— Ace On Fox. Apparently he's already burned a strawman.
He claimed that when he was speaking a few weeks ago about striking the proper balance in the war on terror he meant this. Implication: I sorta did tell you about it, you know.
Then he proceeds to swipe at the right for being interested in this, saying that we we weren't interested in it five years ago, and that it's "mature" that we now are.
Speaking of people who once had different opinions on this but whose views have "matured"...
He meant to leave but someone asked a question and he stayed to answer it. The question was about leaks. He's now gone off on a tangent, effectively blaming Congress, saying they are "fully briefed" and "empowered" to object if there's anything objectionable.
In fact that's false. As Glenn Greenwald noted the other night, Congress may be "briefed" but they're also not permitted to reveal anything they're briefed about. He had a good word for it, which I sadly forget, striking at the idea that they are involuntarily conscripted into being false supporters in such things, as they do not, in fact, have any liberty to discuss it or object openly.
Senator Ron Wyden made this point a few weeks ago.

I'm not sure how Congress would be forbidden from issuing legislation to address it though. That sounds like a Constitutional impossibility.

I have to manually refer to a printed address list in order to communicate. Censorship and suppression of dissent is a primary goal of this administration. And, Yes, I'm with Verizon.

These attempts to claim that collecting the data is Constitutional since nothing is done with it attempts to ignore the differences in kind between the rights of those whose information it is. That, of course, takes us back to the "papers" argument that I am setting aside for the moment. I would agree that NSA has a nearly unfettered right to collect, read and analyze the information for non-citizens. NSA has no right whatsoever to do so for an American citizen without a warrant. Why? Because the Fourth Amendment so states. To say that we will gather the data and then place it in piles to make a 51% analysis of the rights of the person whose data it is ignores that you must make that determination first. Let's pull it out of the technological realm. There is a difference in kind between a police officer who is investigating a crime who goes to a house and sees a door. If that door is open? Then the officer may enter and look around and may be able to use evidence s/he sees in the open. If that door is closed? Then the officer must get a warrant before looking around. The NSA defenders appear to be claiming that mere use of technology is in and of itself an open door. At least, they must be because otherwise they are refusing to acknowledge that such a difference even exists. This is the technological equivalent of the officer kicking the door in and then saying "Well, Your Honor, the door was open." No. No, it was not. Such claims have been soundly rejected in the past. Such claims should be rejected now. To the argument that the warrant cannot be obtained without reviewing that information first, I say too bad, so sad. Yes, this makes your job harder. Yes, it increases risk. Yes, it means that bad people can do bad things without being caught in the planning stages. But if we throw away the notion that citizenship carries with it rights and that I, as an individual, am a free person who has the right to live her life in private, then there's nothing left that needs to be saved.

If so, in each specific case, they could obtain a warrant to search each of the individual carrier's data bases for the information. However, it would be much more efficient to have all the carrier's data in one system for immediate and thorough searches.
I agree that allowing the NSA or anyone in the government to preposition this data in a easily accessed system is a receipe for abuse, but I also recognize how this could be used for actual counter terrorism if we had any competent people to use it.
This isn't as easy a call for me as it is for others here.

He never lived that down. A classmate of mine said that came up at a reunion over twenty years later.
I'm a little confused - what exactly did he have to live down? Would he have been better off punching the guy's lights out - or was he supposed to just sit there and take shit forever?
Oh, but then I guess that the socially adept way of handling it would have involved being an even bigger turd back to his tormentor - but doing it quietly so that other people wouldn't notice.
Sorry about that - being of limited social skills - I just keep noticing that so much of what passes as social skills in society is just learning how to be a bullying turd. Or am I not supposed to point that out because it makes all the bullying turds of the world uncomfortable?
