Happy Tuesday.

Poll finds Americans, by 2 to 1, not really bothered about cell phone tracking in the context of terrorism prevention. The interesting thing is that the overall number remained stable, while Republicans and Democrats shifted on the issue after Obama was elected.

I didn't realize that it had been confirmed that Snowden was the source for Greenwald's cell phone metadata scoop. Investigators are trying to figure out how a contract IT guy managed to get his hands on it. "When he said he had access to every CIA station around the world, he's lying."

Snowden has now given Greenwald thousands of documents. According to Greenwald, "dozens" are newsworthy.

Alright, switching to happier news, folks seem to like 'Man of Steel.' I'm excited.

I’ve told you before about the infamous “Mae’s,” the Hollywood brothel more or less run by MGM, where you could find beddable duplicates of stars from Claudette Colbert to – I kid you not – Shirley Temple.

 

 

But MaeÂ’s was a very high-priced bagnio, for those with a rather thinner wallet, the whorehouse run by Lee Francis was the place to go.  Like her compatriots in the business, FrancisÂ’ home was regularly the target of the vice squad; however, the madam had made enough contacts in the LAPD that she was always given a heads-up when the heat was coming down.  She would send her girls away for the night, then set out dishes of caviar and buckets of champagne.  The cops would arrive, find the place empty, then sit down to enjoy FrancisÂ’ hospitality.

 

 

ThereÂ’s a story about the Earl of Warwick,* who fascinated the Hollywood set on his first trip to America.  As it turns out, he had no interest in visiting the studios or meeting any of the stars; he had heard of Madame FrancisÂ’ bordello and wanted to visit.  By mistake, however, he was given the address of Warner BrothersÂ’ star Kay Francis.  It so happened that the night His Lordship rang the bell was FrancisÂ’ wedding night, and she was upstairs in a negligee sipping champagne with her new husband, producer Kenneth MacKenna.

The actress was the soul of graciousness when she entered the drawing room.  The earl gallantly admired her gown and inquired about the fine paintings on the walls, but soon got impatient with all of the empty chatter. 

 

“You are delightful, Madame Francis,” he finally said, with a touch of asperity, “but would you mind bringing in the girls?”

I got the impression from reading the article they don't actually eat-eat the stuff, just that they get into it, get fried, give off some sort of chemical when they die, which attracts more of the ants, lather, rinse, repeat, until the device becomes useless. I can't count the number of times I have seen a/c repairmen cleaning ants out of switches in compressors.  I  have seen where they have built ant hills inside compressors around switches and relays.  My understanding is that they are attracted to the smell of the ozone that the relays and switches give off when they fire.

He proposes the Trojan War and Troy was not in Turkey, and the war was not about some silly girl defecting to Troy. I know, I can hear the "that's crap" and see the eyes rolling. But he makes a pretty good argument supporting his theory, and he's not alone. The Illiad's discription of distances, terrain, weather and other info doesn't come close to matching Turkey and Greece. But it does come pretty close to Britain and Western Europe.

Like the TSA though, what the feds are doing constitutes a serious invasion of privacy for virtually no return on that investment. Given the balance of good vs. harm and the government's demonstrated pattern of abusing the information they collect we should be much more circumspect when giving them broad powers. Just how far are we going to let this government go before we are justified in fighting back?

 

We were justified long ago, IMO.

 

The big problems are that:

 

1. We have no real "leader" committed to rolling back this abomination of a State who can command 24/7 attention even among the LIVs;

 

2. No one wants to be David Koresh - meaning that no one wants to fire the first shot and risk the wrath of the Imperial Federal Government without being sure there are armed patriots ready to stand with them.  On our side, we hesitate because we know this criminal regime is desperate for an act of violence to finally justify rounding us up.  On their side, they keep pushing and pushing, and are amazed, irritated and glad there's no pushback.  Amazed, because they thought we really believed those old dusty parchments, irriated because they really want to kill us, and glad because they are certain (and I don't think they're wrong) that they will get their fascist state because of our "cowardice."

148 Here's an example of how I used information on my customers. An invoice was generated, the date recorded in data base. When payment was received software calculated time between invoice generation and payment received. Number of days was stored in data base. Customer was assigned a priority code based on number of days. When next order was received, scheduling looked at priority code and moved slow pays to the bottom of the job pile, quick pays to the top. If customers paid quicker the software constantly updated their priority or did the inverse. I never told the customers because they would have been pissed if they knew I was doing that. Just one example out of a couple hundred I could give. I started out as just a 'kitchen table' programmer. If I worked for the government I could devise a million ways to use data in ways you would not like.

