More From Vaclav Havel's 1978 Essay, "The Power of the Powerless"

In which he lays out what it means to be a 'dissident', how to live 'within the truth' and ways to resist a totalitarian system even when you have no power at all.

In 1974, when I was employed in a brewery, my immediate superior was a certain S, a person well versed in the art of making beer. He was proud of his profession and he wanted our brewery to brew good beer. He spent almost all his time at work, continually thinking up improvements, and he frequently made the rest of us feel uncomfortable because he assumed that we loved brewing as much as he did. In the midst of the slovenly indifference to work that socialism encourages, a more constructive worker would be difficult to imagine.

The brewery itself was managed by people who understood their work less and were less fond of it, but who were politically more influential. They were bringing the brewery to ruin and not only did they fail to react to any of S's suggestions, but they actually became increasingly hostile toward him and tried in every way to thwart his efforts to do a good job. Eventually the situation became so bad that S felt compelled to write a lengthy letter to the managers superior, in which he attempted to analyze the brewery's difficulties. He explained why it was the worst in the district and pointed to those responsible.

His voice might have been heard. The manager, who was politically powerful but otherwise ignorant of beer, a man who loathed workers and was given to intrigue, might have been replaced and conditions in the brewery might have been improved on the basis of S's suggestions. Had this happened, it would have been a perfect example of small-scale work in action. Unfortunately, the precise opposite occurred: the manager of the brewery, who was a member of the Communist Party's district committee, had friends in higher places and he saw to it that the situation was resolved in his favor. S's analysis was described as a "defamatory document" and S himself was labeled a "political saboteur." He was thrown out of the brewery and shifted to another one where he was given a job requiring no skill. Here the notion of small-scale work had come up against the wall of the post-totalitarian system. By speaking the truth, S had stepped out of line, broken the rules, cast himself out, and he ended up as a sub-citizen, stigmatized as an enemy. He could now say anything he wanted, but he could never, as a matter of principle, expect to be heard. He had become the "dissident" of the Eastern Bohemian Brewery.

I think this is a model case which, from another point of view, illustrates what I have already said in the preceding section: you do not become a "dissident" just because you decide one day to take up this most unusual career. You are thrown into it by your personal sense of responsibility, combined with a complex set of external circumstances. You are cast out of the existing structures and placed in a position of conflict with them. It begins as an attempt to do your work well, and ends with being branded an enemy of society. This is why our situation is not comparable to the Austro-Hungarian Empire, when the Czech nation, in the worst period of Bachs absolutism, had only one real "dissident," Karel Havlíček , who was imprisoned in Brixen. Today, if we are not to be snobbish about it, we must admit that "dissidents" can be found on every street corner.

And his essay secretly passed from hand to hand eventually helped lead to the rise of Solidarity in Poland and contributed to the crumbling of apparent internal support for other Eastern Bloc governments.

This essay reached us in the Ursus factory in 1979 at a point when we felt we were at the end of the road...we had been speaking on the shop floor, talking to people, participating in public meetings, trying to speak the truth about the factory, the country, and politics. There came a moment when people thought that we were crazy. Why were we doing this? Why were we taking such risks? Not seeing any immediate and tangible results, we began to doubt the purposefulness of what we were doing...Then came the essay by Havel. Reading it gave us the theoretical underpinnings for our activity. It maintained our spirits; we did not give up, and a year later - in August 1980 - it became clear that the party apparatus and the factory management were afraid of us. We mattered. And the rank and file saw us as leaders of the movement...[5]

-- Zbigniew Bujak, Solidarity activist, recalling the effect that Havel's essay had upon the leaders of Poland's nascent Solidarity movement

Liberal Journalist: Hey Let's Junk This Whole Separation of Powers Thing

Funny how it's only a problem when it interferes with Democrat presidents getting their way. Like why should some 100-year old piece of paper get in the way of progress man?

