— Ace Have you read this story?
It's egregious. Go read that; I can't summarize a summary, and there's no sense just quoting half their article.
Clarification: Note that while this woman did in fact do the power-game passive-aggressive asshole-aggressive I'm Gonna Put You on My Twitter Timeline, she didn't actually ask for the guys to be fired. Or at least I haven't seen that claimed. That seems to be PlayHaven's call. That's on them.
Now, this Adria Reid or whatever her name is is a real harpy who enjoys the power-trip she gets in accusing people of the New Witchcraft, which is supposedly hateful speech. It's an Empowering Game for her, accusing people and such.
She's like the girl in Oleanna -- did you see that? Go see that. I'll wait.
Saw it? Tough to watch, right? But it makes a good point: We are empowering the worst of us with this power to accuse people of Witchcraft, I mean, Speechcraft.
Petty broken tyrants like this get off on it, and we just keep giving them that power.
But I don't want to talk about her, actually. Because people like her have always existed. There have always been scolds and hysterical accusers and yes, until recently, no shortage of people willing to bid for a little Spotlight Time for themselves by accusing others of sorcery. (In fact, in Africa and in India's hinterlands, the practice continues.)
We used to just roll our eyes, or, if we were feeling a little empowered ourselves, we used to tell them to have a lie-down on the fainting couch until they had sufficiently re-gathered their shit enough to join reasonable adult company again.
What's changed?
Us.
What the Unholy Hell was this company, PlayHaven, doing firing an employee who broke no laws, stood before no tribunal, and did not even act on the company's behalf, but his own behalf, on the say-so of a serial hysteric and Witch-Finder?
You see the problem? The problem in PlayHaven.
And the problem is corporate America generally.
Mark my words. I've said this before, and I'll say it again: The primary direct threat to your right to speak freely as a private citizen and an adult in a free democracy comes not from the government, but from your employer, who will fire you if some hysteric tweets about something you said in your personal capacity.
Why? Because they don't want the supposed "firestorm" such a tweet will cause.
They're cowards. And they will fire you for exercising your free speech rights as an American citizen if someone accuses you of breaking the Speech Laws on FaceBook.
Now, we can't change that either. The world is full of weak men. PlayHaven especially so.
But we can change incentives. As Milton Friedman said, we cannot expect to put good and noble people into positions of authority over us. He was speaking of the government, but his point applies equally to employers. He said we have to accept that the people with authority will continue to be be bad -- and we will only have real freedom and real progress when we change the incentives such that bad, weak people do the right thing.
Because the bad, weak people will be penalized for doing the wrong thing and rewarded for doing the right thing. They'll still be cowards motivated by fear-- but we can only have progress when we put the correct incentive structure of fear into them.
In the instant case, this means punishing, by any consumer boycott we can manage, PlayHaven, whoever the hell they are, until they re-hire this guy and give him a $5000 bonus as a shame-based cash-money apology for their own cowardice and weakness.
But this is not restricted to PlayHaven. This is going on all over.
What is needed is a statement, an organization, a mission, a continuing effort to let corporations know that what free adult citizens say on their own time, for their own personal account (that is, not on the company's behalf), is not the corporation's problem, and they will not have a lot of lunatic baying for red meat from the "online community" over such personal, not corporate speech.
And, conversely, if they seek to limit American citizens' freedoms, they will have a problem.
I know no one will join me in this. I know I'll just be told it's every company's right to fire people. (But then, people have a right to boycott over unjust actions, too.) And I'll hear that people have to be responsible for their words. (And this includes getting fired for saying "dongle?")
And I know people on both the right and left will think about the times they really would rather like to get someone from the opposite party fired.
But this is going to be affecting all of us, all of us who still dare to speak our minds publicly, and it is actually in all of our best interests to put a stop to this ludicrous Salem Speechcraft Panics.
We should still retain the power to boycott corporations who act against our interests -- in their corporate capacity.
And corporations with an interest in a generally upright image will retain the right to fire people who seriously injure that image with notorious actions of serious moral turpitude.
But people getting fired left and right for simply exercising their basic right to free speech?
Yes, I know company's have the right to do this. But if we keep incentivizing them to do it -- that is, if we keep all the risk on the "Keep Him on the Payroll" side of the ledger, with no downside risk for these ridiculous Salem Witch firings -- we'll have more and more of it until basic company policy will be:
IT IS REQUIRED THAT YOU DO NOT ENGAGE IN ONLINE ARGUMENT OR DISCUSSION OF ANY SENSITIVE ISSUE, AND FURTHER DO NOT ENGAGE IN SUCH DISCUSSIONS IN ANY PUBLIC OR SEMI-PUBLIC VENUE, BUT INSTEAD CONSIDER IT A PART OF YOUR BASIC JOB DUTIES TO REPRESENT YOUR EMPLOYER AS HIS SPOKESMAN IN ANY PUBLIC SETTING WHATSOEVER. FAILURE TO REPRESENT YOUR EMPLOYER AS HE WISHES TO BE REPRESENTED IN EVERY SINGLE MOMENT OF YOUR WAKING LIFE MAY RESULT IN TERMINATION WITHOUT NOTICE.
PlayHaven fired this guy on the hysterical shriek of a Witch-Finder because that is currently the easiest, safest thing to do.
Should it be the easiest, safest thing to do? Or should doing that sort of thing also carry some risks, so that it's not just an Automatic Termination when someone is Accused of Witchcraft?
I believe the latter. And I think we've gone way too far towards the former.
We should not have a regime in which the terror falls on those who speak. We should strongly prefer a regime in which terror should fall -- if terror needs to fall at all, which apparently it always does -- on those who would stop others from speaking.

