Senate Hearings on IRS Scandal
— Ace

Livestream.

The Democrats only want to discuss whether the 501(c)4 rules should be tightened, that is, they don't want to talk about politically targeting at all. They are coming very, very close to flat-out justifying Obama's IRS' actions.

Some small news: Steve Miller now admits the question asked of Lori Lerner was planted, walking back his previous ambiguity.

The author of the IG Report notes that the IRS staffers who denied a political motivation in their targeting did so not under oath.

Not under oath? There's almost no point in asking questions, then.

Not surprising, that's been the spin almost from day one.  It's a standard "blame the victim" strategy.

6 Ace, fact that question was planted not new. That came out with Miller's last testimony. What's new is that planting the question was Miller's idea. Funny this is his idea of getting out ahead of story. Letter to Congress? Not so much.

7 The Dems think IRS harassment is both hunky and dory. Hell, there were members of the CBC who were URGING the IRS to target the tea parties. They see government tyranny as a feature rather than a bug.

14 Blame the victim-  see, it's not that the IRS was targeting Conservative groups; rather it was so blindingly obvious that Conservative groups didn't deserve 501(c)4 (or 3) status, and therefore had to have been hiding something.

They are coming very, very close to flat-out justifying Obama's IRS' actions.

Of course!   That's what they want to do.

"It was the    fault of the organizations to be seeking tax exempt status as a 501(c)(4)   in the first place.    As overt political organizations, they shouldn't have been doing so!  The IRS was simply exercising     proper    oversight!"

No mention given to the scads of progressive orgs that were passed in that same time period.   No mention given to      orgs already in operation that    are 501(c)(4)s.      No    mention of the timing of this IRS scrutiny, nor the     crass political leanings of the Treasury union whose    members   took part   in the stonewalling and harassment.

My hate is so strong, it burns.

27 Via Druge, the Leadership Institute was audited, with demands for the names of anyone who even APPLIED for an internship in 2008.  The IRS also attempted to grab the training manuals for interns. They wanted everything that had to do with 2008.

But this isn't political.

That is not too much of an issue anymore since they made it a felony to lie to a federal officer or congress.  The only thing the oath does it make it perjury which has a stiffer punishment,.

53 Brown (D) pins the problem as a definition of a 501 organization. Doesn't bother to address what happened. Provides Miller cover.

I think it's safe to say that's all the Democrats will be doing.  It's not the IRS's fault, it's the Tea Party's fault (for being there to be targeted), it's sequester's fault (never mind that this started back in 2010), it's the law's fault (to which their answer is to make the law yet more confusing).

If the Democrats admit that the IRS was actively in the wrong on this, then the investigation will creep up, and eventually it will land on TFG's desk.

It's like why they won't answer the question of where SCOAMT was when the Benghazi attack was occurring.  There is no answer good enough- either he was present (that is: in the Situation Room or otherwise connected real-time to events), in which case he ordered the Stand Down (or it was ordered on his behalf and he did not object), or he was *not* present, and was therefore derelict in his duty.  Neither of those are good options, so they simply refuse to pick one.

Did you know that it is a crime to tell a lie to the federal government? Even if your lie is oral and not under oath? Even if you have received no warnings of any kind? Even if you are not trying to cheat the government out of money? Even if the government is not actually misled by your falsehood? Well it is.

Title 18, United States Code, Section 1001 makes it a crime to: 1) knowingly and willfully; 2) make any materially false, fictitious or fraudulent statement or representation; 3) in any matter within the jurisdiction of the executive, legislative or judicial branch of the United States.

Do not include cash welfare, kickbacks, federal grants, paychecks from state or federal government entities (except military branches). Line 2: Copy amount on Line 1. 161 Actual text of 18USC1001 - it is very odd

18 U.S.C. § 1001 : US Code - Section 1001: Statements or entries generally

(a) Except as otherwise provided in this section, whoever, in any matter within the jurisdiction of the executive, legislative, or judicial branch of the Government of the United States, knowingly and willfully -

(1) falsifies, conceals, or covers up by any trick, scheme, or device a material fact;

(2) makes any materially false, fictitious, or fraudulent statement or representation; or

(3) makes or uses any false writing or document knowing the same to contain any materially false, fictitious, or fraudulent statement or entry;
shall be fined under this title, imprisoned not more than 5 years or, if the offense involves international or domestic terrorism (as defined in section 2331), imprisoned not more than 8 years, or both.

