Some email correspondents made an interesting observation. Top news stories yesterday were (1) South Carolina's Mark Sanford, admitted adulterer and confessed misuser of taxpayer money, won the SC1 GOP primary; (2) North Carolina Republicans are trying to pass a nullification law so they can (putatively, but really not, bless their hearts) ignore the federal courts telling them to stop favoring Christianity over other religions; and (3) Virginia Attorney General Ken Cuccinelli is fighting to uphold the state's "Crimes Against Nature" law, which makes it unlawful for adults of either sex to have oral or anal sex. How's that rebranding going?
You might have seen on twitter a bit of dust-up over Ben Howe's column about poorly-made conservative art. John Nolte, for example, is a bit het up about it. I agree with Dana Loesch.
And, just because I spent all night drooling all over it, take a look at this.

Thanks for the morning briefing, Gabe and Vic. TodayÂ’s story concerns Mel Blanc, Bugs Bunny and Clark Gable:
Blanc (born Melvin Jerome Blank in 190
, of course needs no introduction to fans of classic radio or Warner Brothers animation. My story takes place in 1961, after Blanc was involved in a head-on automobile accident on “Dead Man’s Curve” on Sunset Boulevard. The crash left Blanc with a triple skull fracture as well as broken legs and fractured pelvis and put him in a coma for three weeks.
Never a robustly healthy man, doctors became increasingly worried as Blanc failed to respond to treatment, and warned his family that the Man of a Thousand Voices might not survive. BlancÂ’s son Noel (who, uncredited, ghosted several WB characters for his father during this time) took up a vigil at his bedside, reading newspapers to him and chatting simply about the family, but Blanc didnÂ’t respond.
Finally, in desperation, Noel approached his father’s bedside one morning. “How are you, Bugs?” he asked. To his astonishment, Blanc appeared to hear him, and, with great difficulty, managed to whisper, “Ehh. . .what’s up, doc?”
From that point on, Noel would carefully call out the names of his fatherÂ’s characters. Slowly, but with increasing confidence, Blanc would begin answering in the voices of Porky Pig, Foghorn Leghorn, Daffy Duck and all the others until he finally emerged from his coma.
And Clark Gable? Well, the next time 1934’s It Happened One Night shows up on TCM, watch it. When Gable and Claudette Colbert are stranded at the side of the road waiting for a car to give them a lift, Gable chews on a carrot as he trades wisecracks with Colbert. And, slowly, the realization will come to you – Gable is doing Bugs Bunny before Bugs was created. And that’s because animator Cal Dalton based Bugs’ wisecracking attitude on Gable.

Cuccinelli agrees with the dissenting judge, Albert Diaz, who was appointed to the 4th Circuit by President Obama in 2009, who argued for deference to the Virginia Court of Appeals.
In Virginia, sex with a minor who is 15 or older can be a misdemeanor but not a felony. (MacDonald was also convicted of the misdemeanor of contributing to the delinquency of a minor and is not challenging that decision.)
Before the 4th CircuitÂ’s ruling, Virginia courts had found that Lawrence did not apply to minors, meaning that teenagers engaging in consensual sexual activity could be at risk of prosecution.

Not to pile on, because item #1 is to defeat that dipshit Colbert's sister, but Sanford running this quickly after humiliating his wife shows a jawdropping contempt for what he expects the electorate to accept imo. I would expect a "normal" human being with a functioning sense of right and wrong to at least spend some time, like around a decade, immersing himself in a low to moderate exposure undertaking to get back in peoples' good graces. But maybe a lack of a sense of right and wrong is what it takes to succeed in today's politics.

But assuming the 17 year old gave whatever the fuck passes for "consent" in VA, there's not much else you can do sadly. The reasoning is that VA didn't want to make an 18 year old a felon for having sex with his 16 year old girlfriend. And it's actually a reasonable argument on its own merits (however, I suspect most fathers have alternative Hidden Law remedies in those situations...).

