— Gabriel Malor Happy Friday.
Folks that don't like the platinum coin trick because it's silly, though not illegal or unconstitutional, have proposed a new idea that, though it is less obviously silly, is definitely illegal. An IOU is just another form of debt, something Treasury is not allowed to take on beyond the debt limit. Not to mention, IOUs are not a solution to the problem, just another way to delay it and, unlike the platinum coin trick, not even delay it that long.
Sex-selective abortions are already occurring in the UK.
Politico finally figure out something that we've been saying for three years: if you make health insurance more expensive, which is what Obamacare did, health insurance will cost more. OTOH, the writer clearly doesn't realize that placing a new tax health on insurers isn't going to mitigate their additional costs of mandatory new benefits. She seems to think a tax on a business doesn't cost the business anything.
The 8.5 billion foreclosure settlement with banks is just a way to paper over yet another Obama Administration blunder in its failed mortgage reform efforts.

People involved in mergers talk about how companies sometimes set up poison pills to prevent a hostile takeover. This guy from Bloomberg wants the Republicans it seems to drink the hemlock of removing the debt ceiling so Obama gives up even thinking of issuing a platinum coin. How is this a win for the Republic? Its not.

ObamaÂ’s nominee for Treasury Secretary Jack Lew is a revolving-door lobbyist who worked at Citigroup in 2008, and then got a $944,518 check from the failed bank on January 15, 2009, according to his financial disclosure statement. That was just weeks after Congress passed the Wall Street bailout, funneling $45 billion in taxpayer money to the bank.
Also, in the 1990s, Lew worked at K Street lobbying firm Van Ness Feldman.
This certainly undercuts ObamaÂ’s talk about closing the revolving door, keeping out lobbyists, and standing up to Wall Street.

As I have said all along, the Platinum Coin dodge is illegal too. Court have taken a dim view in the past to using a loophole in one law to completely subvert another law.
Just because you have deposits in a bank doesn't mean you can go in with a gun and make withdrawals.

He managed to blame it on the engineering watch who did not have the proper "mud watch" set. Said all the condensers silted up and cause a loss of all propulsion and the ship "drifted" on the sand bar.
Amazing that the "drifting" caused there to be scooped in mud and sand by the ton in the condensers and it took half a dozen harbor tugs to get it off.

I'm pretty sure I just heard the next Andrew Breitbart. Beck had him on in the morning, and Levin had him on last night for nearly the last half hour. Jason Shapiro, author of "Bullies," and staffer at Breitbart, is phenomenal.
He's a fighter and is urging the GOP/conservatives/TEA Party to take the gloves off and fight like the left does. Ex.: When George Snuffaluffagus is the moderator of a Sunday show or moderator of a debate, flat out ask, "What kind of journalism credentials do you have? You're a former member of the Clinton admin turned TV personality. How could you have any objectivitiy where the Republican party is concerned?"
He entered college at age 16. Breitbart emailed him out of the blue when Shapiro was 17. He's now 27.
You can hear the interview at www.MarkLevinShow.com and click on the archives from yesterday. He came on at 8:35, so head for the end of the broadcast.

Good morning, ‘rons and ‘ronettes. And thanks for the morning briefing, Gabe and Vic. Have we got a trillion-dollar wonder coin yet? Has Preezy Barky O’Genius told math, “Don’t call my bluff” yet?
What an age we live in. Anyway, here are two quick apocryphal stories. The first concerns two bitchy actresses; for our purposes, we’ll say its Crawford and Davis. The two found themselves together one night at another actress’ 50th birthday party. Crawford, knowing Davis’ 60th birthday was coming up, sighed, “Oh, I dread to think about turning 50.”
“Why?” Davis snapped. “What happened then?”
Another story is about the great theatrical impresario David Belasco. It seems that for several months, a young writer had been pestering Belasco with the script of his sure-fire hit play. Each time Belasco turned it down, the author would come back, saying heÂ’d rewritten it, making it even better than before. Finally, Belasco had enough, and when the writer cornered him at the premiere of a new show, he told the writer that he was sick of seeing the script and wanted nothing to do with it.
“But Mr. Belasco,” the writer wheedled, “isn’t there any way you could put this on the stage?”
Belasco thought for a moment. “All right,” he said, taking the script and handing it to an assistant. “Cut this up and use it for the snowfall scene tonight.”
And thatÂ’s it for me. If I can pull my notes (and thoughts together), Monday IÂ’ll tell you the story of an unlucky actress named Peg Entwistle, whose ghost is said to haunt a certain Hollywood landmark.
Hope you all have a wonderful weekend.
And by the way, if you like my stories, why not buy my book, The DirectorÂ’s Cut: A Theda Bara Mystery, available on Kindle and from Amazon and Barnes and Noble? Help a fellow Moron out, wonÂ’t you?

