Legal Insurrection: Why Marco Rubio, Bobby Jindal, and Ted Cruz Are Natural Born Citizens

Okay, Okay I know you're all burned out on this topic and tired of rehashing the same arguments - God knows I am too. But given that it IS Constitution Day and for once we have an actual legal scholar who's gone and done the actual research on the topic, I think we can open this can of worms one more time.

So Prof. William Jacobson of LegalInsurrection.com went back to the original sources including the writings of the Founders before and after the drafting of the Constitution and in his post lays out exactly what found regarding the 'natural born' citizen requirement.

No Person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President; neither shall any person be eligible to that Office who shall not have attained to the Age of thirty five Years, and been fourteen Years a Resident within the United States.

It's a clear, well-written and semi-long post and it's worth your time to read it. But if you're all Teal Dear and stuff, here's the quick summary:

  • The term 'natural born citizen' is used but never defined in the Constitution. Nor is it defined in other writings of the time by the signers.
  • There seem to be two categories of persons whose status has never been disputed from the earliest days:
    • Clearly Natural Born citizens  - A person born in the United States to parents both of whom are United States citizens - e.g.  the vast majority of people in the US historically.
    • Clearly NOT Natural Born citizens - A person born outside the United States to parents neither of whom is a United States citizen e.g. Prince Charles, Arnold Schwarzenegger, and most people of the world. 
  • Since the Framers never explicitly defined the term nor included text dealing with the status of people who didn't clearly fall into either one of the above categories, we can assume they intended it to be defined through later laws and statutes.
  • From historical documents and letters the Framers also didn't seem to be looking for technical reasons to exclude people from the first category. They were mostly concerned with obvious foreigners running for president.
  • Later statutes and court decisions have been specific and narrow and haven't defined the term either or set a precedent.
  • Since by statute Rubio, Jindal, and Cruz were all eligible for US citizenship at their birth, they should be considered 'natural born citizens' under the Constitution.

Given that at the time of the drafting of the Constitution about 99.9% of people alive would have clearly fallen into either category one or two, I think that was good enough. After all the Constitution is a framework of laws and meta-laws (laws for making laws) - not a piece of software that is required to cover every single exception and edge case. Ultimately you have to leave it to future citizens to figure out certain things.

Sen. Dianne Feinstein (D-Calif.) insisted on limiting the legal protection to "real reporters" and not, she said, a 17-year-old with his own website.

"I can't support it if everyone who has a blog has a special privilege . or if Edward Snowden were to sit down and write this stuff, he would have a privilege. I'm not going to go there," she said.

Feinstein introduced an amendment that defines a "covered journalist" as someone who gathers and reports news for "an entity or service that disseminates news and information." The definition includes freelancers, part-timers and student journalists, and it permits a judge to go further and extend the protections to any "legitimate news-gathering activities."

Luckily we have a Constitutional scholar in the White House to set her straight on this.

Yes, that's correct. In 1993, President Bill Clinton decreed that US military personnel were to surrender the Second Amendment rights that they swear an oath to support and defend. Lott, writing in 2009, called for that policy to be ended.

Paul Mirengoff over at Power Line has a powerful and thought-provoking post on this subject. He writes "that the most serious and enduring loss to American credibility stems not from President Obama's actions or decisions, but from the unwillingness of Congress and the American people to support him when he proposed taking military action against Assad." Indeed, the failure of Congress to rally to President Obama's side by supporting a military response to the use of chemical weapons effectively left the president little choice but to grasp the face-saving offer put forward by Russia that will supposedly remove Syria's chemical weapons at the cost of keeping Bashar Assad in power indefinitely.

...The most vocal Republican voice on foreign policy is Rand Paul, a born-again isolationist who, if he succeeds, will consign the GOP to perpetual irrelevance. We need to hear more from the Chris Christies, Marco Rubios, Jeb Bushes, and others who support a Reaganite policy of global leadership but are being drowned out by Tea Party isolationists. So, too, in the Democratic Party we need to hear more from the liberal internationalists such as the Clintons to explain why we can't simply turn our backs on war crimes.

