I had a fantastic post loaded with content ready to go but...the sequester.

One thing that hasn't been cut because of sequester....talking in DC. Rand Paul is going old school and filibustering the nomination of John Brennan by talking. He's holding up the nomination because he didn't like Eric Holder's answer to his question about whether Obama claims the right to be able to use a drone on an American citizen.

I think Paul asked the wrong question and I'm not sure he's right about Holder's answer.

“It is possible, I suppose, to imagine an extraordinary circumstance in which it would be necessary and appropriate under the Constitution and applicable laws of the United States for the president to authorize the military to use lethal force within the territory of the United States," Holder said.

Holder said "catastrophic" attacks such as the Sept. 11 attacks or the attack on Pearl Harbor are examples of circumstances where the president could conceivably feel such an action is necessary.

I read Holder's answer (full letter here- PDF) as basically adopting the same position as George W. Bush and Dick Cheney position that they had the authority to down a jet that might have been part of the 9/11 attacks. That's just awkward for everyone.

72 I'm surprised that no one has expressed concern over the recent funding of the Defense Clandestine Service which will eventually grow to rival the CIA in size. The DCS reports directly to the President and SecDef. While the CIA is barred from operating inside the US, what stops the DCS from doing so. Posse Comitatus? Not so much, especially as blasting someone with a Hellfire rocket isn't exactly law enforcement.

Seriously though.  I remember when I got married and people screamed "you have to get a calligrapher to address you're envelopes" or something (the wife and I have very bad handwriting so doing it ourselves was just out of the question.)

I looked at the envelopes (which had return addresses pre-printed on them as part of the invitation deal) I did some (actually quite a bit) or research on the internet and found the same font they used.  Bought the font for $3 (couldn't find it free sadly) bought some clear labels for $15 and went to town.  Saved $150 or something.  People thought it was professionally done.

Not really.  This is much ado about nothing.

Would you also be opposed to an FBI sniper taking out a terrorist US citizen who was about to detonate a bomb?  What's the difference?

There are very, very few plausible scenarios in which a domestic drone strike would have any legitimate application, but the possibility can't be completely ruled out.

NO.  This is still wrong.  Any policeman in the country can try to stop a crime in progress, but to randomly decide from the oval office to kill an American citizen, not a terrorist or a foreigner, but an American without due process is wrong and unconstitutional.  Do we really want Obama to use any number of crisis or manufactured crisis to start eliminating people like his buddy Hugo Chavez did?

 The  problem  with  hypothetical  questions  is you  can  always  craft  a  hypothetical  situation  to  support  something  (well  almost  always).   I  agree  in  general  with  Paul's  assertion,  but  Holder's  response  (from  what  I read  sounded  reasonable  from  a hypothetical  standpoint).   When  you  get  down  to it,  I  would  trust  the  Bush  administration  with  certain  extraordinary  powers  more than  I would  trust  the  Obama  administration.   But  trust  is  not  absolute.  I trust  the  Republicans  more  than  I  trust  the  Democrats,  but  that  is  a  long  way  from  saying  I  have  full faith  in the  Republicans. 

 

Regardless,  I am  for  the  old  school  speaking  filibuster  in  the   Senate.

To a certain extent this principle already exists in law enforcement though. You have an active crime in progress, the police intervene, the suspect puts up a fight putting the police in danger and the police shoot (arguably in self defense.)

Ditto the 9/11 comparison.  Plane is outside it's required flight plan (without authorization) you send in jets to put it back on track (and/or force landing) it continues to disobey *the law* putting others at risk, so you use lethal force to stop it.

Paul's asking the wrong question because he's not asking them to discuss questions other than "attack in progress" situations (which is what matters.)

This is only   justified if the LEOs first tried to get the truck to pull over    and gave the driver and any passengers a chance to surrender,    or   to explain the situation.      

 

Say I'm tooling along in a pickup     truck   with an NRA sticker and a "LOLBama" decal on my   back bumper,   and I've been known to call the government a bunch of worthless bastards.         In the bed of the      truck I've got a load of fertilizer,    because I'm a     subsistence farmer    and    grow my own veggies.     The EPA just told me that I can't expand my operation to be able to    grow   enough   produce to sell at the local   farmer's market,   thus supplementing my income,   which led to a shouting match at the EPA's local HQ.

