— Ace This isn't as uncommon a maneuver as you might think. There are two tracks of a legal defense: The affirmative defense and the more common tactic of challenging each part of a proseuctor's case.
Bear in mind, for each offer of proof the prosecution made, the defense questioned the expert or witness, attempting to cast doubt on his claims.
But the case now goes to the jury, which has been dismissed until Monday. The New York Times immediately announced it would devote a special section of the Sunday magazine to something else entirely.
In addition, the judge reversed his previous error -- apparently he had dismissed the murder charges for the wrong baby. He had meant to dismiss them as against one but instead named another. He corrected this snag by reinstating charges in the case of the murder of Baby C and dropping them against another one, in whose case there was (in his opinion) no evidence of murder.
Update: Obama had been scheduled to be the keynote speaker at a Planned Parenthood gathering on Friday night. The last word is that President Gutsy Call has backed out.

Well Then! I seem to have gotten virtually everything wrong in my original post. "Criminal Procedure 101" corrects me:
The main blog author needs a refresher course. An "affirmative defense" is something for which the defense has the burden of proof. Such as self-defense or insanity. The defense can't call its own witnesses during the prosecution's case in chief. For the defense to call its own witnesses it needs to put on its own defense case. The defense cross-examines the prosecution's witnesses; it does not "rebut" them. "Rebuttal" is an entirely separate component of a trial. Only the prosecution can offer "rebuttal witnesses" in a criminal trial. Not that any of these details matter. It's the Internet, after all.
Okay, so rebuttal witnesses can't be called after a prosecution witness but can only be offered in the defense's case. So apparently Gosnell has none.
As for "affirmative defense," I didn't know the right word; I meant the defense case, apart from the cross-examination of the prosecution witnesses during the prosecution's case.

This doctor is guilty of nothing more that what Obama himself spoke in favor of on many occasions - killing babies born alive during abortions.
And yet, not once have I heard anyone in the press ask Obama about this connection. Not one time. I know the MSM has had their heads shoved up Obama's ass for 6 years now, but it still surprises me when they fail to do even the most minimal of reporting in order to protect him.

The only question is whether THIS jury says a viable fetus is not a person... and this then does not rise to the level of murder...
But when the Judge threw out a bunch of the charges, without even giving the Jury a chance to decide 'if' they believed the fetuses were alive...

People think it's more common than it is, because it happens so often in court dramas. In real life not so much, because reliance on a jury's demand of prosecutorial responsibility is a pure sucker move. Because they don't demand it at all.

Or (I haven't followed the testimony and I'm making this up) the D knows that with the aid of the judge's dismissals (which work as "Who's on the side of right, here?" signals) they've successfully clouded shit up and made this case not about the guy it's about or the dead babies he made.
Which would be a prosecutorial failure, not a defense success. Criminal prosecution is the easiest job in the world, and defense is nearly impossible.
Or (also making this up) they know their odds on appeal are really good, but they're really shitty now, so let's roll.

If both sides agree, then a defense witness can indeed be put on during the prosecution's case in chief. And the idea that the defense does not have the opportunity to provide sur-rebuttal witnesses is very misplaced.
Essentially, the trial court can conduct the trial pretty much how he damn wants to. Happens all the time.

If the terror designation was added on 4-15, then ok, probably a reasonable explanation.
I do not think, however, that that was the case. Apparently the 213(B) designation is as high as you can go, and you actually have to get approval from a panel of fucking people to do that.
Once so designated, they are almost never removed until death. That's how serious that is. I do not think that in one day such a designation could have been accomplished, especially since he was cleared.
If the designation occurred before 4-15, when did it happen and why? And even if it's a complete mistake, how in the fuck is this guy visiting the WH if he was so designated. That would be a total security failure.

The Government presents its case. Once the government's case is over, the defense can simply present no evidence and argue that the prosecutor didn't meet his burden of proof. Technically, the defense does not have to ask a single question.
