Illinois: The Newest Constitutional Carry State?

In December of last year, a federal appeals court struck down a law that forbid citizens in Illinois from carrying a firearm. Check out this gif to get an idea of the evolution of concealed carry laws in the United States. Illinois is currently the only "no issue" state in the union.

So, what does this mean? Well, if the legislature doesn't move quickly to enact some type of concealed carry law, the state will default to "Constitutional carry" on June 10, 2013. Republicans are taking the position that if they don't get exactly what they want (some form of "shall issue"), then they're content to let the deadline pass. Democrats looking for some new restrictive gun control law don't have a leg to stand on.

Concealed carry “will be a ‘shall issue’ permit, there will be no discretion by some bureaucrat as to whether you get to exercise your right,” he said.

“It will be a statewide permit, there will be no carve-out for Chicago. There will be no carve-out for Cook County,” Vandermyde said.

State Rep. Brandon Phelps, D-Harrisburg, who has authored several concealed-carry laws during his time in Springfield, said the federal court ruling goes even further.

"The clock is still ticking. June 10 is the deadline," Phelps said. "We filed a bill, a lot of people didn't think we were going to because we don't have to. Constitutional carry will set-in if we don't do something."

If the deadline should pass, Illinois would become the fifth Constitutional carry state behind Vermont, Alaska, Wyoming and Arizona.

Meanwhile, in California: Democrats are pushing for new gun laws that would make Andrew Cuomo blush:

1. Ban all semi-automatic rifles that accept detachable magazines.
2. Ban possession of high-capacity magazines.
3. Ban “bullet button” conversion kits.
4. Bans shotgun-rifle combinations.
5. Universal registration of all guns.
6. Background checks on ammunition.
7. Regulating gun loans.
8. Prevent prohibited individuals from living in homes with guns.
9. Cracking down on people who canÂ’t own guns legally but do anyway.
10. Required safety training for handgun owners.
I don't have to remind everyone what historically comes after universal registration, right?

It doesn't make any sense.  Most rifle / shotgun combos are over/under double barreled long guns.  One shot of each barrel before reloading- about the last weapon a criminal would use to rob a liquor store if he had a choice.

My best guess is that maybe they're referring to guns like the Taurus Judge that can shoot .45LC or .410?  Not that it would make any more sense.

It's a conversion kit that replaces the magazine release, requiring use of a "tool" (the bullet of an unfired round) to press the release instead of being able to just press it with a finger.

External mags cannot be detachable without a special tool. These kits get around this ignorant law by letting you detach a mag with the bullet end of a cartridge.

 

What this IL law is saying is exactly the core of this issue: States are nullifying a constitutional right to bear arms. Period. The state cc laws are in my opinion also unconstitutional. If ex cons can vote, they should be able to carry. If he is not safe for society, then don't let him out!

It's the magazine lock that we have to swap for the normal magazine release button in order to have AR15s in my beloved Clownifornia.

Except that there was an existing CA push to ban a "bullet button tool" which had a magnet attached, which would allow one to quickly render a bullet button into a regular mag release. Us CA gunnies have been railing against the asshole who came up with the idea and shamelessly (and deceptively) marketing it at gun shows. He was basically doing the wink-wink thing while glossing over the fact that use of his product in-state was an instant felony.

It's not certain which device the proposed law would ban.

I'm perplexed by this.  They claim people aren't getting harsh enough punishments when they use a gun to commit a crime or something.  The news report wasn't too clear.

I was confused, because they compared a case of armed robbery to a case of someone being shot (assault or attempted murder) which, as I understand carry differing penalties because their different crimes.  For whatever reason we tend to treat taking someone's stuff as a lesser crime that actually injuring the person.  So I'm not sure how a special docket will fix this.
Factor in sentencing guidelines and...well....I mean how is this going to work?  Unless their going to throw out the book and just use a new one.

The only other thing I was thinking was maybe the news story is confused and they want a docket dealing with "unlawful ownership" specifically.  In which case we're back at "enforcing the laws we have."

One problem with the Judge is the 'jump' .45 LC bullets have to make because of the disparity of length between a .410 and a .45 LC, which skews its accuracy. Another problem is that the necessarily short pistol barrel diminishes the effectiveness of the .410. I don't see a way around the shortcomings of the design. The ballistic requirements of the .410 and the .45 LC, both very effective and proven on their own, negate each other.

 

The Judge is a very big and scary-cool looking handgun, though. I had to dissuade my girlfriend from buying one when we went to pick out a gun for her after she got her carry license.

The Judge first is illegal in California as no pistol can be chambered for shotgun rounds in the state.

There are far less expensive snake guns. I take a dirt-cheap .410/.45 LC Leinad double-barrel pistol, the one with the 11" barrel, in my knapsack or rucksack when I go camping or fishing. It's very primitive but very sturdy, and very effective for taking out snakes--of which there are plenty where I live. Doesn't weigh much either, but the recoil from a .410 in a relatively light pistol frame can be brutal, so there's that.

Well Class III is how I should have written it. It means machine guns. From what I understood you could own them in jersey, after the usual licenses and fees. In reality you got a better chance of smoking pot with god than ever getting that license, but from what I heard jersey is a class III state. There was a gun store here that dealt with them for law enforcement, and you would hear them going off in the back every once in a while. I would think if a gun dealer could sell and service them here, then yeah there must be a rule allowing it. Of course it is jersey, so maybe there is an exception for "govt". We're facists like that.

312 More thought on the "Cali-ban" gun Nazis: 1. Shotgun-rifle combos are very historical, as is sjotgun-pistol combo (LeMat revolver). 2. Restriction number 8, in addition to my previous, smacks of corruption of blood. I'm not going to pull a Constitution argument--just that it clearly strips rights away from others in a family, and the ability to live as a familial unit and bear arms are natural law rights, not requiring government for basic ability to possess. 3. I'll remind folks of the doctrines regarding "prior restraint". You cannot put blanket restrictions down because of what might happen, can you? Especially when there is no cause, or continuing cause, to doubt the reliability of a particular individual. 4. Regarding the safety classes--I think the same jurisprudence as is used for requirement to see baby ultrasounds and other such before abortions should be used. Live by, die by. If one infringes, so does the other, and vice versa.

313 In WA, you can't get a Class 3 license.  You can legally purchase a suppressor, but you cannot fire a weapon with that suppressor attached without violating the law.

Gander Mountain's Gun Sale Flyer wasn't mailed to postal patrons, nor are printed copies available in the store (at least in the Rochester area)...because of (or fear from) the NY Safe Act. You can't hardly own and now even talk about, getting a firearm in this great state.

315 When's the last time you saw a shotgun-rifle combo? Either a hugely expensive european "Drilling" type poofter hunting gun, or the much-banned Crossfire, banned even before it hit the streets (there are a few pump-action versions out on the market). Why? Because they skeered politicians. Frankly, I'm turning to the opinion that things that scare politicians should be *mandatory*, not banned.

California ordered all registered SKS with detachable magazines which were modified to do that to turn them in by the deadline or face prosecution when the deadline is passed.
