Shock of Shocks: Obama Delaying Employer Mandate, Again For, Get This, Nakedly Political Reasons
— Ace

Corrected: Thanks to commenters and Andy, I've been informed that I've misread this article badly.

I've been so strongly expecting him to delay the employer mandate (as I mention below) that when I saw an article with the words "mandate" and "delay," I just made up the rest of the sentence in my head.

But re-reading the article more carefully, I see that this move applies to enrollment in the Obamcare exchanges. So it applies to the individual market.

Now, this is still being done for political reasons. Remember, Obama seeks to keep the old policies in effect for one year, after which people will have to seek an Obamacare policy. They will of course start seeking these policies, then, on October 15th.

He's keeping them from seeing the Sticker Shock prices until after the election.

I'm sorry I blew the story so badly. I've anticipated the delay of the employer mandate so hard that I just completely misread this article as vindicating that prediction.

Below a rewrite of the post-- without the major error I made.

...

Democrats complained that enrollment for the employer mandate -- with the Sticker Shock that will accompany it -- was slated to start less than three weeks before the 2014 midterms, on October 15, 2014.

In addition, Obama's one-year grace period for old policies means that people will start seeking new policies October 15, 2014, as well.

Well, not any more.

King Obama is now trial-ballooning -- that he'll delay the enrollment period on the Obama exchanges by exactly one month, from October 15th (before the elections) to November 15th (after them).

On the podcast now posted below, and also in conversation, every time someone said "Well the Democrats are going to face the employer mandate before the election," I just laughed and scoffed. Sure they will.

Sure.

That will be the next shoe to fall, I still think. But for now, here's this dropping shoe-- the individual market enrollment will not start until after the elections. Conveniently enough.

John Eekdahl had a point in the podcast, though: How much does this actually help Obama and the Democrats? The public understands what Obamacare means-- it means skyrocketing prices for their healthcare. Does delaying this -- attempting to keep a secret that's already out -- actually help them?

Maybe it could hurt them-- perhaps the public will imagine the damage to themselves will be even greater than it actually will be.

I don't know.

I do know the media is up to its old Obama-protecting tricks. Watch how Bloomberg claims the move is for policy purposes, which may also have a political benefit:

The Obama administration plans to push back by a month the second-year start of enrollment in its health program to give insurers more time to adjust to growing pains in the U.S. law, a move that may stave off higher premiums before the 2014 congressional elections.

Before I read that, I had been thinking "The media can't possibly spin this as anything other than what it is, a stinking filthy attempt to delay the pain of Obamacare so that Democrats have a chance to cling to power."

But there you go. Bloomberg's opening sentence reports, as a factual matter (not "the Administration claims," but that this is factually so), that the move is made for prudential reasons to permit insurers to "adjust" to "growing pains."

And not for the transparently political and, get this, dishonest reason that obviously is motivating the New Unilateral Executive Law-Making.

A one month delay of a mandate he already delayed by one year. Thirteen months instead of twelve months.

I guess it's just a coincidence that this one-month adjustment moves the pain from before the elections to after them.

14 By the way, he's not doing this because he cares about his fellow Dems (he never has, being a malignant narcissist and all), he just want to be able to act even more dictatorially than he is now with little to no push back. After that, they can all go jump in a raging river for all he cares. I think though, that if the GOP gets their act together, they can warn the public about the terrible effects of the employer mandate and other aspects of the law once they take effect after Obama feels safe and use it to destroy the Dems. I suspect the public will be more receptive to what they have to say after this insane debacle.

16 I really don't see what this accomplishes for them. Notices will go out before the election. People know the history of the individual mandate and what happened this year. Employer plans will have the same, if not worse, problems. Stupid move....

18 "Shock of Shocks: Obama Delaying Employer Mandate, Again For, Get This, Nakedly Political Reasons —Ace" He's pushing back the enrollment period for 2015, not employer mandates. Employer mandates go into effect in 2015 under his current delay for them. The sticker shock to come is a result of the insurance mandates, not the employer mandates. Most employers avoided that sticker shock because their polices were renewed before 2104. But Obama pushing back the enrollment start date does not mitigate that coming sticker shock for employer plans.

