Happy Friday.

So far, state insurance commissioners in Washington state, D.C., Arkansas, and Vermont -- all of them Democrats -- have rejected Obama's "fix" to Obamacare that guts the exchanges.

Obama has summoned the CEOs of several insurance companies to the White House for a meeting today, presumably on the Obamacare "fix." Apparently, checking with the insurance companies before enlisting them in a scheme with major practical and legal consequences didn't occur to the White House.

"'I don’t know how he f—-ed this up so badly,' said one House Democrat who has been very supportive of Obama in the past."

Last night Obama threatened to veto the "Keep Your Health Plan Act" a/k/a the Upton bill that the House is going to vote on today. The bill guts the Obamacare exchanges by allowing people whose policies would be cancelled because of Obamacare and people who never even had insurance to buy insurance on the individual market that doesn't meet Obamacare's expensive minimum requirements. What a trap.

And a big win for researchers and stack crawlers:

Google Inc on Thursday won dismissal of a long-running lawsuit by authors who accused the Internet search company of digitally copying millions of books for an online library without permission.

U.S. Circuit Judge Denny Chin in Manhattan accepted Google's argument that its scanning of more than 20 million books, and making "snippets" of text available online, constituted "fair use" under U.S. copyright law.

The decision, if it survives an expected appeal, would let Google continue expanding the library, which it said helps readers find books they might not otherwise locate.

Well, so much for the 4th Amendment:

A Berkeley City Council member says a proposal to ban cigarette smoking in apartments and condos, where smoke can waft through ventilation systems, is not tough enough or fair. Councilman Jesse Arreguin says his fellow council members should consider expanding the proposed ban to include single-family homes where children, seniors or lodgers are present.

Cigarette smoking is already prohibited in Berkeley's commercial districts, parks and bus stops, and within 25 feet of any building open to the public, and the council plans to extend the ban to all apartments, condominiums and other multiunit buildings where secondhand smoke can spread.

But if Berkeley is really serious about protecting nonsmokers, it should ban smoking in the specified single-family homes as well, Arreguin argues in a proposal to toughen the proposed law.

And:

While Berkeley's proposal is among the toughest in the nation, it's lenient in at least one regard: It does not include marijuana. That would be permitted anywhere.

See, this is just not right. But it's only anecdotal and until we have a larger sample size and competent statisticians who can accurately analyze the relevant data it doesn't mean anything. The Plural of Anecdote is not Data.

Apparently, somewhere in the vast ACA bill there is a provision that essentially bails out insurance companies who are adversely affected by the bill. So the legal authority is available to fix any problem with a blank check. Upton will go to the senate, Landrieu will come back. Insurance companies will continue existing policies with the government picking up any increase in cost. Everybody's happy. Immediate political problem solved. And all it took was a shitpot load of your money.

IIRC, a federal "assistance" (read: free money and lots o' corruption) plan is already part of ChoomCare, to "protect" insurers from losses when they have to take on risky clients.

I am astonished by fat-boy "conservatives" like Goldberg who are smugly giggling and tittering at President Historic First's© fuckups. What he and his enablers are doing is committing crimes, for which the Previous American Way was to indict, try and punish.

It is as if they are watching Elliot Ness crack open a few barrels of Al Capone's beer and are proclaiming victory by saying "hahaha! That will show him!" Never mind all the laws ol' Snorky broke; we're seeing him look bad!

I suspect when the polite chuckling by Our Republican Betters is replaced by outrage and demands for action, it will be too late.

More to the point: Congressional Votes Have Consequences Wash Away Washingtonians Of course we're disgusted with Obama for demanding that ACA be created. And though he signed it into law (illegitimately), he didn't write it. He's never written a damned thing of consequence in his life (other than his original campaign platform video released before/as he announced his '08 POTUS primary campaign). Even if special interests (global insurance and pharmaceutical corporations) wrote ACA and submitted it for Congressional Democrats to legislate, ACA belongs to the Democratic Party, THOSE WHO VOTED FOR IT, those who voted to sustain ACA from being reformed to date, and all those Republicans now who are scurrying to "fix" ACA so that the mandate unconstitutional show stays on the road.