Congress, in its infinite wisdom, thought that giving Treasury a broad grant of authority to mint and issue platinum coins was a good idea. That was stupid of Congress, but just because it's a stupid law does not mean it's illegal when Treasury exercises that authority.

A few years ago, I went to a casino in Indiana. First time I ever went to a casino, but it was mainly to see a friends son perform. I tried gambling at a slot machine. Boring as hell, and I lost about 10 bucks in 2 minutes. Wheeee! I don't understand the rest of the games, so I went to the bar. After the show, we were walking out, and I noticed...Most of the people here that are gambling, look like they don't have a pot to piss in or a window to throw it out of. They were standing in line to play the machines.
I do not have any desire to go back.

The President does not have the authority to circumvent this ability.

Hickenlooper evoked the 1999 Columbine High School shooting as evidence that lawmakers can act when a tragedy requires them to do so. After that shooting, Colorado closed the so-called “gun show loophole” which allowed purchases at gun shows without background checks.
Question for the governor. If more restrictive gun laws are so effective, why did the Aurora shooting happen after the post-Columbine legislation? So lawmakers can act, but can they accomplish anything?

Lawmakers and politicians are almost always acting, but very rarely accomplish anything productive.
The most productive and substantive thing ever done by American lawmakers was writing the Constitution, and almost all subsequent politicians/lawmakers have been acting so as to diminish that document and its principles ever since.

On that note my daughter's boss gave her the book Agenda 21 to read. Of course she hasn't so I picked it up last night and read it in one sitting. A bit far fetched and disturbing UNTIL you read the last few pages and find out Agenda 21 is actually a real thing. Not a huge Beck fan but he does uncover some interesting stuff.

Well congratulations; it's obviously worked out well for Council Bluffs. Here in northeast Ohio I don't think it's done a damn thing for the local economy except stopping the outflow of people going elsewhere to gamble. So in essence it's slicing a stagnant pie thinner. Making Ohio a right to work state would go a lot further toward growing the state economy.

From recent experience, in NC, to privately sell a handgun the seller needs to make sure the buyer has either a concealed carry permit, and keep a copy of it FOREVER, or the buyer must give the seller a valid pistol permit from the sheriff's department and the seller must keep that FOREVER. Failure to do so is a Class 1 misdemeanor - $2,500 fine and/or 6 months guest of state.

A Calvin Coolidge story:
Cal and Mrs. Cal are visiting a chicken farm. While the Prez is wandering off somewhere else, the farmer points out a rooster to Mrs. Cal and notes that he's enthusiastic enough to mate all day long. "Tell that to Mr. Coolidge," she chuckles.
Silent Cal walks by, and the farmer repeats his story and Mrs. Cal's comment. "Does he mate with the same hen each time?" Cal asks.
"No, sir."
"Tell that to Mrs. Cooldige."

In Henderson, North Carolina, a 14-year-old boy defended his home with a shotgun.
The boy's sister, who was hiding in a closet, called 911 first. Then, the boy also called 911, after he fired two shots.
Deputies found 19-year old Michael Henderson dead on the front lawn.
The 14-year-old isn't expected to be charged, due to North Carolina law regarding intruders.
Another man is facing multiple charges in the case, including breaking and entering.

