@Locke_Wiggins @Bidenshairplugs Amendments are amendments to the constitution...not laws! When the president signed the ACA it became a law!

The good news is that his vote canceled Ben K.'s, so we've got that going for us.
And in shutdown related news, it looks like the service academies' football games will go on after all.
[Update: BenK] Andy's wrong, I voted for President Dwayne Elizondo Mountain Dew Herbert Camacho.

Good Morning Morons. Today is Thursday, October 03, 2013. On this day in 1955 Captain Kangaroo premiered on TV. This was the first TV show I ever saw at some point in the 50s. I saw it while my father was working on a TV for someone (people were always dragging TV/Radio stuff over for him to fix). We didn't have a TV of our own at the time.

The IRS is still collecting taxes during the government shutdown, but it isn’t sending refunds — and it also has stopped complying with a subpoena to turn over documents to members of Congress who are investigating the agency’s targeting of tea party groups.
They were already stonewalling Congress on their illegal targeting of conservatives and there is not only a subpoena out but also a contempt citation. They are just using the BS non-shutdown as an excuse.

Federal judge calls the corrupt Holder's DOJ guilty of "grotesque misconduct" and orders a new trial for N.O. police officers accused of misdeeds by the civil rights division of the DOJ (which should be abolished). Not a word of this story by any of the MFM, including Fox. This story is worth reading the entire column because it is devastating to the DOJ and the corrupt Holder. ButÂ…Â…
Despite the judge accusing one prosecutor of lying and writing a10 page list of government regulations violated by the prosecutors in the case, there is no indication that he has sought that these corrupt assholes be disbarred and prosecuted.

Latest estimated time to get one back that was submitted on the 30th of September is roughly two years if nothing changes.

From Fox' website (link on Drudge):
Lawmakers spent the evening shouting at each other, as they considered a series of votes on mini-spending bills but got no closer to a deal that could re-open the entire government. In perhaps the most intense exchange, Rep. George Miller, D-Calif., repeatedly accused his GOP colleagues of waging "jihad" on Americans.
Oh, no, precious - you've got it all wrong. See, if Republicans were actually jihadis, then the prez and the left and the media would be fawning all over them AND negotiating with them, championing their 'rights', and sending them the weapons they need to wage the jihad you say they're waging.

Federal civil service: A good thing to do when asked why you shut down something is to say "It wasn't my idea; that order came from the administration." And then wait and in less than 24 hours you'll be told to open that thing back up again.

One of my West Point classmates matched up previous shutdowns with Army football games. Not once previously was a game cancelled during a shutdown. In fact during our time there (79-83), there were two shutdowns during football season, and we never missed a game (boozing it up in the parking lot at a corporate tailgate put on by SAS counts as attending the game, right?)

At some point we're going to have to pull the mask off. Obamacare doesn't do anything to help the poor. Poor people are going to continue to do what poor people do, which is make bad choices. They won't pay premiums, they won't seek medical care in any reasonable way, and they won't pay "their share" of the bills when they get them.
Just like they do now.
So the difference is... what?
Oh yeah, it shifts the costs of providing healthcare away from the government, away from the Big Hospital lobby (and all the assorted suckers of teet attached to it), and back where they want those costs to be absorbed: YOU AND ME.
The only question is, will it become evident to enough people BEFORE it goes into effect or after? The Dems are betting on after. Their lives and livelihood depend on it.

Yesterday, I asked a question If we have to subsidize insurance so that poor people can buy it, who is going to subsidize their deductibles that they can't pay because they didn't have the money to pay for the insurance in the first place?
No one, because they aren't buying it and won't buy it since they already get Medicaid for which they pay nothing out of pocket. If they need immediate care, it's off to the emergency room where they still pay nothing just like it was before. The geniusry of this plan is that since they won't be signing up for insurance, all of that money that would have been used for subsidies can be appropriated for some other handout program.

I was banned for cause.
I am okay with my banning. I am saddened by Dagny and Miss Marple's loss. I broke the rules, and I paid a price.
As I said to Ace I could make arguments about how defined the rules I broke are, but I have been enough of a problem child and try to have too much integrity to do so.
I am happy to be back.

Yeah the correct response is "fuck you pass a fucking budget or shut it the fuck down."
that is a message *we* the electorate have to send to DC.
If it takes a 75% democrat caucus so be it.
It enrages me that the media basically enables the democrats game of "passive-aggressive easy mode politics"....
given that the current GOP caucus refuses to do battle on the media front we're doomed to lose probably.

Hitler relied a lot on the snowball effect. You just keep on enabling more and more evil until one day magically societal norms and accepted tyranny reach critical mass and folk just don't want to be the nail that sticks up to get hammered rather than ensure norms are honored. I encourage everyone to read about the relationship of Darth Shicklegruber and the Christian faith as the "frog in the pot."
What concerns me is the slow ramp up in attempted intimidation and threats of violence. Eventually that's going to boil over, someone is going to be killed, and what we as a people do after that is going to be crucial. I look back at the rise of the Gracchi brothers in the Roman Republic and see a lot of similar themes in play both then and now. Obvious structural problems, a powerful elite who want to keep the system closed to any competition, a large uneducated mob just waiting to be used for violence, and demagogical political figures willing to exploit the situation for their own personal gain. Everything changed when Tiberius Gracchus was murdered because it was then that those striving for power saw that violence was a perfectly acceptable tool.

