— Ace @gabriel_malor notes that the decision is from the "New York Supreme Court," but remember, New York names its courts oddly; the "Supreme Court" is the lowest-level court. (The highest level court, analagous to the US Supreme Court, is the Court of Appeals.)
The regulations are "fraught with arbitrary and capricious consequences," the judge wrote. "The simple reading of the rule leads to the earlier acknowledged uneven enforcement even within a particular city block, much less the city as a wholeÂ….the loopholes in this rule effectively defeat the state purpose of the rule."
If this is the suit noted by the next article (which I'm 99% sure it is), then the action to enjoin was brought by the American Beverage Association and a local Korean grocer.
Starbucks will continue selling sugary coffee drinks under the "half milk" loophole, a special little loophole created by Bloomberg and his minions to make sure that the Crusading Liberal White People who support this ban are actually not affected by this ban. If Starbucks had been included in the ban, the shrieking from Bloomberg's Crusading Liberal White People supporters would have been deafening, and the thing would have been killed.
So they made certain that the ban didn't apply to White People's Big Gulps, even though they contain nearly as much sugar and much more caffeine than Other People's Big Gulps.
For example, Lattes are exempt because theyÂ’re more than half milk and itÂ’s OK for customers to fill their own cups of large coffee with all the sugar they want.Starbucks announced it plans to continue offering 20 ounce venti-sized drinks because of the milk content. Like DunkinÂ’ Donuts, customers will also be able to add their own sugar to their coffee.
Note to Bloomberg: Milk itself is full of sugar.
Below, for no good reason except it's funny, Paul Rudd questions Starbucks' size-naming conventions.

That CS Lewis quote should be fucking etched on Bloomberg's tombstone.
"Of all tyrannies, a tyranny exercised for the good of its victims may be the most oppressive. It may be better to live under robber barons than under omnipotent moral busybodies. The robber baron's cruelty may sometimes sleep, his cupidity may at some point be satiated; but those who torment us for our own good will torment us without end, for they do so with the approval of their own conscience."

*clambers up* It is so freaking annoying when doing research out of state and trying to figure out how the hell the court system is arranged wherever it is you're looking. NY Supreme Court is the lowest level, California has approximately eleventy bazillion different circuits, Superior Court could mean anything, it could be a trial court, it could be an appellate court, you just don't know. It's an exciting adventure of adventurousness! Then there's Louisiana. Napoleonic Code? Really? Really? Annnnnnd I'm stuck.

“We're not banning anything. It's called portion control,” Bloomberg said Sunday on CBS’s "Face the Nation." “It's a typical way that companies use to and governments use to explain to people what's in their interest and what isn't.”That is a scary quote. In his mind, the government knows what's best for me, better than I do.

First of all, wrong. If there is more than one size, "large" would be the biggest of those sizes. Words have specific meanings. Sorta.

He's not "stupid", the character is making fun of a ridiculous and pretentious convention at a coffee store. Yes, you "can" call a "large" coffee anything you like, but what's wrong with "large"?
There is a coffee place near where I work that's even more ridiculous then "Venti", if you can believe that. The "small" coffee is called a "tall".
Me: Can I have a small regular coffee?
"Barista": You mean a "tall"?
Me (perplexed): Is it the smallest one you offer?
"Barista": Yes, unless you want an espresso.

Shit, not just driving, checking the bike lane before you walk across the intersection is now a must or you'll be run over by those bikers who can't bother to follow traffic signals, because when they hop on their bicycle, they suddenly become made of titanium.
In Chelsea, I noticed they put separate little red and green bicycle-shaped lights at the interections too. I was bitching about it loudly and this woman walking behind me gave me the hairy-eyeball.
I was bitching because the city dished out a ton of money to put up another set of lights for bicycles that 100% duplicates the street traffic lights with the exception that they have little bicycle shaped cutouts. If they can't work out that driving across a street against the light get's them smeared across half a city block, then a little shape isn't going to save them.
And as I bitched about it, I watched a bike ride right through his special little light against traffic.

In fact, if you imagined Mayor Bloomberg naked or--for the sake of modesty--strolling around on a European beach wearing a Speedo thong, what you'd see is a soft, saggy, rotound pink ball of mediocrity. The man probably hasn't seen his penis without a mirror in 30 years. So, you ask, who in the fuck is he to tell me how to drink, how to eat, how to live? Good question. Ask New York.
Oh, and that nasty image I put in your head of Bloomberg walking around in a Speedo thong? You're welcome.

