John Boehner: Defund Movement The Way to Avoid the "Trainwreck" of ObamaCare
— Ace

What?

Well he's on board now, he says.

He says, "the House has listened to the American people, and now it's time for the United States Senate to listen as well." Which may be a hidden slap at Cruz but it's also, on the surface, a perfectly routine demand to make at Harry Reid. Well-crafted.

Meanwhile, Peter King, who grabbed every headline he could after 9/11, accuses Ted Cruz of grabbing headlines, and says the loss on this Defund issue in the Senate will prove that Cruz is a fraud.

“I hope people will get the message this guy is bad for the party,” King continued. "The issues are too important, they're too serious - they require real conservative solutions - not cheap headline hunting schemes."

I'm sure I could name a less serious guy than Peter King but it would take a few minutes of thought.

I can only say buck-passing or "Burden Shifting" so many times. Burden Shifting You Guys.

You know, Ted Cruz does grab a lot of headlines. Sometimes he rubs me the wrong way. That said, look: At some point you have to do something besides mark time.

I have a question of defunding.

Some aspects of the law include subsidizing health care and building health care markets.  These parts of the law would need funding in order to happen, so defunding the law would kill these parts.

But what about other aspects of the law that don't require funding?  For example: (1) individual mandate.  (2) Insurers must cover pre-existing conditions, maternity, birth control, etc.

Those items don't require any funding... they are simply commands.  So how does defuning Obamacare do anything about that?  What am I not understanding here?

40 King is reported to already have an "exploratory committee" raising cash for 2016. I don't care if they get their asses kicked. At least they stand for something and try to draw on Public support. As has been stated before by some moron, the palace intrigue method always loses anyway when everyone is a member of the Ruling Class™. I think this may delay a complete ans final rift in the GOP.

ObamaCare is The Thing the Democrats fear ... all the way down to the exit sphincters of their colons. The only things that fear ObamaCare MORE than the Democrats ARE their exit sphincters. The costs it forces upon everyone, the hour-cutbacks, the job-description restructuring, the outright layoffs (that we're already seeing) ... ... ObamaCare in 2014 spells the end of the Democrat Party. Why else would Teh JEF, fia EO, hand out waivers and authorize a 1-year delay? Can we at least depend on Hairy Reid to torpedo this Defunding?

46 >>>Enforcement. If there's no money to enforce the provisions, it doesn't really matter what the provisions are.

Yeah, I've considered that, but I don't really think that will do it, to be honest.

Think about the insurance companies.  Are they going to operate illegally and NOT cover pre-existing conditions simply because they know it won't be enforced?  (And technically, if the PPACA was still law, then it would be illegal to not cover pre-existing conditions).

Furthermore, if the PPACA was still law, it seems to me that any part of the executive branch could use discretionary budget to enforce something which is law.  So it may not be enforced widely, but there would always be the threat that it COULD be enforced.  Again, this will have an effect on insurers.

(For individual mandate, I can see why defunding would mitigate that).

Posted by: dan-O at September 20, 2013 11:39 AM (D0bIN)

I've been saying that since the GOP won the majority in the House. Just pass a more or less balanced budget that defunds or rolls back Obamacare and then split town. That leaves Harry and the Senate to negotiate among themselves and with Obama with all the press focused on them (cause the rest of the guys are all back home doing local media, err I hope). When they come up with a counter proposal or budget reconvene to consider it--if it is a crappy offer vote it down and go home again. At some point they will make an offer worth staying in town to consider.

79 AtC, show me where the funding is for enforcing EMTALA.  AFAIK, there is none, and yet it is still out there, and woe unto the doctor or hospital who violates it.  So I respectfully suggest that even with defunding, portions of it will live on until individually staked in the heart.  This is also my recollection of punditry about O-care for the past few years, that defunding it still does not eliminate it entirely.

