be it.

Under these conditions, all that needs to happen is that the govt chooses you or somebody else and they can effectively control your life without you even knowing it, you had no option to even make a 4th amendment case.

The potential for abuse is scary in its scope.  Given that fact, I'm rather disappointed that this bill didn't pass.

and with good citizens on both sides of the argument it is a necessary one and can be good even when I lose in my preference for liberty if the perceived threat is indeed real.

Take for example the rise of the FBI and resultant cryptographic gorwth in the '30s that stood us in good stead.

The crisis is I am sincerely unable to believe that the surveillance staters are acting in good faith for the whole at all anymore and when one adds in their mad dash for Amigo Grande! to tilt the balance irrevocably you get the partisan rancor we now see on the issue.

That government, and those that would control it, must understand that it cannot experiment for ten years trying to destroy liberty and popular sovereignty as they have existed in the United States for the past two centuries, and if it and they fail, have that government still continue unchanged in form.

Bad law that could be killed in committee gets the "I'm voting FOR passing it out of committee for the sake of debate but, gosh darn, I really disapprove of the legislation." We know the tactic and it's disingenuous hackery. They'll enable bad law and then voluntarily get whipped into voting against said law if it will help them at home for appearances sake.

500 In reality, what NSA is doing really only snags the rubes/amateurs.  Real pros won't use any of the channels they're looking at, or will use them in ways that render stock monitoring schemes worthless.

Pros would use steganography, low information bandwidth schemes, OTP's and such.

Ex. If I wanted to send a short message and hide it in plain sight, I could do it with a series of 100 blog comments and misspell one or two words in each otherwise completely innocuous comment.   The errant letters are the message.  Time stamps provide sequencing.

To detect a scheme like that in the universe of all internet blog comments would require more processing power than every computer CPU ever manufactured has.  Add a layer or two of indirections/encryption and you'd be computing until the heat death of the universe to detect it.

Here's the problem.

How do you deal with someone who works in a place where there is Classified material, even if they aren't supposed to have access to it?

Remember, clearance is as much about making sure you're ok around the material as it is about handling it.

Or put differently, what should the janitor at the CIA have in terms of clearance?

A lot of people will say "Zero!" but that sorta undercuts the point.  Should a room have to be completely "scrubbed" just so it can be vacuumed? That seems foolish.

In some respects, hospitals are having similar problems.  (But not nearly as complex).

Is the government security clearance system broken, yes.  In part because the government has to many secrets.

Does pointing to a single job absent any context make that case? No. It's stupid.

(BTW, packing up submarine props would require clearance, since those are classified designs.  With good measure too, prop design directly relates to detectability.)

526 I mean, we all follow news pretty damned closely here. Quite a few of us could do this, one article a day--"this is how is should have been written." What'd you say? Posted by: RoyalOil at July 25, 2013 11:24 AM (VjL9S) It would be a lot of work, and entail some legal risk. (I think.) Would also require some dedication and talent. Perhaps a sufficient pool of people could do it on a voluntary basis, but if that isn't workable, it would likely take a staff of people to do it. Part of the problem this wouldn't address is the fact that so much of Media bias is the result of what they DO NOT REPORT. We need something that FORCES ugly stuff about Democrats into the national conscious stream.

In other news:

Federal authorities announced a raft of criminal charges on Thursday against SAC Capital, the hedge fund run by the billionaire Steven A. Cohen, an unusually aggressive move that could cripple one of Wall StreetÂ’s most successful stock trading firms.

In the 41-page indictment that includes four counts of securities fraud and one count of wire fraud, prosecutors charged the fund and its units with permitting a broad and “systematic” insider trading scheme to unfold between 1999 and 2010. The case seeks to attribute certain criminal acts of employees to the company itself, claiming that the fund “enabled and promoted” the illicit behavior.

PS - Please note though that this is perfectly legal for members of Congress to do.

With the rate people replace phones and churn phone numbers these days, if you want to find a correlation between something even two years old and now, you gotta delve into specific user account info (which they claim isn't being collected) and map the old number/SIM with the new number/SIM to know they're the same dude.