Just because we choose to ignore the world's problems doesn't mean they will go away.

Sigh.... the key to the Natural Born citizen clause is simple... the framers did not want anyone who could have the legal entanglements of another citizenship to be Commander in Chief.

 

Remember, this is the day when the Son of a British Citizen, was a Brit Citizen, and could be forced into the British Navy...

 

If you were a Brit citizen... you could be Arrested, tried, and convicted of TREASON if you waged war against the Crown.... UNLESS you were following Legal and Lawful orders... then the originator of said orders were liable... (this happened a lot of times in Scotland, Ireland, and France).

 

Thus, the idea behind the Natural Born citizen clause was to ensure that the President of the US, was ONLY, and could BE ONLY... a US Citizen...

 

Thus, born on US soil, of (at the time) a US Citizen Father.

 

The key question is.... why did they even put that clause in... if it was not to ensure that a Potential DUAL CITIZEN was Commander in Chief? (as it is a requirement no where else in the Constitution...).

They just wanted to keep out anyone born a Brit, but had the dilema of lacking anyone qualified to otherwise meet the 'natural born citizen' requirement, hence the granfather clause which was good for the founders, but no good today (unless you have a 200 year old running for pres). Actually, it's a slightly more nuanced question than that. Two spaces after a period is for English-language typed documents. It can be problematic in other contexts -- such as programming code or typesetting. The reason it's such a big point of friction is that people today are much more likely to be intermixing different kinds of keyboarded information with different rules.



Another classic example is quotes. It is perfectly fine to say, "I hope things work well." But, alternatively, you also sometimes tell someone to try "pjmedia.com". And, of course, this makes proofreading a horror.

Yeah, that's how I learned it, and that's the more thoroughly documented way to do it....but such are the rules of grammar that they evolve over time, and I suspect that this one is evolving. It remains to be seen whether textbooks will follow standard "in-the-field" usage before or after they receive their mandatory gender-norming LGBT makeover.



What I do most often is consider the nature of the quoted material. If I am relating the event, then the quote encompasses the punctuation -- e.g. Jane told me, "You could never be good enough." If I am effectively seizing the quoted material, either from another context or from another definition, and using it verbatim, then the quotes go with the material as "handles". Of course, I also tend to use multiple levels of punctuation in the same odd way -- for instance, I might ask, "how cool is 'kewl'?" To me, that's the most natural way forward.

...and lousy titles. And went right on with my introductory paragraph here -- because the instructor and I had just had a discussion about titles not being part of the text of the essay, and shouldn't be used to further the exposition.



I don't feel compelled to write within my spellchecker, but I shouldn't violate rules (or substitute my own) unless I know 'em.

I know very well that classic grammar texts would have the single quote to the right of the question mark.....and I suspect I'm older than you. If you're intermixing various sources of information in print, it makes sense to use quotes as "handles" (attached to the thing [note the period outside the quotes in the original sentence]) when manipulating the thing, and to use quotes as "signifiers" (structured as part of the sentence) when blended into the narrative. It's logical, I can be consistent with it, and -- most important! -- it works, even when quoting code and tweets and L33T-speak and instructions and other garbage.



Incidentally, I'm finding BYTE issues all the time and setting them aside -- and plan to be in SoCal in early November.

I suspect that the "random internet sources" are using a commonsense method based on inclusions of quotes from various sources. To the best of my knowledge, however, standard English (UK) usage is punctuation within the quotes. And, when it's important to appear edjumicated, it is a desirable job skill to write such sentences -- even if it forces some awkward restructuring.

I explained that as sympathetic as I was to the stress being put on the poor bears by trying to relocate them, I thought that the stress of being shot dead was probably the worse option. Being that the gradeschool wasn't going to be relocated anytime soon, no matter how much it had encroached on the bears' natural habitat, there were only two options left. First response got a lot of attention and sparked some debate. I didn't realize that some of the upper-classmen at the adjoining tables had been listening in to what the dopey Freshman were saying... I still was as cocky as any 20-something but at least I knew sometimes I didn't know shit about a situation and when you don't know or don't care to know you shouldn't feel required to voice an opinion either way. Then, the internets happened and so now I feel free to blather on as the mood strikes me.