A lot of people whose conservative bona fides are not up for questioning have come to the conclusion that Cruz is a hack, a liar, and guy who places self-promotion over all else because of his actions here.  It's not just RINOs like Gabe Malor and me and Pete King or whatever.

86 That said, just because the messenger is questionable doesn't mean the message itself is wrong. Cruz really HAS behaved like a cowardly, disingenuous turd since July and August on this fake "Defund Obamacare" stuff. No he hasn't. He's been the public face of defunding and taken flak from both sides. For God's sake, conservative pundits were referring to him as a Canadian Senator from Texas. If John Boehner or the House leadership is your idea of honesty and courage, you have a skewed worldview.

You've been watching the same people say the same thing about the debt and the deficit for decades. Just because someone tells you they stand for something doesn't mean they actually stand for that thing. When the republicans were in a position to win they turned the spending dial up to 11 and added new entitlements, new bureaucracies and new government powers.

Okay so it seems to me that I'm not the only one who thinks that merely defunding will in fact do relatively little to Obamacare.

- Individual mandate will remain... who knows if IRS will enforce
- Requirement for coverage of pre-existing conditions will remain
- Myriad of other micromanaging-laws for insurers and health-care providers will remain

Honestly seems to me that defunding won't accomplish much.  (Not that I'm against it; it seems like a good first step)

So I respectfully suggest that even with defunding, portions of it will live on until individually staked in the heart. This is also my recollection of punditry about O-care for the past few years, that defunding it still does not eliminate it entirely. Posted by: Conservative Crank at September 20, 2013 03:45 PM (sQ0LB) Don't forget that, in theory, the House could zero out all funding for prosecutions of EMTALA violations. It won't but it could. 170 Just go online to look at the exchange I have to use in Ohio.  It's not the Federal one but a private one that of course meets the new Obamacare rules.  Not the broker said the rates on the site were pretty much bogus at the moment (45% lower for the same plan) but said we would be looking at about a 25%-30% decrease because plans now have to use community rating and I am middle-aged.  Take it for what it's worth, but this is going to be an even harder uphill slog.

172 Listen: when the usual DC politicos and journalists were attacking Ted Cruz earlier in the year for being an "attention whore" and "not collegial," etc., do you know what my reaction was?  My reaction was "fuck you, whiners."  It seemed like a bullshit criticism, especially because Cruz was making waves for telling truths, or backing Rand Paul up on his filibuster.  Not only did I not mind that, I loved it.  I respected him for pissing the right people off, and he rose massively in my estimation.

What has torpedoed him for me recently isn't his "non-collegial" style, it isn't the fact that he doesn't play nice -- these are frankly good things in a lot of ways -- it's the fact that he has become a liar.  I don't separate 'good lies' and 'bad lies', I just see a guy who consciously, intentionally shrieking things that he knows to be outright false in an effort to get the base enraged and raise his own profile and get money flowing into his own coffers...and I'm supposed to respect this guy?  Because he's selling me a consolatory dream?  That's like respecting my heroin dealer because the smack he sells me eases the pain of reality.  But reality doesn't actually go away.

Cruz's whole "defund Obamacare" push has always been predicated upon a lie, which is that if the House and Senate were to somehow 'defund' Obamacare then it would cease to function, even absent a full repeal.  IT IS A FUCKING LIE.  The true 'heroin' of Obamacare, the stuff that's supposed to make it politically tough to repeal -- that goes into effect no matter what because it's spending that is not controlled by the budget battle.  It's automatically budgeted: the subsidies, tax credits, entitlement-like functions, etc.  That stuff is what we're really all claiming to be afraid of w/Obamacare (not these stupid "exchanges" which obviously look they they're not even gonna work properly from the jump), and that stuff is utterly out of our hands.

But people who don't wonk out about federal budgeting practice seemingly don't even grasp this fact, or claim that "no really we're playing 4-D chess here, it's a triple bank shot we're gonna hit!"

Nobody ever ran for office promising to be a toady for the party bosses. They all promise to stand up for your values and fight for your issues. They promise to fight the special interests. They promise they wonÂ’t be like all the others.

