Happy Monday.

It didn't get quite as much press as the decision finding Obama's "recess" NLRB appointments unconstitutional, but the same appeals court kicked the EPA in the teeth (again) on Friday, rejecting the agency's intent to punish petroleum refiners and importers for not producing the latest green boondoggle, cellulosic biofuel, in sufficient quantities.

Not just a rumor anymore: the FBI is investigating leaks about the development and deployment of the Stuxnet virus, which is probably as good an official admission that the U.S. created it (probably with the help of Israel) as we're likely to get.

The broad strokes of the immigration reform proposal being hashed out by Democrats Charles Schumer of New York, Dick Durbin of Illinois, Robert Menendez of New Jersey and Michael Bennet of Colorado; and Republicans John McCain of Arizona, Lindsey Graham of South Carolina, Marco Rubio of Florida and Jeff Flake of Arizona: (1) a path to citizenship for illegals currently present; (2) border security; (3) advanced degree green cards; (4) employer verification program; and (5) an ag worker program.

36 Regarding that EPA ruling, pretty much the only thing standing in the way of the EPA literally destroying the economy is the D.C. Circuit Court of Appeals. That's still a conservative court. But whether that will remain the case after another four years of Obama remains to be seen. Obviously Stuxnet was a U.S.-Israeli operation. So for equally obvious reasons the extreme left-wing elements which long ago infiltrated CIA, DOD and State will want to undercut the program and its progeny by leaking sensitive info. Concerning immigration, the three major problems with that Reagan-Kennedy amnesty in the 1980's were that it didn't do anything really to dissuade the black market for illegal labor, that it didn't include permanent border security and that it didn't address the long-term citizenship vs. residency dichotomies. For immigration reform to work we actually need taller and thicker fences where fences are practicable, we need draconian sanctions against businesses which after amnesty continue to employ black market labor, and we need clearly to delineate who gets deported, who gets visas, who gets green cards and who if anyone can wind up as citizens. A tough balancing act even in a vacuum. When you factor in the open borders elements on the far left and the extreme xenophobic elements of the far right it becomes pretty clear that a comprehensive reform is nothing but a pipe dream.

When immigration reform came up last time, those conservatives from safe districts and a fair number of radio talk show hosts went into a complete tizzy. Instead of figuring out how we had to do something, everyone went nutso, even though Ronald Reagan had granted a far more sweeping amnesty than Bush's program.

Well, they certainly showed Bush, didn't they? In the process, they weakened his presidency, paving the way for McCain's disastrous run and getting us a LOSS of Hispanic support and now we are going to end up with a worse immigration program.

But everyone felt good about stopping Bush's pandering to the Mexicans, so I guess we are supposed to consider that a win.
