Happy Thursday.

Some email correspondents made an interesting observation. Top news stories yesterday were (1) South Carolina's Mark Sanford, admitted adulterer and confessed misuser of taxpayer money, won the SC1 GOP primary; (2) North Carolina Republicans are trying to pass a nullification law so they can (putatively, but really not, bless their hearts) ignore the federal courts telling them to stop favoring Christianity over other religions; and (3) Virginia Attorney General Ken Cuccinelli is fighting to uphold the state's "Crimes Against Nature" law, which makes it unlawful for adults of either sex to have oral or anal sex. How's that rebranding going?

You might have seen on twitter a bit of dust-up over Ben Howe's column about poorly-made conservative art. John Nolte, for example, is a bit het up about it. I agree with Dana Loesch.

And, just because I spent all night drooling all over it, take a look at this.

Finally, there are some moron meetups being planned by commenters that ya'll are invited to. Sean Bannion is planning a get-together in the NoVA/DC region sometime in June. If you're interested in that, you can contact him at novadcmoronmeetup [at] gmail. I'm aware of another meetup being planned for NYC next week, you can email CBD at nynjmeet [at] optimum [dot] net for info on that.

1 Good Morning Morons.  Today is Thursday, April 04, 2013.  On this day in 1841 President William Henry Harrison died from pneumonia, one month after his inauguration.

Good morning, fellow Morons.  ItÂ’s another cold, chilly morning here in the godforsaken wasteland of Massachusetts, but at least I get to pull the Harley out of storage on Saturday, so IÂ’ve got that going for me.

Thanks for the morning briefing, Gabe and Vic.   TodayÂ’s story concerns Mel Blanc, Bugs Bunny and Clark Gable:

Blanc (born Melvin Jerome Blank in 190 , of course needs no introduction to fans of classic radio or Warner Brothers animation.  My story takes place in 1961, after Blanc was involved in a head-on automobile accident on “Dead ManÂ’s Curve” on Sunset Boulevard.  The crash left Blanc with a triple skull fracture as well as broken legs and fractured pelvis and put him in a coma for three weeks.

Never a robustly healthy man, doctors became increasingly worried as Blanc failed to respond to treatment, and warned his family that the Man of a Thousand Voices might not survive.  BlancÂ’s son Noel (who, uncredited, ghosted several WB characters for his father during this time) took up a vigil at his bedside, reading newspapers to him and chatting simply about the family, but Blanc didnÂ’t respond.

Finally, in desperation, Noel approached his fatherÂ’s bedside one morning.  “How are you, Bugs?” he asked.  To his astonishment, Blanc appeared to hear him, and, with great difficulty, managed to whisper, “Ehh. . .whatÂ’s up, doc?”

From that point on, Noel would carefully call out the names of his fatherÂ’s characters.  Slowly, but with increasing confidence, Blanc would begin answering in the voices of Porky Pig, Foghorn Leghorn, Daffy Duck and all the others until he finally emerged from his coma.

And Clark Gable?  Well, the next time 1934Â’s It Happened One Night shows up on TCM, watch it.  When Gable and Claudette Colbert are stranded at the side of the road waiting for a car to give them a lift, Gable chews on a carrot as he trades wisecracks with Colbert.  And, slowly, the realization will come to you – Gable is doing Bugs Bunny before Bugs was created.  And thatÂ’s because animator Cal Dalton based BugsÂ’ wisecracking attitude on Gable.

HereÂ’s Colbert showing off a luscious set of gams in Night:

And hereÂ’s Speechless, a drawing by animator Darrell Van Citters on the occasion of BlancÂ’s death in 1989:

Hope you all have a wonderful day.

50 Those "ethics" charges were largely the work of the corrupt SC GOP leadership at the time.   It was then largely controlled by the NW Graham faction who hated Sanford because he was a libertarian Republican who really did believe in small government.

