This Is Just Too Damn Perfect

Josh Earnest, White House Special Assistant to the President and Principal Deputy Press Secretary, read a prepared statement to the press aboard a flight regarding the Verizon/NSA news that broke last night.

There is a robust legal regime in place governing all activities conducted pursuant to the Federal Intelligence Surveillance Act. That regime has been briefed to and approved by the court. And activities authorized under the Act are subject to strict controls and procedures under oversight of the Department of Justice, the Office of the Director of National Intelligence, and the FISA Court to ensure that they comply with the Constitution and the laws of the United States, and appropriately protect privacy and civil liberties.

FISA, of course, stands for FOREIGN Intelligence Surveillance Act. Not Federal. There's a world of difference.

Just a slip of the tongue? Sean Davis asks if we could perhaps see a transcript of that statement just to make sure.

Though, I did have a bit of a bitter laugh of this: That is one reason we have long argued that the Patriot Act, enacted in the heat of fear after the 9/11 attacks by members of Congress who mostly had not even read it, was reckless in its assignment of unnecessary and overbroad surveillance powers.

I'm a Verizon customer. They supply my television, my telephone, and my Internet. I now wonder if every time I click on AoS it is recorded in some database, every time I pick up the phone it is recorded in some database, every time I watch Fast and Loud it is recorded in some database.

Apparently the only privacy left to me, thanks to Roe vs Wade, is if I miraculously (as a guy) become pregnant and decide to seek an abortion.

Doesn't matter if you are making a call or not, you 'phone has to register it's presence within the coverage area of the nearest cell tower in order for incoming calls to be routed correctly to your present location.  If your device is powered up, the cell network knows where you are to within a few feet.

I remind you all that pursuant to HIPAA (which I know isn't applicable here, but bear with me.) Telephone numbers are one of the 18 "Personal Identifiers" that have to be removed from medical data.

Apparently however when attached to phone calls they're just "metadata."

I suppose the argument goes "well, your phone number is sent out to the person who makes the call" which may be true, but I didn't authorize its use to the government.

Telephone numbers are one of the 18 "Personal Identifiers" that have to be removed from medical data. Apparently however when attached to phone calls they're just "metadata." Don't see how that would work.   The cell phone company has to know who you are (which phone is in use) in order to bill you for services rendered.   They're the ones who have the information that is being given up to the feds, not your personal phone.  

I guess there could be an option to anonymize accounts (cash only pre-paid), but it'd be rather hard to control the association of a phone number with you.    "Hey, uh, don't call me at XXX-XXXX, ok?"

I have enough years in the computer industry to assure you that if the first time you ever test a large software project is on election day, the chances of it being a disastrous fuck up are pretty close to 100%.  Just the fact that they did not do a full scale test before election day is a good indication that the people in charge of the project were grotesquely incompetent.

Secondly, I would ask what sort of Engineers were they supposed to be? The title "Engineer" is given to a lot of people who don't actually do Engineering.

Do you think that problem could have been predicted and prepared for?  Banking systems are under attack pretty much all the time now and yet they function.


The fact that they never did a full scale test of a project that they were relying on should tell you all you need to know about the competence of the Romney campaign.

Phone call location is by definition the cell phone company's records - which makes it outside of the user's control to encrypt or conceal. 

Their servers have to have this data, somewhere: 
- Phone with #xxx-xxxx made a call from cell tower at location A at 5:30pm for 3 minutes. 

You could encrypt what you said or texted over that call, but the fact that your phone made that call can't be a secret minus some new laws forcing a privacy focused technical implementation.   (All servers toss out all logs within 24 hours? Can't fix billing mistakes) 

Any fix you can come up for the situation is a legal solution, not a technical one.  (there's no app to fix our legal system, alas)

These folks all have at least a BSE degree and some have an MSE or even a PhD; disciplines include Electrical Systems & Equipment, Structures, Flight Analyst, Flight Test, Software.  There were some manufacturing inspection folks involved too but they are called 'engineers'.

 

 For the most part, very smart people without a lick of common sense.

Phillip K. Dick was on the right wavelength on just about every sociopolitical trend that's become visible in the last 20 years. The man's intiution and ability to extrapolate possibilities from fixed points was uncanny. (I discount his delusional belief in his personal divine revelation; I blame the acid.)

 

'The Man In The High Castle' is one of my favorite novels. It's also one of the few of Dick's works that will never be made into a movie.

When the majority of the audit is on how well the certification files are organized and how the forms were completed instead of how the inspections, the tests and the analyses were conducted...well...you get the point.