It's hard to discuss these issues calmly, given that the Constitution and the Federalist Papers have taken on a Holy Scripture-like role in American political debate. One does not debate if they're right, but only the proper way to interpret them on a given matter, which is then presumed to be correct.

...But it's not just that Madison's system is unnecessary. It's potentially dangerous. Scholars of comparative politics have shown that presidential systems with a separation of executive and legislative functions, like America's, are considerably more likely to collapse into dictatorship than are parliamentary systems where the executive and legislative branches are merged. That's because there are competing branches of government able to claim democratic legitimacy and steer the ship of state at the same time - and when they disagree profoundly, there's no real mechanism for resolving the dispute.

His suggestion: a dictatorship - but of course a benevolent, elected one:

Max Weber, in conversation with Gen. Erich Ludendorff, advanced my personal favorite theory of democracy: "In a democracy the people choose a leader in whom they trust. Then the chosen leader says, 'Now shut up and obey me.' " People and party are then no longer free to interfere in his business. .Later the people can sit in judgment. If the leader has made mistakes - to the gallows with him!"

Hanging leaders rather than failing to reelect them seems a mite harsh, but the overall idea here is exactly right. For a government to be truly accountable to the people, it needs to actually control the circumstances over which the people will judge it. ...If voters expect their leaders to deliver favorable economic outcomes, then those leaders should actually be able to control favorable economic outcomes

Jonah Goldberg on 'Nestoring'

One of the morons mentioned this in the comments earlier in the week.

In the early 1980s, transit officials in Washington couldn't figure out why traffic on the Beltway would grind to a near halt every day around the exact same time. The usual explanations didn't fit.

Then it was discovered that a single driver was to blame. Every day on his drive to work, this commuter would plant himself in the left lane and set his cruise control to 55 mph, the posted speed limit, forcing those behind him to merge right. You can imagine the effects.

To his credit, this driver came forward in a letter to the editor of the Washington Post. The man's name was John O. Nestor. He explained that the left lane was great; less traffic, less merging - why not ride it into work every day? Besides, he wrote, "Why should I inconvenience myself for someone who wants to speed?"

He achieved immortality by being transformed into a Dickensian-sounding verb: "Nestoring," defined as an absolute adherence to the rules, regardless of the larger consequences.

Entering the Quiet Zone

There is a place in the US where all radio broadcasting including cell phones and WiFi is banned. It's in Eastern West Virginia and known as the National Radio Quiet Zone.

So if you truly want to disconnect, this is the place to go.

Four Changes to English So Subtle We Hardly Noticed They Started Happening

1. Shift from "they started to walk" to "they started walking"

There are a number of verbs that can take a complement with another verb in either the "-ing" form or the "to" form: "They liked painting/to paint;" "We tried leaving/to leave;" "He didn't bother calling/to call." Both of these constructions are still used, and they have both been used for a long time. But there has been a steady shift over time from the "to" to the "-ing" complement. "Start" and "begin" saw a big increase in the "-ing" complement until leveling out in the 1940s, while emotion verbs like "like," "love," "hate," and "fear" saw their proportion of "-ing" complements start to rise in the 1950s and 60s. Not all verbs have participated in the shift: "stand," "intend," and "cease" went the "to" way.

Thank you for that excerpt from Havel.

He and his compatriots are great men, and I am in awe of their bravery.

He and a few others like Sharansky looked into the gaping jaws of the Soviet bear and said, "Fuck you. We are free men."

They and other great men like Ronald Reagan and Pope JP II brought a profound evil to its knees.