556 521 NGU,

Ah so now point out that TS cleared people leak partisanly damaging FP points on the GWoT is immaterial b/c "old" and "trust us"....

Like I said guy what I was first known for here was analysis of my one little now archaic part of Cav ops and a history of US Intel and Countr-Intel focused on the Era post the Russian Revolution with a more analytic look and pondering on the penetration of the Anglo intel and legal professions.

I have admittedly not been as topical or wordy since 2010 when it slowly sunk in that perhaps our giving the GOP back the House was a wasted effort.

If you'd like me to the job the ethical and oversight boards over these agencies just say so, and let's lobby the Democrats to give me that power....

"heh"

and that "heh" is a bitter sighful laugh.

The White House leaks NIE data, Congress when they were out of power was leaking NIE data I did game work on showing how Plame was not covert in any meaningful sense when it was topical NGU but again please let's pretend I'm incapable.

You'd love the issue to be a simple "overreaction" by "paranoids and butthurt conservatives" I'd wager but it is not quite that simple.  I have family in the community and I trusted the organizations completely based on a lifetime of being enar it and meeting and seeing people in its orbit but the generation I trusted has been falling by the wayside for about 8 years now and I have not seen any evidence of any desire for sensible restraint or subtlety anymore.

A lot of us on the right feel Obama's abuse of private and sensitive data is our being punished for the sin of empowering this monster in the first place.

The Dept of War had to spy on our State Dept and Spies in the early aftermath of WW2 b/c we were infiltrated so deeply.

The actions of this administration on Foreign Policy lend an air of even deeper penetration in my estimation.

Admittedly I am not a pro, but I'd be thrilled for you to explain to me how the Muslim Brotherhood is not in fact running our Foreign Policy because frankly I can't tell anymore.

561 purp - Friends and I occasionally swap encrypted messages as challenges. No one owns a Cray..., or a huge array of parallel processors, or anything very interesting. While it is undoubtedly true that one of the above would crack any of our codes in jig time, it is also true that none of our codes employ the sort of techniques that you mention. Even the simplest of our cyphers embedded in, and spread across numerous files would, as you point out, quickly become undecipherable.

The public at large has seen too many movies. While it is quite possible that the NSA data *might* serve a valid security function, I am highly doubtful. Tracking of cell phone communications for targeted numbers, and the same for email etc. makes sense only in the specific case, but I believe is highly dangerous (and un-Constitutional) in the general case.

As a parting shot, here is an example of a recent challenge, all punctuation is un-coded and placed as the original message, as are spaces, word lengths are unaltered. Any here willing to have a go?

But let's keep funding it!

It's unconstitutional,   which means it's illegal. In the  simplest of terms, the government has no right to collect any information about you unless and until it can be proven  to a judge that there's   a reasonable suspicion (meaning hard evidence) that   a law has been broken.

Using your phone hardly rises  to that level.

592 Purp: "Time sensitive data gets stale quick though."

Sure. Now technology can improve at an elevated rate to handle the time question, but so can the volume of data to be scanned. That's a given temporal restraint. But my concern was not what data would be so time-sensitive to stop an actual, dynamic terror attack, but the "repurposed" function for the "old" data that has little to do with terrorist targeting. It's a repository of info that's just too inviting even if just contracted out for anonymous research purposes. Let's call it Class One data for acute terror analysis, Class Two for social analysis, Class Three for political analysis, Class Four for research, etc. The pigeonholing could be endless. And it will be abused.

The Key to sam's is to a) factor in convenience and b) know you aren't getting a perfect price on everything.

For example, I don't buy rice at Sams.

But 90/10 ground beef usually runs $2 less/lb than my grocer and $.50 less than aldi.

Frozen Chicken, is no comparision. Sams sells it for $1.88/lb, Aldi's is over 2.

Produce is a mixed bag.

Milk has been $1 cheaper/gallon than Aldi.

Some canned goods were slightly more expensive than aldi, but again convenience. I bought a 10 pack of 15 oz cans.  Aldi's had slightly cheaper cans (on a per oz basis) but they were 8 oz cans, meaning I'd have to deal with 2X as many.  So I paid the extra 30 cents for the Sams pack (still cheaper than normal grocer)

Some things are just better.  Sams has fresh atlantic salmon, Aldi's only has frozen Keta (which I wouldn't feed to a cat.)