58 The militant atheists and their fagtivist allies have been wiping the floor with Freedom of Religion here in NC. Every month a new school or community announces that they're removing or replacing a Christian symbol (to avoid liability or to be "sensitive"). Flags that have flown over memorials for decades are now rotated so that an atheist can place the symbol of his choice on the spot for a week or two a year (they actually draw lots to see which weeks). If those NC lawmakers in the story seem a little nuts to you, that's because sometimes you have to be crazy to beat crazy.

Instead of worrying over what has happened may I make a modest proposal?  Like when Montgomery took command of 8th Army and the staff he inherited was always paralyzed by the fear of what Rommel would do next.  What he said to them was lets start doing things to Rommel.  In other words go on the offense and roll them back.

The adultery isn't the problem for most people. It's the lunatic behavior that exposed the adultery that raised questions about his competency as an adult. If someone had done a movie about Sanford's behavior ten years earlier it would have been considered wild fantasy. Who would believe a person capable of such could be in high office?

And Gabe, did you even read the article you linked to about Cuccinelli?:

-------------------------------------

“This case is not about sexual orientation, but using current law to protect a 17 year-old girl from a 47 year-old sexual predator,” Cuccinelli spokeswoman Caroline Gibson said in a statement. “We agree with the dissenting opinion that the petitioner was not entitled to federal habeas corpus relief and the full court should have the opportunity to decide this matter. The attorney general is committed to protecting Virginia’s children from predators who attempt to exploit them and rob them of their childhood.”

Cuccinelli agrees with the dissenting judge, Albert Diaz, who was appointed to the 4th Circuit by President Obama in 2009, who argued for deference to the Virginia Court of Appeals.

In Virginia, sex with a minor who is 15 or older can be a misdemeanor but not a felony. (MacDonald was also convicted of the misdemeanor of contributing to the delinquency of a minor and is not challenging that decision.)

Before the 4th CircuitÂ’s ruling, Virginia courts had found that Lawrence did not apply to minors, meaning that teenagers engaging in consensual sexual activity could be at risk of prosecution.

-------------------------------

So, taking the start that Lawrence did not apply to minors, a view that a judge appointed by Obama concurred with, is not an outlandish social viewpoint. Sure, the Washington Post (spit), NYT, etc. will brand it that way, but that doesn't excuse a supposedly conservative blogger from likewise behavior. Hmm, two days in a row you mischaracterize something like this. It's almost as if you have an agenda or something.

120 Getting back to the Virginia case, the  reason the case is in court is BECAUSE a 47 year old is challenging his conviction.  Of having sex with a minor.  State law has always interpreted the Lawrence decision as applying to adults ONLY.  So the AG is trying to ensure that it does not create an opportunity for adults to prey on teenagers.

And Gabe has a problem with it, not because it's being enforced on married couples or gay couples or any other adult couples and triples and whatever other number of people who want to engage in  any number of other acts.  No, it's because it COULD be interpreted that way.  But it's not.   The state is using the law to go after adults who are sodomizing teenagers...

Read the simple minded nitwit comments on that  Wapo  article, Gabe.  Those are your comrades.   Go rebrand with them.

Not to pile on, because item #1 is to defeat that dipshit Colbert's sister, but Sanford running this quickly after humiliating his wife shows a jawdropping contempt for what he expects the electorate to accept imo.  I would expect a "normal" human being with a functioning sense of right and wrong to at least spend some time, like around a decade, immersing himself in a low to moderate exposure undertaking to get back in peoples' good graces.  But maybe a lack of a sense of right and wrong is what it takes to succeed in today's politics.

How's that rebranding going?" Hell, that's nothing. Just wait until 2015, when the GOP primary field takes shape. In addition to Paul it's not outside the realm of possibilities that Palin, Bachmann, DeMint and Santorum all will toss their hats into the ring. In which event that primary cycle would become the biggest political farce in history, making the last one by comparison appear sentient and rational. Even one of those potential candidates would have a similar albeit perhaps not as grave of an effect. Palin alone would be a train wreck of epic proportions. Instantly in the foregoing events the primary cycle will devolve into a shrill pissing match about abortion, evolution vs. creationism, vaccines, gay marriage, euthanasia, contraception, etc. Meanwhile the actual electorate will start looking towards Hillary as their best bet. The Dems might win the '16 Prez election in essence by default.