I buy that reporters have generally been the beneficiaries of broad prosecutorial discretion, but there is no inherent reason a reporter couldn't be charged with leaking (again, the Rosen warrant seems to suggest just that, even if it did turn out to be politically motivated in the end; the mechanism for charging him obviously did exist). Under the 1st Amendment their legitimate political speech is protected but that isn't the same as classified information. Reporters can be (and in fact regularly are) jailed for failing to divulge sources.

1. When Snowden found out about PRISM he was placed in a legal quandary by the illegal actions of others. if he reported what he discovered he was violating his oath of secrecy. If he didn't report it he was violating his oath to preserve and protect the Constitution. It was not his fault that he was in that quandary.

2. Everyone else who knew about PRISM was violating both the law and their oath to preserve and protect the Constitution. That makes them indictable co-conspirators. Snowden chose not to break the law with them and not to violate his Constitutional oath.

3. In the military you are taught not to obey illegal orders - this comes from the Nuremberg trials.

4. The proper form of whistle blowing is to report crimes to Federal legal authorities such as the IG. However when you suspect the entire chain of command is part of the conspiracy as it was in this case going to the press is the only reporting option available.

5. Snowden was not revealing any information to our enemies: they already know what the NSA can do. The only people in the dark about this was the American public who were the ones being spied upon. You keep secrets from people you are spying on.

6. Snowden in reporting this is much less culpable than the people who knew and tacitly went along with it.

If you are so hot to send people to jail for violating the law the entire NSA and everyone supposed to over see them - up to and including the POTUS belongs in jail much more than Snowden.

And despite mealy mouthed apologists PRISM absolutely represents trillions of felonies - as it is a felony to intercept electronic communications not being broadcast.

Almost to a person they dislike these tactics and feel it's wrong and unconstitutional. In fact the most common retort from Democrats was- "see what I was talking about" or "do you agree with me now?"

There was also a poll by our super liberal local news station where about 64% disapproved.

209 #183  Many,  if not most of the actions taken have either been ordered by underlings with no written record connecting the order with Obama,  or they have been done in legal gray areas.

I think (although it takes longer) the investigations in the House are probably the best way to proceed.

Despite the fact that I want Obama to go away,  an impeachment would cause a whole host of problems:  Paralysis of the executive branch (yes,  I know,  a feature), resulting not only in inactivity in the EPA and suchbut also in other areas,  like the military.  This is dangerous when we are already weakened internationally.

A second problematic result would be an inceased polarization of the country,  aided and abetted by the prospects of riots and widespread crime.

The third problem would be a loss of confidence in the country's financial future,  causing capital to flee the country, cratering consumer confidence,  layoff's,  and more of what we saw in 2008-9.

So I do understand the hesitation to proceed with this,  and to proceed along the path currently chosen.  What I do not know is when the time comes,  if enough members of Congress can bring themselves to do it.

Hello --- for the fourth time Obama was the only person with authority to call for the military stand down order in Benghazi - since it involved all branches of the military no military officer could have ordered it.

I found out yesterday from an ex army hostage rescue team leader - that the current officers told him they absolutely had military assets ready to go to the rescue of Benghazi [but were ordered not to go[/i].

Either Obama ordered the stand down or he illegally abdicated his command. Both are cowardice and dereliction of duty in the face of the enemy during time of war; Which is a capital offense.

All of these other scandals are to detract from the fact that :

1. There are 4 dead bodies
2. There is a smoking gun with Obama's finger prints on it.

There was a recent gov't study that showed that 75% of SNAP funds were spent on foods with nutrition value;  25% of 760.5B is a whole lot of corn-syrup-sweetened soda and candy.  But I understand the processors get the bulk of the consumer price and the people who supply the raw corn don't get much at all.

(The part that makes me sick is the "75% of it is used wisely!" is a defense for handing out more cash, not cutting the waste and fraud or designing a healthier program.)

