As the Blue State model begins to fail state politicians are getting desperate for additional revenue and looking for the perfect victims: out of state individuals and business who they can tax but who are unable to vote them out of office. Make no mistake - taxation without representation is a key part of the new blue revenue model.
New York and New Jersey are particularly egregious offenders with New York demanding full income tax from anyone who works for a NY-based company no matter where they live and New Jersey holding companies' trucks ransom for passing through the state.
Now this would seem to be a violation of the Commerce Clause but the Supreme Court has repeatedly deferred to Congress to hash out the details. And Congress has declined to do anything about this and so interstate commerce is slowly being squeezed by the grasping hands of failing states.
At least with the Articles of Confederation you knew exactly which state had dominion over you and your purse.
Stretching the limits of the U.S. Constitution's Commerce Clause to the breaking point, local revenue agents have seized out-of-state trucks simply passing through their jurisdiction, refusing to release them until the firms that dispatched them fork over corporate income taxes. Finance departments have slapped out-of-state businesses with bills for thousands of dollars in corporate back taxes, based on little more than a single worker visiting the state sometime during the year. And tax agents have targeted employees who work remotely for in-state firms, claiming that they owe personal income taxes, even when they've never stepped foot in the taxing state.
Telecommuting can now be a tax trap for employees, too. New York State now considers those working remotely for New York-based businesses to owe income taxes on all their work, whether they visit the state or not. New York employs a "convenience of the employer" rule to apply these taxes. It holds that telecommuters for New York firms are effectively physically present in the state, wherever they happen to be. A Hawaiian telecommuter to New York, in other words, might wind up paying income taxes in two states-his home and that of his employer.
According to congressional testimony by owners of trucking companies and the American Trucking Associations, beginning around 2000, revenue agents from New Jersey's department of taxation began descending on truck stops, weigh stations, and loading docks and waylaying trucks, demanding that the owners pay at least Jersey's $1,100 minimum corporate-franchise tax before letting the drivers proceed. Many of the vehicles-about 40,000 have been stopped-worked for companies with zero connection to New Jersey, other than making a pickup or delivery there. New Jersey was, in essence, charging a $1,100 entry fee into the state.
California's Chicken Law and the Commerce Clause
California is essentially imposing a tariff on all out-of-state eggs by demanding the hatcheries they come from meet California chicken coop standards despite the fact that the FDA has stated there is no legitimate reason for discriminating against non-CA eggs.
Californian voters approved a ballot measure in 2008 requiring California egg producers to provide additional room in chicken coops for egg-laying hens. The ballot initiative, according to research done by the University of California at Davis, will increase the costs of egg production in the state by 20 percent, putting out-of-state egg producers at a large competitive advantage
...Justice Anthony Kennedy, writing in the Lopez decision, added that regulations that treat in-state and out-of-state businesses the same are still unconstitutional if they overly burden interstate commerce: "One element of our dormant Commerce Clause jurisprudence has been the principle that the States may not impose regulations that place an undue burden on interstate commerce, even where those regulations do not discriminate between in-state and out-of-state businesses." According to Missouri's attorney general, the law passed in California outlawing the eggs produced under the practices generally used in the rest of the United States clearly offends the Constitution.
John McCain: Obama Was the Smartest Person in the Room
Well just remember that McCain graduated 5th from the bottom of his class (894 out of 899) and seems to believe that the better man won in 2008.
I thought when he had a couple of dinners with Republican senators, we really had a good environment there. Because he is a very, very articulate and attractive guy in a setting with eight or nine senators and him. Because he was smarter than the rest of us. But I don't see that now. I don't see any of that.
Full disclosure: McCain has been one of my least favorite Republicans for 15+ years now and I believe every one of the rumors about his possible defection to the Democrats after 2000.
No Means No and Also Yes Means No. Maybe.
The Forum on Consent, which was also open to the public, featured several panel participants who spoke to the question of what we understand as "consent." The theme was similar to a campaign launched by a Nova Scotia coalition earlier this month - the More Than Yes campaign - which contended that "sexual consent is more than just a yes." According to that campaign, and echoed by the forum participants at McGill on Wednesday, real consent "must be loud and clear. Sex without enthusiastic consent is not sex at all. It's sexual assault or rape." . . .
Defining rape down - until mere unenthusiastic sex or enthusiastic sex but with eventual regret = a sexual assault. Next stop: all PIV.
Targeted by Islamic Death Threats? No Speaking in Public Facilities For You!
Seems like an easy way to shut people up. And remember that activities which are rewarded will be repeated.Next on NJ's Ban List: Any .22 Rifle With a Tube Magazine
Which means the venerable Nylon 66 would become an illegal assault weapon.
The New Jersey Assembly's Law and Public Safety Committee was scheduled to hold a public hearing on Monday (postponed for snow) about a bill that reduces the maximum magazine capacity from 15 to 10.Since the legislation covers both detachable and fixed magazines, it has the effect of to banning popular, low-caliber rifles.
...Thus, the experts found that at least 43 common rifles would suddenly be considered a prohibited "assault firearm," such as the .22 caliber Marlin Model 60, Remington Nylon 66 and Winchester 190.
11 French Travel Tips for Visiting America
You have to be nice to ugly pets and children, the showers are all retarded, and the Americans eat like animals.
Americans eat and drink anything and at any time of the day: in the street, in a meeting at work, in the car, on the subway, in the elevator, the movies ... So, there are drink rests everywhere: cinema seats, baby strollers, shopping carts at the supermarket, in cars, some bike handlebars.
The portions are often gargantuan in the United States (but you already knew that). Americans are not embarrassed to ask for a "doggy bag" to take home. They'll even take home the rest of the tortillas appetizer.
On the other hand Americans generally don't steal from you and will help in an instant and also expect you to help strangers as well:
A passerby stumbles and sprawls in the street, an old lady can barely control Brutus at the end of a leash, a small tricycle driver loses control of his vehicle. Politeness means, of course, that you come and help all these people. American culture wants you to quit all your activities and rescue the unfortunate. In America, you cannot pretend to not have noticed all these little quirks. You must rush to provide assistance to all who need it.

