Happy Tuesday.

Remember, the Obama Administration's first excuse for why the Obamacare rollout was failing was "high volume" of users of the website. WaPo reports that this was a known bug with the website, which had locked up in a simulation prior to the debut date. "About a month before the exchange opened, this testing group urged agency officials not to launch it nationwide because it was still riddled with problems, according to an insurance IT executive who was close to the rollout."

Politico goes through five basic questions that Sec. Sebelius won't answer about the failure of Obamacare exchanges.

Ben Domenech observed on Twitter last night that Terry McAuliffe is about to win in Virginia as an anti-gun candidate. The NRA is bringing $500k to Ken Cuccinelli's defense.

Good Morning Morons.  Today is Tuesday, October 22, 2013.  On this day in 1836 Sam Houston was inaugurated as the first President of the Republic of Texas.   It's about time we had another.

4 Oregon is moving ahead with its "tax per mile driven" plan. They cite fewer miles driven and more fuel efficient cars for a drop in revenue.   How about if we quit diverting 20% of the revenue to damned city buses and commuter trains which are a money sink.   They also cite all kinds of issues with how they are going to track mileage.  The whole idea is stupid to begin with. Why not just jack up the taxes on gasoline?

35

Morning, ‘rons and ‘ronettes.  Now that Teh Vic! Has posted, I can offer up a little palate cleanser.

Whenever IÂ’m stuck for a story, I can usually always find something to use from the life and sayings of Sam Goldwyn.

Goldwyn, like other moguls, was keen-eyed about all aspects of the movie business except when it came to promoting an actress he was personally involved with.*  In the 1930s he, like many other studio chiefs, was trying to find the next Greta Garbo and thought he had her in Anna Sten, a Russian émigré who had some success in German films before Goldwyn saw her in the early ‘30s.**

For her second film, We Live Again, GoldwynÂ’s advertising chief drew up a mock poster for approval.  It read:

THE DIRECTORIAL GENIUS OF MAMOULIAN, THE BEAUTY OF STEN AND THE PRODUCING GENIUS OF GOLDWYN HAVE BEEN COMBINED TO MAKE THE WORLDÂ’S GREATEST ENTERTAINMENT.

Goldwyn looked it over, then nodded.  “ThatÂ’s the kind of ad I like.  Facts.  No exaggeration.”

And hereÂ’s Sten in a promo postcard for We Live Again:  http://tinyurl.com/okufydt

Hope you all have a wonderful day.

*Two examples right off the top of my head are Darryl Zanuck and Bella Darvi and D.W. Griffith and Carol Dempster.

**Her movies did poorly at the box office, however, and after 1935s stinker The Wedding Night, Goldwyn dissolved his contract with Sten.  She continued acting through the 1940s, but with little success.  She died in 1993 at the age of 84.

I was thinking of going to visit him in ME and didnÂ’t want to take the time off because I have taken too much time off because I wouldnÂ’t go to work when I thought he was going to die that first month or so. TheyÂ’ve been doing construction in our office since Mid September. They office smells like new carpet, paint, varnish and makes my eyes burn. TheyÂ’ve done it in phases. Thursday is last phase and part of office where I am is being done. Everyone has had to move everything from their offices, etc and either go work in another office, they rented space on another floor one day and a group of them went up there. Another day they stuck them in an office that is serving as conference room. Friday they didnÂ’t know where they were going to put us. Yesterday they decided that some of the new spaces can take most of us, but not me. I have to pack up today and have to work from home the rest of the week. I offered to work from home be causes I really want to go see Paul tomorrow and come back Thursday. I donÂ’t think I can get him transferred to MA when heÂ’s in the ICU. My face gives me away. ObamaScare, like all of Choom Boy's wild America-hating schemes, is a product of his ineptitude. He is like the stoners I knew in college, who would sit around and Solve the World's Problems and make Profound Statements, but never figure out the details. They'd drift into a dope-addled sleep before actually doing anything.

