— Gabriel Malor

Happy Wednesday.

The Bushes, 43 and Laura, were on Leno last night and it was, I have to tell you, UH-MAZE-BALLS. Here's the tiniest snippet from it that was more serious-y. Most of it was very laugh-y (yes, he painted it). I hope the rest becomes readily available soonest. Do I miss him yet? Yes. Dear Lord, yes.

In other news, the Supreme Court declined to reimpose the injunction that the misguided district court judge laid on the Texas anti-abortion law. Here's the SCOTUS order (PDF), which features dueling opinions from Scalia and Breyer. I wouldn't waste my time with Justice Breyer's dissent because it doesn't actually rely on cognizable legal principles, but Justice Scalia's concurring decision is hard core, so I definitely recommend it, even for the not-so-law-minded. The man is not pulling any punches here.

In other law news, I do so love the weekly legal roundup at Filmdrunk.

In other other news, here's some speculation that Gov. Walker may be Gov. Christie's "worst nightmare" in 2016. Aight.

1 Good Morning Morons.  Today is Wednesday, November 20, 2013.  On this day in 1980 the Lake Peigneur Disaster took place in LA.  A misplaced Texaco oil drill drilled into the top of an underlying salt mine beneath the lake creating a 14" hole from the lake to the salt mine.  The lake then began draining into the salt mine dissolving the salt.  As the water rushed in, the hole became larger making the drainage a flood. The entire lake, surrounding trees, a few houses, and 65 acres of surrounding land were swept into the hole.  And you thought the BP leak was a big problem eh?

2 Obama once again asks congress to hold off on sanctions against Iran while he gives away the store.  However several Senators sent him a letter.

"If we are reducing sanctions, Iran should be reducing its nuclear capabilities," they wrote, specifically voicing concern that a proposal would let Iran access frozen capital without making major concessions in return.

The letter was signed by Sens. Charles Schumer, D-N.Y.; Lindsey Graham, R-S.C.; Robert Menendez, D-N.J.; John McCain, R-Ariz.; Bob Casey, D-Pa.; and Susan Collins, R-Maine. They voiced support for the overall negotiations, though.

RINOs join with Dems to give Obama cover.  If you live in the State with one of these traitors, as I do, be sure to get down to the polls and vote against them.

3 The stupid Obamanite State Department gives away the store in Afghanistan as well as including a public apology.   What do we get in this "security agreement"?  The ability to protect these assholes and give them billions of dollars (not mentioned in this article).  The worst foreign policy for the US in History.  Makes Carter look like Thomas Jefferson.  What we should be doing is taking all of our hardware, troops, and most especially foreign aid and going home.  Then tell the corrupt Karzai to kiss our ass.

5 Another ax grinding report.  This one says children today are less fit than their parents were.  If they are, and that's a big IF, could it be because the lawyers have removed all the playground equipment that made it more fun to play outside?  Running around in circles and doing sit-ups is boring to a 9 year old kid.

Conner showed his tendency to make stupid statements that will alienate some voters.    Bright won the "straw" poll for the night but I view that as meaningless.  But look at this on the straw poll:

Diane Carr, a former York County GOP officer, cast the only vote for Graham in the straw poll.

There are still parts of the State GOP that support Nancy Boy.

Not only does it make it easier for the people using the internet, but it reduces the lines at the DMV for those that have to go there.

The wide-ranging document, still unsigned by the United States and Afghanistan, has the potential to commit thousands of American troops to Afghanistan and spend billions of U.S. taxpayer dollars." ---!--- After the Soviet Union fell, there was a great deal of action to wind down our military because the cold war was over. I thought that was foolish. I'm with this guy: To a Philosopher-General in Israel, Peace Is the Time to Prepare for War (NY Times) http://bit.ly/1h1KQUR "General Halevi, 45, a triathlete and father of four... said his university studies in philosophy proved more salient to military leadership than courses in business administration. ... 'People used to tell me that business administration is for the practical life and philosophy is for the spirit,' General Halevi said. 'Through the years I found it is exactly the opposite — I used philosophy much more practically. "'Philosophers that spoke about how to balance, how to prioritize principles in a right way,' he added, citing Plato, Socrates and Maimonides. 'This is something that I find very helpful.'" About the inevitability of a next war he says: "The interesting issue is how you create a longer gap between the wars.... It’s not going to be a simple one. There are no simple wars. We are ready to pay this price to make a very decisive and strong war to make the gap as long as possible."[emphasis added]

63 Somewhat sorry to inflict this, but it's worth some mockery. The opening paragraphs of the gibberish that Obama had a stand-in read for him at the Gettysburg 150th anniversary ceremony:

"In the evening, when Michelle and the girls have gone to bed, I sometimes walk down the hall to a room Abraham Lincoln used as his office. It contains an original copy of the Gettysburg Address, written in Lincoln's own hand.

