Automatic Citizenship at Birth
Is pretty much a New World idea. Most other countries require at least one parent already be a citizen in order for a child born there to automatically get citizenship.
The Princess Bride and the Dapper Don
Reiner: Yeah, I walked outside the restaurant, and John Gotti was there with six wiseguys. There was a guy beside the limo who looked like Luca Brasi. He looked at me, and said: "You killed my father. Prepare to die!" I almost went right then! He said, "I love dat movie, da Princess Bride!"
The Wit and Charm of Hillary Rodham Clinton
All class baby:
(2) "F**k off! It's enough I have to see you shit-kickers every day! I'm not going to talk to you, too!! Just do your G*damn job and keep your mouth shut." From the book " America Evita" by Christopher Anderson, p. 90; Hillary to her State Trooper bodyguards after one of them greeted her with "Good Morning."(3) "If you want to remain on this detail, get your f**king ass over here and grab those bags!" From the book "The First Partner" p. 259; Hillary to a Secret Service Agent who was reluctant to carry her luggage because he wanted to keep his hands free in case of an incident.
...
(8 ) "Come on Bill, put your d**k up! You can't f**k her here!!" From the book "Inside the White House" by Ronald Kessler, p. 243; Hillary to Gov. Bill Clinton when she spots him talking with an attractive female

Al Gore: Hurricanes Now Go to 6 Because Global Warming
And as usual Gore is full of shit:
However, according to Chris Vaccaro, director of public affairs at the National Weather Service, that's not the case.Vaccaro told me that the possibility of adding a sixth category to the Saffir-Simpson Hurricane Wind Scale ratings, the well known system that ranges from Category 1 to 5, has been raised in the past, but, contra Gore, there are currently no plans to do so.
Moreover, categories are defined solely on wind speed; Category 5 hurricanes, the class with the highest wind speeds, are hurricanes with winds measured at or above 157 miles per hour (I neglected to ask if Gore's bluster has been known to qualify). In other words, Category 5 currently includes anything that could possibly be considered part of a sixth theoretical category. There has not been a Category 5 hurricane in the Atlantic Ocean since 2007.
Seventy years ago this week--on August 1, 1943--more than 170 B-24 bombers lifted off from American airbases near Benghazi, Libya. Heading east, they struggled against the desert heat and the weight of their bombs and fuel load. Operation Tidal Wave had begun.
The plan was to take out the Nazi oil refineries at Ploesti, Romania and starve the German military of fuel forcing a quick end to the war. A good plan except that the Germans were prepared:
What followed was a slaughter. The 93rd Bomb Group lost 11 aircraft over the target; the other groups suffered similar, heavy losses. Some of the bombers flew less than 50 feet above the ground, dodging smokestacks, barrage balloons and other obstacles. Gunners on the B-24s reported firing up at enemy anti-aircraft guns on nearby hillsides. But the crews never wavered; despite withering AAA fire, steady attacks from enemy fighters and heavy smoke that made flying even more difficult, the American crews pressed home their attacks, at great sacrifice. Five Medals of Honor were awarded to aircrew members on the Ploesti raid, three of them posthumously.
The second lesson of Ploesti is a central tenet of modern warfare: powers who depend on distant oil supplies--often controlled by unreliable allies--are at a terrible disadvantage. With the eventual loss of Romanian fuel supplies and synthetic oil plants, Hitler's war machine eventually ground to a halt. Japan suffered a similar fate when U.S. submarines sank most of the tankers carrying crude oil from the East Indies to refineries in the home island. B-29 raids on those same facilities administered the final coup de grace.
Eight decades after Ploesti, the U.S. remains dependent, to some degree, on unreliable foreign sources of oil to fuel its military.

By Hermès:
The fashion brand, which has turned out footballs and soccer balls in the past, eschewed its signature orange in favor of a California-chic, cool blue for the bull calfskin ball that's made using the same hand-stitched technique as Hermes' coveted Birkin bags.
"It represents the sky, the ocean and all the beautiful pools that are a way of life in L.A. and Southern California," says Robert Chavez, Hermes U.S. CEO, who says that the exceptional quality of the leather as well as the artisanal craftsmanship account for the ball's price.
Pssst - Wanna Buy a Spy Rock For $10 Million?
On Ebay the former CTO of a company is selling the plans and remaining prototypes of a 'spy rock' that was developed for Lockheed Martin for just $10M. Why? To finance his legal fight against his former employer and possibly Lockheed Martin for infringement.
"For a cool $10,000,000.00, the prototype of a surveillance rock full of spy gadgets could be yours! More importantly, server backups from the gentleman's time at Lockheed are included, being the real valuable in this auction, as it contains schematics and such. The seller seems to think that the current xBee radio products are actually based on his work with Lockeed. The proceeds will go towards legal action the seller is apparently taking against his former employer."
At my day job I've been peripherally involved in a similar (and more advanced) project and that's about all I can say.

