Judge Halts Nurse Bloomberg's Soda Ban
— Ace

@gabriel_malor notes that the decision is from the "New York Supreme Court," but remember, New York names its courts oddly; the "Supreme Court" is the lowest-level court. (The highest level court, analagous to the US Supreme Court, is the Court of Appeals.)

But still a nice thing.

The regulations are "fraught with arbitrary and capricious consequences," the judge wrote. "The simple reading of the rule leads to the earlier acknowledged uneven enforcement even within a particular city block, much less the city as a wholeÂ….the loopholes in this rule effectively defeat the state purpose of the rule."

If this is the suit noted by the next article (which I'm 99% sure it is), then the action to enjoin was brought by the American Beverage Association and a local Korean grocer.

Starbucks will continue selling sugary coffee drinks under the "half milk" loophole, a special little loophole created by Bloomberg and his minions to make sure that the Crusading Liberal White People who support this ban are actually not affected by this ban. If Starbucks had been included in the ban, the shrieking from Bloomberg's Crusading Liberal White People supporters would have been deafening, and the thing would have been killed.

So they made certain that the ban didn't apply to White People's Big Gulps, even though they contain nearly as much sugar and much more caffeine than Other People's Big Gulps.

For example, Lattes are exempt because theyÂ’re more than half milk and itÂ’s OK for customers to fill their own cups of large coffee with all the sugar they want.

Starbucks announced it plans to continue offering 20 ounce venti-sized drinks because of the milk content. Like DunkinÂ’ Donuts, customers will also be able to add their own sugar to their coffee.

Note to Bloomberg: Milk itself is full of sugar.

If they submit a new rule which they can uniformly enforce, that one would probably pass muster. That is: the injunction is not because the judge said, "No, you can't tell people what they can or cannot drink," the injunction is because the judge said, "If you're going to tell people what they can or cannot drink, it has to be uniform."

64 The ruling is better than that (struck down on "uniformity" problems.)  The judge flat said the Board did not have authority to regulate sales of an otherwise legal food product for a non-imminent threat to health of the people of new york,  and that if it wished to create one Bloomberg could not arrange this unilaterally or through the board, but only through legislation of city council.

Shit, not just driving, checking the bike lane before you walk across the intersection is now a must or you'll be run over by those bikers who can't bother to follow traffic signals, because when they hop on their bicycle, they suddenly become made of titanium.

In Chelsea, I noticed they put separate little red and green bicycle-shaped lights at the interections too.  I was bitching about it loudly and this woman walking behind me gave me the hairy-eyeball.

I was bitching because the city dished out a ton of money to put up another set of lights for bicycles that 100% duplicates the street traffic lights with the exception that they have little bicycle shaped cutouts.  If they can't work out that driving across a street against the light get's them smeared across half a city block, then a little shape isn't going to save them. 

And as I bitched about it, I watched a bike ride right through his special little light against traffic.

I used to make a little pot of espresso (always Starbucks beans, FWIW) at a little machine at my desk at work, then share it with my co-workers.  One week, most of them were away for some industry conference, and I made the same pot as always.   With nobody there, and a pot of yummy espresso right in front of me, I ended up drinking the whole pot myself over the course of the morning.

Sounds like a lot, but it was really only maybe 8 or 10 ounces total.  

About two hours later I had such a bad tremor in my hands from the caffiene I literally couldn't work!

Well, today wasn't a complete bust for Nanny Bloomers.  The CO Senate just okayed a chunk of the anti-gun legislation he's been financing.

 

I just got back from skiing out there.  If I wouldn't have been flushing a load on non-refundable money, I would have diverted to Utah, Idaho, or Montana in a heartbeat.  You can bet the CO resorts will never see another thin dime from me.  The pot smoke in the parking lots and outside the ticket windows was getting old anyway.

303 On coffee, fresh roasted (big and oily) columbian beans are the way to go. "Arabica" as near as I can tell is a shitty bean slightly better than floor sweepings, that is marketed as if it's something special.

Arabica beans originally came from Africa, I think...so it's a different type of plant.

 

Columbian coffee has an after-taste that's sort of bitter to my taste buds.

I can drink it, but I prefer the lighter, nutty taste of Arabica.

I probably have tried most of the beans on this list: http://www.starbucks.ca/coffee/whole-bean but, some of my favorites were from the Asia/Pacific region or Latin America (versus Africa, etc). One of the beans I particularly like is the Komodo Dragon Blend. But, I also like Kenya, French, Sumatra, and Verona. The christmas blend is a joke.

For years, we had one of those coffee-makers that would stop brewing when you pulled out the pot...

 

I noticed that the 'first coffee' coming out of the grinds had a delicious flavor that was diluted, after more water was run through the grinds.

So I began to abuse this.

I got hooked on the flavor of that 'first coffee'.

 

So my husband bought me a Keurig...so that I could have that flavor with each cup.