If the US had a Parliamentary system, the Prime Minister would be a Republican since the House is run by Republicans. In their little scenario, the Senate would be more akin to the House of Lords and thus Reid couldn't be the obstinate ass that he his today. 57 Nobody asked but here are my thoughts on the article by the O so smart lib journalist calling for an end to separation of powers. Yes a hypothetical Prime Minister Obama could do whatever he wants with a majority government in a parliamentary system. A Prime Minister at the head of a majority government can impose his will on a way the president can't. The practice of party discipline gives him control over his party that is very difficult for a president to ever achieve. However I think Bambam would just as much of a miserable failure in a parliamentary system as he is in the American system. I won't even get into the challenge of minority government. As a prime minister the SCOAMF could not play his petty bullshit of pretending to be above politics. A PM is a politician who has to get down and dirty. Obama would be reduced to drooling, stuttering, incompetent fury by aggressive questioning in question period. Opposition MPs have no inclination to treat a prime minister with deference. Obama loves the opportunity to lecture Republicans in a setting where they respond. In the House of Commons his speeches would be subjected to heckling and cat calls. And he would inevitably be at the receiving end of the odd tongue lashing. Oh and no teleprompter.

Two were grizzled state vets and the third was a new young guy. The new guy dove into the job and was making great progress in little time. The vets noticed and then asked the young man what the hell he was doing. This was an all-day job, they said. The young guy seemed confused at first and then caught on. It was indeed an all-day job and the torch was passed to a new generation.

79 The point and the goal is resistance to tyranny. It's sometimes difficult to press this point home on some very right thinking and decent people. They simply do not understand the danger we face and how close everything has gotten. An, often heated, conversation I had with a neighbor (of course there was beer involved, duh) today was the same: "Why don't they just compromise?" You don't compromise with evil. You destroy it. Too many people just don't realize how dangerous things are and how tenuous our constitutional republic is right now. Not good. As a country, we have lived very softly, for a very long time on and due to the sacrifices of those who came before us, not realizing how close the wolf is to an open door.

ALL of Kubrick's work looks awful now. I just watched Full Metal Jacket, and it was like it was made for cretins. I don't remember it being so simple minded.

Same with Dr. Strangelove. Did you see that article about how Kubrick used a bogus lawsuit to keep Fail Safe from being released at the same time as Strangelove? So when Fail Safe--a far superior film--finally came out, everyone thought it was a ripoff of Kubrick's movie.

Henry Fonda was a big leftist, but nobody played a better president.

There's an idea: best and worst movie presidents.

Worst of all time, hands down, is Jeff Bridges in The Contender. The most retarded leftist wet dream movie ever. In that film Gary Oldman played a Republican who chain smoked and ate nearly raw steak.

As could be expected, they immediately brought into play against the Charter a whole set of slanders, distortions, abuse, half-truths and absolute falsehoods which all represent the dismal range of their capacity. Ispeak from experience as one who has been a favourite target for their sort of behaviour for the past thirty years, and who could well lay claim to the laurels of seniority and worthy service. Though the powers that be may not know it, or rather, would sooner not know it, nay, cannot afford to know it (for where else would they find more obedient, unscrupulous and servile creatures), the media are the principal, albeit unintentional, creators and encouragers of opposition, since they are totaJIy suspect and nobody believes them. In his book "Cultural Amnesia" Clive James writes about a now-forgotten French writer (forgotten in the English-speaking world, that is) named Chamfort who basically died because he made a joke during the Reign of Terror. Chamfort said of the revolutionaries that their motto was "Be my brother or I will kill you."

Sums up the left perfectly, doesn't it? The murderous lefties didn't like that joke very much and arrested Chamfort. Chamfort decided to jump out the window to his death rather than wait to get "shaved with the national razor" but he made a mess of it and lingered on a few days before dying. He said "If it wasn't for me I would do brilliantly."

James also describes him as a wastrel and a "mightly lover of women" who said he would never get married because he might have a son like himself.

I think Chamfort was the first moron.

During his eight years on the City Council, Bill de Blasio advocated for millions of dollars in city money for Maimonides Medical Center.

The councilman was Bill de Blasio, now the Democratic nominee for mayor of New York.

During his eight years on the Council, he had advocated for millions of dollars in city money for the hospital, Maimonides Medical Center.