Ace, I recommend that you never go to work for a large corporation. Not only is this not unusual it is common policy everywhere now. In fact at the company I used to work for they told us to not tell ANY jokes, and especially bot in the hearing of women. In fact, any joke that could be considered sexual or racist in nature was grounds for immediate termination.
And you know who is to blame? Lawyers and their stupid "hostile work environment" and the stupid jurors that enable them and also vote for Obama.

"A technologist or technology evangelist is a person who attempts to build a critical mass of support for a given technology, in order to establish it as a technical standard in a market that is subject to network effects.[1] Professional technology evangelists are often employed by firms who seek to establish their proprietary technologies as de facto standards, or to participate in setting non-proprietary open standards. Non-professional technology evangelists may act out of altruism or self-interest (e.g., to gain the benefits of early adoption or the network effect)."
but no entry for "developer's evangelist". Microsoft, on the other hand, has this: "Come represent Microsoft as a Developer Evangelist. The Developer Evangelist (DE) is a member of the world wide team of Developer Platform Evangelists (DPE) within a subsidiary or district. The overall mission of the DPE is to secure platform adoption and revenue growth through evangelism, community engagement, relationship marketing and a vibrant solutions ecosystem."

As Ace said, enumerate the position we find ourselves now on so many topics from out of control taxation (some could say that because of the employer collecting those taxes, it makes it easier for the Government to collect. Ditto sales tax, ditto other taxes. Corporate entities either are enticed or coerced to cooperate and they don't spend a lot of time fighting about it unless it's affecting their bottom line) to getting your private emails without a warrant.
If corporate entities are "people" then their should be some means for other people to counter and/or punish them.
This woman is a professional victim. Trained in gender and ethnic studies and just waiting for the chance to shaft someone over an offhand comment. That she took the picture and made no comment about what was said, speaks volumes. That she got fired also is sweet justice but it doesn't redress the violation of the guy who made the comment's rights and put his life back together.
And was it such a vile and vicious hostile workplace environment causing comment? I suggest no. That she grabbed the other comment and put that in says that SHE was the one who had her mind in the gutter.
That people get fired because of what THEY say someone meant by something they said is the biggest tragedy in the US today.
We are no longer the home of the free. Soon we won't be the land of the brave either and we can thank the pusillanimous pipsqueaks like Mike Bloomberg et al for our being in that state.
And of course the Liberal slanted State Media and all the other brain washed deviants the Progressives have produced over the years.