oh and I want to clarify something I said on the book thread this morning, in case any of my ONT friends took offense. It's not that I don't think books should have girls as the main characters (obviously, I am a girl, I am pro girl heroine), it is just that I would like to have some books where boys are the main characters and they aren't major fuck ups in one way or another so my son has something of value to read. Thankfully he loves science fiction so we have been able to jump right over most YA fiction, but they force them to read it in school and the choices are usually so limited for a kid who doesn't want to read yet another book about a brave girl who saves the dumb boy.

So deep thoughts guys.
I've seen two different stupid things today bitching about either the lack of legally required paid vacation in the US or lack of health insurance for low wage jobs.
Do people realize these are called "benefits" for a reason. If everyone got them it wouldn't be much of a benefit would it?
I feel like we need to push on that, against the living wage shit.
Sorry for the lack of levity...

Absolutely. As someone who reads a fuckton of YA, it's infuriating that there's very little for guys. It's to the point that if it has a male protagonist, I'll probably buy it just so that I can add some tiny tiny contribution to the notion that there's a market for it.
Has he read SYLO? That's has a male protagonist, a somewhat sci-fi plot and it's something that I think would be appropriate for say mid-teen and up.

New adult makes me scream. All of the romance books are moving into the "new adult" category. I look up romance novels on the Kindle and all I get is book after book of either college girls meeting their "true love" or 20 somethings at their first job being swept off their feet by the ultra wealthy boss.
I know I am getting old, and am cranky about it for sure, but doesn't anyone over 40 fall in love anymore? I mean, there's all those news articles about the sexed up geriatric generation, so it must be possible.

yeah but "How Stella Got Her Groove Back" was a dumb book (yeah, yeah "racist"). The books in that category tend to be where the older woman has the money and she falls for a younger guy (like "Flirting with Forty") who is some sort of layabout.
I am really incredibly picky about my romance novels. Probably why I barely read them anymore.

Then some genius at the Naval Safety Center decided to implement a new system where you would make your reports online. Lots and lots of dropdown menus, but written where each change would reload all the choices in the boxes below it. Would suck ass on normal internet, but was absolutely unusable on the limited bandwidth underway. Especially back then. One simple message, I counted 120 page loads.
And that's how military internet works. I can't believe DoD invented this shit.

It's not just about meth. It's about how power corrupts a person with only good intentions. The show details the transformation of mild-mannered Walter White into a criminal overlord, and how it happened. Bryan Cranston is absolutely pwning his character. I will never see him the same way again in anything else. It will always be Walter White/Heisenberg to me.

Interestingly enough, we did the outbound hike on the Saratoga Gap trail by Castle Rock Falls -- and thought that was horribly unpleasant. The ridge trail returning was much nicer, until we passed Goat Rock and it dipped back onto the damned escarpment again. The worst section was when we'd just been passed by a group of youngsters, and 20' later they were like, "WTF? The trail just ended!" Only after we repeatedly asked if they were sure did they find we were expected to climb a 7' rock to continue on the trail. We let 'em scamper on before we followed (that's the place the BH skinned her knees).
We've decided that it's probably called "Goat Rock" because you have to be part goat to get there.

I have a theory. Walter does indeed accept his fate as the creator of all things evil around him. He decides to go out like a boss, but the ricin cigarette is for HIMSELF! He smokes it before the final act. Everyone dies.