Ted Cruz is doing something very unusual for Washington DC – he’s keeping his promises.

You donÂ’t have to like Ted Cruz. You certainly donÂ’t have to vote for him. (As far as I know heÂ’s not on any ballots right now anyway.) But you have to admit that heÂ’s doing exactly what he said he would do.

I find that refreshing. I spent too many years voting for people who didnÂ’t keep their promises. I understand that in politics sometime compromises have to be made. But I expect the people I vote for to put up a fight, not just roll over and play dead. If he has to give ground on one issue in order to gain ground on another thatÂ’s one thing. Making deals to further his own career or increase his bank balance is another kettle of fish.

Ted Cruz represents the voters of Texas, not the Republican party. What the party leaders in Washington or the voters in California and New York think of him is irrelevant.

221 132. Dr. Spank Today's Counterpoint Quote: Focusing on what one doesn’t want is an easy way out of difficult conundrums for many leaders. Expressing what one does want requires more courage. But to move beyond impasses, we need to aim higher. Rather than focusing on how to prevent things from getting worse, we need to think — and talk — about how to make things better. To do that, we all need to muster the courage to start conveying what we want — clearly, concisely and sincerely — and to back it up with the political will to take necessary action. This is the essence of constructive engagement.

227 Defunding means defunding the initial implementation and other bureaucratic functions. It is a serious monkey wrench into the machinery of the beast. Although I must say, while it's true that once an entitlement takes hold it's virtually impossible to repeal it, Obamacare isn't a check in the mail. It's a glass of hemlock with a twist. And that's not something that most people want to be entitled to, especially when it's their life in the hands of some Federal employee who couldn't hack the fry-o-lator at Burger King. Then, bloody murder will be screamed for repeal. I hope.

228 Cruz is actually playing this pretty brilliantly. The GOPe want to isolate and eliminate him. Now he has placed the onus on the Republican Senators not to allow cloture, giving the GOP a chance to make it's case to the People. The People are already on board. The problem is that the GOPe doesn't really want Obamacare to go away. I guess they see it as something to run against for years if not decades/ which tells you in the end they don't want to defeat it.

You cannot defund Obamacare.  You can threaten to do so, but in the end if the Dems are just as pigheaded as you are, all you get is a stalemate.

The theme of "the American people have spoken" is the only tactic that might work.  The best we can hope for is the Dems and Obama willingly delaying implementation.  To some, that would be a great victory, and I suppose it would be politically.

I still think we need to let this thing kick in before enough Americans really hate it. (A bare majority is against it, and only in some polls) The post earlier shows young men still have no clue how badly they will get screwed under Obamacare.

251 Umm...because that's not what I publicly stated? What I said, once, was that yeah sometimes I can kneejerk take a contrary stance before I've thought something through, which is a bad mental habit. But I back down quickly on those sorts of things -- usually in the same thread! This is not kneejerk. This is not a pose. This is not me trying to be 'cute.' I have been consistent about where I stand on these things for a long time now. So don't try to create this "everything this guy says is a lie" meme. Your question completely misinterprets the spirit of what I wrote back then and turns it into "everything this guy says is a lie." C'mon now. Posted by: Jeff B. at September 20, 2013 04:07 PM (n/+FT) Please state where, specifically and exactly and using the text of my comment, I said that you lie. Please. I'll wait. Oh, what's that? You can't? Because at no time did I say you lie? In point of fact, it's as if I took care to go out of my way to not accuse you of lying about what you believe. Gee, it's almost as if you were attempting to take my reference to a comment that you made and turn it into something that I did not say. Gosh golly gee willikers, it's a mystery for the ages why it is that I am inclined to believe that you give less than careful consideration to the replies that are made to you. Not to mention that I am inclined to believe that you are unwilling to address the underlying issues concerning if you do, in point of fact, have any fundamental principles animating your beliefs. I'm in a bit of a generous mood, so I will take your response as an answer to my question. Thus, the only way that we can tell if you are giving something other than a kneejerk, non-thought through response to a matter is to see if you are consistent in said position. That does not answer the fundamental question as to whether or not such position was, in and of itself, borne of actual thought and consideration or if it sprung for a non-thought through kneejerk inclination to take the opposite position merely because it is so and then created post hoc justifications for such a response. Frankly, I doubt at this point if even you know if that's true.