Perversely Cicero himself used the Gracchi as the precedent needed to further empower Pompey.
I would give anything to know whether or not Cicero felt the use of the Gracchi was the beginning of the end of the final throes of the Roman Republic after he was condemned.
Sulla is the man most responsible for the death of the Roman Republic in all likelihood if you Jedi handwave away the evil that was the Gracchi.
Sulla begat Pompey who begat Caesar who birthed, finally Augustus.
The thing is the Roman people no longer gave a fuck.
We're well on our way here.
Republic represents man trusting man to carry his own weight as much as possible, infantilizing the public enables "national daddy and mommy" and the people playing THAT game in this nation are the most hedonistic evil bastards in our faux aristocracy...

Have to go to work, so I don't know if this was already said, but guess what? Normandy was closed yesterday. Yes, the shutdown has reached foreign shows. Obama is a petty, epic douche. From the NY Post:
"Tourists travelling to Omaha Beach to pay their respects to the 9,387 military dead at the Normandy American Cemetery and Memorial will find it closed, a victim of the U.S. governmentÂ’s partial shutdown.
The site overlooking the D-Day invasion beaches is one of 24 U.S. military cemeteries overseas that have closed to visitors since Monday. Ten more cemeteries in in France, as well as others in various European countries as well as Mexico, Panama, Tunisia and the Philippines, will remain closed for the duration of the shutdown."

I realize that this is from Infowars, and Alex Jones is a nutter, but still, I do not doubt this at all:
"Numerous hiking and biking trails throughout the greater DC region, despite requiring zero immediate maintenance or patrols, have been closed down. Irate citizens are merely flouting the law and using them anyway.
- The NPS has stationed officers along the Chesapeake & Ohio Canal that runs 184 miles from Washington, D.C. to Cumberland, Maryland to make sure nobody uses the bike paths. It would have required less manpower to keep this trail open. The handles on all the well pumps have also been removed.
- The feds also shut down a tiny park in which children play on fake turtles, prompting angry mothers to remove the barriers, only to see them put back up. “The park is extremely small and sort of seems pointless to block off,” reports the Daily Caller.
- Lincoln Park in DC, which is known to be used by several Democratic Senators, was not shut down, but numerous national parks across Montana were closed."

I've never had a problem with the Pink month. I only object to the Komen Foundation hijacking the color pink and acting like thugs who believe they have a right to decide when it can and can't be used. Just one example: A few years back, the defensive coordinator at Arkansas started making players who were loafing in practice wear a pink jersey the next day (it cut down on loafing, BTW.) The Komens had a case of the vapors and cried like little babies until he backed down and apologized.

At least this means they admit that Islamic terrorism is a real thing and that it's bad! now if we could just get them to affix the label to the actual people to whom it applies, we might be in business.

1) Is NPR still on the air?
2) Is PBS still on the air?
3) Are Obammy's beloved golf courses still open?
The answer to all of the above is "yes" by the way. '
I fail to see how closing parks, memorials and monuments over which they have little or no control is justified when they won't close down things over which they have a sizeable amount of control. And judging by the hew and cry that always goes up when our side suggests cutting off funding to NPR and PBS -- "You're going to evict Big Bird!" -- I find it laughable that anyone might suggest that the gubmint has no authority to close them down.

You wanna subsidize housing for the poor?

Subsidize healthcare for the poor?
Subsidize safe handgun training
Free daycare for single mothers?
Free gun cabinets to protect the children
And on...and on..and on.

I opened the letter and let loose such a stream of profanity about SCOAMF that I think she feared for her life. She quietly crept out of the house without even saying good-bye which was a good thing because when I got done with SCOAMF, she was next.
I am so depressed today. I have pre-existing conditions and paid a lot for the coverage but it was a great policy. And it made a mockery of the stories that you couldn't buy a medical policy if you had pre-existing conditions. They have been available for years as long as a (responsible) person retained continuous medical coverage and was willing to pay the premiums.
And to top it off, my RINO Rep, Meehan (NoLabels-PA -7) who I helped elect by working on his campaign in 2010, can't wait to cave to the Dems.

WASHINGTON (AP) — Republicans insisted they wanted to shut down the nation's 3-year-old health care overhaul, not the government. They got the opposite, and now struggle to convince the public that responsibility for partial closure of the federal establishment lies with President Barack Obama and the Democrats.
There's ample evidence otherwise, beginning with Speaker John Boehner's refusal to permit the House to vote on Senate-passed legislation devoted solely to reopening the government.