A NSA type of flick, with a woman's(?) voice over as the gumint's big AI.
Started out with a drone strike in Arab land the human operators were waiving it off because of no positive ID. The AI overrides and boom.
Weird killings as in landlines electrocuting non conformists.
The end/climax was that the male and female leads had to prevent her son from hitting a specific note on his trumpet at the State of the Union address. So that all 3 branches of the USgov wouldn't go kaboom.
Plus, I am beginning to hate wiki, rant later.
Edited movie on HBOAsia but it seems I missed the good parts from the USA release. IMDB Machete'

I'm taking a very brief break from today's overload of catgirls and other assorted outlandishness. The Final Fantasy XIV servers are up for early access (i.e. people who pre-ordered or people who were subscribed before the servers went down last year), and that's where I've been spending most of my time today. I can't believe how much the game is improved. And as you might expect in a game where it's a playable option, yes, there are a lot of catgirls running around.

@404 How customizable is character creation in the new FF?
-----------------
Reasonably so. It doesn't have as many options as, say, Aion (which went nuts in that department), but there are enough facial customization options to provide a decent array of results. And you also have a broad spectrum of skin and hair tone options. If you're interested in looking at the character creator, then grab the benchmark program off of the official website. It includes the character creator (so that you can run your custom character through the benchmark instead of the default).

I have a surprisingly similar problem - except that mine is with the gate for my apartment complex. I came home from running some errands yesterday, and the remote gate opener didn't work. I got someone else to open the gate for me, so at least my car's off the street. But if I have to go drive somewhere else then I might have some issues. Would an invading army be "subject to jurisdiction"? How about any POWs on US soil?
What about foreign spies/saboteurs?
"Subject to" is more than just the US having a legal right to throw them into jail. Rather than working from that starting point, we should examine actual subjects - permanent residents.
Those go through a bunch of legal hoops and obey the laws - that is quantitatively different than a pregnant woman smuggling herself across the border.

Posted by: ChelseaMonster at August 25, 2013 10:19 PM (H7UgW)
Yes, yes, and yes. If you can produce an example of a spy or saboteur claiming immunity from US law because they were a foreign national please do it.
I can't think of a single instance of that happening that didn't involve diplomatic immunity. That's why embassies are chock full of spies -- they CAN get diplomatic immunity using their official covers. Those Nazi spies that landed on the east coast got packed away into prisons or executed straight away since they didn't have any official cover to protect them.
That's the whole point of keeping Gitmo open -- to warehouse them OUTSIDE where they'd be subject to Federal jurisdiction and all the mechanisms that would come into play.
CONUS housed POW were always subject to US law as well as various treaties. Being a POW didn't grant you immunity to murder other POW's or camp guards.

So where in US law does it describe the procedure for providing US citizneship to the children of a hostile force? (since they're hostile and all, birth paperwork will be spotty) Is there a pathway to citizenship for the enemy soldiers too?
I'm saying your interpretation is absurd in applciation. Is the law designed to guarantee citiznehip for the previous "non-person" slaves, about granting political power to people hostile to the US gov't and its rule?
I don't understand how you think (hypothetical) active enemies to the US country are "subject to" the US by virtue of standing on US soil. Someone who is able and willing to shoot bullets at US citizens and their representatives is not "subject to" the US gov't.

I guaranfuckingtee you the line will find you before you find it. Someone else found that out earlier tonight when they were warned and busted one of Ace's rules anyway.
If you want to change reams of stare decis based SCOTUS case law, you're gonna need a constitutional amendment to do it. I would encourage and support doing that. I never said I was happy with this situation, EVER.
However, I'm not naive enough to think some BS internet argument is gonna get SCOTUS to reverse and interpret something this major differently without an amendment to force it.

Fascist because I don't think illegal aliens and their children make good US citizens?
It's not that I think they should be second class citizens - but a "citizen" raised to be a welfare bum for all their future generations (so they will reliably vote Democrat) is practically a second class citizen.
Or maybe they're actually first class, since it's everyone else who'll be paying for it. (for as long as current trends continue)
Posted by: ChelseaMonster at August 25, 2013 10:54 PM (H7UgW)
Yet you can't provide a single example of YOUR interpretation so far.
Kid born on US soil = citizen. The current law doesn't give a rats ass how they got here. Fucking space aliens could have snatched a mother in China giving birth up and transported her here as the kid was popping out. That kid is a US citizen under current law.
I'm not saying it right or desirable, it is however the WAY IT IS and your wishful thinking ain't gonna change that.

And where did I ever say my "BS Internet argument" will accomplish that? Do you think I'm discussing this on the AoS because I think that it will cause the SCOTUS to reverse their decision and make things right?
I'm arguing the interpretation is wrong, because it did not actually pay attention to the consequences of the decisions, the priorities of US law and society, and what "makes sense".
SCOTUS may have the final legal word on the Constitution; but that doesn't make their interpretation correct.
In any case, we both agree on the desired result. A Constitutional amendment would accomplish it without any controversy about how to interpret the 14th. Good luck getting the wording precisely right.