"Likely" is a stolen base. The article itself has an update:
A few of the coins in the hoard were from different U.S. Mints and from earlier in the 19th century. It could be the case that the Federal Government might only be able to prove that the coins amongst the hoard which can be confirmed as coming from the San Francisco Mint in 1899 must be returned, while the finders could contest that the remaining coins were not part of that robbery and thus not necessarily stolen property.
But even that is misleading. If the US government wants to claim these coins (or some portion of these coins) are from some robbery, they have to prove it. Merely finding reports about some robbery that occurred during the right timeframe doesn't do it. There were people legally acquiring the same types of coins during the same timeframe. Proving that these particular coins came from a robbery is going to take more than digging up some old newspaper article out of the archives. Until that happens, it's just speculation.

according to high school civics textbooks of fifty years ago, had several problems. The National Government had no tax income, and the individual colonies were taxing each other with tariffs, duties, and fees whenever trade goods crossed borders.
The result was a new Federal Constitution which claimed for the federal government, the power to regulate inter state commerce..
So here we are again, repeating the mistakes of the past. Taxing trade between the states merely for crossing a state border enroute to somewhere else. Special state regulations that require products sold in that state to meet restrictive characteristics.
But it really doesn't matter anymore since we have long ago ignored the plain language the US Constitution was written in.
There is no 'justice system' where laws apply equally to everyone. Instead we have lawyers, and rule by Imperial Decree, and Political Officers.

We were dumbfounded. We appealed, were rejected by the counties, and sued. We learned some used an absurd method of having some local idiot county worker drive by and count antennas, then multiply a revenue estimate for each antenna. Besides the fact that this amounts to a hidden wholesale sales tax applied through property taxes, they completely made no sense in our case as these antennas counted were old AT&T horns from the 1940s and 50s, still on the tower and dead to the world for 20+ years.
Each year, we'd appeal, be rejected, sue, spend $10K per site in legal fees rather than agree to the valuation. They admitted to us that they did this as it was a major revenue raiser, since most companies are out of state and don't sue per the expense of having to have local counsel.
Today, if someone's working in government, they're most likely involved in what would be criminal racketeering in the private sector.

At worst IMHO the couple should pay out the 10-grand 1900 value if the theft is proven. They'll still have to pay taxes on the rest of the current value as they sell so it's not like the government isn't getting its pound of flesh.
Still, I knew something like that was coming although I figured the government would claim that the gold should have been turned in to the government during FDR's gold seizure and that would be the excuse. They should have sold them slowly over many years and not reported it.

So far, I'm highly impressed with the bang-per-buck ratio.
While I was at the shop, I got play an extremely nice Guild acoustic -- 1975 vintage, oh-so-gently used. It wasn't the most beautiful guitar I've ever seen, but my God did that thing ring!

I'd spend the hour with Mr. Putin. Preferably, competing against him in an IDPA match. He'd acquit himself reasonably well, I'm sure, but I'd put the whuppin' on him, for sure.
An hour with TFG? No. Way.
No. Respect.
Mr. Putin may well be the sly, evil, diabolical scheming tyrant he appears to be. But, he's a patriot to his country, unapologetically so. I don't necessarily like him, but I bear him the grudging respect due his competency and comportment.
Conversely, I'm but ashamed of TFG, in every respect, and in every instance. He shames our Nation, and I shall never, ever, forgive him this.
I wipe my shoes of him, I shake his dust off of my feet. He is accursed and an affront to righteousness itself. May history treat him as harshly as he richly deserves.

