— Ace One of the most contested points in the trial is who was heard screaming that night, Zimmerman or Martin. Trayvon's family says it was Trayvon; Zimmerman's family says it was Zimmerman. But Zimmerman has called eight witnesses saying it's his voice.
Angela Corey is in the courtroom. She looks like she's been hit by a bus. #Zimmerman
— Bob Owens (@bob_owens) July 8, 2013
The defense called a veteran, Joe Donnelly, a friend of Zimmerman's, to testify that it was his friend's voice screaming on the call. He's further asserting that his experience in combat -- he was a combat medic during the Tet Offensive in Vietnam -- make him qualified to know what a man in pain and fear for his life sounds like.
[Updated at 11:35 a.m. ET]O'Mara [defense lawyer] asked Donnelly to describe his experience as a combat medic in Vietnam. [Bernie] De La Rionda [prosecutor, often called "BLDR" in tweets and short dispatches] objected as to the relevance of the question, and now the attorneys are at a sidebar with the judge.
[Updated at 11:40 a.m ET]
Donnelly is talking about his experience with his company of soldiers in Vietnam.
[Updated at 11:43 a.m. ET]
O'Mara is asking Donnelly about his duties as a medic in combat. Donnelly said he had to attend to people injured in combat, and appeared to be choking back tears. The attorneys are now at a sidebar with the judge.
[Updated at 11:47 a.m. ET]
"In the midst of combating, there are a lot people yelling and screaming," said Donnelly. "Sometimes they are screaming for help."
[Updated at 11:49 a.m. ET]
Appearing to choke back tears, Donnelly said he did not want to listen to the 911 call with the screams in the background, because it can be "distressing" to hear a friend cry for help. O'Mara is now playing the 911 call with the screams in the background for Donnelly.
[Updated at 11:52 a.m. ET]
Donnelly said he has no doubt in his mind that the person screaming on the 911 call was Zimmerman, and he wishes to God he did not have the ability to understand who was screaming on the 911 call.
Bob Owens (Confederate Yankee) found Donnelly's testimony especially authoritative and moving:
Donnelly is easily the most powerful voice witness so far. Wow. Had to have made a powerful impression on the jury. #Zimmerman

Meanwhile, the Daily Mail admits what is obvious to everyone.
Will George Zimmerman walk? Growing belief Trayvon shooter will escape jail over killing teen as 'prosecution case crumbles'Experts say prosecutors failed to prove murder 'beyond reasonable doubt'
Ex Sentencing Commission economist: 'It should never have gone to court'
Speculation mounts as defence begin their presentation to courtby Matt Blake
Speculation is growing that George Zimmerman will walk free over the shooting of Trayvon Martin amid claims the prosecution's case has 'crumbled'.
Experts say that lawyers acting on behalf of the State of Miami have failed to show that Zimmerman did not reasonably believe the gunshot was 'necessary to prevent imminent death or great bodily harm' to himself.
Even the media's favorite experts think this is a sham:
ABC News' legal expert Dan Abrams said while parts of Zimmerman's account lack credibility, the prosecution has not done enough to convince a jury.He wrote: 'Now that the prosecution's case against Zimmerman is in, as a legal matter, it is difficult to see how jurors find proof beyond a reasonable doubt that it wasn't self defense'.
He told ABC News: 'I just don't see how a jury convicts him of second degree murder or even manslaughter in the shooting death of Trayvon Martin.'
He continued: 'Now no matter how it started, if Zimmerman shot Martin because he reasonably believed it was the only way to protect himself from "great bodily harm" then he is not guilty. That's the law.'
The media's role in this has been shameful. It is obvious now as it was obvious then that this was a racial prosecution, pure and simple, and yet they cheerleaded for it just the same.

Yup. "Zimmerman's guilty as hell - just like Casey Anthony - but the State didn't prove it, so because of some outdated idea of 'innocent until proven guilty,' a murder is going to go free.
You know, this is a nice bridge for them to advocate for a 'guilty until proven innocent' system.