Ms. Neurotic Harridan fucking overheard their conversation, and was "offended" by something she heard while eavesdropping on the other two, neither of whom had any problem with anything.

Most likely if it had been a senior developer or something, he would've turned to them and said "guys this isn't the place for those kinds of conversations" and probably that's where it would've stopped with the two talkers chastised and silent and the senior having exerted leadership and discipline.
But no, she chose to climb up on her vagina and away she went. She even jumped to conclusions beyond what was overt because she apparently has a hair trigger when it comes to anything sexual.
I note that she appears to be of some ethnicity which may or may not have sensitized her to these types of comments and they certainly would've led her in college to associate with those that are perpetual victims with hair trigger responses to words that even barely approach having a sexual or derogatory connotation.
(can you say niggardly, or black holes?) Or any other of the words that have induced ignorant reactions by the perpetually aggrieved.
The Race and Feminist Baiting Industry is a despicable and mean group and this shows they're responsible for more than just what they stir up by themselves.

All of this is the utter destruction of the concept of privacy and the logical outcome of the personal is political. If every single solitary thing I do and think and buy and eat and everything else is a political statement, then it is only fair for those who oppose my politics to attack me when and wherever they can, including through my employer.
I will refer to my prior comments on this matter as to my opinion of what a shrieking harridan such as she means for modern "feminism".

Further, this is the heckler's veto with a side of victimocracy. She wasn't party to the conversation but decided it had to be shutdown because she's Offended™!

When I was in academia, and for my sins dean, I once received a phone call (at 8 am on Saturday, no less) from a Valkyrie who ranted to me about ... the lack of respect shown women in the graffiti in a men's restroom. Imagine.
I heard out, then told her I appreciated her editorial assistance in this regard, and would give the matter all the attention it deserved.
(I restrained the impulse to ask how she came to find herself in the mens' restroom.)

But still. Least bad person in the story, which isn't about what a pussy he is.
The deep-down shut-up-about-it fact here (ignoring all of Ace's broader points, which are good) is that any field where women are "represented" will be purged of nerds. And the womynists' current nerd-purge targets are "science," "technology," and the extra-professional "spaces" where dorks freely congregate and network (video game tournaments, atheist conventions, Reddit, etc.).
So in a century or so, Americans will be pushing Flintstones cars around while the Muslims colonize Europa...if this arrow on my chart is accurate. But our "scientists" will be exquisitely sensitive Brad Pitt-looking dullards, so...progress.

Based on the comments she actually quoted they might be a 3 at best on the Offense Scale. This was really pretty tepid stuff that wasn't even addressed to her. I'd be more upset if they were talking loud enough that she couldn't hear the speaker - that's just rude and more public than a few stupid comments.

If your code of conduct says "don't ever say anything unkind or that might be interpreted as inappropriate," it *will* be violated, *period*.
The problem with this, of course, is that it requires the speaker to anticipate the reaction not only of the person to whom he's speaking, but of anyone potentially within earshot as well. The offense isn't in the deed intrinsically or in the intent, it's in the perspective of anyone overhearing the comment.
Crazy.

1. The conversation did not include the offended individual.
2. The language concerned was "forking" and "dongle" employers should be thrilled that an A and B conversation used such reserved language if the topic was in fact sexuality.
3. You cannot expect any human to maintain a 100% decorum in all conversations avoiding all possible taboo subjects like he was running for public office. No personal connections with other people would ever get made and the social aspect of gathering people together would be lost.

I defend these cases in California regularly (I'm defending six "workplace stress" crap cases right now) where our legislators work tirelessly to drive out the last few businesses that are still stupid enough to operate in this state. As bad as things are now, they still keep coming up with new laws to harass business, all in the name of "protecting" the helpless employee.
They've protected employees right out of employment in more cases than I can count. It's mind-boggling.