ME: Even if we 'win' the Ted Cruz strategy of defunding Obamacare, it wouldn't solve the problem at all because most of the truly toxic spending is statutory in nature and not budgetary.

287 They didn't need to ruin the best healthcare system in the world.  We didn't need to watch all these doctors scrambling to put all our personal health information in the cloud cause "it's the law".  Now so many practices are being taken over by monolithic hospital corporations, so your second opinion will come from another doctor who works for the same monolith.  We didn't need to have to watch all these doctors retire cause they could see a mess down the road.

All they had to do was have the health insurance carriers send a card to anyone uninsured and have them check off what company they wanted.  They could have had a box on your income tax form, like they do for their own campaign money, asking if you want to contribute a dollar to fund someone's health insurance and you'd do it, it's worth it not to muck up the system as it is even though it may be irrevocably mucked up.  They could have passed a law decoupling your insurance from you job and insisting that people be covered for pre existing conditions and it would have been done.  And we'd still have the greatest healthcare system in the world.

Those charges, one of which carries a maximum sentence of life imprisonment if convicted, were reduced to a charge of conspiring to violate arms-control laws, the report said. 314 And by the way, no matter what the tactical effects of defunding, the important strategic goal is to get out above the MFM and tell the American people WHY you are doing this and why Obamacare is an absolutely evil disaster if it is not stopped. This is a winning message. Most Americans across the political spectrum do not want this law to stand. Besides a monkey wrench to delay this thing, that is a really important factor as well IMHO.

334 2008 Republican Party Platform http://tinyurl.com/mpttotq Review how your GOP elected officials actually vote. • We will insist that the budget reasonably plan for the long-term costs of pension and health care programs and urge the conversion of such programs to defined contribution programs. • Finally, while government requires corporations to budget for future pension and health care costs, our government ignores those requirements. No family or private sector business could keep its books the way Washington keeps ours. • We support the Government Shutdown Protection Act to ensure the continuance of essential federal functions when advocates of pork threaten to shut down the government unless their wasteful spending is accepted. • We will insist that the budget reasonably plan for the long-term costs of pension and health care programs and urge the conversion of such programs to defined contribution programs. • Republicans support tax credits for health care and medical expenses. Small Business: the Engine of Job Growth In 2000, when Democrats controlled the Executive Branch, small business faced a hostile regulatory agenda, from OSHA's ergonomics standards and attempts to intrude into the homes of telecommuting employees to IRS discrimination against independent contractors. Republicans turned back those threats, along with much of the onerous taxation that limited the growth of small businesses. We reduced their marginal tax rates, quadrupled the limit on their expensing of investments, and phased out the death tax on family owned small businesses and family farms. We enacted Health Savings Accounts to help small business owners secure health insurance for themselves and their employees. All those gains are jeopardized if Democrats gain unfettered power once again. Republicans will advance a multi-pronged plan to support small business and grow good-paying jobs: • Through the energy agenda laid out elsewhere in this platform, we will attack the rise in energy costs that is making it so difficult for entrepreneurs to compete. • Our tax reduction and tax simplification agenda will allow businesses to focus on producing and selling their products and services — not on paying taxes. • Our plan to return control of health care to patients and providers will benefit small business employers and employees alike. • Our determination to vigorously open foreign markets to American products is an opportunity for many small businesses to grow larger in the global economy. • Our approach to regulation — basing it on sound science to achieve goals that are technically feasible — will protect against job killing intrusions into small businesses. • Our commitment to legal reform means protecting small businesses from the effects of frivolous lawsuits. Using history as our guide, we look to innovative entrepreneurs for the ingenuity and daring that can give us the next generation of technological progress. The advances our country needs, in everything from health care to energy to environmental protection, are most likely to come from the men and women of small business. Enforcing the Rule of Law at the Border and Throughout the Nation: Our commitment to the rule of law means smarter enforcement at the workplace, against illegal workers and lawbreaking employers alike, along with those who practice identity theft and traffic in fraudulent documents. As long as jobs are available in the United States, economic incentives to enter illegally will persist. But we must empower employers so they can know with confidence that those they hire are permitted to work. That means that the EVerify system—which is an internet-based system that verifies the employment authorization and identity of employees—must be reauthorized. A phased in requirement that employers use the E-Verify system must be enacted. The rule of law means guaranteeing to law enforcement the tools and coordination to deport criminal aliens without delay — and correcting court decisions that have made deportation so difficult. It means enforcing the law against those who overstay their visas, rather than letting millions flout the generosity that gave them temporary entry. It means imposing maximum penalties on those who smuggle illegal aliens into the U.S., both for their lawbreaking and for their cruel exploitation. It means requiring cooperation among federal, state and local law enforcement and real consequences, including the denial of federal funds, for self-described sanctuary cities, which stand in open defiance of the federal and state statutes that expressly prohibit such sanctuary policies, and which endanger the lives of U.S. citizens. It does not mean driver's licenses for illegal aliens, nor does it mean that states should be allowed to flout the federal law barring them from giving in-state tuition rates to illegal aliens, nor does it mean that illegal aliens should receive social security benefits, or other public benefits, except as provided by federal law. We oppose amnesty. The rule of law suffers if government policies encourage or reward illegal activity. The American people's rejection of en masse legalizations is especially appropriate given the federal government's past failures to enforce the law.