I suspect they were concerned about being prosecuted. 10 million is an awful lot of money, even if you spread it out over many years. If the government found out, who know what all the charges an eager federal prosecutor is going to come up with. There's the tax code, money laundering, and since the coins were possibly stolen from a US mint, who knows what laws are applicable about receiving the proceeds. Whatever happens now, they don't have to worry about criminal charges.

That is a heckuva question. As I discussed previously, it is exceedingly dangerous to be married in California and for either one of you to supervise employees -- we both know people who were sued for trumped-up "discrimination" charges. The manager starts off losing his job, the employer settles quickly giving them the assets they need to vindictively go after the manager, and the resulting legal fees and damages clobber not just the manager, but his entire family. So I would hope that it'd be slightly after we shake the dust from this place off our heels.

From what I understand, the Thais nibble on street food constantly (and yet somehow manage to stay thin, which I do not if I indulge my love of pad thai too often). So it's not just those crazy Americans who eat on the street. The frogs have an aversion to snacking because their cuisine is so loaded with calories - if they went around eating Brie and chocolate mousse all day long, they'd soon get tubby (what's Hollande's excuse?)
I have to admit, I can understand the weariness of the French guy at hearing the word "inspiring" constantly. The movie was "inspiring," Obama is "inspiring," the story of the athlete's come-back is "inspiring." I'm sick of it too, although the cliche that really makes me grind my teeth is "raise awareness." 'Cause if these pols and celebs didn't yap away, nobody would know breast cancer or rape or a diet consisting of Snickers bars is bad for you.

The other day, Merkel confided in Obama during a phone conversation that she thought Putin was "in another world," losing touch with reality.
Obama promptly let that comment leak to the press.
Causing considerable embarrassment to an ally during an international crisis. (And ensuring allies will no longer speak openly in private with American officials.)
Now, we have the Obama White House saying for the record that Obama himself does not think Putin is "unhinged", but is acting for domestic political reasons. In other words, Obama saying that Merkel's assessment is wrong.
And going on to say, incredibly, that Obama wants Merkel -- the same person he just embarrassingly quoted as saying Putin is nuts, and the same person who Obama then further embarrassed by publicly contradicting her assessment -- to act as a mediator between Putin and himself!
I'd love to be a fly on the wall in that meeting room, but I don't think my lifespan would be very long, as the temperature plummeted towards near absolute zero.

Funny thing about caps being a part of the ONT... right now, I'm drinking Plaid Bastard Ale from Grand Lake Brewing Co. It's rather... peaty, like they were thinking of Scotch ale as being patterned after certain types of Scotch whiskey. It's sort of like drinking liquid caps. So, that smell you're thinking of? The published news item was discovered in the Haithi Trust Digital Library and was provided by Northern California fishing guide Jack Trout, who doubles as a historian and collector of rare coins.
So, Jack Trout finds this old story about the mint robbery, and the internet plays "what if".
But, there is nothing anywhere about the government itself saying that the coins that were found are the same as the coins that were stolen, much less that they will be confiscated. Just because there was a robbery back when does not mean that these are the same coins.

If it had been me, I would have reported $30,000 worth of income from salvage on my property.
According to the federal reserve act, each $20 gold coin is worth $20.
Future numismatic income from collectors will happen in small lots, privately, and completely outside of the state of California.
Talking to the press, or even a close relative, is exactly the same as talking to the IRS. I'm pretty sure that couple only confided to a few relatives in order to turn this whole thing into a fucking media event.

You don't hide the collector transaction. You move out of California, and report each sale of each coin as a collectors item as a taxable event. You are not required to do anything else, and certainly not blab about where you got the coins, and you should just keep your fool mouth shut.

But in the case of gold the meaning morphs. Gold is called fungible because it can be melted down into other forms, unrecognizable* as the original. Turn those coins into gold statues maybe.
*Except in cases like years back when the Swiss did an assay of some gold in their vaults. Because of certain trace elements, it proved the gold came from fillings. Yep, WWII German gold made from the dead of the concentration camps.

Were prostitution legalized, most women would come to their senses regarding the true definition of "rape." As my "big university" experience taught me, a lot of young women use sex as a weapon to get more attention from the boys than the other girls. When they realize that it didn't work because being easy does not win his heart...well, it must have been rape.

You would have to figure that a genuinely smart oppositional political party, facing off against an incumbent party that can't shut up about "global warming", might manage to run a few hey-folks-look-outside ads. Battlespace preparation for the fall.