 

Some EPA creep sees me driving along in my truck full of fertilizer and thinks, "Holy shit, terrorism!    Call in the drone!"

We already had a case of that at a local shoot club in one of the States (forget which one).  Some animal rights group was spying on them and they shot it down with shotguns. 



They are being sued by the group at the same time they have federal charged pending.  It is a major felony to shoot at flying aircraft.  Of course that spy drone was probably unlicensed so no telling how that boils out.

Yes, it would be essentially the same.   But setting up    a    roadblock bristling with    machine guns costs money and manpower that a single drone strike does not.

You know what might work? Bust open old VCR cartridges, and cut the tape into 50-foot lengths, and wad a bunch of it into a canister along with an explosive charge, and launch it ahead of and above the drone with a hobby rocket. That mylar tape is very light, and very strong, and would slowly drift down, and possibly entangle the props/rotors of the drones. For very close drones, just fire a wad of the tape at them with a big slingshot.

The small/cheap ones will have to use COTS r/c gear to keep costs down.  That means 2.4Ghz with frequency hopping in the latest Futaba/JR/Spektrum stuff.  The hobby r/c gear hops quite a few time/sec.  Enough to make jamming difficult.

The downside is control range on the 2.4Ghz is limited to couple of miles at best, and the 2.4Ghz signals are to short to have good  penetration of solid objects like buildings, large trees, etc.  Carbon fiber components can make antenna placement an issue too.

Go out of line of sight and shit gets dicy quick.

The good thing about 2.4/5Ghz, even though its a noisy and crowded freq range, is you can still pass a lot of data at that freq rate before running into the limitations Shannon's theorem will impose.

You're onto something. I don't have to hit the drone, just make something explode next to it, close to it. That's how the Chapparal missile worked. Ideally that missile flew right up the target aircraft's exhaust and exploded. The explosive charge was small, but what it did was release a very long piece of metal that would instantly 'unspool' and act as shrapnel.

The downside is control range on the 2.4Ghz is limited to couple of miles at best, and the 2.4Ghz signals are to short to have good penetration of solid objects like buildings, large trees, etc. Carbon fiber components can make antenna placement an issue too.

Heck, stick an Arduino, or other micro controller in it, add an inexpensive GPS module, and go autonomous.

Satellites, to my knowledge, do not (yet) possess the capability to vaporize American citizens. And why not use helicopters? I guess for the same reason helicopters aren't commonly used to take out Jihadi targets in the Middle East. No risk to the pilot(s) and--given the relatively low expense of the drone by comparison--cheaper cost. And then, of course, there's the cool factor: drones can also make those authorizing their use on specific targets feel somewhat godlike, like Zeus throwing lightning bolts.

There's millions of them.  You'd need some serious mil-spec spook gear to do that. 

The hobby r/c stuff doesn't use the full range possible, BUT each transmitter/receiver pair establishes a different starting point in the hop cycle so they're no stepping on each other too much when several are active, so jamming one bird doesn't necessarily mean you can jam all birds.

Some hobbyists are already doing autonomous pre-programmed copter flight with GPS nav...which is actually a violation of the national model aviation organization rules. 

There's talks underway right now between AMA (Academy of Model Aeronautics) and FAA over what constitutes a model versus private drone so that normal model aviation won't be unduly hindered by all the crazy regulation the govt plans to slap on private drones.

THAT'S the heart of the issue.  The use of an impersonal drone    instead of the involvement of a flesh and blood individual -- a helicopter pilot, a sniper -- just further removes the assassin from any interaction with their living target.

That was my point.  If you got on the wrong side of Gov. Bill, then one of his crooked Highway Patrol or State Police would pull you over for a traffic stop and poof you disappeared.  Low tech works just fine.  BTW, that is not an indictment of all Arkansas law enforcement, just the corrupt cadre that Bill assembled during his tenure.  There were no happier people on the planet than folks in Arkansas when Bill and Hill's moving vans left for DC.  With the Tyson Food and WalMart money and the Arkansas Dim machine, they were stuck with the Clintons and they knew it.

I don't know if we got it today, but I'm sure a prototype system could be designed and built in a matter of months.  The old Keyholes took actual film and dispensed reentry canisters on command that we'd pick up.  Even that kind of old tech would be good enough to do the initial fleschette reentry vehicle dispensing, then the vehicle can fine tune its targeting on the way down.
