The Harpy & The Cowards

Have you read this story?

It's egregious. Go read that; I can't summarize a summary, and there's no sense just quoting half their article.

Clarification: Note that while this woman did in fact do the power-game passive-aggressive asshole-aggressive I'm Gonna Put You on My Twitter Timeline, she didn't actually ask for the guys to be fired. Or at least I haven't seen that claimed. That seems to be PlayHaven's call. That's on them.

Now, this Adria Reid or whatever her name is is a real harpy who enjoys the power-trip she gets in accusing people of the New Witchcraft, which is supposedly hateful speech. It's an Empowering Game for her, accusing people and such.

She's like the girl in Oleanna -- did you see that? Go see that. I'll wait.

Saw it? Tough to watch, right? But it makes a good point: We are empowering the worst of us with this power to accuse people of Witchcraft, I mean, Speechcraft.

Petty broken tyrants like this get off on it, and we just keep giving them that power.

But I don't want to talk about her, actually. Because people like her have always existed. There have always been scolds and hysterical accusers and yes, until recently, no shortage of people willing to bid for a little Spotlight Time for themselves by accusing others of sorcery. (In fact, in Africa and in India's hinterlands, the practice continues.)

We used to just roll our eyes, or, if we were feeling a little empowered ourselves, we used to tell them to have a lie-down on the fainting couch until they had sufficiently re-gathered their shit enough to join reasonable adult company again.

What's changed?

Us.

What the Unholy Hell was this company, PlayHaven, doing firing an employee who broke no laws, stood before no tribunal, and did not even act on the company's behalf, but his own behalf, on the say-so of a serial hysteric and Witch-Finder?

You see the problem? The problem in PlayHaven.

And the problem is corporate America generally.

Mark my words. I've said this before, and I'll say it again: The primary direct threat to your right to speak freely as a private citizen and an adult in a free democracy comes not from the government, but from your employer, who will fire you if some hysteric tweets about something you said in your personal capacity.

Why? Because they don't want the supposed "firestorm" such a tweet will cause.

They're cowards. And they will fire you for exercising your free speech rights as an American citizen if someone accuses you of breaking the Speech Laws on FaceBook.

Now, we can't change that either. The world is full of weak men. PlayHaven especially so.

But we can change incentives. As Milton Friedman said, we cannot expect to put good and noble people into positions of authority over us. He was speaking of the government, but his point applies equally to employers. He said we have to accept that the people with authority will continue to be be bad -- and we will only have real freedom and real progress when we change the incentives such that bad, weak people do the right thing.

Because the bad, weak people will be penalized for doing the wrong thing and rewarded for doing the right thing. They'll still be cowards motivated by fear-- but we can only have progress when we put the correct incentive structure of fear into them.

In the instant case, this means punishing, by any consumer boycott we can manage, PlayHaven, whoever the hell they are, until they re-hire this guy and give him a $5000 bonus as a shame-based cash-money apology for their own cowardice and weakness.

But this is not restricted to PlayHaven. This is going on all over.

What is needed is a statement, an organization, a mission, a continuing effort to let corporations know that what free adult citizens say on their own time, for their own personal account (that is, not on the company's behalf), is not the corporation's problem, and they will not have a lot of lunatic baying for red meat from the "online community" over such personal, not corporate speech.

And, conversely, if they seek to limit American citizens' freedoms, they will have a problem.

I know no one will join me in this. I know I'll just be told it's every company's right to fire people. (But then, people have a right to boycott over unjust actions, too.) And I'll hear that people have to be responsible for their words. (And this includes getting fired for saying "dongle?")

And I know people on both the right and left will think about the times they really would rather like to get someone from the opposite party fired.

But this is going to be affecting all of us, all of us who still dare to speak our minds publicly, and it is actually in all of our best interests to put a stop to this ludicrous Salem Speechcraft Panics.

We should still retain the power to boycott corporations who act against our interests -- in their corporate capacity.

And corporations with an interest in a generally upright image will retain the right to fire people who seriously injure that image with notorious actions of serious moral turpitude.

But people getting fired left and right for simply exercising their basic right to free speech?

Yes, I know company's have the right to do this. But if we keep incentivizing them to do it -- that is, if we keep all the risk on the "Keep Him on the Payroll" side of the ledger, with no downside risk for these ridiculous Salem Witch firings -- we'll have more and more of it until basic company policy will be:

IT IS REQUIRED THAT YOU DO NOT ENGAGE IN ONLINE ARGUMENT OR DISCUSSION OF ANY SENSITIVE ISSUE, AND FURTHER DO NOT ENGAGE IN SUCH DISCUSSIONS IN ANY PUBLIC OR SEMI-PUBLIC VENUE, BUT INSTEAD CONSIDER IT A PART OF YOUR BASIC JOB DUTIES TO REPRESENT YOUR EMPLOYER AS HIS SPOKESMAN IN ANY PUBLIC SETTING WHATSOEVER. FAILURE TO REPRESENT YOUR EMPLOYER AS HE WISHES TO BE REPRESENTED IN EVERY SINGLE MOMENT OF YOUR WAKING LIFE MAY RESULT IN TERMINATION WITHOUT NOTICE.

