Meghan McArdle: Obamacare Initiates Self-Destruct Sequence
— Ace

Ehhhh... I think this is linkbait-edly overstated but it worked. I'm linking it.

Her basic suggestion is that all of these "tweaks" Obama orders by his Kingly Right of Verbal Legislation have the tendency of undermining the actual viability of Obamacare. (Such as it may be.)

As Ezra Klein points out, this seriously undermines the political viability of the individual mandate: “But this puts the administration on some very difficult-to-defend ground. Normally, the individual mandate applies to anyone who can purchase qualifying insurance for less than 8 percent of their income. Either that threshold is right or it's wrong. But it's hard to argue that it's right for the currently uninsured but wrong for people whose plans were canceled … Put more simply, Republicans will immediately begin calling for the uninsured to get this same exemption. What will the Obama administration say in response? Why are people whose plans were canceled more deserving of help than people who couldn't afford a plan in the first place?”

Arnold Kling put it more pithily: “Obama Repeals Obamacare.”

IÂ’d ask this: What do you do for an encore? Will the administration force these folks to buy insurance next year? Or will they keep allowing special exceptions rather than take the political heat for changing health insurance that people liked?

IÂ’m not sure the administration is thinking that far ahead. The White House is focused on winning the news cycle, day by day, not the kind of detached technocratic policymaking that they, and the lawÂ’s other supporters, hoped this law would embody. Does your fix create problems later, cause costs to spiral or people to drop out of the insurance market, or lead to political pressure to expand the fixes in ways that critically undermine the law? Well, thatÂ’s preferable to sudden death right now.

However incoherent these fixes may seem, they send two messages, loud and clear. The first is that although liberal pundits may think that the law is a done deal, impossible to repeal, the administration does not believe that. The willingness to take large risks with the programÂ’s stability indicates that the administration thinks it has a huge amount to lose -- that the White House is in a battle for the programÂ’s very existence, not a few marginal House and Senate seats.

We keep talking about that in the podcast, the obvious observation that Obama is reacting day-by-day, thinking only of the Almighty Newscycle and the next 2-3 days, and not a couple of months or even a couple of weeks ahead.

We're in the very best of hands.

12 Why would he only be thinking in terms of the current news cycle? Of the next couple days? He's a second term president. Other than a "legacy", winning news cycles and responding only to the immediate crisis is completely ridiculous. There's no point. We know he doesn't care about those "downstream", so there's no attempt to salvage the Democrat brand. Is he, and his administration, really this stupid and incompetent?

14 Obamacare will not be repealed - period.  Washington has submerged $100 trillion of expenses in trust funds and lock boxes.  That was money that was never accounted for, yet spent.  Can you imagine if that level of profligate spending were to stop?  Obamacare adds several rows to the bottom of the pyramid scheme that is government finance in this country.  Even Repubs recognize this and though they may squeal, they aren't serious about repealing O care.

19 I also finally broke and went off on my Obama/ Obamacare loving commie boss. I'm tired of her delusions and hypocrisy telling everyone how great this law is while being unaffected herself. She is stopping her stipends for our health insurance and convinced herself we were all going tohave free insurance.

20 "We keep talking about that in the podcast, the obvious observation that Obama is reacting day-by-day, thinking only of the Almighty Newscycle and the next 2-3 days, and not a couple of months or even a couple of weeks ahead."

You normally see that kind of ultra-short-term tactical focus on the news cycle as a deliberate thing, from an incumbent who is running for re-election and cannot think beyond Election Day. But Obama was re-elected just last year.

So his lack of long term focus is instead only an artifact of his being an unskilled and weak executive.

25 Will Obamacare be repealed or won't it? Will Congress fund it or won't it? Will the web site be fixed or not? Blah, blah, blah. We the people just need to do what we need to do and Congress be damned. Resist. Refuse. Revolt. EXEMPT OURSELVES! We did not comply with Prohibition and we simply should not comply with Obamacare. For religious reasons. For privacy reasons. For the cause of liberty and freedom and in protest of the idea that the federal government (under one party rule, no less), can force private citizens to purchase anything with our own money. Are we citizens or subjects? Mice or (wo)men? Just say NO to socialism and to the corrupt, unionized, far left IRS: the gestapo of America's political class. After all, the federal government ignores millions of illegals who are breaking U.S. immigration law every day. Our Founders pledged their lives, their fortunes and their sacred honor. All we have to do is just say no to a scheme we all know is un-American and a violation of our most basic founding fundamentals of privacy, self reliance, limited government and individual freedom.

I would have thought that the equal-protection 14th Amendment lawsuits would have written themselves.

Are these being smothered at birth by the present tendency of the federal courts to casually toss out any and all challenges to federal laws on the basis of a supposed lack of standing?

(Which is just SO much bullshit and crying out for a Constitutional amendment to get rid of. If you're a citizen of a country, you should have standing to challenge its laws in its courts, period, full stop, end of.)

44 If, as Judge Roberts said, to make this Constitutional it must be a Tax... Then this is unequal Taxation... because it is changing who pays, or does not pay, by Admin whim, not by act of Congress.... In fact, this 'rule change' by the Administration changes the 'Appropriations' of said bill, without an Act of Congress.... thus making this an Illegal Action.

Yes, the ACA made some policies illegal. They were call 'Suboptimal'. The policy holders didn't have a problem with them, just King Obama. The insurance companies weren't allowed to offer these policies, thus the 'cancellation' notices everyone received. Since that time, Kingly Right of Verbal Legislation has said insurance companies can continue to off 'suboptimal' policies....even though the insurance companies said 'Wha?! We don't have them anymore because of you!' No Kingly Right of Verbal Legislation has said that insurance companies can offer catastrophic plans...even though those too were outlawed. It i tax, just like the Earned Income Tax Credit is  tax -
For the producers it has a (+) in front of it,
For the moochers it has a (-) in front of it.