In this case, President Historic First© simply sat with his acolytes and said "wow, man, it'd be cool if everyone had, like, health care with the click of a mouse button!" His minions said "duuuude, that's so cool!" And it was done.

74 Here is what they say in nearby CA for release of names:

"Under no circumstances should the names or identities of any juveniles arrested or listed as suspects in a crime report be released to the media. The California Supreme Court in the case of T.N.G. vs. Superior Court, 4Cal.3d, 767 (1971), ruled that the Juvenile Court has the exclusive authority to determine the extent to which juvenile records and identification may be released to third parties. The T.N.G. case does not prohibit law enforcement agencies from releasing information to news media about the facts and nature of crimes committed by juveniles. It merely prohibits the agency from identifying juveniles under the age of 18 years of age who have been arrested, detained or made a ward of the court, without first obtaining the written consent of the Juvenile Court."

86 There's one common element to involved web sites (or computer programs) that I take issue with. When you think about purchasing a book you pick it up off the shelves and note the weight. That tells you something. You browse through the pages and make a determination, based on the size of the type, how long or involved the book is going to be. When you go to these multi-page web sites, they should provide a 'site overview' page; that gives you little screen steals of what each page will look like, the number of them involved, the information that will be requested, etc. Give the people a clue. I have no doubt that people are getting totally lost, have no idea what is required, and are giving up in utter frustration. You're welcome, Federal overlords. My consulting fee for five minutes of typing is $250,000. You can send the money through my Nigerian emissary who will contact you shortly.

Here's Sarah Palin at the end of her article -

The fact that these strong-arm tactics take place in Washington doesnÂ’t surprise me at all. IÂ’ve fought this type of corruption my entire political career. And those who disagreed with me politically used thug-like tactics to try to bankrupt my family with frivolous lawsuits in Alaska, and it hasnÂ’t stopped to this day.

ItÂ’s time for Washington to stop threatening citizens and scaring up dollars through an endless extortion scheme of manufactured crises. ItÂ’s time for leaders to lead. That means doing right by voters without requiring them to pay protection money in advance.

You have to wonder whether Constitutional rule of law even exists when separate rules apply for powerful and well-connected men like Jon Corzine. And you have to wonder whether we really have government of the people, by the people, and for the people when the only way We the People can be heard is if we grease the palms of the ruling class.

Enough is enough. If the permanent political class wonÂ’t drain the swamp, we will. We should follow the advice in the title of SchweizerÂ’s last book and “Throw Them All Out” 2014 is just around the corner.

135 Fixating on the Soeterocare website's failure is a bad idea.

No doubt about that, but it's what "Republicans" do.

We are beginning to see the effects of Choom Boy's treason piling up, and the dumb shits who see politics as a kind of game they can play with their friends will not focus on either the cause or effect, but will cherry-pick and yammer on about process.

This is why some of us see seriously bad times ahead. The focus on "fairness," "optics" and "poll-tested results" lets the traitors act with impunity. The basic issue -- what the Prophets of Choom are doing to us and to our country -- requires someone getting their hands dirty and doing some work to correct.

The Poppin' Fresh response to evil is destroying the country. The only solution for lawlessness is apprehension and punishment of lawbreakers. That the ranks of the evildoers includes damn near everyone in Congress and the president only makes the task a little more difficult. If and when someone comes along who has the balls to act like a patriotic American, that is.

At this point, the only possible alternative to an outbreak of balls can only be expressed in words that would get you banned at Tepid Air.

Ted Poe was awesome as a state judge, sentencing offenders to standing at busy intersections with a sandwich board detailing their crime, slapping contempt of court on lawyers who earned his wrath, etc.  He had been a decent legislator up to now but I am sure he did get a raft of shit about the amnesty stance.  He's not my guy though.  Michael McCaul is my rep and has not made a vote yet that I disliked.

