Senate Votes To Try And Distract America From The Pain Democrats Are Inflicting On America Through ObamaCare
— DrewM

I kind of jumped the gun earlier on the nuclear option. There was some more parliamentary wrangling to be done before the actual vote.

The Senate has now voted to allow cloture to be invoked on judicial nominees below the Supreme Court level (district and circuit courts).

The final vote was 48 yes, 52 no. That means 3 Democrats (Levin of Michigan who is retiring, Manchin of West Virginia who is...just an odd ball and Pryor of Arkansas who is up for reelection next year) voted with the GOP.

Based on the way the question was worded, Should the ruling of the Chair (that you can't end a filibuster with only 51 votes) be upheld, the Democrats voted "no" and invoked the so-called "nuclear option".

This is about a couple of things:

1. Packing the DC Circuit Court of Appeals. This court is important because most challenges to federal regulations go through that court. A small number of those cases may make it to the Supreme Court but generally, it's the last word on a lot of federal business.

2. Changing the subject for a couple of days away from the damage ObamaCare is doing to America. In addition to getting a lot of coverage today, it will lead to GOP retaliation (procedual efforts to slow the Senate down even more) that will let the DNC's media wing to do a lot of "DC is broken and the Republicans are to blame" process stories.

If you missed it earlier, read Mitch McConnell's speech on this. He framed it perfectly, it's about ObamaCare. EVERYTHING is about ObamaCare.

Best line:

“Think about it: The Majority Leader promised over and over again that he wouldn’t break the rules of the Senate in order to change them. On July 14 he went on ‘Meet the Press’ and he said: ‘We’re not touching judges.’

“He may as well just have said ‘If you like the rules of the Senate you can keep them.’

3. The hypocrisy of both parties. The GOP thought about doing this in 2005 when Democrats filibustered a bunch of Bush judicial picks. Democrats thought the filibuster was the best thing ever back then. This stuff often depends on which side you are on in a given moment.

Note that the GOP didn't go though with the nuclear option in 05. Why? Because a bunch of GOP Senators sold out the rest of the party and Bush. Funny how the Democrats never form a 'gang' to screw over their own party. Huh.

Are you mad, bro?

None of this will fix 'the website' or make the pain of ObamaCare go away. It's a short term hit for Democrats and their base. It won't affect the long term ObamaCare problems and it will open a whole new can of worms when the GOP has the majority.

Even if Reid gets 100% of his goal, the solution to this is....don't file must-win Federal cases in DC.  Pick another Circuit.

This will be hilarious when the Republicans start doing actual in-person filibusters of these judicial nominations.  They did not change the Senate rules that allow unlimited debate by any Senator.

Republicans can also start denying unanimous consent and ask for a roll call vote on every vote, and demand that every bill be read in its entirety.  They can gum up the Senate pretty much indefinitely.

They're not though.  In theory, SCOTUS can inject itself in at any level in the Federal courts as it pleases and decide to hear a case.  Within DC itself, it can even choose to hear a DUI or jaywalking case if it wanted.

If you can get a SCOTUS that understands the gravity of the situation, it can preempt a lot of this regulatory chicanery

Only 371 Kansans have signed up for medical coverage through health-care.gov — and there’s considerable doubt that the Web site will be glitch-free by the White House’s Nov. 30 deadline.

214 How is this a pass when 48 voted YES and 52 voted NO? Okay, people keep asking this question, but it’s in the post. 1. The ruling of the Chair was that you cannot end a filibuster with only 51 votes. 2. The vote was, should this ruling be upheld. 3. Since the “no” votes won, the ruling was not upheld. 4. Thus, the Senate has voted that you can end a filibuster with only 51 votes.

Things that people buy that don't make them healthier: Houses, education, cars, computers, any form of entertainment. Basically anything that separates us from subsistence farmers. How's that for a campaign message? We want you all to be agrarian subsistence farmers who homespin your clothes.

280 Lifetime judicial appts were from a time that the judiciary was, by far, the weakest of the 3 branches. In many ways today it is the strongest. Lifetime judicial appts are now a source of evil and corruption.

#260 It applies to Executive Branch nominations too.  Obama's about to announce a radical NAACP lawyer to head the DOJ Civil Rights Division.  And if Sebelius and/or Holder actually end up resigning in the face of all the Obamacare/DOJ scandals, their successors now cannot be filibustered.