193 freebeacon Of all the analogies being drawn between the calamitous rollout of Obamacare and other government muck-ups throughout history, one deserves a closer look. WhatÂ’s happening to Obamacare right now isnÂ’t this presidentÂ’s Iraq war, or his Hurricane Katrina, or his Lewinsky moment. ItÂ’s his Iran-contra scandal: a complicated and controversial policy dispute that involves deception, a hostile Congress, and the bludgeoning of presidential credibility. Iran-contra marked the end of the Reagan Revolution, and itÂ’s not hard to see how the implementation of Obamacare might mark the end of the Obama Revolution as well. A boy can dream.

207 interesting stats on social media over at legalinsurrection.com Pew Research is out with another installment on its study of News Use across Social Media Platforms, some of which may be helpful to activists in the political grassroots movement. Facebook leads the way as a social media platform for news consumers. 64% of US adults are on Facebook, with 47% of those using the site to obtain news – this translates to 30% of the US population using Facebook as a source of news. Though in a previous Pew Research report (noted below), most indicated they do not necessarily go to Facebook seeking out news, rather, they get the news while they’re there for other reasons. In contrast, only 16% of US adults use Twitter, with just over half of those using it for news, which translates to 8% of the population using Twitter as a source for news. And while reddit’s users are very active news consumers, a very tiny fraction of the US population is even using reddit at all. much more over at his site

211 "So the GOP is convinced repeal is the only option, and the public agrees, how do we get from there to the Democrat Senate passing repeal and probably having to override a veto?" Start with a relentless campaign illustrating the forecasts of what would happen if this thing became law and the fact those forecasts were accurate. Supplement that campaign with video and audio of the preznit, every democrat leader and EVERY DEMOCRAT UP FOR ELECTION impugning people for suggesting those forecasts. Highlight the mockery and condescending attitudes these people had. Point out and emphasize that those people are exempted, or were given waivers for the law that was supposedly crafted for everyone so we could all have healthcare. Work towards a political bloodbath in the next election with the focus on the fat that this craptastic Act was brought to you by the Democrats, any ONE of which in the Senate could have ended it. Maintain the push for TOTAL REPEAL giving them ample opportunity to vote for or against it on record. Give those turds in suits every opportunity to save their political skin. IF they do vote to repeal, they'll have to override King Putt's veto; if they don't, or they don't override the veto let them suffer their political demise. 218 Isn't marijuana more carcinogenic than tobacco? Posted by: alexthechick The 10¢ fact sheet from one who has done a tad of study and also created Head Shop Comix. Pot alone may have more carcinogenic-like irritants yet seems not to cause as much damage. Proponents claim it also contains cancer inhibitors. Tobacco is rarely 'pure', cigs containing many nasty additives. Pot is deep-lunged, tobac usually throated (so I'm informed), and the ritual patterns for consumption are different. A casual weekend pot smoker is probably at a lot less risk than a chain nic smoker. All-day bong hitters, maybe the same as. Overall, psychological effects aside, pot is probably less physically harmful, in the general population. Which may be informative for personal recreational substance choices, but the relative effects & consequences ought have nothing to do with repeal of unConstitutional prohibitions and regulations!

Needless to say they smelled like they had bathed in skunk oil. They actually carried on a girl who was with them. (But being high as kites they carried her in the stupidest way possible buy I digress.) The girl was so out of it that the train hit a bump, and she whacked her head into the wall they leaned her against and didn't even move. (For those following along in your Glasgow Coma Scale handbook she just lost several points.) When my friend and I got off at the parking garage we told the security guard to see if he could call someone and get them pulled off at the next stop. But apparently they can't do anything about it unless someone is actively dying (although, to be honest, that may have been partially true here.) At my urging He did call his supervisor who yelled at him over the radio (seriously.) I finally just left, as I was leaving a parent pulled up in a frenzy asking where one of the stations was. Given the time of night, (and how far down the line we were, with so few people left on the train) these two things may not be unrelated.

226 @206 Ordinarily I might have little sympathy for your problem, but I remember my dad's neighbor in western NC, a deputy sheriff who got drafted for forced OT when a DEA grant and airplane surveillance began a massive pot farm uprooting.

He was working six tens, pulling up tree-sized marijuana and burning it on bonfires. He said getting the contact high was funny the first time, but it got old fast. His hands were stained green. He had to throw away uniforms. Worst of all? People "looked at him funny" in church. And yes, he knew the joke about how they would all know, in church, what that smell was.

In my experience, the thing about all-day every day pot smokers is they take Prose Writing and think it's Poetry. The only way they end a sentence is if you parole 'em.

