Lois Lerner Embraces Theory That The Process Is The Punishment

Patterico found an important Lerner quote from 2011:

1 March, 2010 – IRS officials start targeting organizations with “tea party”, “patriot”, and “9-12;" in their names.

27 June, 2011 – Lois Lerner, Director of Exempt Operations, learns of the inappropriate targeting. She initiates an audit of the office involved, but the targeting continues.

17 November, 2011 – Lois Lerner, Director of Exempt Operations, tells Businessweek that receiving a thick questionnaire from the IRS is a “behavior changer.”

Incredible. Patterico is taken with the fact that she admits this to a magazine; if this is the sort of thinking she brags about to a national news magazine, one can only tremble at what she's holding back.

In America -- in any free country -- you are supposed to be free from punishment and compulsion unless you are found guilty of some misbehavior through Due Process.

But Lois Lerner doesn't like that idea. Instead, she embraces the notion that people can and should be punished and compelled into acting the way she prefers, not after Due Process has found them blameworthy, but before anyone even thinks to file charges.

She's decided that the process itself can and should be a tool of state coercion. She doesn't need a finding from a legal tribunal to impose burdens on freedoms and to compel what she considers "correct" behavior -- she'll serve as judge and jury herself, and impose the punishment of a "thick questionnaire" as a tool of "behavior change."

Prisons -- "reformatories," they were once called -- exist, in theory, to change the behavior of the inmates therein. And even a free people admits that some people must have their behavior changed by state coercive power... but only after such persons have been found guilty beyond a reasonable doubt by a jury of their peers of a felony.

But that limits the pool of persons subject to "behavior change" to an unacceptably small number. Lois Lerner wants to make that pool as large as possible, and impose her regime of behavior change on anyone she comes across she thinks is in need of her moral instruction.

And I'm sure she thinks she's doing substantive good. As CS Lewis warned:

“Of all tyrannies, a tyranny sincerely exercised for the good of its victims may be the most oppressive. It would be better to live under robber barons than under omnipotent moral busybodies. The robber baron's cruelty may sometimes sleep, his cupidity may at some point be satiated; but those who torment us for our own good will torment us without end for they do so with the approval of their own conscience.”

This was the inherent principle of freedom  that we once trusted all officials to hold in their hearts.

 

As we're seeing, this is no longer the case. Principle has fled, trust is dissolved and our country is being reduced because of it.   Particularly in this case  and the Zimmerman trial, we're seeing  the  breakdown of the spirit of the law and the intent of the Founders   happen right before our eyes.  And we  find ourselves powerless to stop it.

The IRS is the militant wing of the democrat party.  We cannot allow the IRS to continue as presently structured.  The IRS was a part of a conspiracy to prevent a fair election, and we need a special prosecutor, now.

 

I cannot fathom     with    the preponderance of these scandals, that anyone could consider the 2012 election legitimate.  I also cannot fathom how the secretaries of state of FL, OH, VA, IA, CO, and WI are not investigating voter fraud in said elections.

A while back they covered a charity near here that provided kids with a fairly simple lunch during the summer when school was out (and school lunch programs shut down.)

It was a private charity, so I have no beef with it per say.

In any case, they said they were able to produce a lunch (a cold lunch IIRC) for about 35 cents.  Said lunch had a main dish (sandwich maybe) side and a small drink.

I asked my wife "while this is probably a good thing over all, wouldn't it be important to show parents how they can feed their kid lunch for 35 cents?"

The only communal pot  we had growing up was for tissues.  Every kid was supposed to bring in a box at the start of the year.  And that ended at some point between the 4th-6th grade.

Got into it with one of the teachers, since I had purchased decent supplies for my kid (real wood pencils, good folders, etc) that I bought for, you know, my kid's use. 

 

Interesting turn...the school I guess got tired of fighting parents on this so they offered a "convenient" option of buying supplies at the beginning of the year and the carton would be delivered to the class....to, yes, be dumped into the communal bins.  I asked the administrator that if I was paying for all those supplies in my kid's carton, what happens to the stuff she doesn't use?  Do I get it back? 

 

They really don't like me at that school.

They do the same thing here too.  They tell every student and parent of certain things the child must bring in.  A large portion of the perpetually "underprivileged" (PU) bring nothing.  Thus the communal pot.


