Happy Monday.

Patterico has an exclusive about prosecutorial overreach and potential misconduct in the federal case against tech genius Aaron Swartz for "liberating" thousands of JSTOR academic articles. Swartz co-authored RSS 1.0 at age 14, built the platform that eventually became reddit, contributed to what became Creative Commons. He took his own life on Friday, at age 26, just as federal prosecutors disclosed that they'd withheld a crucial email in the case that could have sent Swartz to jail for 30 years. Alas, it's moot now. Patterico has more on the whole mess.

A New York state senator is claiming that an attempted burglary has been tied to the Journal News' publication of the names and addresses of gun owners.

Both the Treasury and the Fed have ruled out the platinum coin. On Sunday, Treasury spokesman Anthony Coley announced via email: "“Neither the Treasury Department nor the Federal Reserve believes that the law can or should be used to facilitate the production of platinum coins for the purpose of avoiding an increase in the debt limit."

That's good news. The platinum coin, like the IOU idea and the 14th Amendment idea, were just ways that Democrats wanted to use to allow Obama to sidestep negotiating with Republicans over the debt ceiling.

I have to admit to some irritation with Coley's vague statement. Does it mean Treasury and the Fed think the coin is illegal, unconstitutional, or just impractical? Does it mean the production of platinum coins for other purposes would be okay? Treasury and the Fed aren't saying, but have definitely killed the platinum coin trick proposal, so the debate over the coin's legality will remain an academic one.

I don't remember if I wrote about this at the time, but in light of this Politico piece, in which GOP officials are quoted as saying that many in the House GOP want to force a government shutdown, I thought I'd repost this bit of advice from Patterico: "If you donÂ’t want to be blamed for a government shutdown, donÂ’t say youÂ’re trying to achieve a government shutdown."

That Politico piece and, apparently, the GOP officials who talked to Politico make some embarrassingly idiotic statements about what they think is going to happen if we blow through the debt ceiling. First, and most importantly, hitting the debt ceiling does not mean the U.S. will automatically or even immediately be in default of its loans. The government can prioritize its principal and interest payments over other spending. Legally, I think the government is required to do that, but the Democrats keep saying they'll spend the money on entitlements and cowboy poetry first even if it means missing loan payments.

Second, hitting the debt ceiling without a deal does not mean that there will be a government shutdown. This is the dumbest part of the Politico article and the GOP officials' threats. In the context of the debt ceiling being reached on February 15, they say their bosses aren't afraid to force a government shutdown if Obama doesn't allow spending cuts -- except hitting the debt ceiling on February 15 won't result in a government shutdown. The federal budget is authorized through the end of the current continuing resolution, which doesn't expire until the last week of March.

Similarly, letting the sequester go through will not result in a government shutdown either. It will trim federal department and agency budgets, but not close them down.

So the bloviating GOP officials whispering to Politico about shutdowns aren't serious about avoiding the debt ceiling or fixing the sequester. They're just jawing about a shutdown so they can boast to their own constituents about how tough they are, even if that's an utterly stupid and impossible claim in the current situation.

3 Crooked Chicago authority accuses United Airline of running a crooked sham office in Southern IL to avoid paying exorbitant Chicago and Cook County sales tax on fuel.  Are they pressing criminal charges?  Of course not, that would require them to prove criminality.  They are using the new government tactic, civil suit.  It is much easier to win a civil suit than a criminal conviction.  Just another reason to get rid of tort court.  I recommend United Airlines leave the State and buy their fuel elsewhere.  Most States charge no sales tax to businesses.

Lol, I knew before clicking the link who that senator would be. Ball was my state senator until redistricting. Here's the thing about Ball, the NY GOP sucks the big one, and Ball is a constant loud mouth pain in the ass to them, so that's good. Problem is, the guy is also your typical self-promoting politician who always has things happening to him. He's into animal rights (yeah, nuts) and once claimed some Mexican drug gang murdered some goats and left them on his property or something ridiculous like that. I'm almost surprised Ball didn't claim it was his own home broken into.

33 You guys are going to have to take my word for this,  because the NYT has already re-written the article.

The French have gone into Mali with air strikes because the US TRAINED TUAREG members of the military defected,  ALONG WITH ALL OF THEIR EQUIPMENT, to the Islamasist troops coming in from Libya, who are remnants of Ghadaffi's army.

This was a complete rout and the Army was acting under the direction of Obama and State because they did not want to send US troops in (like Iraq) so they decided on this training strategy and the Tuareg (very tribal) just up and went with their borther Tuareg in the heat of battle.

The French have gone in because there are a bunch of French citizens in Mali.

This is yet another result of Obama's ham-handedness in Africa and a complete embarrassment.  The FRENCH,  under a socialist president,  are actually doing something,  while Obama sits around over here worrying about how to grab guns.

If the French get in trouble,  the Chinese army will move in; I will bet cash money on that.