(b) Subsection (a) does not apply to a party to a judicial proceeding, or that party's counsel, for statements, representations, writings or documents submitted by such party or counsel to a judge or magistrate in that proceeding.

(c) With respect to any matter within the jurisdiction of the legislative branch, subsection (a) shall apply only to -

(1) administrative matters, including a claim for payment, a matter related to the procurement of property or services, personnel or employment practices, or support services, or a document required by law, rule, or regulation to be submitted to the Congress or any office or officer within the legislative branch; or

(2) any investigation or review, conducted pursuant to the authority of any committee, subcommittee, commission or office of the Congress, consistent with applicable rules of the House or Senate.

What it boils down to is it is a felony to lie to any government official except a judge or the court (if you are not sworn in)

It is a felony to lie to congress.

If convicted of same it is 5 years in jail which I think is the same as for perjury.  Unless the lie involves terrorism and then it is 8 years in jail.

LOOK OUT HILLARY Benghazi was terrorism. Is that why they maintain it was a spontaneous riot over the film?

The whole Emergency Broadcast System is a joke.  I never heard from it on 9/11, and I think that qualified as an 'emergency'.

180 The problem isn't just that they targeted conservative groups, they also demanded grossly intrusive information.

182 Portman pushing for a time line as to when Miller knew. Did Miller really just pull an Obama? "I read things in the Newspapers"

183 Miller is at least tacitly complicit in the whole deal...

Posted by: Mike Hammer at May 21, 2013 08:09 AM (aDwsi)

184 "We gave people more time" to fill out our over bearing, intrusive, wildly inappropriate questions. Oh that makes it all better.

188 It's so absurd to listen to this guy...'someone should have known', but he has no idea who should have known, who knew, who started this, etc.  It's fucking insane.

193 Clear there is an absolute need for not only an IG "investigation" but a special prosecutor as well.  I have no faith that even the Treasury IG is ruthless enough to prosecute and follow the trail, up and down the chain.

194 That PJ story is a regime-ender if true.

The US directly arming AQ?  Yea that could be troublesome...maybe.  We've said we didn't negotiate with terrorists. Nobody ever explicitly disclaimed gifting weapons to them though.

Expecting that you'll be able to buy your gifted weapons back from the terrorists is pretty optimistic and naive.  That such a mindset could exist is a scandal in itself

Still, it sounds far too good to be true.  A scandal that kneecaps Obama very badly (assuming he continues with his Sgt.Schultz imitation) and removes Hillary from the political landscape forever at the same time?

I gotta see this to believe it.

195 If the White House gives five different versions of their story, is that at least four lying charges?

196 So why hasn't anyone asked the Dems in this meeting "If this wasn't political, how come 'democratic' or 'progressive' or 'green' weren't among the set of key words used by the IRS agents?"

199 don't forget, the Dems almost officially believe that the Tea Party is just a front for the Koch Brothers and other reactionary right wing billionaires, so the IRS wasn't really going after tea party groups, the IRS was just trying to keep big money types from buying/stealing the election.

WASHINGTON (AP) — The man who led the Internal Revenue Service when it was giving extra scrutiny to tea party and other conservative groups seeking tax-exempt status told Congress on Tuesday that he knew little about what was happening while he was still commissioner.

Douglas Shulman, who vacated his position last November when his five-year term expired, told the Senate Finance Committee he didn't learn all the facts until he read last week's report by a Treasury inspector general confirming the targeting strategy.

In his first public remarks since the story broke, Shulman said: "I agree this is an issue that when someone spotted it, they should have brought it up the chain. And they didn't. I don't know why."

How much was this guy paid to have absolutely no knowledge of what was going on?

201 "the IRS was just trying to keep big money types from buying/stealing the election."

Yes.  That is correct.

I would not be quick to assume that were the people being questioned put under oath that they wouldn't lie anyway.

If you can't be nice to your fellow commenters on a conservative blog site, are you nice to anyone?

206 In a federal criminal investigation, investigators do not generally put witnesses "under oath" during interviews.  That occurs when the US Attorney's Office put a witness in front of a grand jury.  There is a mechanism to put a witness statement in affidavit form, which constitutes a sworn statement, but in more complex investigations, it is very cumbersome.

207 So Obama is not the legitimately elected President of the United States.  Interesting.
