Top Headline Comments 5-8-13

Happy Wednesday.

The Alabama Senate gave final approval to the homebrew bill, which the governor is generally expected to sign. Alabama is the last state in the nation where homebrewing is illegal.

The Delaware Senate passed a gay marriage law, which the governor signed an hour later. Delaware is the 11th state to legalize gay marriage.

All of the proposed amendments to the Gang of 8 immigration bill are listed here. Some interesting ones that I happened to spot (there are probably loads of others, these are just the one I spotted pretty much randomly):


  • Cruz 3: To provide that no person who has previously been will fully present in the United States while not in lawful status shall be eligible for United States citizenship. (In addition to making all illegal aliens granted amnesty ineligible to naturalize, this would make citizenship unattainable for many individuals who are granted asylum and all individuals who are granted cancellation of removal for nonpermanent residents).

  • Sessions 34: To clarify that this Act does not preempt any State or local criminal law. (This would undo the Supreme Court's decision preempting Arizona's -- and likely other states' -- immigration enforcement laws.)

  • Hatch 3: To collect a DNA sample from each adult alien applying for registered provisional immigrant status for comparison against the Combined DNA Index System of the Federal Bureau of Investigation.

  • Grassley 3: To require border security measures along the Northern border of the United States. (Grassley has a couple amendments to spend on border security along both borders.)

  • Graham 1: To provide for termination of asylum or refugee status in cases of country return. (With an exception for "good cause." Likely a reaction to the Tsarnaevs.)

  • Lee 7: To modify the physical presence requirement for application for registered provisional immigrant status. (He backs it up to December 31, 2009, instead of December 31, 2011.)

Sen. Grassley proposed the most amendments (77). Sen. Sessions came in second place with 49. Obviously, a lot of these aren't gonna make it into the bill.

Republicans “hounded” the poor Dems.  So was it a cover-up?  No, it was blatant mismanagement by both Hillary and Obama after which Hillary lied to Congress and committed perjury.  If this were a Republican admin the press would be calling for Hillary to be fired and prosecuted and Obama impeached.

And the Dems response?  This is old news.  And Hillary should be fired and prosecuted.  But she wonÂ’t, she is a Democrat and will be the next runner for President for their Party.  This will wash off her back like water off a goose.

5 NJ grabs 6 acres from a Church and wants to pay  $1.9 million for it.  The church says it is worth ten times that much. This is typical of what they do with imminent domain. They must pay fair market value but they always offer a pittance which ultimately forces it to court unless the people they are stealing from canÂ’t afford to go to court.  They just get shit on.

Of some interest as we merry Rochambeau each other over amnesty in the coming weeks, USC has released "Undocumented Californians, Immigration Reform,and Our Future Together".

Pretty much what you would expect, Immigrants Yay!, but there's some useful information in there on the methodologies used to derive estimates of the numbers of illegals and their demographics.

I'd question their estimate for California: 2.6 million for the entire state? 2.6 million between the 101 and the 118 maybe. But it can serve as a starting point as we start tossing numbers at each other.

Morning, ‘rons and ‘ronettes.  Thanks for the morning briefing, Gabe and Vic.  The weather was finally warm enough for me to saddle up the Harley and ride in this morning, so knowing I can ride this afternoon should be enough to keep my emotions on a fairly even keel today.  I can have a heart attack about the Benghazi hearings tomorrow.  I hope.  Anyway. . .

 

 

I know I mentioned that silent screen heartthrob Rudolph Valentino – who was a typical Italian, very touchy about slights to his masculinity – once sparred with Jack Dempsey.  The prizefighter was impressed with the Latin Lover, declaring that Valentino “packed a he-man punch.”

I saw that as more of a Sanford hate thread from a lot of the posters.  As for the spic comments I am not sure if that is considered racist or not since Hispanic is not a race.

Most of the public wants enforcement, and most also would go along with amnesty, but only if there is a secure border. Also most are against amnesty without a secure border. Miss Marple, most computers now have some kind of internal sound device with a mini-output jack on the back or the front.  It is normally a green colored jack.  If it is a case of not having a small pair of speakers to plug in there you can still plug in a set of headphones and get sound.

They talk about how it has worked out so great for gubmint workers, not realizing that most gubmint payrolls have, maybe, 2 to 3 times the amount of employees needed anyway. Most private companies now days are running very lean in the employee department. If the person were to opt for comp time, who's to say when they can take it. On my job as a salaried employee you could get comp time, but you had to ask permission to use it just like vacation time. So sure, you got 10 days coming to you, but you could only take 3 at a time...in January.