Maimonides did not have a job open for Mr. de BlasioÂ’s wife, Chirlane McCray. So it created one.

Kubrick did battle scenes pretty damned well. Paths of Glory, Barry Lyndon, FMJ, Strangelove all had great battle scenes. Watch the battle scenes in Strangelove and think about Saving Private Ryan. He won't admit it, but I'm positive that Spielberg lifted a lot of the Omaha Beach scene from Strangelove.

Quentin Tarantino also lifted the time-displaced narrative thing in Reservoir Dogs and Pulp Fiction wholesale from Kubrick's The Killing. To QT's credit, he's admitted as much.

173 one more from havel moron herd @page 199 of potpl >This is because those who created this machinery have learned more from historical revolts, coups d'etat and revolutions than any other power elite in the past. Their 'historical solidarity' with all ruling groups who have ever been swept from power goes deeper than any ideological differences, because it is consistent with the principle of self-preservation. Moreover, the machinery of violence is continually expanding because, among other things, the group in power feels no reliable support from the population. The movement from which the ideology of the present regime derived originally has been marked from the outset by a traumatic awareness of an incongruity between its 'historical mission' and the possibility of ever gaining a sufficiently broad and spontaneous support to carry that mission out. Various forms of police activity, therefore, have always appeared in utter secrecy even before power was seized, and subsequently, the police apparatus has expanded to such an unprecedented degree, partly because the official ideology contains nothing to inhibit such a development. The material, and ultimately the moral, burden that this places on society has no precedent in history. To make this burden bearable, the totalitarian state has had to raise the policing function to one of the greatest virtues. In television films and propaganda programmes, it is no longer a worker or a party secretary who embodies all the finest human qualities, but a cop. The vast amounts of energy spent on maintaining 'order', however, contribute nothing to the development of society because its sole purpose is to prevent change.<

192 I'd rather discuss politics with a dead red liberal than someone from the Huntsman/Bayh ilk.  Liberal and conservatives are pretty diametrically opposed in terms of what the government could and should do domestically.  You can argue that government should do more and we should soak people with taxes.  I think it's ridiculous, of course, and takes an overly simplistic view of how people operate in the real world.  We all agree you can argue that a government needs to be small, humble, and efficient.

The "No Labels" operates in a totally different level of fantasy land.  They prey on the disengaged, and try to forcefeed the canard that everybody can have their cake and eat it too.

You don't like taxes?  We don't either!  You don't want anything reformed or scaled back?  We don't either!  No policies need to change, not so much anyway, we just need to change the "tone in Washington".  We just need to get along and continue this slow (or not so slow) march to our death.

If libs and conservatives have any common ground, it's that we think these assholes are complete charlatans, even if from totally opposite perspectives.  These guys make a living selling snake oil to the idiots, and that prevents having the cut and dried battle that we need.

Its actually just an inherent flaw in the idea of Government...

It does not matter the form, eventually a small group gets enough power to entrench itself in position of power... then somewhere down the power chain, the successors are not up to the Task of Governance, and the Government falls.

EVERY Government type has followed this historic trend.  Monarchies get a weak Monarch... Republics become Democracies and will not make the hard decision needed for survival... Dictators? Die or get ousted once they become unpopular...

America is to that point.... where those in power have used Government largesse to bribe enough of the mob to support them.... and have no idea of how to Govern Effectively... because they must continue to increase bribes to stay in power.

Max Weber, in conversation with Gen. Erich Ludendorff, advanced my personal favorite theory of democracy.....

Interesting line from Weber's Wiki article "While recognising bureaucracy as the most efficient form of organisation and even indispensable for the modern state, Weber also saw it as a threat to individual freedoms and the ongoing bureaucratisation as leading to a "polar night of icy darkness", in which increasing rationalisation of human life traps individuals in the aforementioned "iron cage" of bureaucratic, rule-based, rational control."

