Of Course: Obama to Give Capitol Hill Staffers an ObamaCare Waiver
— Ace

Perfect.

The Wall Street Journal reports.

President Obama told Democrats in a closed-door meeting last week that he would personally moonlight as HR manager and resolve the issue.

And now the White House is suspending the law to create a double standard. The Office of Personnel Management (OPM) that runs federal benefits will release regulatory details this week, but leaks to the press suggest that Congress will receive extra payments based on the FEHBP defined-contribution formula, which covers about 75% of the cost of the average insurance plan. For 2013, thatÂ’s about $4,900 for individuals and $10,000 for families.

How OPM will pull this off is worth watching. Is OPM simply going to cut checks, akin to “cashing out” fringe benefits and increasing wages? Or will OPM cover 75% of the cost of the ObamaCare plan the worker chooses—which could well be costlier than what the feds now contribute via current FEHBP plans? In any case the carve-out for Congress creates a two-tier exchange system, one for the great unwashed and another for the politically connected.

This latest White House night at the improv is also illegal. OPM has no authority to pay for insurance plans that lack FEHBP contracts, nor does the Affordable Care Act permit either exchange contributions or a unilateral bump in congressional pay in return for less overall compensation. Those things require appropriations bills passed by Congress and signed by the President.

Read the whole thing. Incredible.

Which is what was intended from the beginning. This always was about a politically motivated reward and punishment system run by bureaucrats that no one (who mattered) could escape).

105 The law is written this way. People are getting exercised that Obama is changing provisions at whim but if you read the law, virtually ever major point ends with "or whatever the secretary decides". Meaning of course, the Secretary of HHS. He is just making the decision for his employee. No telling what can happen in the future if it is always what "the secretary decides".

113 One of the privileges of nobility in the feudal system was that they did not have to pay taxes.  One of the characteristics of the Soviet Nomenklatura was that they were not bound by the laws that applied to others.

Neither of those traditions is really in keeping with the traditions of the United States except possibly the large plantation owners of the antebellum south.

Do you remember Holly Hunter blathering about journalistic ethics in the movie, "Broadcast News"?  Back in 1987, that sort of thing did not produce gales of laughter like today.

After that ruling,  the strategy had to be completely changed.   We  have been able to convince a large majority of the public that Obamacare is bad.  That trend continues.  The dems are helping the cause by doing these kind of things.  Defunding is still on the table but if it shuts down the government we need to be able to keep the same LIV  people who oppose Obamacare on our side.  Not as simple as some make it out to be.

155 Start looking for your carve out from Obamacare.  I work in IT for an enormous health insurance conglomerate.  Before ACA was even passed, our actuaries said that even with EVERYONE in the system, premiums would have to go up 12-15 times what they were in order to pay for everyone to be insured.  If your premium was $2000 a year, they said to plan on $24,000 when it was fully implemented.  Now that the Dims have handed out exemptions right and left, there is no telling what that multiple is now.  Remember that Obamacare does NOTHING to bend the cost curve downward.  In fact, it makes the cost curve go up steeply due to increased regulations, etc.

Tell anyone who will listen that they will be competing for jobs with all the newly minted citizens, formerly illegal aliens, who are exempt from ACA.

As if the law matters to this administration. They'll do whatever they damn well please, and you'll STFU and take it, peons! On a related note, Fox News has a story about illegal aliens in Chicago, picketing a hospital there because they're not being provided with "free" organ transplant operations -- and have to settle for their "free" weekly dialysis sessions instead (at least for the kidney patients). How dare U.S. taxpayers not (1) provide them with scarce, donated organs, and (2) foot the bill for their transplant operations and subsequent lifelong medical care? (BTW, Mexico has a lower organ donation rate than the U.S., so it's only fair that we gringos give up our scarce donor organs to Mexico's "migrants" because . . . raaaaacism!). We can dismiss the Congress and all the expenses they incur after they pass one final law, which would render elected representatives unnecessary. It shall be called The "At the Secretary's Discretion" Act of 2013 The text is quite brief: "All laws, statutes and Amendments to the Constitution, past present and future, shall be amended to conclude with the phrase '...or at the Secretary's discretion.' Appoint of the secretary, in whichever department, is at the President's discretion. Exact interpretation of this law will itself be at the Secretary's discretion." Oh wait - we already passed this law? My bad.

Nothing -- and that's NOTHING -- I could post could ever possibly come close to being as self-parodic and as tone-deaf and as bone-stupid as stuff the luminaries of the Republican Party routinely say these days.

Last week, Peggy Noonan opined that the IRS scandals were bad. Like, really really appallingly awfully horribly catastrophically third-degree-burns and shattered-teeth and bleeding-profusely-from-the-squeakhole bad.

And why did the Magic Dolphin Lady say the IRS scandals were bad?

Because it might... wait for it... drumroll... _cause people to lose faith in government_.

Because if there's one thing a supposedly conservative political party ought to be able to agree on, it's that the central article of faith in the lives of the ordinary citizenry ought to be GOVERNMENT. Amirite?

237 Until we are ready to work actual violence on this corruption(and those that support it), nothing will change. Washington can not fix itself, no matter who we vote into office. That is assuming our elections are not tampered with, which is not a safe assumption. At the least-violent level, we need nullification laws coming from the states, and real, credible secession movements. Governors telling state citizens not to pay federal taxes would help to, along with arresting the federal agents who would be dispatched to collect them. Things need to change, and that change is going to have to be bloody, or it won't go much of anywhere.