PlayHaven fired this guy on the hysterical shriek of a Witch-Finder because that is currently the easiest, safest thing to do.

Should it be the easiest, safest thing to do? Or should doing that sort of thing also carry some risks, so that it's not just an Automatic Termination when someone is Accused of Witchcraft?

I believe the latter. And I think we've gone way too far towards the former.

We should not have a regime in which the terror falls on those who speak. We should strongly prefer a regime in which terror should fall -- if terror needs to fall at all, which apparently it always does -- on those who would stop others from speaking.

All because of one off color PRIVATE joke one geek said to another at a conference. BTW, what the fuck is a developer's evangelist anyway? 31 This story has been all the rage the past week in the tech world. I tend to agree with #11, if I was at a work conference like this I think a certain amount of decorum is called for and my employer could certainly act to protect their interests. There is also this stigma in the tech world that it's a boy's playground and girls are not welcome, so these kinds of stories tend to reinforce this stereotype. The lady clearly over-reacted, but it sounds like the dudes making the jokes were also being asses.

At any rate: It occured to me that if churches cannot refuse whom they will marry, why can they then refuse who can get communion (and its not a solely Catholic thing either)? Why can they prevent someone from being baptised? What makes one different than the other? Where is the limit? Surely the common carrier principle has logical limits, esp. when it comes to freedom of association, yes? What will happen is that if churches are forced to marry gays against their will, marriages will stop being held in churches and will be held in private homes, and the step towards war will be that much closer, for those so needing to do so will not love their government, nor the neighbor who made them do so. And I thnk it would be a just war, even though not a Christian am I. As far as this post--if companies cannot fire you for speech concernng unionization, then the social compact has to be they cannot fire you for speech on topics of citizen interest. Lest the birthright of citizenship not exist. Naturally, there will be gray areas, and no one wants an official approved topics list. Well, the Left does, so I take that back. But at any rate--on matters of public interest, it should be a tort if one is fired for commenting on them.

Ace, I recommend that you never go to work for a large corporation. Not only is this not unusual it is common policy everywhere now. In fact at the company I used to work for they told us to not tell ANY jokes, and especially bot in the hearing of women.  In fact, any joke that could be considered sexual or racist in nature was grounds for immediate termination.



And you know who is to blame?   Lawyers and their stupid "hostile work environment" and the stupid jurors that enable them and also vote for Obama.

As Ace said, enumerate the position we find ourselves now on so many topics from out of control taxation (some could say that because of the employer collecting those taxes, it makes it easier for the Government to collect. Corporate entities either are enticed or coerced to cooperate and they don't spend a lot of time fighting about it unless it's affecting their bottom line) to getting your private emails without a warrant.

If corporate entities are "people" then their should be some means for other people to counter and/or punish them.

This woman is a professional victim. Trained in gender and ethnic studies and just waiting for the chance to shaft someone over an offhand comment. That she took the picture and made no comment about what was said, speaks volumes. That she got fired also is sweet justice but it doesn't redress the violation of the guy who made the comment's rights and put his life back together.

And was it such a vile and vicious hostile workplace environment causing comment? I suggest no. That she grabbed the other comment and put that in says that SHE was the one who had her mind in the gutter.

That people get fired because of what THEY say someone meant by something they said is the biggest tragedy in the US today.

I'd be more upset if they were talking loud enough that she couldn't hear the speaker - that's just rude and more public than a few stupid comments.

The problem with this, of course, is that it requires the speaker to anticipate the reaction not only of the person to whom he's speaking, but of anyone potentially within earshot as well. How about reserving some bile for the idiot legislators who write these bullshit discrimination laws?  I defend these cases in California regularly (I'm defending six "workplace stress" crap cases right now) where our legislators work tirelessly to drive out the last few businesses that are still stupid enough to operate in this state.  As bad as things are now, they still keep coming up with new laws to harass business, all in the name of "protecting" the helpless employee. 

They've protected employees right out of employment in more cases than I can count.

Your employer has the right to fire you for public conduct.  Free speech isnt free of consequences and making dongle jokes and carrying on at a profesional conference can lead to a firing.  Also, sure harpies are everywhere and her actions also have consequences and no one is ever going to listen to her either.  But in this day and age for someone to think that making conference wide sex jokes isnt going to get repeated is well - a moron.  Guys I know with three kids and a ton of responsibilities usually try not to do things to put them out on the street.  Yes it is a crutch on the old free speech thing ut I have disagred with the policies of my employers, hell with the whole industry but that - need to pay the mortgage, and the tuition thingy got in the way of me being edgy cool

In the case the plaintiff does not prevail, the negotiating attorney or the person themselves if they are representing themselves is responsible to pay 1/2 the recorded offer for settlement to the defendant.

In California, Title VII isn't burdensome enough.  We have the CA  Fair Employment and Housing Act (FEHA) which is much more stringent in many ways than Title VII.  Except in very unusual cases, almost no employee sues under Title VII here.

Same with wage and hour claims.  The feds have the Fair Labor Standards Act which is bad enough, but California substitutes its own Labor Code with even more punitive provisions than the feds. 