232 I have a question. Does anyone remember the breakdown of the 30 million uninsured? I assume a good number had pre-existing conditions but what about the rest. Posted by: Hawkette at November 15, 2013 08:40 AM (i7KmQ) Your assumption is wrong. There were always plans for people with pre-existing conditions. And, the number was more like 8-12 million. Easily fixed without $trillions being wasted. Most were young and/or healthy, so didn't purchase it themselves. A quarter or so were eligible for medicaid or medicare - just didn't apply. A quarter or so were making more than $75K/year, and just didn't purchase it. And, a quarter or so were immigrants (illegal aliens and legal immigrants). Legal immigrants, like all countries, do not provide taxpayer health care right away, unless they become residents, or other legal means to apply and receive it. It's all bs.

288 194 freebeacon thanks for that, artisanal'ette ACA is far worse than Reagan's gun running for drugs scandal because Obama took away every American's medical insurance (or hope/expectations of affordable policy to purchase) and plopped the IRS and prison on top of being uninsured (if you can't afford the ACA payments), or while paying at least TWICE as much for "coverage" that doesn't even exist in reality should you face hospitalization now. Meanwhile, the tax funds are assessed and collected and SPENT on graft, a total Ponzi scheme. Americans were mad as hell or disillusioned to the core with the Iran-Contra scandal. But the American citizenry as a body weren't being raided and attacked in their own homes by Reagan's task force of mercenaries. And though the hypocritical war on drugs raged, sponsored by his administration, so long as Americans "Just said no!" it didn't apply to those citizens who steered clear of the drug scene (beyond paying taxes that sponsored the deceitful federal war on drugs and all other government boondoggles). It wasn't as if Reagan raised taxes to pay for his organized crime. Btw, readers, go ahead and blame policy on GHWB if you're so inclined ... or something; whatever. Yes, re: CIA, it can be argued that Reagan "inherited" the corrupt practices of organized crime to make a political policy a people's reality. But even there, you can't let GHWB off the hook. Back to the point, the CIA and the FBI and the local police were NOT permitted legal access to invade an American citizen's privacy during Reagan's administration. So the pernicious federal fear factor being used since GWB Patriot Act gone hog wild under Obama IS the difference. Americans today fear and loath our government that has been transformed by politicians and public officials into the authoritarian state that threatens our very bodies and minds, not just our income-savings-homes, but ALL OF OUR LIVES as US citizens are on the line because of ACA.

Posted by: Countrysquire at November 15, 2013 08:58 AM (LSJmV)

It is.  When my first husband was dying from cancer, the pain was ungodly and the chemo made him wickedly sick. The docs prescribed a pill called marinol.  It was made from marijuana, the same components that help pain and nausea.  The pills even smelled like pot.  The cost?   $70.00 per pill.

And ut is a sort if unintended Trojan horse fir tge Dems/Obama to force ins cos to ignore math, the way Landrieu's bill does. Unfortunately, some in the GOP are so hateful if Erickson and Levin that they choose to mock all objections to Upton and attempts to "fix" Ocare, rather than to argue on merits. My view is the GOP should focus their efforts on treating the impacts of Ocare on working Americans while hammering tgat these steps are needed as long as Ocare exists. I'd focus on tax cuts for middle and lower middle class ppl, corprate tax rate decr, and bringing down energy prices.

If you eat a bunch of pot brownies in your car on the way in (or smoke up a storm and then shower) I can...uhhh.....well there's not much to be done. Urine tests would result in you saying "I got high last night." and my understanding of the blood tests is they have the same problem. If we can solve the practical problem (and the welfare problem) I say "Sure whatever." until then, an abundance of caution.

349 from The Corner over at the NRO The President Is Losing His Plan By Yuval Levin November 15, 2013 12:18 AM It suggests that the administration is giving up on the long game of doing what it takes to get the system into place and then trusting that the public will come around and is adopting instead the mentality of a political war of attrition, fought news cycle by news cycle, in which the goal is to survive and gain some momentary advantage rather than to achieve a large and well-defined objective. It suggests, in other words, that the administration is coming to the view that Obamacare as they have envisioned it is not really going to happen, that they donÂ’t know quite what is going to happen (and no one else does either), and that they need above all to keep their coalition together and keep the public from abandoning them so they can regroup when the dust clears. yep, that is what I see happening, too

The marinol that my late husband took was like a gel capsule except that it was perfectly round and the outer "gel" covering was thin .  He could literally hold it in his mouth for a minute or so and that covering would start to melt. Then swallow it and within a few minutes it was working to settle his stomach.  It wasn't great for managing pain and he often lamented the silliness of taking a $70 pill when we could have called my cousin to hook us up with some serious weed.