I'd been 1/8 wondering about that for ages in movies and TV but told myself to knock it off. Long, loooong time ago, I played Hamlet to my late friend Brian's Laertes in Stoppard's Dogg's Hamlet (they set it in a girls Catholic school) and as much of a farce as that play is, we had our fight scenes choreographed by fencer Robert Anderson (Princess Bride, anyone?!?! Well,I was thrilled.) Eh, I spent the summer before learning fencing (or at least how develop the stamina to sustain the correct attitudes and postures whilst being run up & down without actually crying) from an Olympic hopefull up in Evanston, Il. So, when the Fall came around there were rehearsals and all kinds of neat things happened in the play but I will never forget the fight/dance that "Bob" coached us through which was as slick and sophisticated and dare I say it, dramatic a piece of 4 min. stage action as you'd ever want to see, followed up by us both dying the cheesiest stage deaths possible (part of the whole play). The premise of the play, is that it takes place inside a school play of Hamlet. So we got wooden swords, but actually balanced, wooden swords that looked more fakey (as they should) than they were. So, we kept them with us at all times as the most expensive props the school had spent on EVAR. "No! No! Hamlet! You need more extension! This needs to be graceful and vicious. Won't ever read right (on the stage) unless you are quick, quick quick! What are you high, Laertes? (Prolly he wuz) Hamlet's going to kill you! Defend! Oh, at least postion yourself properly. Please?" Soo... Both Brian & I lived in the suburbs and sometimes had to wait in the NW Train Station in Chicago waiting for the last trains out to our respective towns after rehearsals. "How much time 'till your train?" "45 min. You?" "I've got an Hour and 5 min. Fuuuuck!" "Wanna go get McDonalds?" "Nah, I can't afford it, besides there's a bunch of sailors down there (Great Lakes). They cleared out as Sailors often do And so, bored Brian and I started the short-lived spectacle of amazing sword-fights on the food-court level of a mostly deserted train-station, clackety clacking with our wooden swords. First time we did draw some ire and concern from security which was quickly allayed by those that had seen us seperately carrying them to and fro as part of our "homework" as part of a school play. Became kind of a thing for station employees as we extended our rehearsal sessions into the dull times when we had to wait around for the 8PM something trains in a dead station. Brian & I caused an inadvertant rush on tickets by "complete strangers"! Back to YOUR original pointe. Neither of us ever quite figured out how to gracefully manage a book-bag, heavy coat (long or short) a sword, albeit solidly wooden with a wicked point without either ultimately carrying it (me) or wearing it (him) and both looking like a douche-bag. Swords just do NOT belong on commuter trains or in crowds. They tend to knock about.

487 I don't know if it's a "birther" topic to wonder what the Founding Fathers actually meant when they wrote that "natural-born Citizen" clause into our Constitution.
I don't know if most people noticed that the Professor mentioned that he relied on the research of some other lawyer and one of his co-bloggers when forming his opinion on this natural-born Citizen issue.  He didn't personally dig too much.  Just saying.

He should have gone to historians, people who have studied this particular topic.  I believe he would have had a different opinion altogether.  People tend to think this is a "legal" matter, when it is not.  It will only become a legal matter when some iffy Presidential candidate wins and the opposition wants to disqualify them.  Count on that.

Take Cruz for example.  According to our modern day elected elites Cruz is NOT eligible due to his birth in a different country.  Think I'm full of it?  No. I'm not. Since the early seventies our Congresspersons, Senators, and their buddies have been trying to open the path to the Presidential office to persons born in other countries (regardless of parental citizenship), persons naturalized here, and foreign children who were adopted  before the age of 18 by U.S. parents.   There have been at least 15 attempts to amend Article 2 or end run it with a statute.

They claim it is "for the children", for "equality", so that our naturalized citizens don't feel like second class citizens.  They mock and ridicule the chance that a "Manchurian Candidate" can win the election.  They say we have "too much information" available by means of modern tech (internet) to be fooled by such a potential candidate.  That's totally laughable.  