These same PU get three meals a day free, the rest must pay a small fee. This despite these same PU getting food stamps, welfare, and other social benefits worth more than some of the NUP's parents make.

So our company does commercial painting. That includes wallcovering. We do a lot of work for a local hospital. We get awarded a project in which a doctor's suite is converted for new tenants. We work for a general contractor. There's also a project manager for the hospital that acts as the hospital's rep. The hospital project manager tells us on the pre bid walk through that he wants two different prices. Price 1 is for all existing wallcovering to stay as is, infill with matching wallcovering where needed and paint everywhere else. Price 2 is all the wallcovering comes down and paint everywhere. I get word that Option 1 has been selected, go ahead and order your wallcovering. We start the job this morning. We get a phone call at 9am from the hospital's project manager...."Guess word didn't get back to you that we're now going with Option 2." Meanwhile I have $2k worth of wallcovering in my warehouse. Call the general contractor. He has no fucking clue that this is happening. Turns out, someone made the decision and, with no authorization from his employer, the general contractor's on site superintendent went ahead with stripping all the wallcovering and prepping the walls.

Now they want you to write them a check for $60, the District will purchase the supplies, parcel them out according to student name, and deliver the carton to your kid's classroom...to be dumped all into the kitty.

 

The idea was that since everyone would be purchasing the same supplies (same pencils, folders, paper, etc) they wouldn't have to hear from parents who purchased better stuff for their kids only to have it lost to the commune.

.Don't get me started on the "Black Card".  I have almost twice turned in people I know that abuse the heck out of that.  One couple, use the EBT card to buy the good stuff like Lobsters, steak and crab legs and when that runs out, they use their double State Disability money to buy regular groceries for the rest of the month.  He gets disability because he has COPD or some such thing and she gets it because she used to be a crack head and can't keep a job.  Sometimes I just can't believe it.  I figure Karma will rear her ugly head some day at them.  Oh and they live together but won't get married because that would reduce the State disability check.

 

I am 100% convinced that is why the CDC decalred obesity a disease.  Just to get more people on the disability roles. and make them dependent on the Government for food stamps and income.

If the hospital project manager isn't denying that he said to go with option 2, the verbal would be as good as a written change order.

 

Just bill the option 2 price with an additional 2K for the materials (after a good faith effort to return the materials for credit).

Hell, that's being generous.  Like Allen, I was getting kids outfitted for around $30/$40, and that's with all new stuff.  One year I refused to purchase a new set of colored pencils because my kid didn't use but three of the last pack.  Why buy new glue when you still have a half bottle left over from last year?  And so on.

That's why the state has been hitting the "injuries weren't so bad" angle.
They want to make it about reasonable _after_ the fact, not whether GZ _could_have_ reasonably believed at the time--AT THE TIME.

Because that means, unless there's no possible way under any circumstances he could have been in fear--like TM was throwing teddy bears at him from 500 yards away and he emptied his clip--the jury has to "not guilty."

But, they are deliberately lying about that and are going to tell the jury "look at him sitting over there--alive!--do you see any wounds on his head? He wasn't in fear of his life because he's alive today!!"

Outrageous.

As project manager for the company, if I told a sub to change something in the absence of the general contractor and it later turned out wrong, I was still on the hook for the cost.

I think Steam is making a mistake and getting into social media bullshit. I really don't give a fuck about someone's status or what "trading cards" they have. What fresh shit is that anyhow? Fucking trading cards?!?! What is this, grade school?

It's a pretty blatant "buy more stuff!" gimmick.  You only get half the cards you need for a given game, which means that you *must* trade to get more cards (there appears to be a gimmick that allows you to get more cards, but I'd bet that it only triggers on very rare occasions).  So if there's a badge that you absolutely must have for one of your games, then its in your best interests to find a friend who also plays that game, and then buy another game that friend plays so that you have the cards that your friend wants to swap for.

 

All this for a badge that's only a cosmetic award.

 

Oh, and it's apparently also possible to buy and sell cards with your fellow gamers.  But I'm betting that Valve takes a cut off the top of that...

 

You know, not that I ever particularly cared about Half-Life, but I would have thought that Valve would be busy trying to get Half-Life Episode 3 finished (it was supposed to be out HOW MANY years ago!?) before doing silly stuff like this...