Posted by: Soona at July 08, 2013 09:48 AM (1Sqx0)
I suppose the prosecutor got tired of having his ass handed to him by his own witnesses, because he's giving the defense's witnesses a free swing at his ballsack.
During lunch I heard him questioning his friend's wife (the one who wrote the book about GZ) about if that was GZ's voice. She said, yeah, that's Georgie, I know his voice, etc.
So then he's questioning her about the 911 call GZ made and asked if GZ sounded angry on the call to which she replied no, he wasn't angry. So he starts badgering her:
"Were you present that night to witness his state of mind?"
"No."
"So you're just speculating as to whether or not he was angry or not angry."
"I guess we BOTH are."
That one went right into the upper deck.

Previously I brought up the fact that If I were in Zimmerman's shoes I would have also shot my attacker. And though I probably would not have been indicted in Texas, I definitely would not want to take that chance and it made me think a less lethal solution would have been preferrable. This weekend I got me a nice stun gun as first defense against an unarmed person . I will escalate as needed.
I don't want to spend thousands defending myself from discharging my weapon whether I'm found to be in the right or not. Even simply retaining a lawyer after an incident that immediately goes away will cost money.

Good news on the ammo front in Houston. I was able to locate ammo at a number of stores on the weekend. They still limit the number of boxes you can buy but that's definitely an improvement. Shitty batteries were the problem. If you watch the re-enactment Z did with the cops the next day, he mentions that he had his flashlight with him but it wasn't working. If he had a decent maglight he would have shined it toward the back yards and probably spotted T before he could close with him. Give him a face full of halogen light and a bip on the forehead if he charges you and the situation is de-escalated without a dead body.
Also, for all you people saying FL is going to "burn" I can only assume you have never lived here. Do you remember the old fart blazing away in the internet cafe at the would be robbers? That is FL. We don't shoot back-We shoot first.

I think any attempts at riots are likely to largely be a fizzle. Many "notorious" black areas in major cities have become majority Hispanic and/or are surrounded by majority Hispanic areas since Rodney King happened. Snoop Dogg and Dr. Dre wouldn't recognize today's Compton (over 60% Hispanic), for instance, and any blacks who tried to start a riot there would likely be shot for their trouble.

I cannot imagine an earthly justice capable of atonement for such cold calculating malice. It makes the eggs/omelet discussion of Stalin look absolutely compassionate in comparison. ABC News' legal expert Dan Abrams said while parts of Zimmerman's account lack credibility,
I love how he had to put that in there.
"Oh, I don't believe him, but it's the State's fault."
This is an important turning point. The Media can either try to prevent, or provoke, racial violence when Zimmerman is pronounced Not Guilty.
If they want to prevent violence, they can say things like "The Prosecution's case is very weak. Nothing has come out that materially disproves Zimmerman's statement. As tragic as it is, it may be a relatively clear case of self defense."
If they want to provoke violence, they'll say things like what this "expert" said. "Oh, he's lying. We all know he's guilty. But the State is throwing this one to let Whitey off the hook."
Posted by: AllenG (Dedicated Tenther) at July 08, 2013 01:45 PM (/PCJa)
Better the racist mobs blame the prosecutirs than the jury.
The prosecutors can hide behind the police and the power of the state. The jurors only have friends and family. And during the riots, the politicians will make sure the police are deployed to protect their own asses, not the general publics.

This is precisely what happened in the Roney King trial. The media deliberately left out the first 15 seconds of the video - which showed King attacking the police - and deliberately omitted the fact that there was another black in the car with King - who was not touched because he obeyed police orders. They did this consciously and with malice aforethought and 52 people died. And the mf'ers in the media that did this probably got Pulitzers for their "reporting". Spit.
There definitely needs to be a reckoning. And not just for the Zimmerman travesty.

Because St. Trayvon's sainted mother said it was her son screaming.
The defense needs to lay down a lot of testimony to counteract that.

That metalic structure at the end of the crashed plane is the pressurization bulkhead. From there is a small maintenence space seperated by a locked door or hatch, and then the galleys and then passenger seats. Probably a distance in an aircraft that large of 30-40 feet. My guess is is that the maintenence door/hatch remained intact, judgeing from the condition of the fuselage foward of the detached portion of the tail.
Plus, if if the hatch or door would have failed, I'm sure the interior was at neutral pressure when the crash happened.

I asked him why and he said because the 911 operator told him not to follow, and he disobeyed. I told him he'd been misinformed. That the 911 operator said "You don't have to do that." and that Z said "OK". That Z was returning to his vehicle when M jumped him.
Dad says, "I haven't heard that anywhere." Which goes to show you that multiple MSM sources doesn't mean the truth getting through.