Returning late to the Bugs discussion.  The Citters Speechless I linked to was the first.  Then Warner Brothers did a much larger version with many (though not all) of the characters Blanc voiced.  That's the one J.J. remembered, and one you could buy through the Warner Brothers mall stores, when they existed.

I couldn't find a link to the second, but I am a bit rushed this morning.  I'm sure it's out there on the web.

The practical alternative then is to make statutory rape a felony in VA.  I don't see that going over all too well from the Malor types.

Even trying to make this a branding issue misses the mark.  Cuccinelli has been very stalwart in defending laws that he doesn't actually agree with.  Bans on campus carry spring to mind.  IOW he's doing the job he was elected to do, unlike the Democrats with their invoking of "prosecutorial discretion" to deep-six things like, oh, Black Panthers and their voter intimidation...

Sure, some women can make it.  But damn few.  Damn few.  Should we have to change the ENTIRE infrastructure of the Armed Forces to accommodate the, oh, maybe 2% of women who can make it?  (And 2% is being extraordinarily generous based on some studies of previous efforts I've read.)  Should we also ignore the sexual dynamic which would be greatly magnified in combat?

What other law would you drum up? For some god unknown reason, at age 15 statutory becomes a misdemeanor in VA and they've got the guy on contributing to the delinquency of a minor.

The reasoning is that VA didn't want to make an 18 year old a felon for having sex with his 16 year old girlfriend.  And it's actually a reasonable argument on its own merits (however, I suspect most fathers have alternative Hidden Law remedies in those situations...).

I agree that's a reasonable argument, but VA's application of it is moronic.

Most states deal with that in a much more sane way.  I've seen several variants that include "unless both parties are under 18" or "unless both parties are within X years of age of each other."

I even saw one that required a pre-existing relationship be shown.

There are tools in the law to handle that, why VA decided to be lazy on this one I have no idea.  You could exempt young kids "in love" up to a reasonable age and still prosecute this guy, but VA opted for the shorter version of the law.

278 In a staggering case of affirmative action gone wild, officials in a major U.S. city are actually recruiting minorities to be lifeguards at public pools even if they’re not good swimmers. It’s all in the name of diversity. You can’t make this stuff up. It’s a real-life story out of Phoenix, the capitol of Arizona and the nation’s sixth-largest city. It has more than 1.4 million residents and, among its official mottos is “value and respect” of diversity. This means “more than gender and race,” according to the city’s official website. It also encompasses “uniqueness and individuality” and embracing differences. “We put this belief into action to provide effective services to our diverse community.” Evidently officials are willing to compromise those “effective services” at 29 public swimming pools spread throughout the city. To diversify the lifeguard force, Phoenix will spend thousands of dollars to recruit minorities even if they’re not strong swimmers, according to an official quoted in a news report. Blacks, Latinos and Asians who may not necessarily qualify can still get hired, says the city official who adds that “we will work with you in your swimming abilities.” Liberalism run wild

291 And Gabe, that supposed "misuse" of taxpayer funds was made up political horseshit.

Posted by: Vic at April 04, 2013 07:02 AM (53z96)

Um, no. He used taxpayer money to fund his trips to visit his mistress. After he got caught he paid some of that money back. That's misuse of taxpayer funds in my book.

Thanks to several of you for the clarification on Cuccinnelli. I was about to scrape his bumper sticker off my Prius based on Gabe's comments.

Yeah, see, thing is, VA didn't try to convict the guy on statutory rape, which it could have, and which statute is undeniably constitutional. Instead, VA tried to convict the guy under the "Crimes Against Nature" statute, which has obvious problems.

Now, why would Cuccinelli do that? Well, for starters, it's a felony to give or get a blowjob in Virginia. A felony for anyone to give or get a blowjob in Virginia, with no age limitations at all. On the other hand, statutory rape of a 15 through 17 year old is merely a misdemeanor. Cuccinelli is essentially defending a bad law because he thinks the guy in question should be guilty of a felony and Virginia lawmakers, in their wisdom, think that stat rape for this victim's age bracket should only be a misdemeanor.