That law is an old law left over from the days when all of SC was dry (even before mini-bottles).  The intent was to keep people from making beer with 50% alcohol content (like the examples here).  50% alcohol content is not beer, it is liquor.

And getting any kind of rational law about alcohol passed in this State is still virtually impossible.  It is the loosest I have ever seen it, but only by allowing individual counties to kill the laws.

It's the cult of race hysteria.

75 Hey Vic. With all due respect, although there were no doubt quite a few Japanese, Germans and Italians spying before and during the war, the internment of entire classes of people was illegal and in my view unwarranted.

You have to keep in mind the conditions we were laboring under at the start of WWII.  Everyone was scared to death of a landing by the Japanese in CA.  We were losing bases in the pacific right and left and we were woefully unprepared for the war despite a decade of warnings from Europe.

Did some people get screwed?  Yes, but it WAS necesssary given the conditions. Was it legal?  Remember during a wartime emergency parts of the Constitution can be laid aside.  The supremes said it was legal in any case.

86 Were there cases of spying by Japanese?  If you are talking of the Japanese diplomats yes.  There were FBI reports of Americans of Japanese ancestry trying to thwart the US war effort.  In the camps there were agitators wanting to fight for the Emperor.  And then there is the Nihau incident.  I really don't need to read Malkin's book.  Similar treatment was given to German and Italian Americans in both wars, though Wilson's treatment was far worse than FDR's in my opinion.  But so was the sabotage by Germans in the US in WWI.  And least I forget the Canadians also did a round up of their Japanese and other suspect citizens in WWII.

Then there is the case from WWII of a US Army enlisted man named Provoo who came out of a tunnel on Corregidor after the surrender in a kimono speaking fluent Japanese.  He had turned traitor and actively helped the Japanese.  How active, he told the Japanese what an American Medical Captain had said and the Japanese executed Captain Thompson.

Once the Treasury Department runs out of accounting tricks to pretend we haven't already hit the debt ceiling, there will by necessity be at least a partial government shutdown as there won't be enough money flowing into government to pay for the authorized spending.  Of course, since we're entering tax season, the IRS could simply delay sending out tax refund checks until those of us who pay quarterly taxes and those who underpaid taxes last year send in those payments, which would buy the government a bit more time.

The bad news is it's Teh SCOAMF who decides what gets shut down.

146 The Chinese have only one interest in Africa and that is mineral exploitation. They are trying to corner the rare earth minerals market.

Their interest is way beyond that.  They're building factories like crazy in Africa.  They see a continent in flux still dealing with the collapse of colonialism and understand that small(ish) economic nudges now will leverage into big influence down the road.

They're playing a 50-100 year game in Africa.  Someday the colonial shocks will subside and Africa will get (relatively) unfucked, and they want the be the ones there when it happens.

147 You know what I just fucking love? I love having a schedule set by a general contractor, confirmed in a jobsite meeting on Thursday. I love that we hired two more men to make sure that we met their schedule. Then, and this is the part that really makes me feel all tingly, I love getting a phone call from my on-site foreman saying the job isn't ready for us and won't be ready until Wednesday. So now three men get to sit at home today and tomorrow.

You knew on Friday that you weren't going to make the schedule. Make a fucking phone call assholes.

We will see.  I wonder when the US media will cover this.  The NYT article I got the information from got re-written to remove all mention of US involvement over there, so eager are they to cover Barry's butt.

The news is all over Africa,  of course.  My husband called and told me about it yesterday.

The higher the alcohol content the less complexity you have and when you drink it all you can note is, "shit this thing is high in alcohol."

You know,  I am a Boomer, but because my parents married late my sisters and I have more of the WWII generation mindset than a lot of our contemporaries.

So does my husband,  who was born as a surprise when his mother was 45 and his dad was 49.  It's probably why we get on so well together.  No whining is allowed.

I can't help but think that the emphasis on talking as a qualification for the presidency has not worked well.  We are letting the TV people set the standards for leadership,  and we see how well this has worked.  An analogy would be if we allowed Hollywood to set the admission standards for med school.

I propose other tests for the primaries.  Shooting and chainsaw operation would be two that come to mind.

The people who spout this nonsense clearly have not read the science.  They only read left-wing freakout stories about the eeeeeeeeeevils of fracking.  And/or watch Matt Damon movies.

Next time your relatives spout off about fracking/earthquakes, ask them what they think about CCS (carbon capture and storage), aka carbon sequestration.  It's a way to reduce CO2 in the atmosphere.  Of course the physics behind it is remarkably similar to fracking - it involves injecting a fluid deep underground, just in the case of CCS, the fluid is supercritical carbon dioxide.  But your typical leftie numbnut won't know the two are related, just that "fracking causes earthquakes" and "we have to sequester the CO2 out of the atmosphere before we all BURN UP AND DIE".