Except, unlike the EIC, the moochers do not have to even file the 1040 to get it, the insurance companies are the middle man.

Moochers also get 'free' health care, at least as far as routine crap most producers are happy to pay for out of their own pocket like a $5 pack of rubbers, and flu shots, $100 checkups... Moochers with something kinda big will continue to go to the e-room and not give a shit about the $5-10k deductable, just like they do now.

Producers, being responsible will pay for the insurance, and pay for their own deductibles,.. twice...

Meanwhile the Obamacre will suck their life savings out of them

I am insured through Blue Choice in SC. They only offer ACA compliant plans. Bronze, Silver and Gold. No catastrophic at all.

Not sure where these folks that had their insurance cancelled are going to find their same plans. They don't exist anymore.

Two, Barack and his cronies will fiddle with this thing in all kinds of discretionary ways that are frankly not within the scope of their lawful duties Three, because of (two) above, it will become irrelevant who has a majority in the House and Senate, because they are now neutered by the most lawless President that has ever held office. Not only is it the end of the Republic, it is the end of any kind of meaningful voting. We are well on the way to not even being citizens anymore. Subjects. Nope.  They may pass some eyewash bullshit that isn't amnesty (no 'path to citizenship' or 'path to permanent residency', those are my keys), but nothing more.  And I doubt they'll even do that.  There's just no way: look, did you notice how the House GOP basically was willing to commit public suicide over the shutdown, simply because of outside pressure?  Now imagine that times FIFTY, because not only will you have the hardcore conservative group types freaking out (along with the part of the base they represent), you'll have more RINO-ish types like me also pitching a fit.

Boehner and Ryan keep making pleasant-sounding noises about 'immigration reform' for one reason only: not to further alienate Latino voters (because guess what, they do matter and we don't want to lose them by an even greater margin than 2012).  But no bill will ever be brought to the floor, because it would be the end of the GOP majority in the House and they well know it.  They can read polls.  And despite the darkest conspiracy-theory fears of some, Congressmen are not simply going to torpedo their own political careers permanently because "shadowy business interests" told them to.  They were willing to go for the shutdown because they knew, in the end, that it's what their voters WANTED.  They're not going to do this because it's clear as crystal that their voters DON'T want it.

U.S. Chamber of Commerce President Thomas Donohue said he is not worried about House of Representatives Speaker John Boehner’s refusal to negotiate with the Senate on its sweeping bipartisan bill. Donohue said he supports Boehner’s decision to instead take a step-by-step approach with smaller measures to fix the nation’s broken immigration system. “I believe it will get done,” Donohue said at a news conference attended by business, religious and law enforcement leaders, all of whom echoed his determination and optimism. A landmark bill to bolster border security, help business get needed workers and provide an earned pathway to U.S. citizenship for up to 11 million undocumented immigrants won Senate approval in June." Like people here. But thus far, the House has passed only a handful of limited bills, most dealing with enforcement and none providing a pathway to U.S. citizenship. 161 131 There are several outcomes to all this: One, is that when the Employer Mandate kicks in, there will be an epic uprising of negative public opinion, like nothing else in this country's history. Subjects. There is a remedy for this at hand, but it is not to be discussed here or anywhere on a blog on the Internet.

241 229 I think Obama's short term focus is that he's like a degenerate gambler doubling down. He's just hoping to shore things up for long enough for them to turn around. He probably knows it's not a good bet, but he's so far in debt right now he has to take the risk. Besides, the law has to turn out great, it's called Obamacare after all.

245 U.S. District Judge Robert Shelby, ruling in a lawsuit brought by three gay couples, found that an amendment to the Utah Constitution defining marriage as exclusively between a man and a woman violated the rights of gay couples to due process and equal protection under the U.S. Constitution. Off the top of my head, if the Utah amendment was passed according to law, there is no due process violation. If a gay man can marry a woman, or a lesbian marry a man, there is no equal protection violation. WTF is this judge talking about? Judges are all powerful now, no respect for the democratic process or the meaning of the constitution.

Technically none of us have `standing` because we have not been affected by the law yet. That changes Jan 1, 2014 when the law goes into force. I would not be surprised to see a class level suit brought by We the People on a level of the tobacco lawsuits of yore.

258 I doubt the illegals really care about a "path to citizenship". They are here, and they are having babies, which we stupidly declare to be American Citizens. Hispanics make up 25% of the school-age population (with whites barely 50%). In a few years, they will have the right to vote. Keeping the borders wide open for 35 years has consequences, and the most immediate consequence is that we are becoming a Latin American country.

Well, thatÂ’s preferable to sudden death right now."

292 O-Care isn't about created a viable insurance marketplace -- it's about creating a taxpayer funded money laundering scheme to pave and pay for the road to single payer.

It goes like this -- OCare is really a massive expansion of Medicaid -- that part has been very successful.  Medicaid claims are processed by carriers because the gubermint has been proven to be incompetent at this task.  Carriers don't mind the task, they get the taxpayers to pay for processing OMedicaid claims, and they don't have to pay for the claim -- it's all paid for by the taxpayer.  Easy gravy...

The carriers in turn will take significant portions (billions?) of what they are paid for processing OMedicaid claims, and lobby politicians for more Medicaid claims to process, plus higher taxes so they get paid even better.  All paid for by the taxpayers...   A socialist money launderying scam made in liberal heaven.

Don't hold your breath for any of the crony GOP LOSERship to stop this sort of crony activity -- helping crony's out in exchange for more campaign bucks and insider trading info is the LOSERship's bread and butter when it comes to maintaining their power over common sense Constitutionallist tea party types.