430 So... this whole NSA scandal has me pulling my hair out in Mark Davis's direction. He seems to think being okay with the more limited Patriot Act under Bush automatically means we have to be okay with the expanded Patriot Act under Obama. Okay, that's stupid enough, but at least it's understandable. It just means that he hasn't actually put any thought toward it. This morning, though, he said something that about made me drive off the road. A caller asserted that if the final test of if a power is okay is whether or not you trust the person wielding it, then the power is not okay. Davis's refutation was thus: "That's a failure of logic (wait for it- AG) because you wouldn't say that a town could do without a police force just because the police force is corrupt." Yes. Really. Should I bother counting on how many counts that fails?

Its a fucking lie that there were no military assets available. And that lie can be proven. There was a destroyer with cruise missiles 200 miles away. It could have cleared the streets around the embassy without hitting the embassy.If absolutely nothing else the drone could have been crashed into the target the ex-seal was lazing

448 Let It Burn is the theory that the country cannot be saved due to the policies which have been enacted. Mostly due to the financial ramifications of those policies. LIB says that we should step back, let that play out and then pick up the pieces. I've never seen any of those around here who advocate LIB say that the law is meaningless.

But those policies are also the law.  At some point the inside-the-Beltway crowd would loot the fuck out of the Treasury and flee to some accommodatingly statist locale, at which point the government would come to a halt and there would be very literal burning, as Slow Joe might say.  (With the likely exception of Texas and a few other strongly red states).

This is, I think, the flaw with LIB: they underestimate how easy it would be to bring things back under control once you'd "rebooted" the government.

Glenn Reynolds, who probably knows this stuff better than we do, makes sort of the opposite argument: because everything you do is now illegal, or some alphabet agency is empowered to make it such, the law is effectively meaningless.

Plus I've covered this about 100 times already. Believe or not Nuremberg is a pretty big moment in research ethics, so I've spent some time on it.

My understanding of the case is twofold:

1) I'm not sure they really bought the defense that they were "just following orders"

2) Even granting that the idea is you're supposed to decline to follow the order, take your lumps (or maybe escape if you can) and that's all Nuremberg required.  People tacking on the idea that you had to subvert them is a massive misinterpretation.

As I said, I'm of two minds about this fucker in Hong Kong.  (Although if we really paid him 200k a year when he never finished high school I'm suspicious and angry.) On the one hand the public needed to know about this. OTOH, this is not how you inform the public, and telling Greenwald you "know the location of every safehouse" is a pretty big tell to the Chinese that you'd really like some help in exchange for secrets.

(Alternatively I've wondered if this is Obumbles intentionally handing over a spy to the Chinese, as a sign of friendship ya know.)

That actually netted me a phone call from ClaireBear, sadly the 202 area code FREAKED ME THE FUCK OUT (I thought maybe I had just got my wife fired.) and I didn't pick up.

Turns out when a senator calls you, you get one chance to talk to them. (Note that folks, note that.  The number she gave me to call back went to voicemail and I never heard from them again.)

I ordered 12 packs of the big ones last week - they freeze really well. If you're on the low-carb lifestyle, these are roughly as life-changing as the introduction of Bacon Jerky. Actually, that was what my “question” to you was concerning, Anna.  I was going to ask if youÂ’d read the (approximately) 1/3 IÂ’d written and tell me whether it was worth continuing with, but I decided that was too much to impose on you.

 

 

I decided to start on a completely different track, and itÂ’s been interesting.  ItÂ’s all within the context of the novel, but I have no idea where itÂ’s going and for the first time in quite a while, IÂ’m enjoying the process of writing again.  Of course, it helps that IÂ’ve created this walking wet dream of a character where I can channel all my PG-13 fetishes into!

 

 

So IÂ’m writing. . .but at the moment, I donÂ’t want to say much more, since IÂ’m my own worst critic and jinx.

 

 

And I’ve got Allen’s book to go through, as well – that’s the weekend project.

I think the polling is reaching incorrect conclusions.  Most people I've seen interviewed or talked to are saying that they are willing to accept some surveillance, so long as they themselves aren't subjected to individual oversight and so long as it is effective in helping prevent attacks.

 

No one yet knows if the "safeguards" Obama keeps mumbling about really exist, what function they perform, what the programs involved actually do or how effective they are.  It's all secret. 

 

Hey pollsters:  ask Americans a question like "If the government kept everything secret but launched an effort to view every electronic communication you personally have with others, would that be OK with you?"

 

I bet you get a lot of no's in response.