I agree that words need to have specific meanings. I disagree that large necessarily means the biggest size. If there is a modifier before the word "large", then it may be even bigger.
Examples: Extra-large, or Mega-Large.
BTW, love your work EoJ. You crack me up.

Btw, when were the Native Americans indigenous to the USA guaranteed the right to vote?
The whole Republican Party anti-slavery initial platform was, intentions aside, their own effective way of adding new voters to their affect elections in favor of the GOP.
Likewise, to gain voter advantage, the Democrats legitimize the illegal aliens with a registration to vote, along with US social security numbers, drivers licenses that don't reveal citizenship status. In fact, comprehensive immigration reform would likely be used to effect a constitutional amendment, even if only in policy which has been already in effect since GWB. Eventually, citizenship is beside the point, regardless of nationality given the open boarders NAFTA, etc.
We all return to serfdom, manipulated by corporatist lords of boards made of people, too. Know your caste, and stfu or Big Bro will give you something else to cry about.
On crying shames, Austrians are supposedly nostalgic for Hitler's government. Slavery...

Do cyclists have to pay any sort of taxes that go towards creating those 'bike lanes'?
That's what gets me...cyclists who take up space on the roads that are maintained with the taxes that are levied on cars and trucks.

I used to make a little pot of espresso (always Starbucks beans, FWIW) at a little machine at my desk at work, then share it with my co-workers. One week, most of them were away for some industry conference, and I made the same pot as always. With nobody there, and a pot of yummy espresso right in front of me, I ended up drinking the whole pot myself over the course of the morning.
Sounds like a lot, but it was really only maybe 8 or 10 ounces total.
About two hours later I had such a bad tremor in my hands from the caffiene I literally couldn't work!

All of us down at the Brattleboro WomanÂ’s Reproductive and Pregnancy Decision Center think Presdent Obama ought do something about enforcing Senator Bloombergs bill. He is just trying to protect the children and those on food stamps. Presdent Obama should sight Michealle Obama's "Let's Moove" program as a source of law to enforce this. We must pretect the children from this evil so that they go old and help pay off the debt that Bush built up over 10 years and helps Presdent Oblama reduce this debit. Had some on a 300 mile jaunt Sunday morning in rural SC.
Only peeps in the truck stop were me and three cops. . .two looked like they were 23 year-olds, and the third was a short 50-something year old blonde woman.
I said, "good evening officer". She said "heya hon".
I picked the "Hawaiian" coffee. . .24 ounces for $2. It was actually not half bad.

No. It should taste like coffee. If it doesn't, then there's no point to drinking it.
Same goes for booze. If you need to load up a drink with Coke or fruit juice to make it go down, you're probably better off with a juice box in the first place.
Now get off my lawn!

There are two kinds of coffee beans:
Arabica; these are the tasty ones you want and
Robusto; these are the one that taste like wet cardboard and are found in Maxwell house and other cheap coffees. To offset the nasty taste, they do have a lot of caffeine.

303 On coffee, fresh roasted (big and oily) columbian beans are the way to go. "Arabica" as near as I can tell is a shitty bean slightly better than floor sweepings, that is marketed as if it's something special.
---------
Eh, well...to each his own.
Arabica beans originally came from Africa, I think...so it's a different type of plant.
Columbian coffee has an after-taste that's sort of bitter to my taste buds.
I can drink it, but I prefer the lighter, nutty taste of Arabica.

There is such a thing as French Roast (also Italian Roast) which is darker and stronger than "blends" and doesn't taste like burnt JP-8.
However, none of these options exist at Starbucks.

349 And if you're drinking super-concentrated coffee just to get the extra caffeine, you're better off just taking a tablet of No-Doz and drinking normal coffee. This way you get caffeine you want and can actually enjoy the coffee's flavor for its own sake.
--------
For years, we had one of those coffee-makers that would stop brewing when you pulled out the pot...
I noticed that the 'first coffee' coming out of the grinds had a delicious flavor that was diluted, after more water was run through the grinds.
So I began to abuse this.
I got hooked on the flavor of that 'first coffee'.
So my husband bought me a Keurig...so that I could have that flavor with each cup.