All that aside, why would these elected persons spend what must amount to hundreds of hours, enlist their learned friends, and file attempt after attempt for FOUR DECADES to try and amend Article 2? For the children?  You must be fucking kidding me.   In 2004 SIX different elected officials, including Issa, were involved in yet another attempt to end run that Article 2 requirement.  Each one of those men said that it was at least clear that "natural-born" meant to be born in the U.S..   What?  Are they all birthers too?  They were arguing FOR the inclusion of non-birth citizens, and had to state why they are not currently eligible.  What has changed since then?

Is this country still a prize to drool over?  Is this tiny protection that was written into our Constitution germane today?  This is the single solitary thing that was meant to, and has kept the office of the President of the U.S. safe from foreign  influence likely to have inherent emotional or familial attachment to another nation.

But whatever.

488 So, natural born means born in the United States.  Then why the 14th Amendment?  Perhaps because natural born citizen meant only whites?  Perhaps it meant more than just born here, or in Cruz's case, born to one American parent born overseas.  Perhaps natural born does not include those Americans born overseas to one or more American citizen parents or those who otherwise derive citizenship.  But I think Cruz is out because he was born overseas and held Canadian citizenship until recently.  But suppose he was born in Singapore?  Then he would not have Singaporian citizenship because Singapore does not extend citizenship to those who happen to be born there.  Only to those who's parents are Singaporian citizens or legal permanent residents.  Clearly natural born means more than born in the U.S. or born to American parent(s) overseas.  Note that McCain was born in the United States as the Panama Canal Zone was officially and legally United States territory at the time.

490 @Federale - I'm sure we are in agreement that the fourteenth has NOTHING to do with the Article 2 clause.  Many try to make that connection, but the fourteenth amendment was to address specific societal wrongs, one of which was denying that those from African descent who were born here in the U.S. were citizens of the U.S.  That amendment does not mention Article 2, nor did it amend Article 2.

As to McCain, yes - the Panama Canal Zone was US territory when McCain was born there.  Even back in the 1700s that was considered to be a "natural born citizen".  "Parents in service" to ones country was the qualifier.  McCain was specifically mentioned in the Feb. 2004 H. J. Res. "Maximizing Voter Choice".  Oh, yes - poor McCain might suffer legal challenges to running (if he so chose to do)  if we didn't pass this resolution.  It's urgent.  gah

I advise anyone and everyone who has any nasty thing to voice towards "birthers" to read that proposal.  Over and over those duplicitous bastards claim that they are just in it for the poor little children who look up at them with tear filled eyes, weeping over the heartbreak of being barred from the chance to be President of the United States.  Oh, the humanity!  *sniff*

I wish I could post a screenshot or a link here to even one of these J.R. records.  If more people would READ instead of emote we might have a reasonable discussion instead of name calling. 

Four decades this has been going on.

492 The idea that since the framers never defined natural born citizen they intended it to be defined later is laughable. They did not put in a word that none of them knew what it meant. The reason that they did not define it further was simply because they already knew what it meant. Because they already were applying it as a legal standard. At that time the citizenship of children was determined by the citizenship of the father. This is known as derivative citizenship. Under derivative citizenship a wife and their childrens citizenship was derived from the citizenship of the father. This is the only way a child would have been a natural born citizen at the time the Constitution was written. Naturalization statutes and the 14th amendment have only addressed citizenship, they have never addressed natural born citizenship. Consequently what constitutes a natural born citizen still stands unaltered to this day. If lawmakers are allowed to alter the constitution by simple statute and not amendments then the constitution is meaningless. With derivative citizenship in mind there are only two possible interpretations of NBC. First that to be a natural born citizen your father has to be a citizen at the time of your birth. This interpretation would mean that Obama, Rubio, Jindal and Cruz are all not natural born citizens and are ineligible to be president. The second interpretation would be that both of your parents have to be citizens at your birth. This interpretation again means that Obama, Jindal, Rubio and Cruz are not natural born citizens and and are ineligible to be president.