And of course when others took there comp time, guess who got to cover for them?

127 #117  Vic,  it's the sound program within the system.  My computer guy said that to fix it he would have to re-load the entire system,  and even then he wasn't sure it would work.  He said he had never seen it before,  and he's the old IT guy from my husband's former company and not stupid - has a good position and does consulting on the side.  I don't want to have everything re-loaded as I might lose info for my business.

Most of the time it's no big deal as all it does is keep me from wasting time on videos.  I have a lap top but daughter will be using it today for job applications.

We never got comp time (exempt) or overtime.  I checked on this in the actual labor law.  There is no such ting as "comp time".  What it is is a "salaried employee" is paid by the month for a job.  When a company breaks that down to weekly paychecks he is getting the equivalent of 40 hours pay no matter what hours he works.


So if you work 50 hours you get 40 hours pay, if you work 30 hours you get 50 hours pay.  I actually saw this proven on one occasion.  An exempt employee (engineer) was give a week off without pay for sleeping on the job.  He filed a complaint.  The lawyers came down from the home office and told the bosses "no can do" he is Act-II exempt.  They said you can do nothing or you can fire him but you can't cut pay.



But he could not resist screwing up again and he was fired the next time.

Sanford may have already effectively declared he's running in 2014.  Says he'll term limit himself to 12 years, but whether he's including his previous terms or restarting the clock, who knows. He's broken that promise repeatedly already.

So, he'll have to be winkled out.  Which was one of the arguments for hoping C-B won, because she would be neutered in this Congress and bounced in the next election.

Defending the tax code isn't quite the same as agreeing with it.  I think the tax code is a monstrosity and I want it reduced to a one page flyer:  if you have $x in net income, you pay y%. 

 

But I can also recognize that the income tax is authorized by the general taxing power granted to the Congress by the Constitution, even absent the 16th Amendment.  In other words, a 16A repeal wouldn't eliminate the income tax but would instead create an apportionment requirement on income earned from property (rents, dividends, etc).

 

There's room for a political beef with what the income tax has become but that doesn't mean saying the tax itself is valid means one is anti-Liberty.

Then you have an i20, which says how long you can stay, and this is conditional on enrollment in school. You overstay this and you break the law. So I guess grad students aren't breaking the law!

303 Kinley Ardal, yes it would be a lot of concrete.  But it would definitely improve national security in a concrete way.

Some areas of the south it would be impossible to build such, where the mountains get rugged, but that would be a design plus.  Would channelize the attempted inflow to known ingress points that would deter the faint of heart.  Thus can better manage Border Patrol resources.

Another thing that would have to happen would be to expand the border crossing inspection stations.  Plus fortify them more and allocate some of the agents who are no longer required to patrol remote stretches to those border crossings.

My entire family would like to be here and those who live back home have had ample opportunity to overstay visas but no one ever did. When my dad was ill and they couldn't travel back home when they originally intended, you should have seen how nervous my parents were. Border for sure.  I am deeply sympathetic to the people fleeing a third world hellhole, but the bloody fact is that they are being used by the powers that be in both America and Mexico to continue the very processes that are making them flee.

359 Simple way to solve future visa overstays is to:

1. Fingerprint/ID everyone entering.
2. Require anyone entering the country to post a bond.  Bond is provided by private companies that can set bond amount based on likelihood of not returning.  (Also require medical and liability insurance.  You go to jail or get sick, the taxpayer isn't paying for it.) 
3. Anyone not exiting at specified time is immediately posted for bounty with 75% of bond going towards anyone apprehending said fugitive.
4. If number of fugitives from a specific country reaches over certain number (say 1,000).  No more visas are issued until half that number are found and returned.

For the existing ones, I would just start placing bounties on them.

Build your form. Pour a slab base. Once it cures, you pour on top of that for your panels. An agent is added to keep the panel from sticking to the slab, obv. Well, I suppose it depends on what congressional district the panels were being manufactured in.  I'll bet that politicians in Ohio or Wisconsin would be a lot more enthusiastic about a border fence if somebody in their district got a contract. 

The "L" shaped panels that the last version of the Berlin Wall used were essentially copied by the Israelis when they built their fence.  They might not stand up to a tank, but they will stop any civilian vehicle except maybe one of those giant trucks they use in open pit mines.