379 People have a comic view of marijuana, based on light experiences they had in college, the idea that it's used by smart creative types, and movies. I once had that view. Then I started spending time with more desperate characters, the kind of people who gave alcohol a bad name in the old days. For many people, and I don't want to paint with too specific a brush here, any substance will be used to excess, and for other than its "intended purpose."

Pot does not always make you mellow. I have had to baby-sit people through psychotic episodes brought on by way too much of way-too-strong stuff. Were they psychotic types anyway? Yeah, sure. Pot just made their psychosis cool.

I don't feel one way or the other about legalization, anymore. Frankly, it bores me. I always wonder why goldfish-swallowing didn't manage to stay front and center in the national psyche. Wouldn't you think the fad would have passed by now?

You can't go around saying "This is a serious and potentially dangerous drug." You just can't. People will discount your testimony. The whole argument is now a politicized morass of tu quoques and ad hominem. The one thing the argument has accomplished, thanks to high-school newspaper editor's earnest comparative editorializing, is the impending criminalization of tobacco. And off we march.

The story is woefully slim on details, so I don't know what would prompt these people to "return" the child like a    stale loaf of bread,    but     the story says these were the child's adoptive parents, not foster parents.  If so, that means they are legally his parents in every way but biology.  It would be like someone taking their own    biological    nine year old    (or older)     child to county     services and saying, "Nah, I can't deal with this kid anymore.  You take him."

Or are you saying since we're all being "transitioned" back to high deductible plans, that's how we see cash coming back in vogue? FWIW, my lab job required me to either take the university insurance or provide proof of insurance elsewhere (not insured was not an option.) Granted the insurance at the time was $9/pay period (biweekly) that was horrifically raised to $18/pay period the next year, so not exactly bank breaking by any stretch of the imagination. (There were stories of people when it was $9/pay period who just decided getting the forms from their other insurance wasn't worth it and kept double insurance for a while).

In fact, I distinctly remember my wife not being able to get renters insurance via my agent when she lived in Omaha because my agent was licensed in 46 states but Nebraska was not one of them. Having said that, I remember when Bamby was saying we could do that because all the insurers would "just run to states like Delaware where rules are more lax." And my initial though was "wait, isn't your VP pick from Delaware, didn't he have a hand in those lax rules?" (this is in 200 . Also "Uhh...competition between states, it's a thing!)

I don't see why you'd have to.   It's perfectly fine to have insurance and not use it.  If you can pay cash it's usually a lot cheaper.  I always use the example of going to the dermatologist to have some minor skin tags removed.   Going through my insurance would have cost $250+, and there was no guarantee they'd pay it, so I'd be on the hook for that if they didn't.   Paying out of pocket was $85.      I chose the $85 option.      I still have the insurance,   I just didn't use it in that instance.

418 Posted by: MWR, Proud Tea(rrorist) Party Assault Hobbit at November 15, 2013 09:32 AM (4df7R) Maybe it's because I'm fairly healthy or my docs are good at coding, but I've never had anything insurance has refused to pay (I've had a few moles removed and they've paid that as well.) Things are a bit weird here though I admit. All my friends who have tried the cash thing get hosed relative to what the insurance contracted rates are (so even if they have a huge deductible, the insurance company was a better negotiator than they were and they'd have been better submitting it to get the contracted rate.) My experience with deductibles (which is somewhat in the same arena) has been a PITA too, I had one place try to insist that the deductible meant I had to pay their chargemaster prices. Eventually I got the insurer involved (since the place wouldn't even submit it to my insurer claiming I had to "satisfy my deductible" before they could submit a claim. Which was odd, because I had other bills that went to my deductible.) Finally I got EOBs from my insurer, just paid what those said and told the PT place to shove it up their asses. (My actually response was "Come after me if you want, but I think you're engaging in fraudulent billing, so I will report that if you do.) Needless to say, I'm a bit burnt out on the whole "just negotiate prices" thing. I'm not seven sure when you do negotiate it, it's a great deal. If I pay $35 for something that was listed as $100, it sounds great, except my insurer would have only paid $10.

And as long as that stays going, I'm just not sure I see the utilization of insurance going down.