Right now the VA is my Primary Care provider until I find an acceptable doctor who takes TRICARE where we moved to.   My first visit to my VA Primary Care Doctor was not pleasant.  I was told the two drugs I was previously prescribed were not available in the VA formularies and we would have to "experiment" with the dosages of my new my heart medication.  OK that is scary and is not working well and the closest Military Base is Fort Knox 90 minutes away so that option is out until I can find a Doctor local who takes TRICARE.    The second thing I learned was that my Doctor was placed here by the Underserved Rural Doctor Program.  Her Doctor School was paid for by the US Government and she agreed to serve 4 years in an underserved area.  The problem with that is I use the VA in Lexington, KY population 500,000.  I am still not sure how the heck that one worked out.  We are not even close to Appalachia.

It is a dual device with both a pacemaker and an AICD included. The cardiac resynch therapy is constant, so it runs down the batteries fairly quickly. You are correct, however, in that they normally last for much longer. Even pacemakers normally last a lot longer than that because they only kick in when the heart is beating too fast or too slow. Mine, however, due to a really weak heart, fires in synch with every heartbeat in order to strengthen the contraction.

Here's something I know you won't bother to think about, but I'll say it anyway: maybe it isn't everyone else that thinks you're an asshole. Maybe it's just that you're an asshole, Asshole.

359 I stand for principles Like the principle that Ted Cruz is a liar because an article by Ed Morrisey from last week claims you can't defund Obamacare. At least you've ditched the 'Coward' nonsense.

360 EoJ --

I'm done arguing with you about this.  We've both taken this about thirty notches higher on the personal insult-meter than it needed to be, and even though I think you ought to be more circumspect about not personally attacking someone who hasn't personally attacked you first, let's just wind it up in this thread and move on.  For the record, I don't think you're being intellectually dishonest or disingenuous, not really.  Even though I suggested that in my previous post.   I think you're quite wrong about this, catastrophically so, but then again you think I'm quite wrong as well so big shock there.  I respect your service in the military, but once again -- you shouldn't be so quick to assume I've never served my country in any capacity either.  Just because I don't talk about things like that (on the internet, of all places, where shit is PERMANENT) doesn't mean I haven't done them.  Maybe it just means that I don't feel free to talk about them in public, regardless of how many "oh you're just a pussy lawyerfag" provocations get thrown my way.  Maybe there are good reasons for that.