Congress has the power of the purse and can raise or lower the debt ceiling and fund things generally or explicitly.
The President does not have the authority to circumvent this ability.
The US mint cannot conjure into existence a 1 Trillion dollar coin and put it into the pocket of the President to spend on whatever he pleases.
THE EXECUTIVE SIMPLY DOES NOT HAVE THAT POWER IN THE CONSTITUTION! OR IN LAW! OR STATUTE!
It is simply illegal!
Period!
No matter what "clever" lawyers think!
Now whether congress asserts it's authority is another matter.

After a mom shoots an intruder in Georgia, police have found that the man likely had more crimes in mind.
Paul Ali Slater tried to break into a home on Friday afternoon but ran into an angry mom, who shot him five times, police in Walton County say. But now police have found that before the mom shoots the intruder, he was looking into other homes in the neighborhood to break into.
....
But instead of hiding, the mom pulls out a .38 and shoots the intruder.
“The guy’s face down, crying,” the sheriff said. The woman told him to stay down or she’d shoot again.

The teenage son of a Harris County Precinct 1 deputy shot a home intruder Tuesday afternoon in the 2600 block of Royal Place in northwest Harris County, deputies said.
The 15-year-old boy and his 12-year-old sister had been home alone in the Mount Royal Village subdivision when around 2:30 p.m. a pair of burglars tried the front and back doors, then broke a back window.
The teenager grabbed his fatherÂ’s assault rifle and knew what to do with it.
“We don’t try to hide things from our children in law enforcement,” Lt. Jeffrey Stauber said. “That young boy was protecting his sister. He was in fear for his life and her life.”
The home invaders fled, leaving a trail of blood.

That's the old game of check kiting in a nutshell. For you young whippersnappers, back in the olden days, it took a week or so for a check to clear the bank. A quick way to prevent a check from bouncing was to have a second account which also had little money in it. Kiters would write a check against the second account and deposit is in the first account. When the check to the first account reached the bank, the deposited funds from the second account would be there to cover it. The race was then on to get funds into the second account to cover the bogus check making it's way back through the system to that account. The game amounted to shuffling funds between the two accounts to cover whatever paper was moving between the two. The hope was that there would eventually be enough real money in the accounts to cover all outstanding checks and stop the cycle. It rarely worked out that way.
The platinum coin trick is just that. At some point, there has to be enough money available to return the coin to the mint without taking that much money out of circulation.

Thank you Congress.
See, once upon a time, ERs were free to triage you, say, "This isn't an emergency. Go to your doctor or come back during clinic hours." But then congress got involved. You see, it wasn't "fair" that people were being "turned away" from receiving "emergency care" for their bunions. So a law was passed that said, in essence, "If the patient thinks its an emergency, then it is."
Now, obviously none of them have ever worked help-desk support with a ticketing system, or they would know this obvious truth- when everything is rated as an "emergency," nothing is treated that way.
Money is a medium of exchange.
Sorry, pedantic and all that- Money is no such thing. Money is an abstract concept meant to convey the combination of work and time. Currency is a medium of exchange.

That liberals/progressives (and many Unionists) never seem to get this fact of basic economics never ceases to amaze me.
It's like companies are magic boxes where greedy owners rape the earth and exploit their workers and skim the wealth off the top.
It's because the majority of those who preach socialism, have never had to produce or been an employer they've either been subsidized by someone all their life or been a government worker.

I worked at a Health Care claims clearinghouse as a customer support type. They way our support worked, though, was that clients would log tickets online, and rate their urgency from 1 ("Wishlist") to 5 ("Emergency").
Every day, it seemed, I had to explain to the same clients that if they listed every problem as an emergency, then the only way I could work them was chronologically. If they wanted their support triaged, they'd have to rank them more reasonably, so I could really get to the most important things first.
That claim that didn't go through today, unless it was some 5 figure claim amount, is probably less important than that whole set of claims that didn't go to a payer yesterday, for instance.

As for homosexuality, I don't think there will/or can be a definitive genetic marker, since many homosexuals are such by environment. Not all, mind you, but at least a quarter to a third if not more are not born that way but instead are the product of various factors after birth.

