When Children Kill (Niedermeyer's Dead Horse)

No person wants to think of a child's life wasted. We want to see them raised in a loving, supportive home. We want to see them receive the best education. We want them to feel safe. We want these things because they contribute to the quality of adult life they will lead. Yet with sadness, despair even, we are aware that too many children do not live the lives we dream for them.

Cristian Fernandez is just such a boy.

The story of Cristian's life reads like a horror story: Born to a 12 year old girl who lived with her own drug-addicted mother, he has endured both physical and sexual abuse during his short life. It is impossible to not feel sorry for what he, only a child, has endured. Yet.... it is impossible not to mourn for the child whom he has killed.

At 12, Cristian Fernandez was the youngest person in Jacksonville to have ever been indicted for murder. He has been charged as an adult with first-degree murder and aggravated child abuse in the case involving the death of his 2-year old brother, killed in a beating while the two were unsupervised. Further he has been charged with sexual battery of his 5-year old brother (Charges were later dropped due to lack of evidence).

His mother has already pleaded to manslaughter for failing to seek help (for eight hours!) for the critically injured child who died, and will serve a minimum of 13 years in prison.

This week, Cristian was allowed to plead to manslaughter and aggravated battery and he will be held in custody in a juvenile facility until he is 19-years old. Upon his release, he will serve, with good behavior, another 5 years on probation. The pleas came after his videotaped interrogations were tossed as a judge sided with the defense in stating that Cristian, interrogated without an adult present, did not understand the Miranda Rights that were read to him. (Plea deal and subsequent press conference here.)

During the past year this case has been the source of a great deal of angst and debate: Do you throw away the keys to a child when he is only 12-years old? Can you call a 12-year old child a monster? What are the consequences of placing a child, albeit a murderer, in either an adult or a juvenile facility? How about the needs to punish weighed against the needs for rehabilitation?

Oh.... and....

Did Angela Corey seek to make a name for herself by too aggressively pursing the charges against him?

This post could go on for page after page and I might never make it any more lucid than it is now, for my head is still turning.

Take a peak at the story and let me know your thoughts, about the child, the prosecution, the protection of the public.

Maybe someone will be able to put my mind at ease about the whole, ugly, damnable mess.

Yup, the Great Society ain't so great.  I think it is responsible for the breakdown in Black families since the Gubamint replaced the role of the father.  I think it was Walter Williams who talked about how when he was growing up, 2 parent Black families were the norm.  This norm was eroded away by government entitlements that encourage and foster dependency. 

 

With the direction this counry is headed, we will all be in that same boat as the Black community.  You can already see it happening as non-minority families are increasingly headed up by women who are on the dole.  This will be America's new normal, not just one minority group.

Oh, and it always kills me that children who commit heinous crimes not only get released when they turn 18, but have their records expunged.  It's an outrage. 

 

We have a thug out here in the Seattle area who with his friends, beat a tuba playing, developmentally delayed, homeless man to death.  They used his own tuba to beat him and bragged about it later.  This kid went to juvie for less than 2 years and got released.  A few short years later, he was recently arrested for shooting and killing another man at a nightclub.

105 I worked on wagon trains (the real deal) with VisionQuest for 3 years. They take in the nastiest, toughest kids adjudicated you can imagine. It was very physical, and I was a teacher. Children have remarkable recovery abilities. They can be redeemed far more that adults. Very unpredictable though. A kid that was very good, did the program right and you would think was going to make it would get out and kill someone the next week. Another kid whom you spent a good deal of time on the ground with, and was just as nasty as could be would get out and end up doing great. Bottom line kids are redeemable, and should be given a second chance. Some times you just want to strangle them but then you look at their file and want to cry for thinking such a thing. Young are a product of their environment more than genes, which come to the fore later in life.

It is a fallacy  that our country's mental health services are somehow adequate to "fix" someone who is so hardwired so wrongly.  Psych medications can dampen certain behaviors  (if you take the meds), and counseling can perhaps temporarily alter them.  Unfortunately, the ability of psychiatric professionals to accurately predict whether a given individual will commit a violent act within any given timeframe is just non-existent.  I  am not going to pass judgment on whether he "lacks a soul" on the basis of a single photograph taken without context, but I don't hold great hope that he can be rehabilitated and reinserted into decent society.  Somehow the "adults" in situations like this must be held accountable.  I don't see the collective willpower in our state or federal legislators to do that however.

Why charge the boy with 1st degree murder?  Why not manslaughter?  The tasks she should have been focused on were getting the boy out of his wretched inhuman situation, getting him help, and MOST IMPORTANT, keeping him away from the innocent until he is cured.  What difference would her attention seeking publicity ploy of first degree murder as an adult accomplish?  The kid in still in juvie custody either way.

What has not been mentioned is the Chidren's Services / Welfare / social workers fetish for "keeping families together."  The kids are abused, terrorized and totured by their blood parents.  Finally someone notices the abuse and they are pulled out of that hell to recover.

I also do not think that it is for punishing really, but rather that it is based on the social contract and therefore it is an agreement by people to accept certain consequences as a result of violating society's rules. In law school, I took a class on the rights of children. We had a local judge give a guest lecture, and one of the questions he asked as he began was why we send children to jail. I answered "So they can learn to be better criminals." He liked my answer.

I'm opposed, generally, to "criminal camp", especially for children. I'm not opposed to jail particularly, but I think we really need to reform it. But it's hard to reform something when there is no consensus on what the purpose of it is. Reforming the prison system would mean taking the time to look at it and understand it, and it's not a fun job. So people avoid thinking about it because it's unpleasant to think about.

But that makes it really difficult to change the status quo.

Still, by far the best system ever, natural, spontanious, as it should be. But there are some things the government should do. But the closer, more local, the better. The problem with externalities is that they aren't borne by those who create them. This problem has absolutely nothing to do with the fact that people, in general, act to improve their lives.

So the solution to the problem is to have those externalities borne by the people who create them. The solution isn't to stop them from acting to improve their lives.

264 Yes six months to a year after his 19th birthday the newsies will be bleeting about how the system failed and how did he get set loose on society to kill and maim again. I feel for him but he is not fixable, the agent who created the FBI behavioral sciences division once stated serial killers are made not born and here is a prime example of that. I don't understand why we don't sterilize these women and men who continue to have children and abuse them over and over again. He should be locked up for the rest of his natural life.