Sam Houston (Indian name "The Big Drunk") ran from Santa Anna so long that his men nearly deposed him but the stretch them out tactic finally worked in the middle of the swampy land near San Jacinto.  Houston knew that Santa Anna alive would throw Mexican politics into turmoil so he let him go after capturing him.  And it worked.  BTW, friends of mine in Tyler have Davy Crockett's fiddle in a glass case and one of old Sam's rocking chairs.

An ad should be developed about New Yorkers sticking together, with Bloomberg and McAuliffe pictured together. I think we should highlight the technical accomplishments of the Obama Admin, since obviously they are extremely capable in those spheres they consider critical.

The government, for example, can read every email and monitor nearly every cellphone. They can automagically read every Facebook entry, every Tweet, most SMS textings. They can break encryption and set keylogging worms on the PCs of average citizens. They can track users of "Dark Net" sites previously unknown even to each other. They've even taken credit for internet warfare oriented things like StuxNet, which set back Iran's nuke program to some unknown degree.

I mean, that's some seriously sophisticated tech know-how. Just because they can't build a simple e-commerce site for insurance that they require you to have or face penaties isn't any reason to call 'em names, guys.

The GOP would rather let him lose because he didnÂ’t wait for his turn? They should be doing everything to help him.

--------------

Yep - here's the situation...

First, VA Governors are term-limited to one term.

Bill Bolling (RINO) was Lieutenant Governor under Tim Kaine.  Bolling was set to run as Governor in 2009, but was persuaded to run a second term as Lieutenant so Bob McDonnell could run.  The deal was that Bolling would step aside, then run in 2013 with McDonnell's endorsement.

Meanwhile Ken Cuccinelli, who was a Delegate before winning statewide election as Attorney General under McDonnell, ran for the Governor slot and forced a convention instead of a traditional primary.  And Cuccinelli won the convention, taking Bolling out of the race he was "supposed" to be in.  This created bad blood in the VA GOP because, hey, the backroom deal  between Bolling, McDonnell, and the VA GOP  was now null and void.

So Bolling goes apeshit and starts badmouthing Cuccinelli, going so far as to question his ability to be governor on several interviews...all of which were gleefully lapped up by the VA Democrats.  Meanwhile, you have Dems working to nationalize McAuliffe and the national GOP passing up a chance to nationalize Cuccinelli (like they did with Brown (MA) and Walker (WI).).  Because hey, Cuccinelli is a tea party kind of guy and makes the suits a little too uncomfortable.

The whole thing is a case study in how Establishment GOPers still have the party in a stranglehold.

171 Virginia is deep purple, but 5 years ago we elected a Republican governor and LT governor in a 20pt landslide. Our governor was hugely popular and was talked about seriously as a running mate for Mitt Romney. Then events happened. As they say, all politics is local The Republican Party had an ugly fight over how to select the next candidate. Blood on the floor and lots of leftover butthurt. A cook got fired in the Governors mansion for stealing food, he said the governors kids took food too and it was true. Plus some legal but ugly looking gifts from a friend to the governors wife in the amount of about 100k. The governor should have resigned but he let that hang out there for months while the campaigns were just getting started. McAullife is air dropping bundles of money on the airwaves and they are all saying that Cuccinelli hates women . Cuccinelli is trying to duck that so he is pointedly NOT running as the progun candidate, just as McAuliffe is NOT running as the antigun candidate. I'd say unlikely, even if McAuliffe went full retard and started agitating for gun bans.  While it'd get play in the northern suburbs, the structure of the House of Delegates and the State Senate is such that he'd still have a hard time getting things through.  However, it would also mean an end to expansion of gun rights for the next four years as there aren't enough votes to override a veto.

That said,  the main thing I'm worried about is the end of statewide preemption.  Local governments are forbidden to create local ordinances having to do with guns - it all has to be at the state level.  I'm concerned that there are enough RINOs who would offer that up as a fig leaf to McAuliffe in lieu of a statewide gun ban.

181 So I went to our local adult toy to check on several outstanding purchases.

My wife's one toy, purchased, and received by the toy store is 42 days into waiting for the State paperwork to clear.

