Right or Privilege?

A reminder of the mindset we're dealing with on guns appears below the fold.

We laughed at that. He's serious ... and representative of a sizable swath of the left.

24 John Bad Elk v. United States - 177 U.S. 529 (1900)

Three policemen in South Dakota attempted, under verbal orders, to arrest another policeman for an alleged violation of law when no charge had been formally made against him and no warrant had issued for his arrest. Those attempting to make the arrest carried arms, and when he refused to go, they tried to oblige him to do so by force. He fired and killed one of them. He was arrested, tried for murder, and convicted.

However, the Supreme Court ruled that Bad Elk had the right to use any force, including lethal force, to prevent his false arrest, even if the policeman was only trying to arrest him and not kill him. Basically, the Supremes of the day ruled that as a citizen, you have the right to defend against your civil rights being violated using ANY force necessary to prevent the violation, even if the offending party isn't trying to kill you.

Of course, modern law enforcement organizations would most likely kill you if you try this, so don't try this at home.

Yeah.  And it's on purpose.  If the government can "grant" a right (instead of a privilege), then they can take away any right.

In essence, the Leftists have very purposefully conflated the words "right" and "privilege" in the language.

49 We have right on our side--you simply do not nullify a provision of the Bill of Rights, you simply do not change the makeup of a population for your petty political gain. I would hope the only way this would be possible would be at the point of a bayonet. If Americans still have the blood of their forefathers runnng through their veins, that is. The blood that was shed at Lexington and Concord, Shiloh and Gettysburg, Belleau Wood and Omaha Beach, Khe San and Tora Bora. The blood of liberty, the blood of individuals acting together, not a collective ordering individuals. Each will have to make his own decision when enough has become enough. I have made mine, though that point has not yet been reached, and a critical mass of the populace is not yet even engaged in the conversation. But the Democratic Party and evety last one of their supporters can go to blazes. America will remain as it was, in spirit, and they can take their grand dreams and go hang. I have no doubts they will attempt to make sure those like I do, instead.

They aren't "simply" doing it.  They've been working toward this for 90 years or more.

That said, it is to their own peril that they buy into their own propaganda.  The Bill of Rights does not grant a right- it secures them.  Those rights exist anyway, and regardless of what anyone thinks on the matter.  The only question is how the Government attempts to secure, circumvent, or infringe on those rights.

You can tell me I can't have a gun all you want.

If your goal is power, then yes, you do whatever is necessary to gain it,  even if it means directly violating the  law.

This is what we're dealing with: naked aggression by the Left. They will stop at nothing to achieve their goals, the citizenry and laws be damned. Their  ends justifies their means. They are in control now, having so distorted the truth and the language for generations, that we have little hope of  setting things right peaceably. These people are the  political equivalent of the Terminator: they  don't  feel pity or remorse, they cannot be reasoned with,   they do not respect reality and the absolutely will not stop until we are  dead.

122 Fordo said to be crippled by 'blast' Despite staunch denials by Iran, new details regarding explosion in nuclear site depict moments of detonation as allegedly captured by CCTV Ynet Published: 01.29.13, 13:49 / Israel News Despite vehement denials by Iran, new details emerged Tuesday regarding the alleged blast in the Fordo nuclear website. The website reported Saturday that Fordo, which is considered to be Iran's second-largest uranium enrichment facility, has suffered a massive explosion, which has razed a significant part of it, trapping over 200 people underground. Related Stories: Report: Israeli officials 'confirm' blast in Fordo US 'does not believe' reports on blast at Iran nuke plant Iran exposed spying device at Fordo nuke plant The credibility of the report has been questioned mostly due to the fact that the Qom-adjacent facility has been carved into a mountain and as such it is believed to be virtually unassailable by neither air strikes nor bunker-buster bombs. According to a Tuesday report by WND, the Revolutionary Guard has set up a 15km security zone around the site, cordoning it off completely.

This is why we cannot have a conversation about gun control.

We are speaking different languages.

It's deeper than that. What we're dealing with is  form of mental illness. What else   explains the lock-step thinking? The unity of purpose to deny the  truth, to distort the language, to twist the law, to ignore principle  and to enslave others?  These are all symptoms of the disease of  wanting  control  over others. It is nurtured by the ego and must find a way of expressing  itself. It is the Core Human Fault,  from which all other faults flow.

The Founders understood this disease far better than this mewling  quim,  and wrote the Constitution the way they did to try to stop precisely the type of government, and the people  who currently infest it,  that   we see today in Washington. The enemies of freedom knew that they couldn't overthrow our government from the outside, so they did it from within, over  the course of  generations, in full view.