Not really related to a "theory of democracy" but I'm not so sure that WaPo cockholster would know the difference.

By the way, I'll note that we're talking about the same Erich Ludendorff that threw the weight of his military reputation behind the Nazis in the 20s and 30s, but was largely cast aside by the party after 1933 because the Nazis thought he was TOO WHACKADOODLE CRAZY.

And apparently he doesn't listen to one thing Obama has said--because he suggests Congress come together and pass everything the military needs right now. He blames Congress and not Hagel or anyone else--said the Republican congressman was evil or something for suggesting Hagel could have done something. Also Montel never mentions that the current Commander in Chief could have done something. Then goes on to say how awful Congress is because only 20% have served in the military like Montel. Meanwhile Montel forgets that Obama didn't exactly strap on the uniform. Also someone should ask Montel how Camp David managed to stay open, the golf courses managed to stay open--the mechanical bill managed to go out an expense of $50,000-- but four families flying to Dover AFB--(which would cost a hell of a lot less than the $50,000 for the mechanical bull)--were denied funds for that. It was a really atrocious "performance" of political theater by Montel Williams. Truly despicable.

That's precisely what I felt about A Clockwork Orange. I couldn't believe all the fuss over it. And then Eyes Wide Shut was pure horseshit.

Kubrick's lifelong goal was to make an X-rated film with A-list actors. Supposedly Donald Sutherland and Julie Christie really did it in the sex scene in Don't Look Now.

Also, the Spanish made a film called Sex and Lucia that has Spain's most famous actors appearing to have actual sex, but I think they're body doubles. Don't bother renting it. Easily the most depressing film ever made.

211 I do like Kubrick's movies, but they are a little off-putting. Dr. Strangelove is one of the funniest movies ever made, from my perspective today. It may not have seemed like that in 1964, though. At the height of the Cold War, I'm guessing that it may have made audiences somewhat uncomfortable. A Clockwork Orange was practically prophetic in depicting feral youth. 2001: A Space Odyssey, despite its idiosyncracies, set a new standard for realistic depictions of spacecraft and spaceflight in movies in 1968. As an earlier commenter pointed out, Destination Moon also did that in 1950. But 2001 had a very sterile and antiseptic look about it. In the 1970s, the first Star Wars movie gave us spacecraft that looked a little beat up and lived in. Today, Gravity has raised the bar again.

I do like Peter Sellers as the British officer having to deal with the insane general. And Slim Pickens is always great. But the last time I saw it, I found it too heavy handed for my current tastes.

I had to turn off The Shining the other night. The pacing was awful, and Nicholson was chewing the scenery.

Kubrick was such a control freak he had a studio typist actually type each page that said "All work and no play makes Jack a dull boy." He wouldn't let her photocopy them, so the typist went nuts and started rearranging all the words into those crazy patterns. Luckily Kibrick liked them.

Think about it.  Some tattoo person wants "ObamaCare Rules!" across his pecs, or, her buttocks.  Fine, needle it in.  Then, in a few months, when the pain of the actual ObamaCare starts, they can go to meet friends, etc, secure in the knowledge that "they didn't mean it" because "Hey, check it out [zip]  see?  It's like gone and stuff!"

If they really meant it, they can have a re-do with the indelible inks and be fools in their 90s.

Agreed. O'Neal's pretty bad.

I read a review once on Walter Hill's The Driver in a book on film noir. While discussing O'Neal's performance, there was some mention of the word "tree", and possibly "maple" or "redwood". My memory is kind of vague on the point.

I don't know about you, but I haven't heard a word about amnesty the last couple of weeks - other than the usual (i.e. non-Congressional related) back and forth over at NRO (which is normal - a couple of their regular writers are pretty die-hard supporters, and some of their other regular writers always respond in the opposite direction whenever the former bring the subject up).  For all intents and purposes, amnesty is dead for at least the rest of the year.  I think you're overlooking the obvious here.