Yes that's my point. Most of the people there were not real emergencies. They use the ER as of it were a General Practice Dr's Office and they are there for free stuff. And real emergencies like you had get shunted aside or have to wait. The system is broken and obamacare does NOTHING to address that.
The two biggest reforms that would fix the medical system are to reform the emergency room debacle and to end the deliberate shortage of medical schools imposed by the state.

Actually, the problems with HIPAA are much more around enforcement (some of the law is intentionally very vague, but that makes it hard to enforce) and the fact that few medical office personnel have the reading comprehension skills of your average 6 year old.

He should have vetoed the law but did not.
However, an ER does not have to accept patients who come in for routine non-emergency conditions. This is where it gets complicated. Determining "non-emergency" is a judgement call by the doctors. It is subject to second guessing by ambulance chasing lawyers.

Ah, Vic, once again using the clear meaning of a word, in this case "bullion", to attempt to subvert the sophisticated arguments of legality by his superiors, the lawyers. But that won't work, because the lawyers can argue what the definition of "is" is.

As a practical matter (see also "ambulance chasers"), it is not. As a practical matter (and actually encoded into law in most States, I think), if someone thinks they're having an emergency, the ER has to see and treat them.

make health insurance a personal deductible and you have a trifecta
I'm actually a supporter of states imposing mandatory insurance requirements for emergency care. Require everyone to have insurance covering emergency room care up to ,say, $10,000 and say that while ERs must treat you even if you aren't insured, if they do you can be charged by the state. Most policies would come out to a few bucks a month at most, which is within reach even for poor families. Those that can't afford it could apply for coverage through a state program but it would come with restrictions.
Add to that a removal of the state restriction on medical schools and you'd eliminate much of the problem with health care in one swoop.

Congress, in its infinite wisdom, thought that giving Treasury a broad grant of authority to mint and issue platinum coins was a good idea. That was stupid of Congress, but just because it's a stupid law does not mean it's illegal when Treasury exercises that authority.

As someone mentioned here yesterday, it doesn't matter what you think or even what Congress thinks the law means. When the law is unambiguous, outside context is immaterial. The law, while stupid, is simple and straightforward. What anyone intended for the law to say is irrelevant.

I've been following "the coin" discussion, and it seems to me Vic is pretty persuasive. The law touches on bullion coins, which are minted as investment vehicles and not "money" per se. Such things are purchased as an easy way for people to buy a guaranteed amount of bullion, not as a way to spend the face value of the coin in a novel way.
For instance, look at the Platinum Eagle program. These have a legal tender amount fixed to them, but it is far less than the actual value of the 1 oz of platinum that makes up the coin. This is, to me, distinct from the pennies, nickels, etc made by the mint where the face value far exceeds the material value of the coin.
Trying to say the Mint has the legal power to create a bullion coin with a face value in excess of the bullion value seems to me to turn the law on its head.

No, it's not.
Or, rather, it must not be if we want "the law" and "justice" to mean anything.
That's actually why having laws about anything that isn't fairly cut and dried is morally perilous. If there is an substantial possibility that the law will be given subjective, and not objective, judgement, then the law is unjust.
When the administration in charge can elect (without consequence) which laws to enforce, and how, we're asking for problems.

The Medical supply is artificially restricted by the state. This, among other things is responsible for the high demand and high prices charged for such services.
I disagree with you about insurance. I regard Insurance as one of the major CAUSES of high medical costs. With someone else paying the bill, there is no incentive to be thrifty by those seeking or supplying medical service. In Engineering, this would be known as a broken negative feedback loop.

Coins made of fissile material would certainly curb pickpockets while adding lead pockets to purses and slacks. And such coins would not rest long in those lead pockets for fear of collecting so many coins the pile goes critical.
And no I did not think that up on the spur of the moment. IIRC Larry Niven literally coined all that reasoning decades ago.

The 14th amendment has zero to do with the ability to "borrow" in excess of the legal limit.
And you will NEVER get SCOTUS to accept a case on this. They will simply say congress has an option and refuse to grant standing.
Of course the option is impeachment. Something the Democrats will not vote for if they had proff that Obama was a pedophile who killed his victims after sex and then ate them.