I believe this is what the goal is.  Reid brought up the two DC Circuit nominations as bait to draw a filibuster so he could do this.  But it's really about the executive branch nominations that are coming and may be coming soon.

I think we will see Sebelius resigning in the next few days.  The only reason she hasn't yet is that the White House feared a bruising confirmation battle and possible filibuster.

294 271 267 If the GOP Senate wanted to keep the filibuster rule, could they not have filibustered this vote?

---

Senate rules are set by a majority vote IIRC.

Posted by: Brandon In Baton Rouge at November 21, 2013 01:27 PM (/Crba)

Actually, current Senate rules allow a change in those rules only with 67 votes.  This is why Reid did it this way today.  It was a "ruling of the chair" that was appealed and then voted on.

So, not only did they kill the filibuster, they violated existing senate rules to do it. That is why they called it a "nuclear option" - not because it nukes the filibuster but because it nukes Senate rules in order to do away with the filibuster.

295 life expectancy for an already middle-aged guy was still pretty high back then. Life expectancy 200 years ago was much shorter because of the much higher odds of dying in infancy or childhood. Ben Franklin wasn't a freak of nature. It wasn't crazy that people live into their 70s -- especially if they'd already made it into middle-age.

I'm on the Move-On email list, and it's been deliciously hilarious; today, especially so: In addition to "just a website glitch", evil repubs, and the media "not covering the good stuff"; today, they ask their legion lunatics, "Not sure if Obamacare's helped you already?"

And, of course, they're still begging for 'success stories'  SHWING!

I used to read A. J. Strata's website (The Stratasphere) almost daily until he went along with the "The Coalition of the Chillin'" - McCain and Co. He really didn't like my comments about this "deal." (His is probably the only website I left voluntarily before banning.)

Anyways, I'm wondering what he's thinking now. Along with all of the other "conservative bloggers" that jumped on "The Coalition of the Chillin'" bandwagon.

Anybody remember any of those bloggers? There were some pretty big ones. Was Poppin' Fresh also a member? (I think he was).

Think they feel like dupes today? I have a funny feeling they have an excuse for why it was a horrible idea back then but no big deal now.

I knew this was coming eventually, but would anybody listen back then? The "smart" ones didn't.

299 these are typically lifetime appointments

they don't change every time there is an election

Yeah, beginning to doubt the wisdom of that.

Ten year terms. One only.

If you do 18 year terms, you get two appointments per presidential term.  Works out nicely.

Ten year terms comes out to about 1 new justice every year, which means that a two-term president would be able to appoint an eight-justice majority.  Bad news.

300 ...and it will open a whole new can of worms when the GOP has the majority. I'd be inclined to say that it MAY open a whole new can of worms when the GOP has the majority. I'm not sure the Republican "leadership" has demonstrated that it has the balls to attempt to steamroll their opposition like the Democrats do.

301 Hey, don't forget Obama was telling donors a week or so ago that he was going to reshape the courts. Obama can't get his nominations through because of their ideologies. He is nominating people from the militant activist class of the Democrat party. We will be getting OWS judges and just anlittle closer to the full Chavez.

309 Drew: "This is about a couple of things: 1. Packing the DC Circuit Court of Appeals. This court is important because most challenges to federal regulations go through that court. A small number of those cases may make it to the Supreme Court but generally, it's the last word on a lot of federal business." Give Drew a cookie, Uncle Ace. He cut to the point -- the LEFT's point, BTW. Leave aside whether filling EXISTING VACANCIES qualifies as "packing" [which it clearly does not; "packing" is like where FDR tried to expand the raw number of positions in the SCOTUS], Drew gets this completely correct: THE REASON the DC Court is so important -- and by far the most important CCA in the nation -- is that 1) it, and it alone, has original and first appeal court jurisdiction over the POLICIES of the administration of the day, and 2) to a lesser, but still significant, extent, it's the single 'go-to' court for elevation to the SCOTUS. All of which explains the Big Lie that rural nitwit Grassley is leading about "packing", and on the larger level why the Filibuster Rule is being killed NOW, as opposed to when and if the day comes when Republicans control both the White House and the Senate (a day that is, admittedly, increasingly unlikely to arise over the next quarter century).