Anyway, I'm laying down arms for now.  I'm sure we'll battle again soon enough.  I'll try to be of better humor about it when it happens...I think it was BurtTC's "coward" remark that set me off here, and not even anything you said.  'Til then.

361 My dear friendJeffB... let us not forget that heaven Ace is blue.

362 Goldbergs newsletter today touched on something that I think is connected this this. Here's the key bit, word for word "But move away from philosophy and down to earth. Liberals and leftists are constantly denouncing "false choices" of one kind or another. In our debate, Jonathan Chait kept hinting, hoping, and haranguing that -- one day -- we could have a socialized health-care system without any tradeoffs of any kind. Environmentalists loathe the introduction of free-market principles into the policy-making debate because, as Steven Landsburg puts it, economics is the science of competing preferences. Pursuing some good things might cost us other good things. But environmentalists reject the very idea. They believe that all good things can go together and that anything suggesting otherwise is a false choice. Listen to Democratic politicians when they wax righteous about social policy. Invariably it goes something like this: "I simply reject the notion that in a good society X should have to come at the expense of Y." X can be security and Y can be civil liberties. Or X can be food safety and Y can be the cost to the pocketbook of poor people. Whatever X and Y are, the underlying premise is that in a healthy society we do not have tradeoffs between good things. In healthy societies all good things join hands and walk up the hillside singing I'd like to buy the world a coke." They live in world where there are magic policies that will give everything. All upside, no downside. No competing goods and honest debate about which is the greater good. The simpletons, the true believers of this ridiculous concept, well of course they will lash out like this. They are the pure virtuous ones. If you stand in the way, what else could it be but pure evil?

363 Oops, wrong thread...

Posted by: Dave S. at September 20, 2013 01:07 PM (M3APu)

364 Incidentally, I wrote my #366 before I saw #364.  Doesn't really change what I wrote, though:  my rhetoric was too harsh in this thread, so I'm sorry for that, but I think yours is obviously way over the top too.  Figure it's best to take a breather on fighting with you in this thread if for no other reason than all we're gonna do is hurl names at each other at this point.  We obviously come from very different positions on the right when it comes to these issues.  Neither are illegitimate.  (Yours is wrong, but not illegitimate. <-- joke.)

Anyway, let's step back a bit and lock horns later if we must.

365   297 --" Cruz doesn't think Obamacare is going to be stopped or delayed in any way."

Bullshit. You're smearing the man based on your suppositions.

I don't know Ted Cruz any more than most people on this blog. What I do know is he's rallied our base and forced our leadership to be a real opposition party. There's no contradiction in doing that and compiling a list of future donors.

What seems to upset you and Gabe is that your own plans and preferences are different than Cruz's. You lost the argument. Time to get in the game or go home.

366 You know what, EoJ?  I was all ready to forgive and forget and move on, but then I went to your blog and I saw that you gave a good review to Man Of Steel.

Fuck it, it's BACK ON ASSHOLE.

Anyone who issues curses in tweets should be screened out when seeking security clearance.

Also, he should be questioned if he hears voices being microwaved to him.

And keep him away from guns.

369 Wait, I thought this was about that shameful tweet.

371 Folks, let's face the facts. The progressives are so close to their goal they can taste it. They are willing to do ANYTHING to make it happen. All of this is a game to them and they care not a rat's ass about you and me. And this ubama-care is gonna have all the money (1.00 dollar equals 2 dimes and 1 penny) they want to buy more votes. Now here is the sad part. They are all progressives. ALL. OF. THEM. Except maybe Cruz and Gohmert. Those two I know personally. Sorry to bring bad tidings. Yeah, I hate it too.