Ace,
Your employer has the right to fire you for public conduct. Free speech isnt free of consequences and making dongle jokes and carrying on at a profesional conference can lead to a firing. Also, sure harpies are everywhere and her actions also have consequences and no one is ever going to listen to her either. But in this day and age for someone to think that making conference wide sex jokes isnt going to get repeated is well - a moron. Guys I know with three kids and a ton of responsibilities usually try not to do things to put them out on the street. Yes it is a crutch on the old free speech thing ut I have disagred with the policies of my employers, hell with the whole industry but that - need to pay the mortgage, and the tuition thingy got in the way of me being edgy cool

In a tort case. All attempts to settle are made part of the court record but kept private. In the case the plaintiff does not prevail, the negotiating attorney or the person themselves if they are representing themselves is responsible to pay 1/2 the recorded offer for settlement to the defendant.
That will give the defendants some motivation to fight the bullsh*t and the plaintiffs to be f*king reasonable.

Yep, they contribute to the insanity, for sure.
But then, a lot of 'laws' are created without any legislation at all...when a lawyer wins a case and a new Precedent is established.

In California, Title VII isn't burdensome enough. We have the CA Fair Employment and Housing Act (FEHA) which is much more stringent in many ways than Title VII. Except in very unusual cases, almost no employee sues under Title VII here.
Same with wage and hour claims. The feds have the Fair Labor Standards Act which is bad enough, but California substitutes its own Labor Code with even more punitive provisions than the feds.
I regularly tell my clients to move as much of their business out of state as they can.

THIS.
Thank you. I've made mention of this once or twice and got some push back claiming that the hiring policies don't come from HR they come from Corporate or some such and don't be so hard on the HR scrunts.
Sorry, NO. The domination of HR has stultified the hiring of innovative and out of the box thinkers in all areas of commerce.
Those type of people will usually not have followed the approved path and have the accreditation or referenced experience to be hired by those who have learned the current mode of hiring.
It seems that hiring is done these days with the eye mainly on not hiring any problems whatsoever and this automatically will wind up being a sort for the mediocre.

The woman was an idiot... well she's generally an idiot.
The problem, of course, is like many of the other problems in society: the traditional behaviors that we were taught have been all but washed away by the left, which encourages narcissism and shock value. Upsetting the squares is a badge of honor, right up until you cross some imaginary line and offend the wrong protected class. Once that happens the power of the state comes into play because the traditional method of shaming and social isolation are no longer available.

That seemed to take care of a lot of problems back in the day before everyone became neurotic about producing some kind of documentation during a lawsuit discovery.
It's all because of the lawyers, as has been said. There was also a time when two guys could have a disagreement, throw a couple punches and then have a beer afterward. Not anymore. Now it's assault charges and a lawsuit and the next thing you know, you can't own any guns, cause you're a felon. All because of lawyers. Again.

Maybe you're right. I've been working in a politically correct environment for so long that I'm conditioned, I guess. But I was saying this back in 1990whatever when Clarence Thomas was being lynched for the Anita Hill nonsense. Which is to say, you haven't learned by now what the corporate (and government office) world is like? You don't know the environment well enough to know that if there are harpies present, and they have the power to "report" you or fire you, you're going to get fired for stupid, silly, HARMLESS jokes?
You will. And no, it's not fair. But it's the world in which we live.

All of this so that I would end up agreeing to take some anger management classes and pay for the cost of cleaning a carpet stained in the brawl. You know, things I would have done anyways if my friends had simply asked me. Hell, they wouldn't have had to ask about the carpets.

When men are allowed to be men and boys men in training society has built in guard rails that sort of prevent a lot of this passive aggressive shit.
Society is better of with school age boys rolling around in the lot behind the school once or twice and getting it out of their system, rather than bottling it up until it explodes.
I was only in one fight in high school and I got my ass kicked. It was three on one and they started it by trying to push me around. Even then after it was done they left me alone. They knew I wouldn't take shit from them, and moved on.