The one this morning, or one of the previous ones?  It's kind of been a topic lately.

That said: I don't think I can convince Liberals via a blog.  For one thing, I don't have the readership.  I probably have about 30 - 50 regular readers (I post multiple times a day, so each one might hit the site more than once per day).

What I'm hoping to do is give conservatives enough of an edge in their own conversations.

197 Rep. Marsha Blackburn, R-Tennessee, joined a chorus of skeptics who questioned President Barack Obama's recent comments about his hobby of skeet shooting, a sport where participants fire shotguns to break airborne clay disks.

"If he is a skeet shooter, why have we not heard of this? Why have we not seen photos? Why hasn't he referenced this at any point in time?" Blackburn said Monday on CNN's "Erin Burnett OutFront."

"I tell you what I do think," she later added. "I think he should invite me to Camp David, and I'll go skeet shooting with him and I bet I'll beat him."

They're not infringing on your rights they're merely regulating certain privileges incidental to the rights.

Expect that to be the call.

Remember: This country would have thought it stupid and tyrannical if someone had proposed requiring licenses to drive a horse and carriage.

And yet, we allow all sort of restrictions on our right to free movement because it's an automobile. Restrictions that amount to completely eliminating the right.

Same thing here, they're pushing this line of attack.

There's a lot of fucking people who need to be hung 'cause I'm getting damned sick and tired of everyone telling me what I can and can't do merely because they've assigned themselves the role of "smarter and better than you."

OT -

I just found out I've been paying for Netflix for the past year, without the benefit of watching anything.

Apparently, when I purchased a new tv a year ago for the bedroom it was "smart" tv (I bought it because it had a good picture and was the right size for the cabinet).  At some point in the sale, I must have agreed to include a subscription to Netflix, although I don't remember ever being asked.

I guess I'll try it for a month or two while actually watching something on it.  If you're out buying a new tv, pay more attention to the details than I did.

"We believe that insurance companies are making it increasingly difficult to practice patient-centered medicine," the doctors in the practice wrote to patients this month. You know, I think IÂ’m really late to this party, and this is a bit of a rant, but I want to confess.

Four years ago (and in some cases, longer) some very alarmist voices started popping up here. I never dreamed they were anything more than tin-foil types. I mean, martial law? Repealing the 22nd? Confiscating guns? Please. That shit just doesnÂ’t happen in the States.

Yet here we are, in 2013, actively discussing amongst ourselves whether or not we are actually willing to die on this hill. Not in some romantic metaphorical sense, but in a stone-cold literal one. ThatÂ’s scary.

WhatÂ’s scarier is that those alarmist voices donÂ’t sound alarmist anymore. They sound practical. It can be easily argued, through well-supported empirical and tangible facts that ObamaÂ’s entire Presidency has been leading to this: the disarming and enslaving of the populace.

The media has become an arm of the government in a sense never before seen. Bias we’ve seen. Advocacy and collusion we haven’t – not on this scale.

The takers have overpowered the makers in terms of voting demographics and planted our economy into what is – in my eyes – an unrecoverable spin.

The government has begun making all the moves one would expect if they were to declare themselves above the people. They are positioned to declare us their subjects, and half of the country is screaming in ecstasy. The other half is marveling at how easily itÂ’s happened, mourning the Republic, and quietly preparing for what looks more and more likely to be the inevitable showdown.

When I swore my oath, I always knew it was possible for me to die defending my country. I just never imagined it was possible for me to die defending it from my government.

And so to the question: Is this a hill IÂ’m willing to die on? Is this a hill on which IÂ’m willing to spill my blood in the literal sense of the word? When the metal meets the meat, am I prepared to give my live protecting my country from itself?

Yes.

I hear net neutrality and I think of govt forcing ISP's to provide equal bandwidth and service to all sites. Then I think of an ISP wanting to provide special service with additional pricing, and offering it to customers as a choice.

Here is the "logic" (if you want to call it that) of "Net Neutrality."  Because Internet Service is not regulated highly enough by the government, some ISPs might decide to throttle bandwidth for certain classes of customers, or certain specific websites.

For instance: small businesses might "only" be allowed so-much throughput, causing their site to run slow or crash if they get slammed, but bigger businesses could afford a better plan. (So, like it is today, when you think about it).