I agree that's a reasonable argument, but VA's application of it is moronic.
Most states deal with that in a much more sane way. I've seen several variants that include "unless both parties are under 18" or "unless both parties are within X years of age of each other."
I even saw one that required a pre-existing relationship be shown.
There are tools in the law to handle that, why VA decided to be lazy on this one I have no idea. You could exempt young kids "in love" up to a reasonable age and still prosecute this guy, but VA opted for the shorter version of the law.

Um, no. He used taxpayer money to fund his trips to visit his mistress. After he got caught he paid some of that money back. That's misuse of taxpayer funds in my book.
Thanks to several of you for the clarification on Cuccinnelli. I was about to scrape his bumper sticker off my Prius based on Gabe's comments.
Yeah, see, thing is, VA didn't try to convict the guy on statutory rape, which it could have, and which statute is undeniably constitutional. Instead, VA tried to convict the guy under the "Crimes Against Nature" statute, which has obvious problems.
Now, why would Cuccinelli do that? Well, for starters, it's a felony to give or get a blowjob in Virginia. A felony for anyone to give or get a blowjob in Virginia, with no age limitations at all. On the other hand, statutory rape of a 15 through 17 year old is merely a misdemeanor. Cuccinelli is essentially defending a bad law because he thinks the guy in question should be guilty of a felony and Virginia lawmakers, in their wisdom, think that stat rape for this victim's age bracket should only be a misdemeanor.
I don't think it's very conservative to use unconstitutional laws to procure heavier sentences against criminals than what the legislature intended. They could have gone after this guy for stat rape. Instead they chose this. Now they have to defend this ridiculous law, which, as I said in the post and here, has no age limitation in it at all.

Well prosecutors don't make the laws, they just have to try to get something resembling justice with the laws on that books.
In that regard, I feel bad for the prosecutors, who likely felt "misdemeanor" wasn't harsh enough (and it's a moronically crafted law, IMHO.)
So unless I'm applying ill will to the prosecutors (Which I'm not) then they did what they had to. Leave it to the legislature to change the law. (Or ballot initiative.)
By the way whoever said "Gabe doesn't come around." I would remind you, you're wrong, he tussles more than most (except maybe Ace.) with us Plebes.

Who was the prosecuting attorney in that case? Cuccinelli or one of his charges? Or was this a local DA decision? Unless it was the AG's office that prosecuted the guy, it wasn't a VA official who made that call. It would be a county prosecutor.
I know you and all of the fiscons here hate Cuccinelli and think he's an embarassment. But if you look at what he has done in office and not what the MSM thinks, I think he's a pretty good example of what we would want in an AG. For example, he expressed legal objectives to the transportation deal in VA, despite it being pushed through by the sainted Governor McDonnell, because of the tax increases included in it.

It's easy to snark at Cuccinelli, especially if you have a vested interest in the law in question, but others are right: he has to play the cards he's dealt and I don't think society is all that forgiving of the facts we have in this situation.

Mexico attacking the US would have been a disaster for the nation of Mexico but a huge boon for the people of Mexico. Sleazy as this Johnson guy might be, the lengths the state is going to put him away is really ridiculous. The more details that are revealed the more silly this whole case becomes. There was no sex of any sort, unless proposing a blow job be performed counts as the act itself. The map is not the territory.

Which crime? The sex with a 17-year-old part is only a misdemeanor in Virginia. They dragged in a plainly archaic law that would never have been invoked if the girl was a year older at the time.
What this really comes down to is that Virginia has some ill-designed laws and the prosecutor should cut his losses to instead use the case as an argument for updating those laws. Because if they're seriously going to put someone in jail over a hypothetical blow job it isn't just the gays who should be worked up over this. Unless extremely selective prosecution has become acceptable, millions of adult Virginians should be facing prosecution as well.