Posted by: NotCoach at November 22, 2013 07:22 AM (rsudF)

19 The kitteh is already out of the bag.  The employers won't wait until the November deadline to start handing out warning notices about what's going to happen.  With the clusterfuck of the individual mandate, everybody knows what will happen with the employer mandate.  They could delay all they want, it will not help them.

The mandates "go into effect" in 2015, but people have to ENROLL before insurance takes effect. The enrollment period precedes the in-effect period. He's pushed back the enrollment period until after the elections, so that no one can see what they'll be paying for insurance until after the midterms.

56 Here's the thing.    The article says that the gubmint is (illegally, btw)   pushing back the FILING DATE for insurers.   That's not, as far as I'm aware, the same as pushing back the ENROLLMENT date for customers,   which is still in the law.

And even if the    filing date  AND enrollment date    are pushed back a month, so fucking what?   insurers are, as far as I'm aware, required to notify customers of any changes within 60-90 days   of the changes taking effect.   The bulk of enrollments won't be in until March next year, but that leaves April, May, June, July, August and September before the original October 15 deadline,  during which insurance companies can look at the numbers and make the final determination of what their premiums and deductibles and coverage maps will look like.

This is as nakedly political as it gets, but I don't think   it helps the gubmint as much as they think it does.

61 "Posted by: ace at November 22, 2013 11:24 AM (/FnUH)" That's what I'm saying, but that's not how your headline reads. The employer mandate is still set to go into effect come 2015 despite these latest political shenanigans. And employers don't worry about the exchange enrollment period anyways. They enroll with insurers directly. Many employers were renewing their policies back in September despite the exchange enrollment period starting in October. The same will be true next year. Besides, many employer plans will expire next December. they can't wait until November 15th to renew.

64 Employers make their benefit package desions much earlier than November, ealier than even September. If they know there will be a change coming in the law for the coming year they wil make changes to abide by it. That was why Obama announced the 1st waiver back in July b/c employers where getting ready to make necessary changes, they don't wait till November.

Are companies going to hide this disaster from their employees until after the election? As Flatbush Joe wrote, it already worked once—but that was for defense, which is heavily dependent on the federal government, so they were willing to be strong-armed into breaking the law on the promise that they wouldn’t face legal consequences. Will companies as a whole be susceptible to such tactics? I think it’s a tough call. The federal government wields a lot of power.

Posted by: EC at November 22, 2013 11:22 AM (GQ8sn) _______________________ Yep. Businesses that end their accounting year in October need to plan ahead, and they need to know what their next year's expenses will be. The cost of their employees' health insurance is a big expense. Unlike Obama and the Dims, businesses can't run endless, trillion dollar deficits, and they also can't fail to have budgets year after year after year. I used to produce enrollment forms for a major BC/BS carrier in this area. Employers have different enrollment periods. I produced the application forms every month of the year. My wife's 'open enrollment/policy renewal' date is around May to June every year. The biggest moaning and groaning is not over for another year. It's gonna be continual. Anyone have any opinions on this? Posted by: HeatherRadish™ needs a beer at November 22, 2013 11:14 AM (ZKzrr) This is an interesting point. I have been thinking about this a lot lately. When I was in China, I happen to get sick. Nothing too serious, just needed antibiotics, but needed them intravenously at first. The concierge of my hotel chaperoned me to a separate (for foreigners only) part of the hospital. I was the only one there. It was a huge wing, empty. They found a doctor who could speak English, then I was placed in a room which was fairly clean, and the nurse/doctor made a point to show me the syringe was in a sealed package, etc before administering the injection. But, when I had to pay, I had to walk down very long sets of corridors to a metal gate, that separated myself from the Chinese citizens. The pay "window" was on the other side of the gate. I was surrounded with folks to "protect" me, and shuffled to the pay window ahead of everyone else. It was weird and eye opening. That side of the gate was stuffed from side to side to ceiling with the sick, packed in like sardines... as I slipped back onto the other side of the gate for "foreigners."