I linger on these few words that have helped define our American experiment: "a new nation, conceived in liberty, and dedicated to the proposition that all men are created equal.''

Uh, huh. I'll bet he does that all the time. Sure. And of course the focus is on himself. What a tool.

I got to hear a Planned Parenthood spokesman on the radio this morning complaining that the SCOTUS decision spells the end of safe abortions and will drive women to get their abortions from back alley providers.

Yep,  according to the industry  a law that requires an abortion doctor to have hospital privileges makes abortions unsafe.

I've always thought it unfair that the courage and tenacity the Marines showed on Tarawa has never gotten a fraction of the attention given to Omaha Beach.

The image of David Shoup, up to his hips in water, legs riddled with bullets, bullet wound in his neck, commanding his Regiment is as dramatic as any in American military history.

81 From the Hill piece http://tinyurl.com/mnnulrz Democrats say the biggest favor Obama can do for them at the moment is to focus on untangling the web and trying to smooth out the glitches on healthcare. “The only way he can really make it up to us is by fixing this s--t,” one Democratic House aide said. Luckily, the aide surmised, Obama is going to want to fix the problem because his legacy is on the line. “We have his own self interest working in our favor,” the aide said. exactly he won't stop because ego good, let his ego drag the left through the sewers again and again

Essentially conducting a survey a private company is forcing drivers off of the street with no cause and they're being aided by city police in doing so. I know you can't just rev your motor and crash the barrier but you damn sure aren't just supposed to abide and then argue with them a way to let you go without participating. Two questions with resulting answers ending in possible gunplay for illegal detention, i.e. kidnapping. 1. Am I under arrest? 2. Am I free to go? A "No" answer to both is bad juju for everyone involved. A cop would immediately know where that questioning was headed & why.

107 In sum, the dissent would vacate the Court of Appeals’ stay without expressly rejecting that court’s analysis of any of the governing factors. And it would flout core prin-ciples of federalism by mandating postponement of a state law without asserting that the law is even probably unconstitutional. Reasonable minds can perhaps disagree about whether the Court of Appeals should have granted astay in this case. But there is no doubt that the applicants have not carried their heavy burden of showing that doing so was a clear violation of accepted legal standards—which do not include a special “status quo” standard for laws affecting abortion. The Court is correct to deny the application.

109 About 'going back to back alley abortions".... My very personal intro to the abortion issue was when I was 17. A 14-year-old friend confessed that, when she was 13, she had been seduced by a well-to-do older boy, was dumped immediately, then was persuaded by his parents to abort. Never mind the poor girl-rich boy social imbalance. Never mind her horror at feeling like a murderer. Never mind law or morality or when souls initialize; strictly from a medical standpoint... Illegal at the time, the abortion was performed by a real doctor, but, yes, literally on his kitchen table, but from what I read, that 'kitchen table' surgery was probably done in much cleaner circumstances than legal abortion clinics I read about.

When a politician like Ryan surveys the political landscape, he sees an opportunity to upend the power structure in Washington.  To grab hold of what already exists, and  hold onto it as long has he can.

When you and I survey the landscape, we see an opportunity to change the direction in Washington, to  get rid of the stuff in Washington that is bad for the country.

Is it any wonder that our interests and the interests of politicians rarely converge?

Many abortions were performed legally, under the guise of a DandC.

The family doctor would nick the cervix, and then send the woman to the hospital with uterine bleeding.

We will never get rid of abortion, but I think a just society can limit it.

However, people start insulting each other, and the sections of the country they come from and it gets bitter and acrimonious. Lincoln is dead but we aren't. We must maintain a united front about Obama and the ways he chews up the Consitution. Obama would use ANYTHING to divide his opposition-including whether you're a Northerner or a Southerner, Hopefully whatever anger you have about a war fought over 150 years ago is less than your anger about what' s happening now. Conservatives here on on the same side now whatever area they come from. I apologize for letting my irritation with sort of thing come out in that way. It was not directed towards anyone in particular-just a general comment. I don't much like myself when I behave in that way, so I need a break. KEEP ON PRAYING -that God will have mercy on our country, forgive us our sins -and yes (if you're Christian) that Obama may be filled with the Holy Spirit and the fruit of the Spirit. i don't think solutions will come politically. I agree with mama winger. It's only God who can save us.