Hmmm.....
Hmmmm.
The question I suppose is does decryption itself constitute a 4th amendment violation or do the emails have to be "read" (even digitally.)
I skimmed the article, but it's still unclear, but let's suppose there is only one encryption key but there is also a way to pull out Snowden's emails specifically. (Even if the feds have to decrypt the entire database to do so.)
Does that constitute a 4A violation? I'm inclined to say it does, but I really can't come up with any justification for that.
Put differently, if I share a 3 bedroom apartment with 2 other people (hawt women for this example) and one of them gives up the key to feds so they can search her room, is my 4A violated because they now have access to my room, even if they follow the rules and don't go into it? (Common spaces obviously can be consented to search by any resident. And we'll assume that these are the very rare law abiding feds who make a good faith effort not to violate my 4A rights.)
It seems like a reasonable analogy to this case, but I agree, I don't like that potential outcome. So Reflective Equilibrium! I must go back and adjust the conditions of my original position I guess.

It's a pretty obvious scare tactic, no different from local and state governments claiming that crime and fires will skyrocket if they aren't given more funding for police and fire. Cleanup on (BwsYg) .
Though I find it funny that silly trolls think talk radio hosts and authors are somehow in charge of the country.

Money, sex, and blackmail have turned many a spy in the past.
So is statement is not in any sense of the word inconceivable. And given our current approach to OpSec and Counter Intelligence it's probably even a logical thought in his head.
But a few points
1) Current approaches to OpSec and CI left us with Snowden and Manning. Current approaches are no longer sufficient anyway.
2) Was this said during the last shutdown? My guess is, no. Why? Even if we grant it as a possibility (which is a stretch) it's not something you say.
3) There's an implication here that there is a statistically significant number of people in the IC who are so overleveraged they cannot even survive 1 missing paycheck. That's disturbing on multiple levels (I'd note that TSP plans can be borrowed against during the shutdown, even if someone has 0 liquid savings. Also, my wife has been told partial checks for the pay period immediately preceding the shut down were put in process, so the earliest missed biweekly check would come on 10/25.)
If what Clapper says is even remotely true, then even a simple problem that causes unpaid leave of 2 weeks (without any other incurred cost) would compromise our spies.

Good morning, Horde.
Morning, Gingy!
I am so petty that I just walked through the
parking lot and said "fuck you" every Obama-Biden bumper sticker I saw.
At a college. In Maryland.

I spit on them. It's very liberating. Walking through the parking lot, see a lefty bumper sticker, *SPIT*.

Only sometimes. If you use a stencil and spray paint, you can vandalize to your heart's content and possibly even get rich as an "artist."

I understand the sentiment in part. My wife would rather deal with layoffs than this.
At least in a layoff there's some level of finality, "I'm fired, time to start looking for another job."
Somehow she got the worst of all worlds, no payment (So like being laid off) but no extra time to start looking for another job (since she's essential employee at work.)
Anyone who doesn't like this and isn't at work would be well advised to put the time towards sending out resumes though.

We won't have to foment open revolt if we win this one. The media broth has whipped these idiots into a froth. I actually heard the "jihad" thing repeated to me by someone who does not know me in a training situation. I couldn't help it: "Well, the Republicans aren't actually gouging out eyeballs and desecrating corpses in shopping malls, are they?" Fool: "Not yet."
If we lose this one, let me recommend 500 targeting killings, say 10 in every state. To start. (Hey, what happened to Iran's cyber chief? Jus' sayin', is all.) the froth is thick hereabouts, and you can't punch froth. Just take 'em out from the top down, an' they'll all go back to hating Simon Cowell.

This is the part that's unclear to me based on the article.
The key clearly provides the ability to decrypt the entire database, but I'm not sure it's necessary.
i.e. can the key be used to only decrypt the stuff caught in the trap. If so, does the 4A get violated for all the stuff that could be encrypted but is not actually being captured?
As I said though, I don't like the idea that then the fed can just set up a trap somewhere else and use their new fancy key to decrypt stuff that wasn't in the warrant. (And this is where I worry, that they won't abide by the rules.)

Economics, how does it work?
They really think six-figure bureaucrats in a flatlined-GDP economy with an asset bubble driving everything based on unsound fiscal policy while underemploying millions of Americans in part-time jobs in 50-job-limited small business environment is a great way to run a country.
People keep talking about our children paying off this debt. We're looking at a default in maybe ten years depending on interest rates and GDP growth leading to increased tax revenue. Not to be confused with more idiotic taxation which has already tasered our economy along with health care and regulation overload.

well to be snotty, That Reid will hold one child untreatable for cancer because He and Obama want what they want and will deny that child life saving care is ____?
So the next thing Obama and Reid,Pelosi want Because it is the Mostest important legislation to them will Healthcare be denied as the Knife to get what they want from congress?
you know 1 death is a tragedy but thousands are just a rounding error?

The Luby's shooter was an ordinary seaman, not an officer. He was ex-Navy, not an MMA graduate.
And they are Merchant Mariners, not "Merchant Marines."