167 The insurance companies will be forced to say, "it's just a change in plans; business as usual." They'll be bullied, again, into breaking the law and NOT sending out the letters per law - they are getting paid off with subsidies, so hey, no sweat off their backs. And, the other companies that will have to drop their own plans due to the costs, or, reduce work hours, will be blamed for being cold-hearted greedy bastards. While this shitsandwich weaves into every institution in the country. Repeal is the only way. The only way. Who has the fortitude?

Many businesses are having extended Black Friday sales because Thanksgiving is so late this year.      They lose what's essentially a week's worth of revenue that they'd get if the holiday were earlier.   Christmas is less than a month away by Friday, 11/29.

176 If you know a JFK conspiracy theorist (or if you've ever wondered yourself) here is a site that thoroughly DESTROYS the conspiracy theory industry, and rips the various conspiracies to pieces with surgical precision. But I warn you, True Believers don't want to hear it. Just had a long-time FB friend defriend me without reading it. mcadams.posc.mu.edu/home.htm Among my favorite of the conspiracy theories, you know that photo of the Dallas cop handing the "real murder weapon" down from the roof of the TSBD? Um, yeah. Except that's clearly a shotgun. And no one has ever tried to claim that JFK was killed by a shotgun. Not only that, the shotgun in the photo happens to be the same make and model that was standard issue to Dallas police at the time. And anyone who ever watched an episode of SWAT knows that the photo depicts the exact method of handing a firearm down from an elevated position. But seriously, check out mcadams.org for the real truth. Oswald did it, alone, from the 6th floor of the TSBD.

The bizarre charge comes as international pressure mounts on Pakistan to free Afridi, who was sentenced last year to 33 years in prison for "conspiring against the state," a sanction western observers believe was a pretext to punish him for helping the U.S. Afridi executed a vaccination ruse that helped establish Bin Laden's presence in an Abbottabad compound, a development seen as embarrassing for Pakistan, which claimed not to know the world's most wanted man was living openly a stone's throw away from a military complex. 210 Senate Minority Leader Mitch McConnell said on a conference call organized by Karl Rove’s Crossroads organization for large donors and their advisers on Oct. 30 that the Tea Party movement, in his view, is a “nothing but a bunch of bullies” that he plans to “punch … in the nose.” On the call, according to a donor who was on it, McConnell personally named Sens. Mike Lee (R-UT) and Ted Cruz (R-TX) as Tea Party conservatives he views as problematic for him. “The bulk of it was an attack on the Tea Party in general, Cruz in particular,” the source, a prominent donor, said in a phone interview with Breitbart News. But the most memorable line came at the end of the call. “McConnell said the Tea Party was ‘nothing but a bunch of bullies,’” the source said. “And he said ‘you know how you deal with schoolyard bullies? You punch them in the nose and that’s what we’re going to do.’” So this fuckin cock sucker is going to War with other Republicans instead of the cock sucking democrats? And people wonder why we are called the party of the stupid. Maybe oprah is right: old white men have to die?

247 Ace, the point of the story is still valid even if the details were mixed

With insurance companies trying to hold off the Death Spiral, massive increases in premiums for 2015 will be coming to cover the lack of healthy overpaying buyers

The Dems don't want to face voters who were already pissed that their premiums went up from $400 to $800 per month no matter what shiny nice things the new policies are supposed to do. To then face voters when their $800 policy is going to cost them $1800 isn't going to be mitigated by massive tv advertising about Republicans taking tampons away from wymyn

254 209 Wow -- guys, thanks for pushing back against my completely-erroneous reading. I have rewritten the post -- hopefully now with ACCURATE information, rather than the bad information I initially foisted on you. Posted by: ace at November 22, 2013 11:59 AM (/FnUH) Ok, now I'm REALLY confused...(as opposed to my normal state of confusion). "But re-reading the article more carefully, I see that this move applies to enrollment in the Obamcare exchanges. So it applies to the individual market." Unless I'm misreading your update....it applies to the individual market only insomuch as employers drop coverage and force employees into the individual market.... From your link at Hot Air: However, this misses the real risk for the White House, which isn’t in the individual market in 2015.The people in that market will have been battered all year with higher premiums and ridiculous deductibles, and another round of escalation in both will only have a limited shock value. The risk is in the employer-provided group market, where costs will either skyrocket or employees will get kicked out of their coverage and forced into the individual market. Those decisions will come in the late summer or early fall, as businesses have to prepare 2015 budgets in those time frames. By the time the standard October 1 open enrollment date hits for those consumers, the enormous impact of ObamaCare will be well known — even if they can’t access price information in the individual exchanges. When tens of millions of Americans get handed huge price increases or get pushed out of their group coverage altogether at that point, the outrage and political meltdown will dwarf whatever pricing changes take place in the individual markets.