Native Americans.
From wiki on the 14th amendment:
" During the original congressional debate over the amendment Senator Jacob M. Howard of Michigan—the author of the Citizenship Clause[39]—described the clause [...] that it excludes Native Americans who maintain their tribal ties and "persons born in the United States who are foreigners, aliens, who belong to the families of ambassadors or foreign ministers. [...] The Supreme Court held that Native Americans who voluntarily quit their tribes did not automatically gain national citizenship."
So "subject to" was understood at that time to not include all sorts of people born on US soil.
That our current set of politicians interpret it in a different way right now does not make them correct, any more than the Assault Weapons Ban was a Constitutionally correct piece of legislation. ("shall not be infringed")
What do you think my wishful thinking is?

Indian reservations aren't considered US soil. They have their own internal governments, laws, and law enforcement agencies.
Congressional debate and "intent" don't mean anything. The words that got passed and how SCOTUS interprets them are all that matters. Ever.
I'm not happy that indians have this defacto special status of acting like citizens when it suits them (ex voting) and then acting like non-citizens when it suits them to do that.
You don't want to be on a reservation and run afoul of their laws. There's been instances of drug running planes forced down on indian res runways here in FL due to mechanical issues. The crew, plane and loads were never seen or heard from again. FDLE and DEA just walk away in those cases. the tribe dealt with it their own way.

As you know, Monster, the wording of a law has to be tighter than a frog's ass (which is watertight) to avoid these 'misinterpretations'. Even then, they somehow read between the lines, or just ignore the law via selective enforcement.
Vic thinks that the cure is an Article 5 constitutional convention but I have many doubts. Nevertheless, it might be worth a try since we are down to last ditch efforts to roll back Leviathan.

Indiana has so far only had 6 confirmed tornadoes in the entire state.
The reason is because we had a cool spring and summer, without the extreme temperature changes we usually have.
Of course, now it has turned hot so we still will be in danger when the next front moves through.

This point would be meaningful if SCOTUS didn't change over time. How SCOTUS interprets the Constitution shifts with each new justice.
SCOTUS is quite willing to use "original intent" of laws when it suits them. And make shit up out of whole cloth when it fancies them - even stuff that isn't even addressed by the letter of the Constitution.
But hey, if SCOTUS creates new law with a horribly bad interpretation, I guess I can't think otherwise, since they're SCOTUS and my opinion doesn't matter.

What is a British "subject"? We've never had American "subjects", as we have no king, but "subject to" is related to the meaning of that word, which involves allegiance and loyalty. It is more than being subject to penalty under law.
That is why the ambassador is explicitly, by mutual agreement, not subject to the host country. His purpose is to argue for the interests of his country, which would be compromised by being "loyal" to the guest country. (though for the sake of diplomatic relations, he does abide by the guest country's laws to some extent)
This article puts it better than I could, with historical context and evidence:

There are multiple meanings of "subject to" based on context, and the choice of interpretation has very wide ramifications.

You're constructing sentences that use one meaning of "subject to" and finding that those uses have one meaning - which of course match up to your original intended meanings.
But "subject" does not have one single meaning. Just a quick survey of dictionary definitions shows half a dozen, and which is being used depends on context. All the more so in the legal realm, where words are narrowly defined for specific contexts.
You'd call foul if I took the intended meaning behind your sentences and twisted them to mean something different. I'm calling foul on taking the intended meaning of the 14th Amendment and twisting it into the perversion that it is today. (That illegal alien children have equal voice in the fate of this nation as the children of US citizens)
There are several errors here. A major error is to say the Supreme Court had no authority to make the Wong Kim Ark decision...and then cite the opinion of an Attorney General and a Danish Minister as prevailing, contrary authorities.
The article doesn't say anything about the Supreme Court's authority in the Wong Kim Ark decision.
An Attorney General, as an official in charge of executing the law, is a legal expert, and his interpretation of the law provides contextual information about what the 14th Amendment was understood to mean in the 1800s.
An American minister to Denmark is not a Danish minister (which indicates a foreign gov't official with no business commenting on the application of US law). Furthermore, what is of interest is that his opinion was accepted without controversy by then Secretary of State back when the 14th Amendment was ratified.
Those are very solid examples that show off the "lawmaker intent" behind the language of the 14th Amendment. Mine is not a kooky 21st Century invention, but has roots in American legal tradition.
Under the flawed notion of "subject to the jurisdiction", none of those men could have given birth to natural born US citizens.
The article examined several historical examples of foreign nationals becoming US citizens by first renouncing their prior allegiance to foreign states and claimed it was the common practice throughout the US. You don't understand the arguments of "subject to jurisdiction" advocates if you ignore that.
The US was outraged over impressment because the men in question had renounced their allegiance to the British Crown and given it to the US - these men did not hold allegiance to both countries simultaneously.
Contrast that with illegal aliens, who do not declare allegiance to the US, and by their unlawful behavior rebel against US law and society. Their main interest in being in the US is to take what they can from the corrupt welfare system.
We will not have a nation of laws if we say that the criminal must have equal voice to the law abiding citizen.