Some states have laws protecting those who engaged in legitimate self defense from being sued in civil court.
I don't know how it reads in Florida though.

I recall that FL doesn't allow for civil prosecution of those who successfully argue self defense. It seems to me that if there's a justifiable homicide (as self defense is), there isn't much of an opening for a civil suit anyway.

Further, don't care about 'my reputation on this site' or any other, so I'm guessing I'll live with it just fine, thanks. It would only bother me if I actually cared about your opinion. What I do care about is the truth. The truth is none of you would take kindly to be followed by a stranger and some of you, no doubt a small minority, would double back and confront the stranger following you around and try to find out why he was following you. An even smaller percentage of such face-to-face confrontations would end, as this did, with a fatal result and with both parties sharing varying amounts of blame for that result, depending on who made what decision and when.

Listen, let's just end his "dispute" here. It's over as far as I'm concerned.
But what I thought about your opinion obviously did bother you at least a little because you respond to my comments on the Zimmerman trial that are directed at you pretty much each and every time I post something. I don't care but don't pretend that you're above the fray while claiming that myself and others who have argued with you on this issue are the ones who are ignoring the facts of the case. You didn't even know the facts of the case when you first started posting your opinions on it. Now, you're admitting the facts but are still clinging to your weak conclusion based on those facts. If you care only about the "truth," you would at least admit that regardless of any mistakes that Zimmerman may have made, none of them warrant him serving prison time for it. The kid didn't deserve to die either but his behavior is the primary reason that he was shot and killed. Plain and simple.

I did not say Martin was justified in assaulting Zimmerman. I have said Zimmerman was justified in the use of lethal force when he was attacked by Martin since he (Zimmerman) did not initiate the physical confrontation, acted defensively throughout, and resorted to lethal force only when he had reasonable fear that his life was endangered.

Being a stupid kid who's too quick with his hands shouldn't be a capital offense, but if you put an armed man in fear of his life, it tends to work out that way. None of us were there but the available evidence (i.e., facts) point to GZ justifiably defending himself.

Your reference to me and what I've been doing in our debates on this issue are patently false. I've let the facts of the case guide my opinion on it, while you've spent a lot of time ignoring those facts and acting like a victim, which is what you're doing AGAIN with your reference to "ad hominem attacks." I don't know why you won't just let this go, considering that your opinion on the case continues to inch closer to mine the longer the debate goes on.
BTW, you've engaged in plenty of "ad hominem attacks" yourself. How many times have you mocked those of us whose views differed from yours on this case by making comments insinuating that we support the murders or innocents or are ambivalent about the kid being killed? Your debating tactics on this whole issue have been enraging for me -- and I'm sure many others here -- who have watched you twist logic into a pretzel trying to justify your views on this case. It really is not that difficult of a case to analyze and judge when you remove emotion and any emphasis on the racial composition of the two principals, Trayvon and Zimmerman.

Second Tripwire
2. When do I make an overt evasion?

Under what thesis would you ever come to that conclusion? If you are "screaming" in a fight you're wasting extremely valuable energy in the hopes that mere noise will help you prevail. Anyone who has ever been in a fight outside of the 5th grade knows only the loser screams.

So Zimmerman walks because it was not proved beyond a reasonable doubt that he committed murder, and most everyone agrees that should never have been charged in the first place, so my question is when do the usual suspects pop up on the various and sundry MSM news shows to declare this was all a sham and scream about justice for Trayvon? When do the riots begin? Which happens first or is it simultaneous release?
@419: Blaming the victim. What would a mature, self-assured adult do in the situation? Yeah, call 911 and move in the general direction of a known safe place asap. A 17 year-old guy, eh, not so much.

In the interest of justice you are never supposed to take a clearly inadequate case to criminal court. Doing so can be grounds for disbarment.

Angela Corey was in the courtroom? Is this the same Angela Corey who was
just indicted by a grand jury for falsifying the Zimmerman arrest warrant?
So far, the prosecution team looks like the Keystone Kops. More than half
of their witnesses have done more good for the defense than the prosecution.
The question is not will George Zimmerman be acquitted, but what will happen
after he is acquitted. The community organizer in the White House will do
nothing to keep the inner cites from burning. He is what he is. A community
organizer fans the flames of racial hostility. Only after the damage has been
done, will Obama begin to sound like Ghandi.