One of right-wing hate radio’s loudest and most poisonous voices was conducting an embarrassing public feud with our press secretary. The President had trapped himself in a seeming contradiction. The video and audio were both damning, and one must admit, very funny—if one’s goal was to make the President look and sound like a liar and a fool. The Youtube videos were getting millions of hits; the TV comics were not letting it go. We had been knocked completely off message, the optics were horrible, and our favorability ratings were collapsing at a crucial moment. (It seems like an ice-age ago when such trivialities actually mattered to me.)

I said something offhandedly to Dennis. “I just wish we could get rid of those bastards, once and for all.”

He stared at me for a long time, chewing on his second BLT sandwich until the Navy steward retreated from range, and then he said, “Actually, Jacinda, there is sort of a plan for that.”

“What do you mean, ‘a plan for that’?”

How do plan on stopping the Dims from funding another Akin or Sarvis; or the media from trumpeting their comments around the walls.  Notice how all of the calls from the rest of the Party to step aside were given little airtime or that Palin backed another candidate.  Personally, I would attack with pictures of happy children who were born premature at 20 weeks, they mention rape - attack with the under-reporting of statutory rapes by abortionists.

But, since your not going to have the media, you are going to need your base to turn-out at the polls.  Then you need to suppress their base - scandals, insurance price hikes, or thrid party identity candidates to split the vote.

If I ever bring up Akin, it's to highlight Democrat dirty tricks. Akin--simple-minded rube that he is--was deemed (correctly) by McCaskill and her people to be the weakest Republican primary candidate. Therefore, Democratic voters were enjoined to cross over en masse and vote for Akin in the primary election. They knew--as anyone knew who followed Missouri politics--that Akin was bound to say something incredibly stupid at some point during the general campaign, and he witlessly obliged.

Akin's catastrophic gaffe had nothing whatsoever to do with campaigning on social and cultural issues such as abortion (or 'women's issues' in general). It has everything to do with the inability of the Republican Party formulate a counter-strategy against Democratic Party 'anything to win' tactics.

The same thing would happen if anyone were to suggest that the right would allow people to die in the streets because they didn't have enough money to pay. My suggestions on how to structure the system so that costs are minimized and incentives are put in place to only use providers when necessary and then to search for the low-cost provider have been the subject of numerous comments here. I believe the plan is far superior to Medicaid or Obamacare. Suggestions like "let them die in the street" are just ridiculous and unserious.

That's funny because uh last I checked *you* are the only person who think a free market in health care leads to "death in the streets"...

reality says otherwise.

399 “What do you mean, ‘a plan for that’?” http://tinyurl.com/9592nav Posted by: drowningpuppies ---------------------------- I am reminded of Obama's address of July 2, 2008: “We cannot continue to rely only on our military in order to achieve the national security objectives that we’ve set. We’ve got to have a civilian national security force that’s just as powerful, just as strong, just as well-funded.” ------------------

402 "That's funny because uh last I checked *you* are the only person who think a free market in health care leads to "death in the streets"..." OK sven, let's walk through this... Right now, Obamacare is on the ropes. People who have their own policies are scared and piss off due to being cancelled and see what the new rates are. Democrats are scrambling trying to find some way to turn this around. Something is going to happen. My suggestion has alway been to institute free market reforms to the everyday healthcare through the use of HSAs. Yes, I caused some contraversy saying we should give up the tiny slice of catastrophic healthcare not already covered by Medicare, Medicaid and the VA, arguing instead that this was an insignificant portion of what we are after. The prize is getting the everyday treatment in a buyer - seller relationship, instead of having an insurance company or government inbetween paying the bills. There is no way, in anyone's opinion, that the country would agree to eliminate all healthcare benefits for the poor. It just wouldn't happen. My plan accepts the reality of this and instead allows the govenment to fund the HSAs of the poor, basically by taking a portion of the existing EITC and increasing the amount to cover costs up to the point catastrophic takes over. It incentivises the poor to use it judiciously so that they can skim the difference off the top of their accounts at the end of each year. It would save the government money and allow the poor to be treated as cash customers by provicers - a win win. Is this such a terrible communist plot?