But not subject to the jurisdiction of the United States for the purposes of the 14th Amendment, if we use the 1800s standards of "subject to jurisdiction".
Language has changed, but that doesn't mean the old way of doing things automatically must be ignored.
At issue is their children, born on US soil, who assert US citizenship. Your response is to INVENT a theory of competing allegiance and pretend their claim to American citizenship is murky.
Dual citizens have competing allegiances. It's not an invention on my part - it's the very nature of claiming two countries as one's own.
Everyone on earth does citizenship by blood; the children of two US citizens are US citizens; just as the children of <insert country> citizens are citizens of their parents country. So the children of illegal aliens, by the fact that their parents are foreign citizens, hold dual citzenship.
Their claim to American citizenship is murky - you're ignoring the article's historical evidence because it destroys your counter claim that my understanding is made up.
Your belief that deporting minor US "citizens" is no trouble is short-sighted. How about when the minor returns the US as an adult with no knowledge of US culture or tradition, with loyalty to the place they were raised in? Full voting rights and political power as a person who grew up in the US, or the naturalized citizen who swears allegiance to this country?
Are the children of deported minors going to be US citizens? Even if the parent spent their entire life outside of the US?
Granted, your solution is still better than our current status quo. But I don't like that it still dilutes American citizenship.

Except it wasn't, because the states did not recognize them as deserving citizenship in accordance with the states' authority to choose who is a citizen, and the states' interest in only granting citizenship (political power) to those who demonstrated commitment to their society. (ex: by not having allegiances to foreign nations)
The UK's claim to allegiance was contested because those individuals had renounced it and sworn allegiance to the US, as an active choice. It involved people who were born in the UK; who had switched allegiances. If you bothered to read the article more carefully, these were "naturalized citizens" (or in the process of becoming such) and their children naturally gained the same citizenship.
You are maintaining the citizenship status of people born in the United States, AND who declare themselves US citizens, is revocable. There's no historical basis to ignore the place of birth AND an adult declaration.
No. I am saying that the children of illegal aliens do not qualify for citizenship under the (properly understood) language of the 14th Amendment. I recognize this is not how things are currently being done. Whether they declare themselves to be US citizens is also not clear, but it is clearly unjust to grant them citizenship as a reward for their family's lawbreaking while legal immigrants respect US law, wait in line and are rejected for residence and citizenship.
I have made no comments at all at what should happen to people who have been granted US citizenship certificates for being born here even though they do not really qualify under the law. There is no easy solution there, but I am not arguing for a solution, I am arguing to define the problem - misapplication of our nation's laws for citizenship, which shifts us away from being a republic and a nation of laws.
Yep. That was granted by the 14th Amendment, which was passed to regularize millions of people who were born outside the American mainstream, and whose parents had never been citizens. If you want to change it, you'd have to repeal the 14th Amendment.
No, that's my whole position - the 14th amendment does not grant citizenship to these illegal alien children because its citizenship is conditional on being subject to jurisdiction, which in context involves declaring allegiance; the illegal alien by reject US laws has not given allegiance to the US.
As far as what you're talking about, many of these "wrongly issued" citizenships have been given out for many years; I think it's too disruptive and impractical to take them back.
But the first step is to correctly apply the law now by not giving out citizenship to birth tourists and whatnot. That is wishful thinking on my part - but that does not make it less correct or desirable.