I know what straw man means, thanks. If you'll look at Jeff's comment, he claimed I was saying Martin was justified in physically attacking Zimmerman. I've said nothing of the kind. What I have said is that Zimmerman is not blameless. He started following Martin for what amounted to insufficient reasons. Martin, a 17-year-old, lived in the neighborhood and was--by all accounts (and undisputed by Zimmerman's defense)--walking home from a convenience store. In short, Martin was doing nothing wrong up to that point. That Martin reacted badly to Zimmerman's actions is also not in dispute. Going back to ambush Zimmerman amounted to criminal intent. Martin was wrong (and criminal) for doing it, and paid for that bad decision with his life.
Finally, here's my point: if you are being followed by a stranger who you have ascertained is not a police officer, then you will react either well or badly to such a situation. Martin reacted badly. You might react differently if you are being followed by a stranger, but you would almost certainly react in some way; e.g., walk faster, run, seek to shake the follower, notify police, or--in Martin's case--confront the follower. Such a reaction does not mean you are behaving suspiciously. You are behaving like someone who is being followed by a stranger. Viewed from the perspective of the one being followed, it was Zimmerman who was acting suspiciously.

Pretty true. You can't form a logical paradox as an excuse for denying the defense evidence.

You have no clear case law for this. I'll give you my general opinion. You cannot set aside a question of the court once answered in favor of the defense. The practical question before the court currently is "Did GZ unjustifiably shoot TM?" Any level of guilty verdict, even Manslaughter 2, answers to the potential (Though not definite) affirmative of that question and further prosecution of federal crimes on the same premise may commence. If GZ is acquitted the answer "When GZ shot TM it was not unjustifiable*" may not be set aside for federal charges. Without the action of unjustifiably shooting TM as a premise the case for a violation of civil rights becomes intractable. What are they going to say? That GZs following him in furtherance of his duty as a neighborhood watch in a public place somehow denied TM his civil rights? What right would that be? The right *not* to be followed when wondering around a housing complex at night? They would put up weak argument for racial profiling, which doesn't take a lot of work to push into the reasonable doubt area of "Well he reasonably might have suspected TM based on how he dressed or acted". I would say that in the case of acquittal further prosecution is unlikely.
*Double negative deliberate.

I'll be in DC, working in the very worst parts of town, when the verdict comes out. I'm thinking seriously about taking a personal day.
--
One week after the Rodney King verdict and riots, I was househunting in the DC area after accepting a job offer there. Unfamiliar with the area, my husband and I mapped a route that took us through SE DC. There was a flash flood and we were trapped in no-moving traffic. Not before, or since, have I ever been so aware of my creepy ass cracker skin. The tension was palpable, all eyes were on us.
For your situation, the bad news is that you never know exactly when a verdict is going to be read. Hopefully they announce that it's coming and give people a chance to get out of dodge.

Citizen Grand Juries all across America are empowered to issue indictments
in criminal matters. Anyone who thinks that a Grand Jury indictment carries
no weight in our legal system, is woefully ignorant of the American justice
system! Grand Juries exist at the local, county, state and federal levels.
When a Grand Jury issues an indictment, it is handed over to a local D.A.,
coutny prosecutor, state or federal attorney. If they fail to file for political
reasons, they risk their careers.
By now, everyone has seen the two photos of the injuries George Zimmerman
sustained at the hands of Treyvon Martin. The now famous photo of the back
of Zimmerman's head was taken by a private citizen and was already in
circulation. She had to include this bloody image (As is) in her filing. But
Corey altered the frontal photo of Zimmerman's broken and bloodied
nose. Easy to do in this digital age, just manipulate the resolution and
convert to black and white. This made the blood on Zimmerman's face
look like a bad goatee.
First year law students understand the rules of discovery. Falsifying evidence
in an arrest warrant and complaint is a serious felony, as is any failure to
include exculpatory evidence. Angela Corey's tit is in a wringer and she
will likely spend a decade in prison!
Many convictions have been overturned by an innocent failure to include
evidence, even evidence not pertinent to the guilt or innocent of the defendant.
Corey was fanning the flames of racial animosity in order to win reelection.
She learned nothing from Mike Nifong and the Duke Lacrosse rape case.
Political ambition is not a bad thing, but when it becomes an obsession and
drives you to commit a serious felony, you deserve everything you get!