One toy, ordered 54 days ago is back ordered at the manufacturer.
That toy can no longer be purchased legally in this State, but my purchase was made prior to the enacting of new adult toy ownership laws.

And the last toy purchase, made in the final hours of September has no shipping date available from the manufacturer.

I am lead to believe that if one were inclined to not follow State law, one could take physical possession of any of these toys within days, if not hours of the decision to make a purchase.

But I shall continue to follow all applicable laws ,no matter how cumbersome and burdensome they become.

It gives me an opportunity to verbally throat punch those citizens who like to blather on about how one can legally buy adult toys at the drop of a hat due to loopholes large enough to drive a truck through.

204 @56, A Cure for Baldness. Good news, it really works. Bad news, it involves the use of someone else's foreskin, and a laboratory mouse. This will set back the anti-circumcision movement rather badly, one would think. Talk about your organ donors.

A "fair" and relatively unobtrusive way to assess highway use taxes for differently fuelled vehicles? Just require a (possible witnessed) report of the odometer reading on each year's license-registration form, then fuck-you-pay-me. Most states already class odo-rolling as a felony, for much older reasons. Cheaper and less hassle than installing sneaky-Flo's on all cars.

The only objection -- it's a big one -- is that in some cases many of those miles may have been off road, not on publicly funded highways. What would probably happen is that the fee would be re-purposed as a pollution tax (yeah electrics have a pollution profile too, and sooner or later gummint will need that excuse). After that case, the next complaint would be that some miles were out of state. The ultimate solution as with everything else will be federal licensing.

209 "I hate to say it, but everytime a bicyclist is killed, I am torn between "That's Sad" and "Fist pump!""

I guess it depends on the specific circumstances of the accident.
Where the rider is not at fault, I clearly would go with  "That's sad"

But on the other hand, some events just beg for a fist pump.

One time soon I will probably go on a long tearing screed about the stupidity of urban joggers.  In most municipalities, these people fall under the category of "Pedestrian", and pedestrian law applies to them.
Recently, our local State University had to remove signs because, as someone pointed out, the signs read "State law, Stop for pedestrians at crosswalk".
State law actually says that one must stop for pedestrians IN the actual crosswalk. And that pedestrians must not step out into traffic in such a way as to cause vehicles to be forced to come to a sudden stop.

I actually derive great pleasure from mentioning this law to my MiL, while she stands on the sidewalk yelling that cars should stop for her.

Now that electricity is a motor fuel, all use of electricity will be road-taxed. The precedent already exists. I expect to feel very unhappy when it passes, at 2 AM.

And got better benefits to book (IIRC post docs aren't eligible for the 401k, but I may be wrong about that.) Why? In my case it was mostly luck*. But generally speaking American works (especially young ones) demand more money than their immigrant counterparts. And since we've created this awesome safety net, they'll hold out for it too. My old lab manager called it "insourcing." (A pretty good name for it actually.) I'd imagine you'd see the same thing in other fields as well, immigrant labor will work for minimum wage, American worker wants that plus $0.50/hr. *I say lucky, and that's because it was my first post college job that wasn't part time, I honestly had no idea what I should have made or even wanted to make, so I took the first number they said (which was just about $13/hr.) 254 182 Will Virginia now be giving up its Second Amendment right? Posted by: Marcus at October 22, 2013 08:54 AM (GGCsk) ---------------- I'd say unlikely, even if McAuliffe went full retard and started agitating for gun bans. ---- Unless the Assembly flips, there is no way that pre-emotion gets overturned. And there are a lot of democrats in Virginia with guns and carry permits, many of them minorities. They are going to be in for a rude awakening about their new beloved candidate. They are used to the way things have been and have always rested on their laurels knowing they could safely vote dem and still not worry about their gun rights. Bloomberg is going all in because the Plan is to argue that the voters chose gun control by picking T-Mac. They will then pound away at it for the next four years. It is going to get Colorado ugly here real soon. I don think we will see any significant changes, but the anti-gun people smell blood hete. They have been after VA (as one of the most pro-gun states in the country) for decades and they see a golden opportunity here. Pro-gun democrats are just took blind to understand the kind if pressure they are about to face.