Ryan's a budget guy.  He came to national prominence for figuring out long-term budget-related stuff.  The current mess in DC is partly budget-related.  Ergo, Ryan's the exact kind of guy that you want providing advice to the people calling the shots.  *Not* having Ryan act as an advisor to Boehner would be a surprise in the current impasse would be a surprise.

284 Anti-bullying programs actually cause kids to bully more

Anti-bully programs are so people can feel good about "doing something".

If you actually want to stop bullying, the bully needs a victim to step up and beat the crap out of them.

I used the latter approach once in my life in HS as a freshman being bullied by a senior and its effectiveness was 100% and lasted for the remaining 3 years.  No blowback at all.  The whole school and administration knew the dude had it coming, and the dude filed no complaints.  Incident never happened according to him.

285 In Toronto you would call the physical traffic or stop light's "pole" the standard but you use "traffic lights" or "stop lights" (or just "lights") for the intersection you're talking about e.g. "You turn right at the second set of [traffic] lights, eh."

Those other items like "Commission" for the liquor store must be Manitoba-isms. Here a provincial-government-run liquor store is just "the LCBO" for example.

289 Ann Coulter, whom I have mostly tuned out over the last couple of years, makes an interesting point in this Human Events article:

A longtime Democratic operative, Karen Finney, explained the Democrats’ intransigence on MSNBC to a delighted Joan Walsh (aka the most easily fooled person on TV) by comparing House Republicans to a teenager trying to borrow his mother’s car. “No, I’m not negotiating!” Mother says. “It’s MY CAR!”

This wasnÂ’t a stupid slip of the tongue that other Democrats quickly rejected. Finney had used the exact same metaphor to a panel of highly agreeable MSNBC guests the day before. (MSNBC books no other kind of guest.)

The left thinks the government is their car and the peopleÂ’s representatives are obstreperous teenagers trying to borrow the government. Which belongs to Democrats.

291 In a statement citing the Authorization to Use Military Force, which was passed by Congress after the 9/11 attacks on America, the US military yesterday justified the Oct. 5 raid by US Navy SEALs that targeted a senior Shabaab leader in Somalia. As for the first two episodes, I very much enjoyed the murder porn/Minecraft episode because I have a friend who was a Minecraft player. He's also shown me some videos of an Aussie video-game player who does online reviews of video games that I assume was also being parodied in the episode.

I didn't like the premiere because of the gratuitous shot at the R.C. Church at the end and they tried too hard to paint both pro- and anti-NSA sides as nuts while not really belittling the NSA.

I guess the brave libertarians believe that the NSA really is just trying to defend America and would never allow itself to be used against the Obama administration's domestic foes as the IRS was used and Obama doing things like getting rid of the Bush Era rule about domestic surveillance requiring a court order isn't an indication of that. (Especially after the NSA stopped all those terrorist acts like the Boston Bombing.)

For that journalist joining the chorus of those who want to replace the Constitution with a parliament, it should be noted that of the nations he listed, all of their current government structures are not as old as the U.S. Of them:

1 that goes back to the American Civil War is currently collapsing due to Muslim immigration and socialist policies

1 that goes back to the American Civil War is struggling to recover from a socialist period where free speech was suppressed and gun rights are still absent

1 that goes back to WWI is also collapsing due to Muslim immigration and socialist policies

2 CAUSED WWII with their parliaments

1 that was established after WWII is on the verge of bankruptcy after less than 50 years of existence

1 that was established after WWII is degenerating to where the one established before the ACW was because of socialism

1 that was established after WWII is barely able to form a government on a regular basis in the last 20 years

1 that was established after WWII is, technically speaking, a socialist country that barely manages to hold with massive aid from the U.S.

And finally the U.K. did in fact have a pair of bloodless coups to end both the power of the monarchy and then the power of their upper house

Those are supposed to be good examples of why we should dump what James Madison put together?