In this appeal, we consider a constitutional challenge to Code § 18.2-361 prohibiting sodomy.
I. Facts
The facts of this case are not in dispute. William S. McDonald (“McDonald”), a man who was 45 to 47 years old during the years when the subject events took place, engaged in private, sexual intercourse and oral sodomy with a 16-year-old female, L.F., on two occasions. McDonald also had private, sexual intercourse and engaged in oral sodomy with a different female, A.J., who was 17 years of age at the time. In a non-jury trial, McDonald was found guilty of one count of contributing to the delinquency of a minor under Code § 18.2-371 and four counts of sodomy under Code § 18.2-361. Only the sodomy convictions are before this Court on appeal.

McDonald contends that the contributing to the delinquency of a minor statute refers only to sexual intercourse and penalizes such acts as a misdemeanor for an adult to commit such acts upon children aged fifteen, sixteen, or seventeen. Because the statute does not mention sodomy, McDonald argues that the contributing statute does not apply to acts of sodomy. He further infers from the carnal knowledge statute that because prosecution under its provisions includes both sexual intercourse and specified forms of sodomy, that this “puts the age of consent for sexual activity in Virginia at 15 years old.” McDonald is incorrect for two reasons: (1) the sodomy statute stands alone and without age restrictions concerning consent in this case, and (2) the real issue in this case is the victims' legal status as minors.
First, the fact that separate statutes may overlap in their proscription of specific conduct does not detract from their independent enforcement except when double jeopardy concerns are implicated. “[W]hen an act violates more than one criminal statute, the Government may prosecute under either so long as it does not discriminate against any class of defendants.” United States v. Batchelder, 442 U.S. 114, 123-24, 99 S.Ct. 2198, 60 L.Ed.2d 755 (1979); see also Muhammad v. Commonwealth, 269 Va. 451, 501-02, 619 S.E.2d 16, 45 (2005). “Whether to prosecute and what charge to file or bring before a grand jury are decisions that generally rest in the prosecutor's discretion.” Batchelder, 442 U.S. at 124, 99 S.Ct. 2198. McDonald raises no double jeopardy issues. Furthermore, there is no basis for engrafting provisions or perceived implications from the carnal knowledge statute and the laws governing the crime of contributing to the delinquency of a minor into the sodomy statute. Such matters are for legislative consideration, and here the provisions are simply different.
Second, the real issue is the legal status of the victims as minors. Determining the age of majority is the province of the General Assembly. Mack v. Mack, 217 Va. 534, 537, 229 S.E.2d 895, 897 (1976) (holding “minority is a legal status subject to change by the legislature”). The Code is quite specific concerning the dividing line between minors and adults. Code § 1-203 (“ ‘Adult’ means a person 18 years of age or more.”), Code § 1-204 (“For the purposes of all laws of the Commonwealth including common law, case law, and the acts of the General Assembly, unless an exception is specifically provided in this Code, a person shall be an adult, shall be of full age, and shall reach the age of majority when he becomes 18 years of age.”), Code § 1-207 (“ ‘Child,’ ‘juvenile,’ ‘minor,’ ‘infant,’ or any combination thereof means a person less than 18 years of age.”).
The sodomy statute has no express age of consent; however, it must be applied in a constitutional manner in conformity with Lawrence and Martin. The Court in Lawrence was explicit in its declaration of the scope of its opinion: “The present case does not involve minors.” 539 U.S. at 578, 123 S.Ct. 2472. We were equally explicit in our opinion in Martin: “It is important to note that this case does not involve minors, non-consensual activity, prostitution, or public activity․ Our holding, like that of the Supreme Court in Lawrence, addresses only private, consensual conduct between adults and the respective statutes' impact on such conduct.” 269 Va. at 42-43, 607 S.E.2d at 371.

Cuccinelli was not the prosecutor. The man was convicted in 2005. Cuccinelli was in the VA Senate at that time. He was not a prosecutor. So, do not blame him for the original charge. Again, you hate the man so much that you ascribe things to him that he did not do. Cuccinelli, as AG, is defending the laws of the Commonwealth of Virginia. That is what he is supposed to do.