I regularly tell my clients to move as much of their business out of state as they can.

410 The problem in most tech firms (I have worked in a few) is that that firing people is a minefield of laws and lawsuits and in response the HR departments are out of control. In many companies they are brought into any discussion about any employee right up front and their only interest is in (a) getting rid of the problem, and (b) not breaking a law or getting sued. Managers are interested in mundane things like making a profit, productivity, keeping good people, etc. but HR is not a profit center and their bonuses are based on how many people they hire and fire and how many lawsuits they avoid. I have done 30 day paper trails on drug addicts that fall off the wagon and can no longer make it through a day without puking or passing out at their desk. 30 days since all previous reviews were good and you can't just fire some one for no reason. I have seen guys show up at work in short skirts and no underwear and not get fired after two years since GLBTXYZ are a protected class and no one had the balls to tell the guy to put on a pair of pants and cover his nuts (he didn't work for me) My guess is that HR took over and decided to fire the guy quick to "minimize risk" while his managers stood by quietly not wanting to be responsible for all the horrors the HR people imagined as fallout from a dongle joke. I would have gone to the wall to defend the guy, (and I have many times in slightly similar circumstances) When the VP of HR says that this is a disaster and we have to fire him now, as soon as we discover the problem -- and not two weeks later only if there is fallout since that would invited a lawsuit) it is hard to blame the others in the company for going along. The problem is that we have amplified the risk of trying to deal with things intelligently and so we have to pull the trigger at first sign of risk.

My incident over Thanksgiving ended up costing me $1200 in lawyers fees plus several days off from work and a reinvestigation.  All of this so that I would end up agreeing to take some anger management classes and pay for the cost of cleaning a carpet stained in the brawl.  You know, things I would have done anyways if my friends had simply asked me.  Hell, they wouldn't have had to ask about the carpets.

Human beings are social creatures, and we have a need to figure out where we stand in the hierarchy.  Men tend towards direct confrontation.  You push a guy and see if he pushes back.  If he does then you know he's willing to stand up for himself and you respect him.  If he doesn't, then you don't.


Women tend to be less direct.  They maneuver and scheme and, I think, end up with a hierarchy much more rigid than a man's.  It makes sense when you're dealing with a small tribe where the women are competing for the attention of the highest men and two or three may share a chieftain's bed. 


The problem comes in modern society when women enter into male dominated areas and professions.  They don't want to play by the rules that the men operate by because they're unused to them.  I remember hearing a woman complain how if she's assertive and tough at work then she gets called a "bitch".  Well no crap, sister.  Here's a news flash: the tough and assertive guys aren't necessarily well liked either.  They're respected for the job, but you don't want to have a beer with them after work.

Where in ANY of this does it say this guy was acting in any "official" capacity ? As if his making a joke while employed is equivalent to making an official statement on behalf of his employer. 542 As a woman who has worked in the tech industry I think that I would be offended if my company fired a developer for telling an off-color joke.  Part of the fun of working for a small company (and a predominantly male one) is the occasional off-color humor that can crop up.  I never found it threatening, as long as the guys were respectful to me personally in conversation and the jokes obviously weren't directed at me.  And yes I did work for a company once where off-color jokes were rampant.  The tech industry is like the unknown frontier for women.  If you can't rough it up and laugh at your own gender then you really don't belong there.  Not everywhere needs to be as sterile as a corporation's board room.  When people are constantly afraid that what they say can get them fired, this increases the amount of stress in the work environment.  Let people be people.

544 So I'm supposed to believe two things according to the women (and men) defending this action. 1) Women are totally a man's equal and capable of doing anything a man can do. 2) Women are dainty flowers who will faint and cry at the sound or a crude word; and who require cradle-to-grave reassurance to get anything done at all. Um... If you want me to believe #1, quit acting like #2 is true. If you want me to believe #2... fine, I just didn't realize it was the 1800's. I tell off-color jokes on occasion (depending on my audience). I'll even ask if my target audience isn't one I've told a joke like that to before (i.e. 'I have a somewhat dirty joke... do you want to hear it?' and when I get a "no" I simply file that away). To be fair, I already don't treat men & women equally. I've never asked a guy if he'd be offended by a mildly dirty joke. Apparently this inequality isn't offensive that I do this, but that I'd ever consider telling a dirty joke where women are present... according to those who think women are equal. What the hell? This wasn't massive harassment, "dongle" is a funny word, and "forking" is also mildly amusing. He wasn't derogatory or offensive or EVEN TALKING TO HER. Oh, and in closing.. your dirty joke for the day: A guy goes into a doctor's office for a checkup; on leaving he's given a jar for a semen sample and told to bring it back tomorrow. Tomorrow he comes back with the empty jar. The Nurse looks at him and he says, "I tried, I tried with both hands, my wife tried... we even got the neighbors over to try... nothing". The Nurse says "You got the neighbors involved? What were you thinking?" And the guy says "Well when I can't open the damned jar I've got to try something". ... Feel free to have me fired if you're mortally and horrifically offended. Once my boss stops laughing when you tell her the joke that offended you.
