— Ace Patterico found an important Lerner quote from 2011:
1 March, 2010 – IRS officials start targeting organizations with “tea party”, “patriot”, and “9-12;" in their names.27 June, 2011 – Lois Lerner, Director of Exempt Operations, learns of the inappropriate targeting. She initiates an audit of the office involved, but the targeting continues.
17 November, 2011 – Lois Lerner, Director of Exempt Operations, tells Businessweek that receiving a thick questionnaire from the IRS is a “behavior changer.”
Incredible. Patterico is taken with the fact that she admits this to a magazine; if this is the sort of thinking she brags about to a national news magazine, one can only tremble at what she's holding back.
In America -- in any free country -- you are supposed to be free from punishment and compulsion unless you are found guilty of some misbehavior through Due Process.
But Lois Lerner doesn't like that idea. Instead, she embraces the notion that people can and should be punished and compelled into acting the way she prefers, not after Due Process has found them blameworthy, but before anyone even thinks to file charges.
She's decided that the process itself can and should be a tool of state coercion. She doesn't need a finding from a legal tribunal to impose burdens on freedoms and to compel what she considers "correct" behavior -- she'll serve as judge and jury herself, and impose the punishment of a "thick questionnaire" as a tool of "behavior change."
Prisons -- "reformatories," they were once called -- exist, in theory, to change the behavior of the inmates therein. And even a free people admits that some people must have their behavior changed by state coercive power... but only after such persons have been found guilty beyond a reasonable doubt by a jury of their peers of a felony.
But that limits the pool of persons subject to "behavior change" to an unacceptably small number. Lois Lerner wants to make that pool as large as possible, and impose her regime of behavior change on anyone she comes across she thinks is in need of her moral instruction.
And I'm sure she thinks she's doing substantive good. As CS Lewis warned:
“Of all tyrannies, a tyranny sincerely exercised for the good of its victims may be the most oppressive. It would be better to live under robber barons than under omnipotent moral busybodies. The robber baron's cruelty may sometimes sleep, his cupidity may at some point be satiated; but those who torment us for our own good will torment us without end for they do so with the approval of their own conscience.”

Is responding to a "thick questionnaire" from the IRS better or worse than being "crucified" by the EPA? It's getting hard to keep track of how each government agency fucks its hapless subjects anymore.

This is the same thinking that drives gun legislation in this country. "We won't ban everyone from owning a gun because then we'll get swamped by second amendment whackjobs. No, what we'll DO, see, is make the legal process for obtaining, owning, keeping, and USING a gun so onerous, so draconian, that no one will ever bother to do it. AND, if we find out they have a gun or obtain a gun in any way outside of the workings of the law, we can charge them with a felony! 'Oh, you inherited grampa's 10/22? Well too bad, sucker, you didn't keep it broken down into its component parts and stored in a vacuum-sealed, air tight safe with the ammunition kept separately!'"

In America -- in any free country -- you are supposed to be free from punishment and compulsion unless you are found guilty of some misbehavior through Due Process.
This was the inherent principle of freedom that we once trusted all officials to hold in their hearts.
As we're seeing, this is no longer the case. Principle has fled, trust is dissolved and our country is being reduced because of it. Particularly in this case and the Zimmerman trial, we're seeing the breakdown of the spirit of the law and the intent of the Founders happen right before our eyes. And we find ourselves powerless to stop it.

How can these martinets not realize that they're sitting on a fuckin' powder keg ?
Because they don't believe they are. Consider the average political scum. They get waved through checkpoints, are driven or flown wherever they want and are used to people respectfully addressing them as "sir," "ma'am," "senator" or "representative." They almost never hear how despised they are and when they do, they write it off as "agitators" or "teabaggers."
We have, slowly, accepted so many infringements on our liberties - smoking bans, seat belt laws, regulation of fats and so on - that these martinets believe we will continue to shrug, say, "well, complaining won't pay the bills," and bow meekly to whatever diktat or whim they conjure.

In an old Episode of MASH Col. Blake says something to the effect of "They [Holihan and Burns] went over my head, down to Radar."
The idea being of course that he was not actually in control, but rather the chief bureaucrat, Radar was. And whoever could control Radar (by whatever means, in this case intimidation) actually controlled the unit.
America has become the same. Not a nation of laws, but a nation of bureaucracy, and whoever controls the bureaucracy, by whatever means, controls the nation.
In this case Lois Lerner gained control, through various means, some legitimate, many not. And leveraged it as a weapon against the people.