Everyone knows the famous legal adage that "It is better that ten guilty persons escape than that one innocent suffer." In the context of this post that could be restated as "It is better that ten terrorist plots succeed than that one innocent citizen suffer."

Expansion of surveillance can be abused by government, but restrictions can also be exploited by our enemies.

As someone who has been on the inside I believe the current balance is just about right. Not only are there additional safeguards that the public doesn't know about, but the people that do these jobs are definitely NOT politicians. As a rule (with rare exceptions) they do their jobs for love of country and are highly patriotic. They are also people and recognize that "hey, if I am spying on a fellow citizen then THEY could be spying on ME", and they react accordingly to maintain the balance between security and freedom. Snowden is such an example. Whether you support him or not (I don't) his existence and actions prove my point.

Bottom line is that to protect ourselves we have to be right 100% of the time, but our enemies only have to be right once. The OP asks, "Why didn't it stop the Boston bombing when we had advanced warning that the older brother was connected to terrorists?" to which I ask, "How would MORE restrictions have stopped the Boston bombing?"

596 "who ran to our enemies" Consider when the US Government, via Republican administration, made "our enemies" our most favored trade nation. K I S S I N G ' E R And what of Obama's Hillary-State "Reset" with Russia, hardly as an "enemy" of his administration. We're not at war with either Russia or China. Yet. Currently, we're in a military war with our "other" allies, al Qaeda enjoying the US support in Libya, etc. "Our enemies"? Hillary Clinton wants to be top dog somewhere, somehow. Her epic "We came, we saw, we killed, bwahaha!" puts her on the list of American saboteurs along with Obama's Cabinet and most members of the US Congress. As for individuals who do what they do, they're stuck dealing with their own consequences. It isn't as if any "typical American" blogging here or anywhere is privy to anything beyond what we're being fed by the MSM/Obama administration. Innocent until proven guilty in a court of law was the mantra during GZ's outrageous trial. Lawyers and law geeks worth their salt are supposed to be big on protecting civil liberties. They sure did work on protecting Obama's outrageous fabricated bio during the '08 perpetual campaign. If someone's a fly in the ointment, "because he could," that's as far as it goes. Being a fly in the ointment is not necessarily either being a traitor or a hero. And if we're upset with flies in ointments, then address in trickle down fashion all the damned flies beginning with Obama.

597 599. Onus, your singing the liberal-social-justice refrain to the wrong choir: /Everyone knows the famous legal adage that "It is better that ten guilty persons escape than that one innocent suffer." / What we've heard said hardly means we go along with something famous. You've heard of the Pied Piper, as if you'd jump off a cliff because everyone else did on cue?

598 How would MORE restrictions have stopped the Boston bombing? Resources are finite and fungible. Had some of the money spent on the massive, unconstitutional spying on US citizens been diverted instead to effective counter-terrorism programs, that could have helped stop the Boston marathon bombing. I cannot prove that, but you cannot disprove that, either. My point is that your begging-the-question little punchline that forces me to stipulate that the NSA programs are effective on your say so is not the slam-dunk that you think it is.

Career guys like Hayden know where all the sleazy politicians skeletons are buried.  Some toad like Obama doesn't dare try to lean on him.

Now I'll *never* find out if it makes any sense.

God-damned fascists, that's what they are.  Power hungry... nay "voracious."

Carlos Danger is hardly unique in this crowd of sycophants and narcissists.

Defend the Constitution?  They'd sooner cut their own junk off.

We don't have leaders, we have owners.  I say damn every one of them that voted against this.  Evil bastards.

602 602 How would MORE restrictions have stopped the Boston bombing? >>>Resources are finite and fungible. --- This. IIRC one of the bombing bros left the country, which ran counter to his political asylum claim under which he was in this country in the first place. And of course we all know about the 9/11 dudes visa problems. How about we insist our bloated govt do the jobs they are already authorized to do before letting them trod all over the Constitution?