I don't think it's very conservative to use unconstitutional laws to procure heavier sentences against criminals than what the legislature intended. They could have gone after this guy for stat rape. Instead they chose this. Now they have to defend this ridiculous law, which, as I said in the post and here, has no age limitation in it at all.

292 How's that rebranding going? Very well, unless you are a chickenhawk looking for a twinkie: One judge dissented, agreeing with a lower court that the Supreme Court’s ruling in Lawrence v. Texas on sodomy laws applied only to consenting adults. The case in question involved a teenage girl and a 47-year-old man, William Scott MacDonald, who was convicted of soliciting a minor to commit a felony. A clerk told the Washington Blade that a petition was filed on Cuccinelli’s behalf asking for the full 15-judge court to reconsider the panel’s decision. LGBT advocates have expressed disappointment, saying the law is unconstitutional and anti-gay.

Well prosecutors don't make the laws, they just have to try to get something resembling justice with the laws on that books.

In that regard, I feel bad for the prosecutors, who likely felt "misdemeanor" wasn't harsh enough (and it's a moronically crafted law, IMHO.)

So unless I'm applying ill will to the prosecutors (Which I'm not) then they did what they had to.  Leave it to the legislature to change the law. (Or ballot initiative.)

Gabe,

Who was the prosecuting attorney in that case? Cuccinelli or one of his charges? Or was this a local DA decision? Unless it was the AG's office that prosecuted the guy, it wasn't a VA official who made that call. It would be a county prosecutor.

I know you and all of the fiscons here hate Cuccinelli and think he's an embarassment. But if you look at what he has done in office and not what the MSM thinks, I think he's a pretty good example of what we would want in an AG. For example, he expressed legal objectives to the transportation deal in VA, despite it being pushed through by the sainted Governor McDonnell, because of the tax increases included in it.

And encode a difference for a 21 year old man having sex with a 17 year old vs a 47 year old man doing the same thing?

Do you believe there is anything wrong when a 47 year old predator has sex with a minor, even a 17 year old minor?  Should the 47 year old not face a felony conviction for what he did?  Law aside...what's your preferred solution to this issue?

332 MacDonald was forty-seven years old at the time of the events giving rise to his state court convictions.3 On the evening of September 23, 2004, MacDonald telephoned seventeen-year-old Amanda Johnson, a young woman he had met through a mutual acquaintance. MacDonald and Johnson arranged to meet that night at a Home Depot parking lot in Colonial Heights. When they arrived at the parking lot, MacDonald got into the backseat of JohnsonÂ’s vehicle and they drove to the nearby home of JohnsonÂ’s grandmother. Johnson went into her grandmotherÂ’s residence to retrieve a book, and when she returned to the vehicle MacDonald asked her to "suck his dick." J.A. 51. MacDonald also suggested that they have sex in a shed in JohnsonÂ’s grandmotherÂ’s yard. Johnson declined both proposals, however, and she drove MacDonald back to the Home Depot parking lot. Nearly three months later, in December 2004, MacDonald filed a report with the Colonial Heights police maintaining that Johnson had abducted and sexually assaulted him. Mac- Donald thereafter met with and was interviewed by Detective Stephanie Early. MacDonald advised Early that, sometime in September, Johnson had paged him and asked that he meet her in the Home Depot parking lot. MacDonald stated that, once they met, he got into JohnsonÂ’s car and she drove them away. When MacDonald asked Johnson where she was going, she did not respond. MacDonald told her, "his has got to stop, lose my number, IÂ’m married, donÂ’t call me anymore." J.A. 59. MacDonald also advised Detective Early that he and Johnson stopped at a location on Canterbury Lane in Colonial Heights, and "at that point Ms. Johnson forcibly removed his penis from his pants and performed oral sex against his will." Id. MacDonald acknowledged that he knew Johnson was only seventeen years old. Soon thereafter, Detective Early met with and interviewed Johnson, who gave a sharply conflicting account of what had occurred. Crediting JohnsonÂ’s version of the events, Early secured three arrest warrants for MacDonald, charging: (1) the felony criminal solicitation offense; (2) the misdemeanor offense of contributing to the delinquency of a minor; and (3) the misdemeanor offense of "knowingly giv[ing] a false report as to the commission of a crime to the Police with the intent to mislead," in violation of Virginia Code section 18.2- 461. See J.A. 4-6. MacDonald was arrested on January 25, 2005. He was prosecuted in the Juvenile and Domestic Relations Court of Colonial Heights on the false police report charge, and in the circuit court on the other two charges. http://goo.gl/0Vc2J