If you want a glimpse at something truly scary, try a simple math exercise:
Multiply Lois Lerner by every federal and state bureaucratic functionary (social workers, EPA officials, IRS, etc.- across the board) and ask yourself what are the odds that someone, somewhere, sometime, will make an arbitrary ruling that subjects you to the 'penalty of the process'.

A while back they covered a charity near here that provided kids with a fairly simple lunch during the summer when school was out (and school lunch programs shut down.)
It was a private charity, so I have no beef with it per say.
In any case, they said they were able to produce a lunch (a cold lunch IIRC) for about 35 cents. Said lunch had a main dish (sandwich maybe) side and a small drink.
I asked my wife "while this is probably a good thing over all, wouldn't it be important to show parents how they can feed their kid lunch for 35 cents?"

Just once, I would like to see someone with an EBT card use it in conjunction with coupons. I swear I would pay for all of their groceries were I to witness it. I've asked my uncle who is a grocery store manager if he has ever seen such a thing. He said he hadn't really thought about it before, but when he did, no, not a one.

I'm so outraged by the IRS scandals that I will only vote for politicians that support a flat tax/fair tax or a national sales tax. Anything that would replace current tax law and render the IRS as nearly insignificant.
When a federal department targets law-abiding citizens because of their political beliefs, that department must be rendered mostly powerless.

You assume parents who give a shit about caring for their own child.
You should assume a mother, or one of her relatives who got stuck with the kids when she flaked out or went to prison or got killed by her boyfriend or whatever, who just keeps them around for the increase in state and federal welfare benefits.

I was astonished that when I sent my kid to school, all the students were directed to dump their school supplies into communal bins. Might as well get them used to communism early, I suppose.
Got into it with one of the teachers, since I had purchased decent supplies for my kid (real wood pencils, good folders, etc) that I bought for, you know, my kid's use.
Interesting turn...the school I guess got tired of fighting parents on this so they offered a "convenient" option of buying supplies at the beginning of the year and the carton would be delivered to the class....to, yes, be dumped into the communal bins. I asked the administrator that if I was paying for all those supplies in my kid's carton, what happens to the stuff she doesn't use? Do I get it back?
They really don't like me at that school.

They do the same thing here too. They tell every student and parent of certain things the child must bring in. A large portion of the perpetually "underprivileged" (PU) bring nothing. Thus the communal pot.
These same PU get three meals a day free, the rest must pay a small fee. This despite these same PU getting food stamps, welfare, and other social benefits worth more than some of the NUP's parents make.

Before you'd buy your own supplies and on Back To School Night dump it all into the kitty.
Now they want you to write them a check for $60, the District will purchase the supplies, parcel them out according to student name, and deliver the carton to your kid's classroom...to be dumped all into the kitty.
The idea was that since everyone would be purchasing the same supplies (same pencils, folders, paper, etc) they wouldn't have to hear from parents who purchased better stuff for their kids only to have it lost to the commune.

.Don't get me started on the "Black Card". I have almost twice turned in people I know that abuse the heck out of that. One couple, use the EBT card to buy the good stuff like Lobsters, steak and crab legs and when that runs out, they use their double State Disability money to buy regular groceries for the rest of the month. He gets disability because he has COPD or some such thing and she gets it because she used to be a crack head and can't keep a job. Sometimes I just can't believe it. I figure Karma will rear her ugly head some day at them. Oh and they live together but won't get married because that would reduce the State disability check.
I am 100% convinced that is why the CDC decalred obesity a disease. Just to get more people on the disability roles. and make them dependent on the Government for food stamps and income.

Of course, that would have me down there in a minute, because I'm not paying $60 for my kid's supplies when I could really get them for $30. The other $30 is for the kid whose parent's won't bother to plan to buy for school supplies.
-----------------
To which I have to ask, why does it even cost that much? We're talking about a couple of pencils, lined paper, and a folder. $10 tops.

Ugh. It's not even limited to low income kids- just anyone who randomly shows up at a park.
The accompanying picture says it was taken in NE Minneapolis, which isn't a particularly poor area.
Nice to know my city has so much money to burn that they can just give shit away. I'm sure the massive property tax hikes have absolutely nothing to do with it.

Involuntary manslaughter fits with overzealous self-defense, if that's what happened here. But I don't see how having your head smashed into the concrete does not suggest upcoming serious bodily harm. Valid and legal self defense is a complete defense to involuntary manslaughter as well.

"That's why you have sign offs every step of the way. Verbals don't mean shit."
Got to disagree.
If the hospital project manager isn't denying that he said to go with option 2, the verbal would be as good as a written change order.
Just bill the option 2 price with an additional 2K for the materials (after a good faith effort to return the materials for credit).