Money happened.  My company is spending $100,000,000 to implement exchanges that have to be ready to go 1/1/14 irregardless of what Poofter and Company deem or do not deem.  States do not have that kind of money to throw at the problem and they did not have the money to turn down Federal funds for Medicaid, so they are shutting up and letting the health insurance companies build them.  In our five states, we are the largest carrier, so we HAVE to build them or be shut out of the individual market.

Texas already folded and took the Medicaid money.  AMHIK.  Hint (I did a lot of programming to make it work for us.)

We must force them to be a part of the system, or the system falls apart.  -Oblamer

275 @256.. Thanks.  Figures.  Reality happened.  Everyone complies and the goose is cooked.  And in the new normal, too many new regulations written for anyone to unravel because too many companies have already adjusted to the ACA.    We're doomed...  and the donks knew it would be this way when they rammed it through.   Damn you Justice Roberts!

The number quoted by the Census Dept was 48M.  Of which 3/4 were legal/illegal aliens and people under 30 who did not want it.

277 So, John Roberts foisted a shitty law on America by ignoring the truth and brought down the respect that is paid to the Supreme Court to boot. Posted by: ejo at August 05, 2013 04:37 PM (GXvSO) I can't speak for others, but the Roberts decision isn't the beginning of my loss of respect for the Supreme court. I have been steadily not respecting it since 1973. The court system is the legacy of Roosevelt drones.

Well, you may not remember back that far but there was a time when love of country and its form of government was considered a conservative value.

I know.  It sounds crazy today.

291 How does one apply for this new Tax Exempt status?

Posted by: garrett at August 05, 2013 01:05 PM (N1cR5)

292 Of that 30 million uninsured I would wager over 50% is voluntary meaning they made the choice to not incur the expense of a policy. ___________________ And a lot of people make the choice not to buy insurance because they know that hospitals are required by federal law (EMTALA) to treat anyone who shows up with a medical "emergency," regardless of ability to pay. Illegal aliens started taking advantage of this stupid law when it was passed back in the 1980's -- that's why they show up pregnant and about to give birth in the E.R.'s in the southwest U.S.; they know the hospital can't turn them away. So they get "free" OB care (at taxpayer expense) in a nice hospital, and as a bonus, their anchor baby gets U.S. citizenship, which then puts mommy and the rest of the illegal alien family on the quick path to legal status, plus qualifies junior (as a newly-minted U.S. citizen) for all sorts of taxpayer-funded welfare benefits. In cities like Miami and SF, wealthier foreigners fly into the U.S., have their babies in a state-of-the-art U.S. hospital, and then leave with the babies, stiffing taxpayers for the costs of the delivery (but getting junior a nice U.S. birth certificate for the future, just in case). It's win/win for the illegal aliens and unscrupulous wealthy foreigners, and lose/lose for U.S. taxpayers and law-abiding citizens. It's been going on for decades now, and Congress knows all about it (Marco Rubio even lamented once how angry the Miami situation makes him), but they refuse to change the law. Government run by special interests, for special interests, but paid for by us suckers.

Posted by: Vic at August 05, 2013 04:28 PM (lZvxr)"

In the way that the tiny planter class ran most things, including government so that no laws were passed that they did not care for and taxes were never imposed for roads or education.  Not only were they concerned about blacks learning to read, they weren't too enthusiastic about poor white trash learning to read either.  They consciously modeled their society on Walter Scott's depiction of the feudal system and many accepted George Fitzhugh's social prescriptions in "Cannibals All!" as a design for a perfect society.

303 Let's see here -- Constitution Article 1, Section 8: "The Congress shall have Power To lay and collect Taxes, Duties, Imposts and Excises, to pay the Debts and provide for the common Defence and general Welfare of the United States; but all Duties, Imposts and Excises shall be uniform throughout the United States" Obamacare imposes a tax under the authority of this section for non-compliance with its insurance requirements. Note that last sentence: "all Duties, Imposts and Excises shall be uniform throughout the United States". Obama giving a waiver to non-compliant Capitol Hill staffers doesn't sound very "uniform," does it?

304 So... The people who FORCED this goddamned atomic bomb of economic and personal destruction upon us...and begged for months on cable news that it would hurt them, actually are getting a free pass from Mao Tse Hussein?  (80%+ of all 'jobs' of the recovery are part time.. all because of this)

I've heard the crying from these people on the news for the last few months.  These are people.. staffers, who go to the most expensive schools, live the most kingly lives on the planet, and worst of all: THEY THINK THE LAWS THEY FORCE ON US ARE ONLY FOR THE LITTLE PLEBS.. NOT THEM, NO SIR!

I will not join an Obamacare co-op.  I will not pay the tax.  I will not join.  I WILL NOT COMPLY

I've already discussed this with my DR.  He'll just accept cash directly from me.  Afterall.. isn't that the obvious solution here?  Why all the paperwork and this and that for a Dr. visit?  PLUS A CO-PAY.... and monthly premiums that have gone up x2 for me since this damn 'law' was passed.  It doesn't make any fucking sense sweet mother of god i'm fucking pissed!

THESE MOTHERFUCKERS ARE REALLY EXEMPT FROM THIS SHIT!?!?  Its time folks.  Whenever the townhall meetings start, I hope fucking riots start