Mexico attacking the US would have been a disaster for the nation of Mexico but a huge boon for the people of Mexico. Just imagine if they got us pissed off enough for a repeat of the Mexican-American War. It ends with us pushing the southern border a lot further south and the Mex government getting a pile of cash.

Better yet, we could have taken territory all the way down to the narrow part at Oaxaca. Make them all citizens in a US that hadn't been corrupted by welfare yet. Image how much better off the average citizen of those Really Deep South states would be.

Preferably, people would attack us until we'd conquered and retroactively bought everything down to Panama. Let Canada know we're watching them and if the maple doesn't keep flowing the kid gloves are off. Secure the continent. Sure, a few million casualties would occur along the way but the benefits to the survivors would be great.

343 If Virginians don't want 47-year-olds getting, not even that, requesting blow jobs from 17-year-olds, when it would be a finger wagging offense if the penis in question was a lot younger, they're going to need some new laws that actually live up to that intent, rather than trying to bend law to do something that isn't its intent.

Sleazy as this Johnson guy might be, the lengths the state is going to put him away is really ridiculous. The more details that are revealed the more silly this whole case becomes. There was no sex of any sort, unless proposing a blow job be performed counts as the act itself. The map is not the territory.

a 47 year old man who solicits a minor for sex acts and then lies to police and accuses her of crimes in order to pre-emptively silence her deserves to be in a little trouble with the law for attempted solicitation and false report.  Yes the law is not perfect.  But there is such a thing as prosecutorial discretion.

Which crime? The sex with a 17-year-old part is only a misdemeanor in Virginia. They dragged in a plainly archaic law that would never have been invoked if the girl was a year older at the time.

What this really comes down to is that Virginia has some ill-designed laws and the prosecutor should cut his losses to instead use the case as an argument for updating those laws. Because if they're seriously going to put someone in jail over a hypothetical blow job it isn't just the gays who should be worked up over this. Unless extremely selective prosecution has become acceptable, millions of adult Virginians should be facing prosecution as well.

And I get that soliciting a crime is a crime. But it's clear that the prosecutor is really stretching by trying to charge a felony. As I mentioned, he has prior convictions and I believe he was still on probation for them. I think he filed the false police report because he thought she was going to or was going to go to the police. By claiming to be a "victim" he thought he could avoid additional charges or having his probation revoked. I see no stretch by the prosecutor. If four recent misdemeanor convictions did not alter his behavior, than upping it to a felony might. Plus, the fact that he filed a false police report, too, makes a felony filing well deserved. Dumbass? No. He has a compulsive personality disorder. I doubt that he will ever change. He's married, too.

MacDonald rode with A.J. from there to her grandmother's house to retrieve a personal item. When she returned to her car, MacDonald asked her "to suck his dick." He then pointed to a shed in the backyard and suggested they go back there to "have sex." A.J. said she was tired and wanted to take him back to his truck. When they returned to the parking lot, MacDonald pushed her up against the hood of her car and starting kissing and groping her. She pushed him away and went home. WILLIAM SCOTT MacDONALD v. COMMONWEALTH OF VIRGINIA Record No. 1939-05-2. In the Court of Appeals of Virginia, Richmond. January 9, 2007.

360 By all means let's swallow whole.... ---- I see what you did there.

361 by the way, WaPo reporter on the story is Rachel Weiner.  Funny

Posted by: thunderb at April 04, 2013 06:15 AM (+afNf)

362 so, in sum, I am not swallowing whole Weiner's report that this case is all about sodomy.

