Report: Gosnell Jury Hung On Two Charges
— Ace

Out of 261.

This doesn't mean Gosnell has been found guilty on all other counts, only that they've agreed to verdicts -- including the possibility of "not guilty."

It's possible, for example, the jury has found that there wasn't enough evidence to convict on murder in two of the baby-slayings (say, if they evidence wasn't beyond a reasonable doubt regarding whether they were born alive). There could be one or more jurors resisting any murder charges for the "aborted" babies, even if the evidence is strong they were born alive; it might just be that the rest of the jury agreed with them on two counts, for insufficient evidence.

The judge will now holler at them some and remind them of their duty and tell them to work it out.

Why I Think This Is the Case: I think this way because if they were split 2-2 on guilty/not guilty for the baby murders, they would simply split the difference and present their verdict of 2 guilty, 2 not guilty. They would have still convicted him twice for capital murder; the third and fourth conviction are of less consequence after the first two.

So it's my guess what's going on is that the jury has agreed that on two deaths, there isn't enough evidence to say the baby was alive (and hence murdered), and then there are one or more jurors who are against imposing the verdict of guilty in these cases whatever the evidence.

So I think the fight is between those who want 2 guilty, 2 not guilty verdicts as to the baby murders, and those who want 4 not guilty verdicts for all of them.

Because if there were more than two this is interesting (and would seem to imply to me that there's at least a single guilty verdict in there somewhere.)  I find it hard to believe they'd find "not guilty" on a few and then get hung up on 2.

This whole thing is sickening. I don't see how anyone on the jury (or anyone in the courtroom) can not be affected by the cruel  barbarity that's been allowed to happen.

 

I just hope the prosecution hasn't spared any of the details. I hope there are  plenty of pictures and videos for the jury to see.

 

And I  hope Gosnell gets  punished to the fullest extent of the law.

I always go back to the same question:   If the babies were not alive, what was the     reason    to     sever    their spinal cords?       What, did Gosnell and his merry band of ghoulish    staffers    just want to be REALLY SURE those babies weren't going to get up and    walk to the bus    stop,   so they killed them again?   Is that what I'm supposed to believe?   Did they    have to MAKE SURE the babies were dead and couldn't spontaneously regenerate like Doctor Who?  

 

Whatever the verdicts   in this case, I'm sure I'll rage stroke at least once.   Probably multiple times.

I'm thinking you make up your mind early to consider the many small counts as a block and then consider each of the murder counts separately. That's the outcome I think we'll get: guilty on a bunch of small counts, hung jury on the murder counts.

I've noted this before, but spine severing (and/or cervical dislocation) is a common "assurance of death" approach to animals in animal research (especially mice and rats).

Since we don't exactly break out EKGs and PulseOx machines, with some of our common methods we're not 100% sure we've actually killed the animal (rather than just reducing it's respiration down to unperceptible levels), so we pop their necks.

To be honest, this is likely where Gosnell got the idea for it.  But you're right it does point to the idea that he wasn't actually sure they had died which by itself is pretty damned disturbing.

Well I'm not a lawyer, I'm a scientist turned bioethicist.

But I'll say this much.  This is the sticky wicket about the moronic nature of these laws. IF the baby did in fact die in utero, than it seems to me that under the law he performed an "illegal 3rd trimester abortion." If the baby was born (i.e. came out), then it's infanticide.

It's a boundary that makes 0 sense philosophically, or legally IMHO. (Well not so humble on the former.)
But that's the dividing line we're stuck with in this post Roe world.

When I'd "euthanize" mice, I had 0 evidence that they were still alive.  In fact I had lots of evidence to the contrary.  And I don't think I ever had a single mouse come back.  The jury may be making that argument behind closed doors ("well they were more likely than not dead prior to being born.").  Now in my world that's still f'ing murder, just at a prior time point (before the snipping.)  But apparently not in Philly.

What is the penalty I wonder for illegal 3rd trimester abortion? It seems to me you can't find "not guilty" on both the murder or the 3rd trimester thing (outside of pure nullification) it's either A or B in this case.

Obammy making this statement means one of two things:


A) If it's not true  (it's not)    then it means he just flat out lied to the MFM and the American people (all six who bothered to tune in).  

 

OR

B) If it's true (it's not, but if it is)    then it means he has    absolutely zero interaction with or knowledge of the workings of his administration.   In that case, he   is   almost criminally incompetent and grossly derelict in his duty.  

 

Either one of these should be    cause for serious   castigation in the MFM.      But the MFM is not serious, so there will be no castigation whatsoever.

I didn't find anything out of the ordinary in the basement, either. Window is now closed, fixed with wood screws to prevent it being opened again, ditto the external screen.

During the FNC show I prayed for all who had been witness in that courtroom. I can't imagine how you erase that testimony.

Came down to ethic punk v a'hole cop after a sports game. We split the charges, but kinda wish we'd applied a little more burden of proof and said not guilty on both. Something happened, we couldn't be sure what. Word of a cop still better be believable. And it wasn't even a big crime, but someone's fate was in our hands. Good lesson that even the best trying their best can only judge humanly. But we must.

Birds of a feather flock together, and the monied elite gather at such spots and keep them afloat. It can only last so long. Even SF is developing some cracks. If it ever looses its status as a destination for tourists, I suspect it will sink. If my favorite Aunt didn't live there, I'd never go to San Francisco. What a cesspool. Tried to take a quick walk in Golden Gate Park one day and had fanooks waving their damned dicks at me. Turns out it's a gay pickup haven. Well, so is the whole damn city. Was glad I had my Aunt's rather large dog with me. And the legions of filthy homeless crack addicts in the train station, the ridiculous public nudity/exhibitionism of the Castro... It amazes me that anyone would go there for a family vacation.