2nd For instance: Time Warner (closely affiliated with ESPN) could throttle traffic to MSN Sports (aka Fox Sports), thereby causing that site to load slowly for customers. (As far as I know, no one is doing this today.  Further, it would actually be fairly problematical to start doing for both technical and "diplomatic" reasons).

The Net Neutrality crowd- believing that Internet access is (or at least should be) a "Right" has declared this operation of the Capitalist system to be "unfair."  Therefore the Government should assume more control and tell ISPs what they can charge, and force them to give "equal" bandwidth to everyone.

Never mind that, for instance, Amazon.com takes in a whole lot more traffic than, say, The Ace of Spades Headquarters.

Ok here's my one squish caveat.

The ISPs DID take fed money to expand to hard to reach areas. Therefore they've essentially been given oligarchy status by the govt. So if they start squelching freedom of information blatantly, I wouldn't categorically say no to regulation. Maybe a breakup of the telcos again, and end subsidies.

But for now, there is no smoke, much less fire.

What exists now under "smart meter" and what the govt wants that to become are 2 different things.

The Unified Smart Grid Tree Boy pushes for coupled with the necessary reduction in generating capacity will in fact lead to targeted rolling brown outs Vic, and since it is GOVERNMENT! based systems engineering I'd bet unplanned blackouts become a way of life if ever enacted.

They never strive for anything sensible and small no if we need CHANGE! let's make sure we strive to make it "as big as Ike's superhighways were in changing things!"

The Net Neutrality Bill was another attempt at Crony Corruption by the Democrats  for people like Net Flix and other "movie providers".  They wanted the government to force the internet providers to give them access at the same cost as small service providers while they were using 100 times the bandwidth and driving up infrastructure costs.

Posted by: Vic at January 29, 2013 06:11 AM (53z96)

277 BTW- anyone who hears "net neutrality" and says, "Yeah, that's a good idea!": these are your allies. Are they? This topic is always slightly confusing to me. I can't tell who the real "small govt" folks are. I hear net neutrality and I think of govt forcing ISP's to provide equal bandwidth and service to all sites. Then I think of an ISP wanting to provide special service with additional pricing, and offering it to customers as a choice. It's all very cloudy to me. Posted by: EC at January 29, 2013 10:01 AM (GQ8sn) It's even murkier than that. There are two different topics that both use net neutrality. One version is forcing ISPs to provide equal bandwidth and to prevent tiered servicing. The second refers to attempts to make the FCC require equal time for political views on internet sites. The same term is thrown about for both things and they may be interrelated but do not have to be. I'll admit that whenever the net neutrality debates start up I just tune out because it is extraordinarily rare for anyone to define what they mean by that term at the start of the debate.

I don't think that's totally true. I think it's more about the speed of packets. Large companies already pay per GB.

It's packet speed they wanted to be able to control. So ISP A might let Netflix packets through faster compared to ISP B for a little extra money.

There are zero electric meters now that can shut off power to your house via remote control. Some utilities experimented a few years ago with boxes to be installed IN your house that would allow them to shut off your A/C or hot water heater in return for discounted bills.

But if I am not mistaken even those have been discontinued because they were not able to make much difference in the load.

For almost ALL of the country individual home use does not constitute a large portion of the grid.  Most of the power is being used by industrial and commercial businesses.

If you want proof just go out and look at a meter that is "wireless" and look for a large (100 amp or greater) breaker controlled by that wireless device.  You will not find one.

297 There it is in living color and in a nutshell; a highly educated and successful lawyer and politician who is hopelessly ignorant of the difference between a right and privilege.

At the most basic level, the difference is that a right comes from God and inures to all persons. They are, as Jefferson proclaimed, inalienable.  Rights are the legal power to have another to act in a particular way or, as is the case with the rights enumerated in the Bill of Rights, to bar another from acting in a way toward you.

Privileges, in contrast, are created by the State and so are subject to removal by the state at its option/whim.

Thus, as Justice OW Holmes once famously pointed out in brooming some whiner out of his court,  there is a right to free speech but there is no right to be employed as a policeman as government employment is a privilege.

Similarly, no one has any "right" to the labor of another which is why health care can simply never qualify as a "right".  It is a commodity. A service, maybe a privilege. But it cannot ever be a right, because to deem it such would necessarily force an unwilling provider into involuntary servitude.

If health care or internet access are "rights" that government is obligated to provide, then how come I have to pay for them?  And what about cable TV is that a right too?  With the deluxe HBO package.  And the Playboy Channel too.

Just as bad is Edwards' muddled thinking about citizenship being a "right". What Edwards is really saying is that simply by operation of the passage of time an illegal act (entering the country in violation of the law) can be transformed into a legal "right" .