255 Alexthechick, several places, all of which are grey, at best. No benefits, cash employment, greater productivity then natives at that price point (racist, but real), easier to manage or self managing extended families of workers. Sometimes your literally hiring a village and if someone is slouching, it's not your problem - el jefe (his uncle, and your shift leader) takes him out back and kicks the shit out of him. Posted by: Jean at October 22, 2013 09:42 AM (CMlD4) All of which means said small business is not, in fact, complying with the law. If you know that your shift leader is going to beat the shit out of someone for not doing his job, that is on you. You do not get to claim to be the good guy because hey I'm going to hire a bunch of people that I will treat like a pack of dogs and who I don't give a shit if they can actually communicate with my customer base because fuck you. Look, I am deeply sympathetic to the position that the legal and regulatory burdens on small businesses are ridiculous. I am not sympathetic, at all, to the position that we need to ignore immigration laws in order to allow businesses, large or small, to get around those provisions. Or, more to the point, stop lying to my face about it. You want cheap labor that's not going to sue you and that you can pay cash to get around having to comply with record keeping burdens. I get it. I completely and totally get it. Hell, I even kinda agree. Just stop acting like you're doing something else.

The laws of economics say that when the labor supply increases, the cost of that labor decreases. But when there is surplus labor already (15%-20% unemployment), I doubt that the marginal decrease in labor costs is worth the huge increase in sociatal costs of amnesty.

In fact, I'm willing to bet that labor costs will go up, because more of these previously off-the-books workers will suddenly be legal, with all of the protections of our wonderful legal system.

On Saturday I got my application for NJ Homestead tax rebate. Yesterday I got an escrow shortage bill from Chase.  I gotta GTF out of here. Fuck Christie, Fuck Chase, Fuck the town I live in. And fuck the deadbeats that don't even pay their mortgages and taxes. I must be a real dupe. These cocksuckers laugh at us while spending our money.

Read the article, reading the comments. Salon. *snort* The guy managed to work every juvenile insult they have come up with in the past year into the article.

What's funny is that they really think they're the ones who are fueling the economy.  The minute we "teahadists" are gone from the tax rolls, the FSA is fucked.  Which, as much as I dislike strikes, tells me a nationwide work stoppage would throw one hell of a monkey wrench into this administration.

I already knew they hated us and it warms my heart. March the Army of the Potomac down here asshole.

259 Power companies along the coast here in the South, particularly in FL, do hold money in reserve for repairs from storm damage.

Posted by: Vic at October 22, 2013 09:47 AM (zZbNF)

Probably part of utility regulation; a minimum reserve. And of course they can't reserve enough for the outlier storms, so they get their asses kicked by the politicians looking for cheap publicity. And if they do hold that much cash, then they are attacked for high rates.

260 Posted by: Vic at October 22, 2013 09:47 AM (zZbNF) I'm sure Ameren gets to hold some money but it's never enough. I haven't cracked their financials lately (they're a publicly traded company) but the utilities commission had them paying a $0.09 dividend for while (Which, given revenue was quite high.) And the commission is almost always approving the post storm "emergency" surcharge and rate increases.

261 Vic,

What are you talking about with Oregon diverting money to public transit? The state of Washington just gave Tri-Met (Oregon) power of emminent domain in WA state to build a light rail system that WA voters have voted against twice. AND, Tri-Met will get to keep all tolls collected on WA residents. We are in a serious fight in Clark County, to throw out the weasels on the city council that voted for this nonsense. It's not enough that they are collecting money in Oregon for public transportation. Now they are going to get to collect it in another state!

And, the current mayor of Vancouver WA ran on a campaign of no tolls on the new bridge across the Columbia river. It worked to get him elected, when he promptly decided that we really do need tolls after all. Don't get me started.