The story ended with the PRC attacking the West Coast as an "infidel" branch of Communism and the President surrendering immediately. It was written quickly and badly but I still think the Union Coup could happen. Actually, I think it has already happened.

It all goes back to Article I, section 8 -- the enumerated powers. Go ahead and find "controlling a substantial portion of a state's landmass" in there. You can find the interstates if you squint at "post roads" hard enough; you can find post offices and embassies and military bases....but I don't see National Parks or National Monuments or National Seashores in there at all.

There was this......

90 years + after the massive artillery shell that exploded almost on top of them, yet did nothing more than bury them (alive?) in their trench, French Highway workers discovered the remains of German soldiers from WWI

arrayed "En Situ" from the exact moment they met their end. So well preserved was the trench and the soldiers that they were able to recover  artifacts right down to letters from home and newspaper articles along with

armaments and leather goods. Bottles of wine, razors, reading glasses and other personal items that acted as a "time stamp" as to what they were doing on the very day of their collective end.

How this plays into the ONT is beyond me......much of everything these days is beyond the ONT......and frankly beyond me as well....

At least when you are on the hadj in Medina, you get to get close and cast stones at The Devil. It's part of the ritual. Just like when you go to Yellowstone, part of the ritual is to go see the geyser. No, it's not exactly the same, but the concept is similar. A trip to Yosemite is not complete without that stop.

Only if the person(s) who had to pay the costs were the actual humans that did the deed.  The idea that some asshole bureaucrat can screw over ordinary citizens and then ordinary citizens have to fund the damages doesn't sit well with me.  For example, Lois Lerner should be homeless and completely without assets by now -- and I should not have to pay one cent to rectify the fact that she is a complete asshole.

If you need high performance you're probably out of luck, unless it is an odd laptop with more than the usual external video ports.

If high performance for gaming isn't an issue, you can run several additional screens with USB adapters. My brother has four monitors hanging off a docked HP laptop. One is being driven directly by the laptop and the others are hanging off USB 3.0 video adapters. His job requires him to remote into multiple client machines simultaneously, plus he needs screen area for his reference materials to resolve the problems in the client's machines.

For that purpose it works pretty well. For anything needing a high frame rate it isn't a solution, though 30 fps video is fine.

One huge problem we have in civil litigation is that anyone can sue anybody when they feel "wronged", regardless of whether they were "wronged" in the first place or whether the defendant is actually the person who wronged 'em.

In a classic example, let's posit a company that made an "affirmative-action hire" of a candidate who was borderline for meeting the essential qualifications of a position. As it happens frequently in borderline situations, the employee wasn't quite what the business needed and is let go. The employee sues his manager because "it isn't fair, it's racist."

1. Why should the manager pay legal and court costs?

2. Why should racism favor the employee when it was racism (affirmative action) that put him in the company in the first place?

3. If the company gets embroiled in this, why should their "good deed" of seeing whether someone deficient in qualifications can actually perform be held in a "bad light" because they didn't? It's not like the company was hoping for the guy to fail.

Posted by: Epobirs at October 10, 2013 12:16 AM (kcfmt)

361 360 So you agree with me (and many others). No surprise; the civil system is biased towards the aggrieved. It's the opposite in criminal matters however; the indicted has massive incentive to plead guilty even when innocent, as the penalty for going to trial (vs plea bargain) is so huge in most cases that it too is a no brainer -- concede or suffer. That's because the aggrieved is put into the role of the State, not the indicted.

So I guess there is an internal logic there. The opponent of the aggrieved is almost always going to be the loser. That could be why 95% of all criminal charges are pleaded out. It's also why most (% unknown by me) civil suits are settled out of court too.

366 The Left is all over the news saying how apocalyptic a default would be. Yet the course they set us on in terms of spending commitments (and that is assuming Ocare doesn't wildly exceed its budget as Medicare did within five years) guarantees that the cost of servicing the debt will exceed tax revenues, which in turn means either default or confiscation of nearly all wealth in the country.