165 "The big question is: How do we teach that life has value, in a valueless society." -- Begin with the libertarian-republican position, against abortion, certainly against funding abortion by mandate and taxation, and leaving determination to each State, never left to federal authorities to handle. Maintain the value of life through personal and local example. And produce influential media to touch the minds and hearts of children to love Life, recognizing themselves just as adults should despite stunted-mature imaginations, as once the fetus. And in a valueless society, most assuredly, refuse to fund the devaluation of Life via taxation. Hold politicians publicly accountable to their chagrin. How dare legislators and government bureaucrats presume the right to vote against Life, to enact deadly policy even prior to law excusing the same, and to cross the line further by legislating taxation on Believers in Life to fund the mass murder of innocence. Let the truth hurt the guilty politicians, legislators. But stay out of people's private decisions and the individual's entering clinics. That's between them and God, and they bear the guilt, wittingly-willingly or not. But our taxes and our attitudes be damned for enriching the abortion death squad industry with public funding, assent, and now, FEDERAL MANDATE TO AUGMENT WITHOUT LIMIT.

This is where I believe the "All politics is local" phrase has some merit. If a local community is tired of its police forces treating its citizens like the enemy, they can vote out the Sheriff or Police Commissioner.

Like any other politician, they will want to keep their jobs. Enough pols lose their jobs and the word will roll downhill in the copshacks.

Of course this would require enough mugs to come to the conclusion that respect for the Law and respect for the law enforcement officers are no longer synonymous.

That and they would have to get off their asses to actually vote.

I do not know what one of those pieces was, but the other one that I took was my passport. As the DMV person took my application, she looked at the passport and said, 'Nope, that won't do'. I was surprised as I figured the PP was a slam dunk ID. "Why not?" I asked. "It's expired" she replies. Which I knew, but could not imagine as an *ID* what difference that could make. I asked her if it expired one minute from now, would she take it? "Yes". I then asked if she would take it one minute after that, "No". I then asked if she thought that I was the person I was representing myself to be, "Yes". So what is the problem. "The rules", she says. Thus functioneth the bureaucracy. So this happened.

CBS Local, Miami:    http://tinyurl.com/mqjbmkc

MIAMI (CBSMiami) ¨C Seven weeks to the day since the troubled healthcare.gov website was launched, HHS Secretary Kathleen Sebelius was in Miami, meeting with so-called ¡°navigators¡± who are helping the public get signed up for coverage.

...

At a second table, the secretary met Carmen Salero who was trying to sign up online.  As the secretary and Salero made small talk, CBS4¡äs Brian Andrews noticed the site crash on the lap top in front of them.

¡°The screen says I¡¯m sorry but the system is temporarily down,¡± Andrews pointed out.

¡°Uh oh,¡± responded the secretary.

¡°That happens every day,¡± said Salerno, ¡°it must mean a lot of people are on there trying to get coverage.¡±

*rolling eyes*   Yeah, that's it, Carmen.   That's the ticket.

Nick Bianchi, who owns a Social Media Consulting firm on Miami Beach, was selected by HHS to meet the secretary personally based on what he posted on Twitter about his positive experience during the sign up process.

¡°I selected a silver plan,¡± Nick said.  ¡°The website didn¡¯t work for me so I ended up waiting on papers from the provider I selected.¡± Nick told the secretary his new plan, effective January 1st, will run a little more than $300.00 a month. ¡°Hearing your situation is really helpful,¡± the secretary told Bianchi.

Oh, that's a positive experience, Nick?   The site did jackshit for you so you went the paper route?   Oh, okay.

The story is clearly supposed to be about how great it was that Sebelius was   in Miami to   visit with people working with the site, but it's laughably bad.

225 Should have asked her, "So, if I take out a gun & shoot you, the cops won't look for me because it's not me?" Posted by: rickb223 ---------------------------- More likely, "I'm sorry sir, that will take three ID's, fingerprints, and thirty days."

226 "Leno always seemed like a decent dude, even if he's always been a lib. They way he's been hammering Obama lately, I wonder what it was that finally made the light bulb go off?.." Reality. The one thing a good comedian/entertainer has to have is a very crisp grasp of the immediate and obvious. The OCare fiasco is front and center right now. Glaring. Outshining all other. You can't ignore it and be a Leno. Some will try, sure. Leno is simply one, historically too, who takes the low-hanging fruit in front of him and makes wine out of it. Whether he agrees or disagrees with the issue he knows how to make comedy wine out of it.