Posted by: thunderb at April 04, 2013 06:16 AM (+afNf)

363 362 Cute. The prosecution isn't all about sodomy, which is good because none occurred. One part if the prosecution---cuccinelli's insisting on adding a ridiculous felony charge to the reasonable charges against McDonald---kind of is all about sodomy and who super-duper against it Cuccinelli is.

In this appeal, we consider a constitutional challenge to Code § 18.2-361 prohibiting sodomy.

I. Facts

The facts of this case are not in dispute.   William S. McDonald (“McDonald”), a man who was 45 to 47 years old during the years when the subject events took place, engaged in private, sexual intercourse and oral sodomy with a 16-year-old female, L.F., on two occasions.   McDonald also had private, sexual intercourse and engaged in oral sodomy with a different female, A.J., who was 17 years of age at the time.   In a non-jury trial, McDonald was found guilty of one count of contributing to the delinquency of a minor under Code § 18.2-371 and four counts of sodomy under Code § 18.2-361. Only the sodomy convictions are before this Court on appeal.

WaPo didn't see fit to report that

Posted by: thunderb at April 04, 2013 06:28 AM (+afNf)

365

McDonald contends that the contributing to the delinquency of a minor statute refers only to sexual intercourse and penalizes such acts as a misdemeanor for an adult to commit such acts upon children aged fifteen, sixteen, or seventeen.   Because the statute does not mention sodomy, McDonald argues that the contributing statute does not apply to acts of sodomy.   He further infers from the carnal knowledge statute that because prosecution under its provisions includes both sexual intercourse and specified forms of sodomy, that this “puts the age of consent for sexual activity in Virginia at 15 years old.”   McDonald is incorrect for two reasons:  (1) the sodomy statute stands alone and without age restrictions concerning consent in this case, and (2) the real issue in this case is the victims' legal status as minors.

First, the fact that separate statutes may overlap in their proscription of specific conduct does not detract from their independent enforcement except when double jeopardy concerns are implicated.  “[W]hen an act violates more than one criminal statute, the Government may prosecute under either so long as it does not discriminate against any class of defendants.”   United States v. Batchelder, 442 U.S. 114, 123-24, 99 S.Ct. 2198, 60 L.Ed.2d 755 (1979);  see also Muhammad v. Commonwealth, 269 Va. 451, 501-02, 619 S.E.2d 16, 45 (2005).  “Whether to prosecute and what charge to file or bring before a grand jury are decisions that generally rest in the prosecutor's discretion.”  Batchelder, 442 U.S. at 124, 99 S.Ct. 2198.   McDonald raises no double jeopardy issues.   Furthermore, there is no basis for engrafting provisions or perceived implications from the carnal knowledge statute and the laws governing the crime of contributing to the delinquency of a minor into the sodomy statute.   Such matters are for legislative consideration, and here the provisions are simply different.

Second, the real issue is the legal status of the victims as minors.   Determining the age of majority is the province of the General Assembly.   Mack v. Mack, 217 Va. 534, 537, 229 S.E.2d 895, 897 (1976) (holding “minority is a legal status subject to change by the legislature”).   The Code is quite specific concerning the dividing line between minors and adults.   Code § 1-203 (“ ‘AdultÂ’ means a person 18 years of age or more.”), Code § 1-204 (“For the purposes of all laws of the Commonwealth including common law, case law, and the acts of the General Assembly, unless an exception is specifically provided in this Code, a person shall be an adult, shall be of full age, and shall reach the age of majority when he becomes 18 years of age.”), Code § 1-207 (“ ‘Child,Â’ ‘juvenile,Â’ ‘minor,Â’ ‘infant,Â’ or any combination thereof means a person less than 18 years of age.”).