It is Muslim city out there. Now I have met a few generals in my time in China. All the military bases are hidden/unseen here by the general public. You never see them army guys back east in Guangdong province until a workers riot breaks out. But out in Xinjiang it is tanks, rockets, artillery and shells piled up every which a way. It is obvious. They have this road..the Karakaroum highway if my spelling/memory is correct. Runs all the way down thru china into paki down to islamabad. I been on the Chinese side, unlike the Paki side it is paved. They put that in to get tanks up close to the border. Hired a guy once to take me up to the Wakjahir passÂ…the spot where Afghanistan touches China like a long bony finger of death along a mountain range. I just wanted to see where our boys were fighting. It is not an official border crossing, and one is likely to get their ass shot off from being there. Chi-com Troops everywhere. It is not an arduous hike, I looked at it thru binoculars from a mountainside to avoid troops, questions, imprisonment and torture and got the hell out of there. I liked it out there in Xinjiang. My wife is Han Chinese but born in Xinjiang. I had a ball out there. The food was great, a lot of sheep meat on skewers.

218 #196  You know your total lack of interest in Jodie Foster?  Well,  you can trace the ignorance of the American people in celebrity news.  Consider these milestones:

1. 1950's Movie fan magazines are considered "trash" and have to be sneaked into homes by teenagers desperate for Elvis news.

2. 1960's  Fan magazines such as "Tiger Beat" appear nationally and are  considered harmless fun for teens obsessed with the British invasion invasion.

3. Early 1970's  Time Magazine introduces the "People" section with short celebrity items on its last page.

4. Mid-1970's People Magazine debuts with an entire magazine devoted to celebrities

5. 1990's People starts issuing special editions devoted to just one celebrity or event.

See how this goes?  We now live in Kardashian world, three sisters who got famous because their father got a celebrity murderer off and are themselves supremely untalented except in sspending money,  sleeping around,  and being on TV  yakking about their totally inconsequential lives.

To add:  the key to making a *good* higher alcohol beer is to use enough malt to give the brew a good malty structure.  That means using the correct yeast.  If you are using a high-alcohol yeast then it will keep going until you hit 15% or so.  Using a normal strain of ale or lager yeast means the yeast will peter out before it converts all the sugar to alcohol.  That's usually around the 10-12% range.  If you have enough malt in there (and, of course, use hops correctly) the higher alcohol won't detract from the taste of the beer.

If a brewer is just looking to goose the alcohol content by adding corn sugar into the brew, it's going to have an off taste.  100% malt, baby.

230 201 The civilian Chinese economy seems more like a chaos than command economy. China is currently operating under a Marxist's understanding of Capitalism - a system of lawlessness and exploitation. What centralization exists exist to protect the regime. The goal here is to lay the material foundations for Communism ( as defined by Marx as the end of history). Both Russia and China had the same problem - they were feudal states, and as any good Marxist cleric knows, feudalism must give rise to capitalism, then communism. You can't skip. So the question was, how to go from feudalism to communism. Option 1 (which Lenin favored after his world revolution failed to materialize) was to bring in a controlled capitalism. It would build the factories and the proletariat could take over and brutally murder the capitalists in their sleep. Option 2 (which Stalin favored) was Socialism - having a centralized government build the factories and brutally murdering all the current-day captalists. The Soviets chose option 2, and China (after trying out Mao's batshit insane theories) are going with option 1.

251 Purp, "They're playing a 50-100 year game in Africa. Someday the colonial shocks will subside and Africa will get (relatively) unfucked, and they want the be the ones there when it happens.", I think Africa has a series of major shocks coming. One of which is the devolvment of the colonial borders - which is already in process in the lakes region. Nobody in Africa trusts the Chinese, but they are willing to take their cash, I don't see it turning out well for the Chinese.

I am partial to the Dogfish Head 90 minute IPA.  I think that's hitting around 10%.  The thing is they do a 90 minute boil of the wort during the brewing process, during which they add a buttload of hops.  The longer the boil = the better the hop utilization is.

Rogue Brewing makes some pretty good ones too, but some are definitely offbeat.

The homebrewer has an advantage because he gets the beer much fresher than you can get at the store.  The freshness is pretty key, I think.  You are also in complete control of the brewing.  If you think Sam Adams could use a little extra hop aroma/flavor to it, you can make a clone and add more hops at the end of the boil and/or dry hop it.  If you really like Sierra Nevada's Pale Ale but think the original 1982 recipe was better, you can make it.  If you can't find a bottle of Pliny the Elder to save your life, you can make a reasonable cloned batch of five gallons.

And the best beer in the world is the one you've made.

Swartz was a HAcker, he was associated with criminal hacker groups.  He was an activist who wired his property into the MIT phone exchange and stole literally millions of copyrighted intellectual material.

Was it 35 years?  The hacking laws are overly strict, IMO, but then again, what if a few years down the road Swartz started thinking that the Stock Market should be shared with everyone, or the Federal Reserve?

He was ectremely highly intelligent and for him to be ignorant of the laws he was breaking and was so distraught that he committed suicide sounds like a story from a shocked and greiving family.