God help us.  We are doomed.

The general public routinely scores poorly. You know who scores even worse? Politicians. I couldn't believe it when I first read some results a few years ago, but it seems to be the norm. And then we see asshats and frauds like Edwards and we have to think, "How could the results be otherwise?" I mean the idiot missed every single question. How is that possible? Statistically he should've stumbled over one correct answer by accident.

That, my good man, is who writes the laws which will control us: people who are both a) dumber and b) more dishonest than the average citizen.

The JEF has the Army in Houston practicing suppression of the citizens.  Check out The Blaze.  Army has no notice exercise in neighborhoods of southeast Houston, running around the neighborhoods and frightening the citzenry.  Anybody think its an accident this is happening in Texas?  I don't.

Utilities already have the capability to do rolling blackouts by area, but not by individual homes.

325 That, my good man, is who writes the laws which will control us: people who are both a) dumber and b) more dishonest than the average citizen. --- Dumber depends on the politician. Edwards is certainly far more dishonest than the average politician, let alone citizen, so I figure a lot of his crap is just populist rhetoric that he figures he can ride to easy street.

Posted by: Empire of Jeff at January 29, 2013 10:16 AM (eKiiX) Which is why I say the term net neutrality is murky. There are those who use net neutrality to refer to bandwidth throttling mentioned above. There are those who use it to mean preventing ISPs from bandwidth throttling of sites containing political speech. The same term is used by different people for different things.

328 Our task is to prevent the 'completely' part of the description. Personally I see it as making it possible to recover and rejoin the ranks of functional, relatively sane societies, instead of becoming some Third World hellhole, or even worse, France.

The only thing I can find is this:

"I want to ensure constituent companies like Netflix continue to grow and are not hindered by discriminatory data caps or other tactics that deny consumers the freedom and flexibility to stream video content whenever and wherever they want," the Silicon Valley lawmaker said.

But no such bill actually exists, as the FCC net neutrality rules I think still stand.

332 336 Vic,

Of course they do, they are not yet in the position of needing to do so as baseline part of the system engineering design.

This is the Goreons trying to be too cute by half and "demanding production meet real demand."

Well forgive me for suspecting that the end result when they are mandating things like 33%-50% "renewable energy" in their Fapping is that what they mean is "demand will fall to meet production."

I am not in love with that market dynamic ever, and am even less in love with it when it is being done in the service of some half-baked barking moonbat Gaia religion's Book of Revelations equivalent fantasy.

333 TFG and his minions can't simply declare the Constitution null and void; but rallying 34 states to call for an Article V convention for the FSA wish-list is out of reach as well.

I'm wondering if they get "conservatives" to do the dirty work: call a convention for something we want, like a balanced budget amendment, etc. Then hijack the convention with "socio-economic rights" amendments. Once the convention is called, the floor is open.

Exactly their point.  "Net Neutrality" is a prime example of an Orwellian Term.  They want laws that prevent ISPs from creating "discriminatory data caps."

Never mind that no ISP has done so.  Never mind that ISPs charge for basically two things (both summarized as "bandwidth"): amount of data moved, and the speed with which the bytes move.  Never mind that it only makes sense that, say Netflix, would pay more based on pricing structures that existed (though perhaps not with the specific numbers they do now) prior to Netflix ever delivering a single movie via the web.

The point isn't "access to information" or to "prevent censorship."  The point is to give the Government more control.

That was from reading the Net Neutrality act of 2006 and the comments at the internet related sites who were opposed to it.  They advertised it as one thing but once you delved into you could see what the bill actually did.

You would have to go back and find articles from 2006-2007 time frame.  And do not believe ANYTHING on Wiki that is politically related.

340 340 Brother Cavil,

You gotta figure the best we may be able to get is to try to get our people with degrees to create an underground school of economic and legal thought akin to the Chicago School and the Original intent crowd.  Endure the shitstorm and try to create pockets of non insane stability to reeducate the people in what can and cannot work indexed to liberty.  The problem comes with people expecting 22 minute fixes now thanks to TV.

Maybe try to find an old UHF studio somewhere and rebroadcast pirate style after the implosion?

344 The second is part of the Net Neutrality crowd's fear-mongering to get NN passed. See, without Daddy Government watching them, those big mean ISPs might shut down your blog, or sell you bandwidth at such a high price that you can never host more than a few dozen visitors at once. ---------------- Remember when they called the internet the digital wild west? Good times.