So apparently an apocalypse isn't really what they fear. It's just not on their schedule. Makes you wonder what they plan to have in place by 2025.

Posted by: Epobirs at October 10, 2013 04:30 AM (kcfmt)

There are two very disparate things going on with the talk of "default"....the first (and easiest), is that it's totally bullshit. Real financial default is when your income can't pay your interest, and we are very far from that.

Then there is the talk of "default" as lies -- stuff like "if you like your doctor, you can keep your doctor" or "this will lower costs for everyone by $2500", or "we'll be the most transparent administration, ever." By that metric, this administration has defaulted on pretty much everything all around already.

But the added wrinkle is -- what would happen in the case of an honest-to-God financial default? With respect to everyone else's default in the world, this has lead to an actual, published financial plan for repayment and guarantees against actual, real things. So where they're currently issuing 10-year bonds at 2.7% based on unicorns shitting skittles, they'd have to provide securities based on more explicit things like "10-year notes based on new homes purchased" or "5-year notes based on interest rates going down".

375 Did you see this headline at Drudge? "Eleanor Stares Down Obama" (http://tinyurl.com/kstlmgg)

I loved this part: 'Norton said she was compelled to interject when Obama suggested in his response to her that the budget crunch facing the District is similar to how other congressional districts are adjusting during the shutdown.

"That demanded that I give a response," she said. "Obviously weÂ’re the only District in the United States. WeÂ’re uniquely in this position."'

Obama made another gaffe today thinking that we have a lot of districts like DC when DC is the only one of its kind (thank God, lol); just another "57 states" from Genius-in-Chief.

The service will result in the cancellation of some classes on the Paramus campus, as well as the closures of roads in the area, officials said. On Wednesday, Governor Christie ordered flags lowered to half-staff for one week starting Thursday. Oresko was an Army master sergeant who, although critically wounded, wiped out two enemy bunkers near Tettingen, Germany during the Battle of the Bulge. He died Oct. 4 at Englewood Hospital and Medical Center of complications from surgery for a broken right femur. It was the same leg that Oresko wounded on Jan. 23, 1945 as he crawled from one enemy machine gun bunker to another to obliterate each using grenades and his M-1 rifle. President Harry S. Truman presented the Medal of Honor to Oresko at the White House on Oct. 30, 1945. Oresko grew up in Bayonne where the city’s high school was renamed in his honor. He lived for several years in Tenafly and then Cresskill. He is predeceased by his son, Robert, who died in 2010 at age 63, and his wife, Jean, who died in 1980. Organizers ask that the public arrive by 12:15 p.m. to the campus, 400 Paramus Road. The service will be held in the Anna Maria Ciccone Theatre, resulting in the cancellation of classes before 4:45 p.m., said spokesman Larry Hlavenka. He said campus staff will report to work and offices are open. Classes will resume after 4:45 p.m. Seating in the theater is limited, those wishing to attend should contact Lauren St. Helaire in the Bergen County Executive’s office at (201) 336-7317 or send her an email. The service will also be streamed live on the county website: www.co.bergen.nj.us/ Following the service, interment is at George Washington Memorial Park, 234 Paramus Road. In lieu of flowers, a tax deductible donation may be made in Oresko’s name to the Congressional Medal of Honor Society, 40 Patriots Point Road, Mount Pleasant, S.C. 29464.

422 Peter Sellers was just out of control on the set and pre-production.  Compared to his later antics he was on good behavior.  Lolita sorta marks the schism in his personality though.

All worthy stuff today.

They Havel essay is too important to bury however.

We should circulate that essay, because we, by necessity, are once again dissidents, and more people need to know that they are not alone!!!

Things really are messed up and the Democrat/Media cabal really are to blame and I hope they really can be overcome!