No "hey that's not a subject for conversation here" or "I find your comments make me uncomfortable" and then waited to see if they went away or shut up.
but NOOO. she took the pic and then splattered their images on the internet and complained to the boss before she took any personal action. (other than ratting them out)
That shows exactly what she accomplished was exactly what she wanted to happen. She didn't want to stifle speech or have them disciplined, she wanted them CRUSHED.
This girl has got some kind of man/woman issue and maybe some ethnic resentment going.
She got fired because her company realized that at this point she wouldn't be able to do her job and who would want her around?
It's like she turned into an undefined trigger time bomb. No one could guess when where or who she would go off on next.
Who needs that around. Especially in a position where shmoozing is a job requirement. (I'm assuming here.)
I made a comment on the Pyon's Pres. statement that they should hire the guy back. Get the other company to hire her back and call it a wash. maybe sponsor a seminar on conference etiquette. They ALL look bad. Fix it and move on.

My son threw a dirt clod at another kid during recess back in grade school. I got a call from the principal's office, and when I went there, she handed me the name of a child psychiatrist and suggested I make an appointment for my son.
I suggested a couple of things of my own, and promptly withdrew him from the Government Castration Center.

a lesson I'm trying to teach my son...
I'm not a huge guy I am ~5'10-5'11" and am burly but not stocky...
I was small, in school my son is on track to be 6'4"-6'6" and will take after wife's dad....
and he is a kind gentle hearted boy...
too kind at times, I fear if/when he finally fights it will be bad.

'Zero Tolerance'.
We seem to be living in the Era of Zero Tolerance.
Little boys get sent home from school for 'sexual harassment' for just kissing a little girl on the cheek.
Liberals love to use that term, and call for tolerance on some things...and yet declare 'zero tolerance' for other things.
So there's like, zero tolerance...for being intolerant.
But then, isn't 'zero tolerance' the same as being...intolerant?
Bottom line....businesses are under fire from all directions these days.
It's not just lawsuits they have to worry about.
They can get boycotted too.
So they're going overboard, to avoid anything that could hurt their bottom line.

Later on they brought back twice as many people and basically played the musical chair version of throttling my ass all over the school yard, though i tried to put up a good fight. Weirdly enough I never got bothered after that.
Human beings are social creatures, and we have a need to figure out where we stand in the hierarchy. Men tend towards direct confrontation. You push a guy and see if he pushes back. If he does then you know he's willing to stand up for himself and you respect him. If he doesn't, then you don't.
Women tend to be less direct. They maneuver and scheme and, I think, end up with a hierarchy much more rigid than a man's. It makes sense when you're dealing with a small tribe where the women are competing for the attention of the highest men and two or three may share a chieftain's bed.
The problem comes in modern society when women enter into male dominated areas and professions. They don't want to play by the rules that the men operate by because they're unused to them. I remember hearing a woman complain how if she's assertive and tough at work then she gets called a "bitch". Well no crap, sister. Here's a news flash: the tough and assertive guys aren't necessarily well liked either. They're respected for the job, but you don't want to have a beer with them after work.

But equally likely but unsaid is this theory. She is a known troublemaker and has been for quite some time. So odds are her employer has wanted to fire her sorry ass since days after making the mistake of hiring her but has been terrified to do it. This incident finally have them as close to an airtight excuse as they were ever likely to get and they jumped on it. Truth be known I'd put money sighs of relief throughout her previous workspace if not outright rejoicing.
But ain't it typical of the doublethink of her ilk when you consider the crap she (and most feminists in general) are pushing? Women are just as good as men, damnit! And just as soon as you retards implement a carefully designed affirmative action program, totally redesign your business methods and processes and force all employees to undergo mandatory sensitivity training so that we don't see or hear anything that might shock us to our fainting couch we will prove it to ya.

If PlayHaven ever faces sexual harassment claim, the claimant can point to an incident of an employee making a "sexist" joke in an "official capacity" while PlayHaven took no action.
And as for Richards, she's basically wearing a giant neon sign saying "I'm a walking frivolous sexual harassment lawsuit waiting to happen". How many employers are going to offer her a job after googling her name?

Despite what this woman thinks, most women are not children who have to be nurtured and supported with positive messaging so that they feel welcome during their entire career. Who the hell wants to hire such a dimwitted, self-centered adolescent that they have to constantly reassure them that they are wanted. Here is a clue. If they give you a paycheck then they want you. You are experiencing the opposite of that right now so in the future it should be easier for you to tell the difference.