Hey, it's been a while since law school, but doesn't manslaughter require a depraved heart or like a gross indifference to potential deadliness of your acts?
------------
Voluntary manslaughter can include instances when you lose it emotionally - such as, for instance, finding your wife in bed with your best friend, and killing both of them on the spot. If you wait a bit, though, then its murder, not manslaughter.

Hell, that's being generous. Like Allen, I was getting kids outfitted for around $30/$40, and that's with all new stuff. One year I refused to purchase a new set of colored pencils because my kid didn't use but three of the last pack. Why buy new glue when you still have a half bottle left over from last year? And so on.

You make a great point here. Miss a couple of great tie ins.
Everyone's a criminal or criminalization of everything to expand the number of people subject to the states coercive power.
The need to subject coercive power to tiers wherein lighter coercion is available to use capriciously under the color of legitimate government function while the most powerful coercion is saved for the criminal (still everybody) to maintain the illusion that no undue coercion is being used. Otherwise the people would know they are not free and controlling them would be more difficult. The use of heavier coercion is reduced to declaring someone a criminal then using it. The process whereby that declaration is made while itself subject to whim, separates that whim, from the resulting coercion in the eyes of the subjects as it is buried in enumerable rules that they have all violated. This allows a tyrannical regime of control to utilize whatever coercion is necessary to bring a single subject to heal while maintaining a broad illusion of public liberty.

Wal-Mart Stores no longer plans to build three stores in the nationÂ’s capitol, after the cityÂ’s council voted to force large retailers to pay starting wages that are 50% higher than the minimum wage there.
The worldÂ’s largest retailer also said it will consider its options related to three other Washington, D.C., stores that are still under construction.

State gonna make it all about feelings and not facts for the ladies
==========
That's why the state has been hitting the "injuries weren't so bad" angle.
They want to make it about reasonable _after_ the fact, not whether GZ _could_have_ reasonably believed at the time--AT THE TIME.
Because that means, unless there's no possible way under any circumstances he could have been in fear--like TM was throwing teddy bears at him from 500 yards away and he emptied his clip--the jury has to "not guilty."
But, they are deliberately lying about that and are going to tell the jury "look at him sitting over there--alive!--do you see any wounds on his head? He wasn't in fear of his life because he's alive today!!"
Outrageous.

Depends on which set of laws you're referring to-
Written law passed by elected officials.
Regulations indistinguishable from law and passed and enforced by unelected bureaucrats.
Unwritten tribal law, where racial and/or political affiliation determines which course of action must be taken.

"I was responsible for two manufacturing facilities and a corporate HQ. 4 billion dollar company. What's your experiance?"
I was the executive in charge of designing and building 3 manufacturing facilities, one big-ass house and another house for my son.
As project manager for the company, if I told a sub to change something in the absence of the general contractor and it later turned out wrong, I was still on the hook for the cost.
Verbal contracts as just as enforceable as written.

I think Steam is making a mistake and getting into social media bullshit. I really don't give a fuck about someone's status or what "trading cards" they have. What fresh shit is that anyhow? Fucking trading cards?!?! What is this, grade school?
----------------
It's a pretty blatant "buy more stuff!" gimmick. You only get half the cards you need for a given game, which means that you *must* trade to get more cards (there appears to be a gimmick that allows you to get more cards, but I'd bet that it only triggers on very rare occasions). So if there's a badge that you absolutely must have for one of your games, then its in your best interests to find a friend who also plays that game, and then buy another game that friend plays so that you have the cards that your friend wants to swap for.
All this for a badge that's only a cosmetic award.
Oh, and it's apparently also possible to buy and sell cards with your fellow gamers. But I'm betting that Valve takes a cut off the top of that...
You know, not that I ever particularly cared about Half-Life, but I would have thought that Valve would be busy trying to get Half-Life Episode 3 finished (it was supposed to be out HOW MANY years ago!?) before doing silly stuff like this...

Wal-Mart Stores no longer plans to build three stores in the nationÂ’s capitol, after
the cityÂ’s council voted to force large retailers to pay starting wages
that are 50% higher than the minimum wage there.
***
“The question here is a living wage; it’s not whether Wal-Mart comes or stays,” said council member Vincent B. Orange (D-At Large), a lead backer of the legislation, who added that the city did not need to kowtow to threats. “We’re at a point where we don’t need retailers. Retailers need us.”
Posted by: WalrusRex at July 11, 2013 09:40 AM (Hx5uv)
Mr. Vincent B. Orange's words need to be passed around to every retailer in the city. If the retailers don't listen, it's their own fault. They need to be looking for the exits.