603 The holder managed cesspool is back in operations.  I guess the "Incompetent Administration" needs another distraction from the scandels and corruption.

605 NGU I'm home but I'm getting the lease ready to sign, I am not personally calling you out other than I think for a bit of poor form in acting as though those of us against this expansion are acting from a place other than good faith.

Your hypothesis if I have understood it correctly is that we have a duty because "enemy" to shrug and accept this intrusion on the American concept of privacy and liberty until it personally impacts us.  Abuse of the mechanism we've created is a "personal failing" on the part of "bad actors" and we should trust to the star chamber to address these issues since we simple peons are unable to handle the knowing of the mechanism or the actors.  I sincerely am not trying to chickenshit this analysis on my part of your view.

My contratemp to you as offered, and my defense against your insistence those of us who are wary are conflating "multiple issues which have NOTHING to do with one another" is that there are MANY layers of the Federal Machine that have access to sensitive data or private data and I can point to a laundry list of willful maluse and leaks.  I answer your offering as I understand it that somehow "NSA" is different with "no not really" because I can point to breaches other than Snowden with ease, and that is apart from the massive data pool and ever increasing invasiveness and reach of the Federal machine.

I had a hard time trusting the mechanism in the Cold War when the stakes were literally a civilization altering paradigm and I knew people involved in the intel biz personally, and I am having an even harder time with this generation coming up who seems to lack the civic spirit of the prior generation.

I will be happy to go to whatever length on whatever focus is necessary to get the point across.  I do feel you are attempting to move goalposts on "why NSA is different" I showed with links I have used here in the past that the National Intel Estimate was willfully malused on multiple occasions for partisan purposes.  NSA is not somehow supreme to the sanctity that is supposed to be there for NIE briefs.  I am not arguing in circles my hypothesis is that I do not trust anyone with the amount of power that is being pooled, that no agency is innately more moral than any other and that there is a severe risk of the very nature of the NSA's oversight for malfeasance.

Balls in your court.

You SHOW me NSA is innately superior to the IRS, the FBI, the DoJ et al....

I'll be happy to show you NSA's errors and bad actors if you want me to limit the field or multiple Agency failures across the corporate suite, or if you're generous enough to allow me to show partisan misdeeds and malfeasance I'll happily go over to Treasury and DoJ as well.

We can go back to the '20s where I have highlighted the nascent FBI and Sidney Reilley's antics vis a vis the Bolsheviks here and in EUrope to the '30s and the Penetration of the academy structure here and in England to the deep penetration of Foggy Bottom, OSS, and Labor here in the US.

I must admit my scholarship on the early cold war west as a hole in their failures on Counter Intell is somewhat lacking given I focused on the "sin" of McCarthy.(which is mostly being correct)

606 606 Y-not,

Quite, that is why I am wary of the claim they "need this to stop terror" when the reality is they are refusing to look where terror most often springs from.

The Muslim Brotherhood runs the State Department and possibly our Intel services from what I can see.

I think you misunderstood my point. I used that adage for exactly the reason you said - not because I agree with it. And I don't see the difference between that hypothetical and the one I posited.

Great debate! Your points are valid and well taken.

Just to clarify, I am only stating my opinion based on my personal experiences and what I know of the current program. Those experiences allow me to have a higher level of trust in this program than others folks. In light of all that is swirling around Obama now, I can see how most folks are a little gun shy and I respect that.

Yes I did beg the question because I perceived the question in the OP as flippant and offensive and returned in kind. Sorry about that.

This is a tough question, the balance between security and freedom.

Is it constitutional? I honestly don't know. Is it necessary? At this specific point in time I believe it is.

610 Hear, hear. An important, well-reasoned, and necessary column coming from the American Right in an area where the Lindsay graham's of the world too often dominate. Well done, DrewM.

611 McCarthy is only reiterating what the Supreme Court first ruled on wiretapping on Olmstead v. US. It was the law of the land for many years until Congress outlawed wiretapping in all instances. Of course the FBI in both national security and other cases used it for intelligence purposes, not for evidence in criminal cases. The idea of privacy is a new invention with the Warren Court. So, it looks like you are defending a Warren Court definition of the 4th Amendment.