262 Alexthechick, I don't personally employ anyone without at TS clearance, so immigrants aren't my problem. However, I have family members who have restaurants and contracting/ small construction firms and what I described is how it works. If you hire a native, who turns out to be a bum, it can cost you a lot of money to get rid of him. Not so with an illegal. The self managing extended family stuff happens, do you think the responsible people from that family or village don't appreciate making 20x the cash they could back home. Those consolidated earnings might support 300 people, if some kid needs his ass kicked, oh well. You know what we need - more ass kickings for the native bums.

What usually happens after a major storm hits is the reserve fund is used for starting repairs short term.  The they ask for an emergency limited time rate increase to pay for all the repairs.

Speaking from the other side of the fence, prior to E-Verify, SSA confirmation was our only tool in construction to verify employee eligibility.
I am often confused when people speak about paying their employees terrible wages in stereotypical illegal immigrant jobs.
No sarcasm at all here; do other industries NOT have certified payrolls to report to the state/fed? In our industry, everything gets reported. Absolutely everything.
wdol.gov is there as a reference for what you are supposed to pay in what area - and the state/Fed do indeed police this kind of thing. There has not been a project I have worked on in the decade I've been an adult that has not had at least two, more often three, random inspections and inquiries to employees about their paid wages.
Then there are the post-project audits.
How exactly is it that so many folks are getting away with robbing their employees? I just do not see it in our industry. o.O I do not understand how it happens elsewhere.

Here, and in all the counties that I am familiar with it goes into the general fund.

While it may be too late for this election, there is a way to save Virginia.

Republicans can support Blue State Congressmen in efforts to get Federal offices relocated to their states.  Massachusetts, for example is a hopeless Blue State and always will be.  How likely would Massachusetts Congressmen be to trade their votes, for example to vote against amnesty in order to move some federal facility with thousands of jobs out of Virginia and into their district?  Similarly, various administration functions can be moved out of DC itself and off to other hopelessly Blue states.  I bet you could get Chuck Schumer and Kirsten Gilabrand to vote for a law removing the restrictions on silencers and automatic weapons in exchange for moving the Department of Agriculture to Syracuse.

269 This is where I bring up how everyone is yelled at to conserve water and such and then the water company slams a surcharge on the bill because water usage declined. Posted by: alexthechick - Commence drinking now. at October 22, 2013 09:29 AM (VtjlW) Hilarious, huh? 'Buy fuel-efficient cars because they save your money and put less 'carbon pollution' (meaning CO2, which we need) into the air.' Then they try to figure out new ways to tax you because revenues decreased. Just like the cigarette taxes. 'How are we going to fund all of our special programs now?'

Posted by: blindside at October 22, 2013 06:00 AM (WzWmY)

270 You know what we need - more ass kickings for the native bums. No. We need to prosecute the sleazy employers who break the law and foist legions of low-info third worlders into our healthcare and welfare systems. The workers are only cheap because we subsidize them.

271 Posted by: Vic at October 22, 2013 09:59 AM (zZbNF) So I shouldn't feel bad then for titling and registering my vehicles out of state is what you're saying. Not that I would do that of course. Why the f should I pay 'property tax' that goes into a general fund for a VEHICLE which was taxed at the time of purchase, pays registration and inspection 'fees' and pays gasoline taxes? I'd rather have a higher gas tax. At least that way I can decide if I want to pay it by not driving.

Posted by: blindside at October 22, 2013 06:02 AM (WzWmY)

272 BTW, property tax used to go primarily to the schools here with an actual separate tax on your annual bill.  But they passed a 2 cent sales tax increase and eliminated all local school taxes as part of a plan to equalize school funding with poor vs rich counties.

So what did my county do?  They added the same tax back and called it a fee.  So now I pay double.

273 Kinley Ardal, those are bigger projects. Someone adding a deck doesn't get audited. Bevel, the problem is that they don't go home. Setup the system so they don't get paid until they pick up the cash back home - and they'll leave.