Cthulhu,
Are you going to leave CA or find new jobs? I gather you both work at the same place?
I was using my iPad to read what stupidity Graham spouted earlier on Twitter & canÂ’t copy & paste from it.
I made your roasted tomatoes for dinner tonight. I added some mozzarella cheese. I used two packages of Campari tomatoes & ate all of them. After seeding they did not fill a small baking pan. If I left the rest for later they would end up in the trash Monday night. they were the only thing I had since a blueberry scone early this morning. I would like for us to leave California -- and the sooner, the better. I'm glad the tomato-roasting is going well for you -- it really is a forgiving recipe and can be adapted in all sorts of fun ways. I normally don't seed the tomatoes, just chop 'em into chunks.

I think it was SundayÂ’s ONT that I read before 5 am because I work up again too early in pain & took my meds & did not know it, that I read that you are still praying for my brother Paul. He is a little better. He was in the hospital again & I was pissed off that the rehab did not call to let me know last Tuesday. He has been pic line antibiotics since February 6 & still ended up with high fever & on oxygen since December 6. He called me last Wednesday expecting that I knew he was in the hospital. HeÂ’s back at the rehab & his oxygen level is better & he doesnÂ’t have to use it constantly. They seem to have latest case of pneumonia under control.

nice ONT thread Maetenloch.
the Saddle Ridge Haul story. some issues with the SF Chronical article (i'm hoping the couple gets to auction the coins).
>>>In addition, the coins were largely in chronological order<<<
this is false. they were found in 8 cans without regard to date. the dates of the coins span 47 years.
>>>New information, which adds credibility that the heist was an inside job at the Mint, became available late Monday afternoon from research by historian Jack Trout: An 1866 Liberty $20 gold piece — which did not include the words “In God We Trust” — was part of the haul, a coin that alone is worth more than $1 million.
“This was someone’s private coin, created by the mint manager or someone with access to the inner workings of the Old Granite Lady (San Francisco Mint),” Trout said. “It was likely created in revenge for the assassination of Lincoln the previous year (April 14, 1865). I don’t believe that coin ever left The Mint until the robbery. For it to show up as part of the treasure find links it directly to that inside job at the turn of the century at the San Francisco Mint.”<<<
this is also false. there were 3 variants on the liberty head double eagle and "in god we trust" was added after 1866. 1866 was the change point between type 1 and type 2 and the SF mint struck both variants (the no motto is the rarest) in 1866.

Kudlow was a fan of her's before she had a national profile. As gov she popular, competent, and generally moderate (at the time she was one of the most popular elected officials in the US). Think it was a case of buyers remorse for McVain when she outshined him at the announcement.

Are there enough French Basques to matter?
You do have to wonder about this scattering of tribes throughout Europe who are very oddly matched to their immediate neighbors and whose prior ethnography is a mystery. Hungarians must be alien descendants too.
"Only the Gauls are 'native,' but we have no idea what percentage of modern Frenchmen are actually descended from Gauls -- probably very few."
I read the recollections of an Anglophone lout who joined the French Foreign Legion on a bet. The Legion said they must all learn to speak French, and the instructors went straight to the classic French elementary school texts for that purpose.
("Our ancestors, the Gauls...")
Except in French elementary school, if you fail to conjugate a verb properly, the teacher doesn't beat the crap out of you and make you sleep outdoors in the rain without dinner.

good point on the cans. i've seen a few pictures but they look like cans to me.
also a good point on the time frame. the 30's depression is the one I had in mind but, the panic of 1893 touched off a depression that lasted until the late 1890's too.
it is a great mystery. brb

True. Basque is a language isolate, meaning there is no discernible connection to any other spoken (or identifiable extinct) language. The current theory is that it is pre Indo-European and was part of a family of languages spoken widely across western Europe until they were swamped by the Indo-European languages of the invaders.

(I had this pointed out to me once not realizing what I was doing is not most people's way of referring to animals. Usually they use impersonal nouns and pronouns and don't use verbs that one would use for people. Interestingly I've found it a fairly good indicator of someone's closeness and empathy for animals. And believe me their are people who don't.)

A typical ejaculation contains 5 to 7 calories. By doing some complex math, that means that consuming 20 ejaculations would add 100 to 140 calories to your diet. Given the sad history of humanity, there would be a lot of times when 100 calories would mean the difference between life and death. Given the propensity that people have had for locking up their enemies and providing them with minimal, if any food, it would seem likely that some significant number have survived this sort of starvation captivity only by giving a lot of blow jobs.
I can understand why this sort of thing would be one of the details that people would be likely to leave out of their accounts of living in those circumstances, particularly in the 1940s and earlier but I am curious as to how much this has been a factor in survival.

While New York might demand payment of income tax - it is a bit difficult to see how they could enforce that on the individuals who don't reside there. Of course in the thug based blue state model of the world I guess they could be made offers they can't refuse.
New Jersey's actions are exactly why the commerce clause was put into the Constitution in the first place. Of course - under the Obama model of government, the Constitution no longer applies to anything - so have it goons.