The sodomy statute has no express age of consent;  however, it must be applied in a constitutional manner in conformity with Lawrence and Martin.   The Court in Lawrence was explicit in its declaration of the scope of its opinion:  “The present case does not involve minors.”  539 U.S. at 578, 123 S.Ct. 2472.   We were equally explicit in our opinion in Martin:  “It is important to note that this case does not involve minors, non-consensual activity, prostitution, or public activity․ Our holding, like that of the Supreme Court in Lawrence, addresses only private, consensual conduct between adults and the respective statutes' impact on such conduct.”   269 Va. at 42-43, 607 S.E.2d at 371.

366 It was in the story WaPo linked. And anyway, it's a different case, with the same defendant.

367 I will climb in the barrel for the lack of spacing.  It was there when I copied it.  The law is imperfect, but this is not a case of gay hate.  It is a case of predator hate.

368

a prosecutor should consider the record of a defendant when making charging decisions.

Posted by: thunderb at April 04, 2013 06:43 AM (+afNf)

369 Cute. The prosecution isn't all about sodomy, which is good because none occurred. One part if the prosecution---cuccinelli's insisting on adding a ridiculous felony charge to the reasonable charges against McDonald---kind of is all about sodomy and who super-duper against it Cuccinelli is.

Cuccinelli was not the prosecutor. The man was convicted in 2005. Cuccinelli was in the VA Senate at that time. He was not a prosecutor. So, do not blame him for the original charge. Again, you hate the man so much that you ascribe things to him that he did not do. Cuccinelli, as AG, is defending the laws of the Commonwealth of Virginia. That is what he is supposed to do.

370 No, thunderb is correct. The WaPo did NOT mention this guy's prior convictions for similar behavior.

Posted by: Waldo Truth at April 04, 2013 06:45 AM (TE8aX)

371 There was nothing wrong with the charging in this case. And I agree that Lawrence v Texas should not be extended to minors.

Posted by: Waldo Truth at April 04, 2013 06:47 AM (TE8aX)

372 I think calling this a case of sodomy between consenting adults was a lie.  She did not consent and was not an adult, and the defendant is a predator.

Posted by: thunderb at April 04, 2013 06:52 AM (+afNf)

373 372 I think calling this a case of sodomy between consenting adults was a lie. She did not consent and was not an adult, and the defendant is a predator. Posted by: thunderb Well, get use to it because you will hear it repeatedly described as such -- worse by our own side.

Posted by: Waldo Truth at April 04, 2013 07:18 AM (TE8aX)

374 No one said it was a case between adults, only that the law says it can be a crime between adults. And, Waldo, the WaPo linked to a story about his previous convictions. Click the blue letters. We'll have to agree to disagree about how Lawrence should apply to teens. I take the view that sodomy should be treated no differently from other sex---if sex between adults and tenth-graders is a misdemeanor in VA, that should go for all flavors of sex. It's silly to say that a _____ year old is capable of consenting to vaginal sex but not to oral sex, as though oral sex requires some sort of special maturity or poses additional risks over vaginal sex.

375 It would be easier to take the LGBT advocates cries of discrimination more seriously if they stopped advocating for NAMBLA type positions

Posted by: thunderb at April 04, 2013 07:30 AM (ekY91)

376 BTW Gabe said it was between adults, and absent an age in the sodomy law, that's McDonald's position as well.

Posted by: thunderb at April 04, 2013 07:32 AM (ekY91)

377 So WaPo not mentioning ALL the facts in the case, like the perp's history, in the body of the story is not misleading? And pretending the AG charged this case is not misleading? And describing it as a case between consenting adults is not misleading?

Posted by: thunderb at April 04, 2013 07:40 AM (ekY91)

378 And, Waldo, the WaPo linked to a story about his previous convictions. Click the blue letters. Where? I have no "blue letters." There are what appear to be five links in the article but none that indicate that it will direct you to the actual facts of the case. The facts of the case are important. Why aren't they all put out up front in the actual article? To do otherwise is unacceptable and typical lefty bullshit.

Posted by: Waldo at April 04, 2013 07:48 AM (TE8aX)

379 It would be just as accurate to claim McDonald and LGBT advocates are fighting for sodomy with minors. Would you find that fair?

Posted by: thunderb at April 04, 2013 07:50 AM (ekY91)

380 This isn't a case of gay hate and liars piss me off.