Your plan still generates market disequilibrium.

But you know what using that patented LOGC! I am missing the moral argument against just handing everyone a 100,000 buck Debit card every month.

406 The public believe Obama before with the "if you like your plan, you can keep it" lie.

That's been exposed as the naked lie it was. Hence the numbers for "trusting" Obama have dropped through the floor.

They can certainly move the date. I don't think it's legal given the very clear way the PPACA reads. In fact, it's blatantly illegal and if Obama gets called on it (in court) he will lose (by the way does eliminating the filibuster for judicial nominees and thus stacking the DC Circuit Court start to make sense now idiots?)

But people don't believe Obama anymore, they know this is coming. People have already been adversely affected and there is nothing to indicate it gets better. Once informed of the date movement, most are smart enough to figure this out.

That's why Obama will try a legislative fix with Republican help...and Republicans are dumb enough to do it. They are too smart for themselves and have some crafty reason WHY they will do it...and then promptly get bit in the ass.

After all- what says "trustworthy" about Obama better than the way Republicans have gotten nailed to the floor in every negotiation or the way the PPACA was passed or now the way the filibuster was changed (and will be changed back before Republicans take over again. Sheesh, I mean this screams "trust".

Dopes.

407 "Your plan still generates market disequilibrium. But you know what using that patented LOGC! I am missing the moral argument against just handing everyone a 100,000 buck Debit card every month." I don't understand how you can argue that, when the total amounts I'm advocating are less than what is presently being spent. Yes, insurance company profits may suffer and a large number of bureucrats at Medicaid might lose their job, but I don't believe the markets would be thrown into chaos.

Your ranting about "dying in the streets Nazis" sort of is based if on anything other than your Moderate ire at anyone to the right of Lincoln Chaffee on the notion that the market will not reestablish price structure quickly enough for the "poor" to be able to find solutions.

Your "reduced Medicaid" paradigm still has the feds using the free shit cannon to artificially raise price champ.

That *is* the point, we have little idea what a competitive market driven health economy would look like because the feds have not allowed it to exist since ~1968.

Your rant on your fear that having as free a market in healthcare would lead to death in the streets is predicated on distrust of price point.  I distrust a disrupted market's price and availability structure.

I have no need for a GOP that can't argue for economic sanity and liberty.

The number of uninsured has continually been ratcheted up from 15 to 20 to 30 and now to 45-50 million people who will be "saved" by commiecare, but little notice by the treasonous bastards formerly known as a free and ethical press have given much attention to the estimated 29 million who will still be uninsured, when all is said and done. So, in effect, a lot of suffering, confusion, and more financial expenses has been foisted on the working class, while those that  reside in the nether world between the truly needy and the working class (what, maybe 20,000,000 people) are having a banquet of prime rib with all the fixings, and president codewriter is having his way with the Constitution.

415 It's just not the individual market that is effected it is also employer supplied plans. When open enrollment comes each year that is when all employee's get to choose which plan from a set of plans offered by their employer they choose, or even to opt out to the individual market or another type of coverage. That means that people on employer provided plans will not see their rate increases until after the election instead of prior to it.

418 The way that OCare as a tax works is only the worker bees of Main Street have to pay into the OCare tax, most everyone else is exempted by the President and the burrOcrats.  How's that a general tax, or fair?

Seems the Supreme's messed up on the 'general taxing authority' concept -- OCare isn't being implemented as a general tax.

OCare's tax (and coverage) is targeted at a limited segment of the population and that segment of the population is getting hammered with paying for coverage for all sorts of Medicaid and Drug Rehab and other prorgrams that should be paid for by everyone, not just just the Main Street workerbees.