227 I'm sure that they knock out black people on occasion, especially cornball brothers who look like they have a job and shit.

228 As much as I despise the fact, the media control the elections. Posted by: Mike Hammer at November 20, 2013 09:01 AM (aDwsi) The GOP's candidate is only a fragment of the opposition. The GOP is weak in nearly all areas. The primaries, debates, interviews, attack ads, everything is weak sauce. They do more sniffling and whining than resisting.

229 I think we are going to find out in the years to come,in a concrete way, that the 2012 election was like the 1960 election.

230 In the Recovering Republic Congress will not have the power to ban light bulbs.

My years of dues to the Military Vehicle Preservation Assn were worth it just to read the For Sale section of their magazine Supply Line. An Honest John rocket launcher with rocket had the addendum, "Note: nuclear warhead not included."

In the Recovering Republic bygodsirr things are going to be different.

231 As much as I despise the fact, the media control the elections. Posted by: Mike Hammer at November 20, 2013 09:01 AM (aDwsi) _______________Amen! Romney wasn't perfect. Nobody is. But Romney on his worst day is 100 times better than Obama on his best day. How truCons still refuse to see this is really fucking scary and depressing going into 2016. Posted by: Mr. Moo Moo at November 20, 2013 09:03 AM (dfLY4) Being 100x better than Obama is not good enough. Mitt, like every other GOP moderate, would have just been a yellow light for the Democrat Machine. Not good enough.

232 Moo-moo We rarely see eye-to-eye, but in this case, we are in agreement. Finding a candidate with a record and philosophy that suits the 'core' of conservatives, suits the tastes of the country at large, and has the charisma/presence to attract LIV's is going to be impossible, I fear. I believe that Romney was as close as we could get, and he was torpedoed by the media. I, personally, do not believe that conservatives stayed home because Romney was a bit sqiushy around the edge, I think that conservatives *themselves* were affected by the media image of Romney.

233 Mitt, like every other GOP moderate, would have just been a yellow light for the Democrat Machine. Not good enough. Posted by: eman -------------------------------- I agree, but there are two problems. Does that person exist?, and, are they electable? As you say, Romney was hardly radical right, but he was rejected. Are you suggesting that a more conservative candidate might have fared better? If so, who?

236 Are you suggesting that a more conservative candidate might have fared better? If so, who? Posted by: Mike Hammer at November 20, 2013 09:16 AM (aDwsi) It isn't my job to name that person. It's the GOP's job to do that. Think about why it is so hard to pick one from the GOP. Isn't that the problem? It should be easy to name a dozen of them, but the GOP has made it difficult.

237 Not able to pose counterfactuals, but Mitt mainly lost the EV race (not the PV) by losing states such as Ohio, Iowa, Wisconsin, Michigan, Pennsylvania.  Major factor was not conservatives staying home in these states but rather the LIV Indep. Reagan Democrats not voting for Mitt.  Corporations are not well liked due to factors like Globalization.  Abstract doctrines such as creative destruction of capitalism will fail to move such voters.

Mitt was portrayed in Obama's ads as the perfect example of the rich white guy who takes over your company and ships the jobs to China while also denying health care to poor employees.  Needless to say, Romney failed to get the vote totals that GWB got in 2004 in these states.

Right now, for a Republican to win, they must run the table on persuadable states which can generally be marked by states that have Republican governors and significant representation by Republicans in the State Leg.  Dem base is roughly all the West Coast, the NE, and Mid-Atlantic, + Illinois.  Thus, a few states like Florida, NC, VA, CO, NV, make up the difference.  Right now, the playing field at the national level tilts Dem as well as the Senate due to Dem. domination of the small states in the NE.

240 Here's my take on regulatory agencies:  A problem is discovered that the public wants taken care of, so Congress creates a regulatory agency.  After a period of due diligence, 80-90% of the problem is taken care of.  Rather than drastically cut back the agency staff to a reasonable number of people to  deal with the miniscule remaining problem, agency insiders look for more things to regulate in order to justify the size of the agency.  Thus, we have Animal Control people investigating the care and feeding of magicians' rabbits (which are basically pets) and Fair Housing people patrolling real estate open houses to make sure that agents don't spend more time talking to white people than they do talking to minority people.  Never mind that this grossly interferes with business.  That's irrelevant to the regulators.
