DNI Clapper rebuffed the Washington Post and Guardian stories about PRISM, saying, "They contain numerous inaccuracies," and asserting that the disclosure of the program "is reprehensible and risks important protections for the security of Americans." Notably, however, he declined to specifically identify the inaccuracies, suggesting only that the program does not intentionally target U.S. citizens. I'm reminded of the NSA "overcollection" scandal of 2009.
Turning now to the other NSA scandal, Wall Street Journal confirms that NSA has court orders to collect cellphone metadata from all three major U.S. carriers and the Democrats want you to know that this has been going on for a long, long time, so why should anyone care, amirite?
One thing that's been bugging me about this is why NSA needs this at all if its claims of being able to subpoena records are true. Brian Fung over at National Journal is thinking along similar lines:
As Marc Ambinder points out, if the NSA is already collecting metadata, why should the government need to subpoena said information to go after whistleblowers? In principle, barriers exist between the NSA (Pentagon) and the FBI (Justice Department) to prevent this sort of thing. In practice, however, the court order shows NSA was gathering the metadata on behalf of the FBI, so those barriers didn’t appear to operate as intended this time. One answer may be that even if DOJ had been able to look at the NSA’s information, it wouldn’t have been admissible as evidence in court—hence the need for subpoena. I’ve reached out to legal experts for a clearer answer, and I’ll update if and when we know more.
I don't know. On the on hand, the metadata collection was operating via court order, so you'd think the metadata would be admissible as evidence. On the other hand, it's possible NSA rules and the terms of the program require that the metadata not be used to target Americans (like James Rosen and the leaker, Stephen Jin-Woo Kim). The judicial orders were obtained under the Foreign Intelligence Surveillance Act, after all.

Let's be honest - everyone, government servants from top to bottom included (look at you, Obamney) have done stupid things on the internet. This argument is fine with regular law enforcement; but when law enforcement basically already knows everything that you're doing? And if everyone (pretty much) has done one or two things that could be held against them?
This is exactly why we have a 4th amendment. The corrupt seek power, therefore those who must have power over us must have the least power necessary to do their job. The personal attacks are bad enough as it is, but now to have the government actually able to blackmail anyone it wants with a simple PRISM search?
I mean.. really? That's what is necessary to fight terrorism?
How about this. How about we kick out all of the Muslims. That is a cheaper solution, by all measures, than this surveillance method. If anyone professes to Islam or practices it, they get exiled. We give them due process to prove they aren't Muslim as it becomes a crime and we have an amendment about that as well. All mosques are disbanded,
Will never happen though, since this gov't is not about smart solutions, but rather, about creating the bigger nail and the bigger hammer.

Also, and I'm sure this has been brought up but whatevs, I was thinking about ace's thinky post and it struck me that the argument was an interesting variant of the gun control arguments. ace was arguing, or at least contemplating, the classic conservative position that the thing itself (a gun, collecting data) is not evil per se but is merely a tool. The rest of the Horde was arguing that Constitutional rights should guide the use of that tool.
What fascinates me about it is that both sides were actually arguing from the same starting point, namely, that the thing itself was not inherently evil but that it was the usage thereof that is problematic. This does vitiate, to a degree, ace's justifiable concern about merely taking a knee jerk bad! bad! response to the program.

I'm sure that the nsa computing apparatus could be used for good , but at this point because of the actions of those in power, and the lack of self control shown in general for the last several years.
The apparatus has no moral code/ and unfortunately nor do the people in control of it.

We the people have lost the ability to consider in our votes and what we are voting For . and given up rights willingly of the right to be allowed to be a soverign citizen and individual. We have a population that would even agree to give up the 'others' rights to protect ourselves or be allowed to voice an idea or opinion different than their own.
Obamacare comes to mind where we/They decided that the rights to our bodies itself could be given away for an authority to make decisions for us.

The other problem with PRISM is that it requires (and thus only catches) somewhat naive terrorists. There exists a darknet which can be used (one reason why they're creating this massive data center) for the truly determined.
Also, they have to get on board the companies, and if the terrorists happen to use those who aren't on board, we won't catch them. It's the same problem with surveillance in general versus specific surveillance. If you're watching a safe, yes, the camera is effective because you can't get near the safe without getting on film. But with cameras 'everywhere' there must be holes in the system; (realistically there always ARE.) some are intentional, others just are the limitations of any such system.
Like the Maginot line, the Big One, the One that Matters, will learn the loopholes or blind spots and use them. I do not pretend that the security on my house could prevent a determined robber from getting in; the only point is to stop the casual thief. For that, I don't need a system of cameras, I just need some regular locks.
Given our take on immigration, we have thrown away the locks. Now we need the cameras?

I agree. Luckily however, it appears a good many terrorists (and would-be terrorists) are naive and not all that bright.
Personally, I'm trying to determine where the line should be drawn. Is the collection of the information bad in itself? I can think of a number of situations where we would be screaming about incompetence if we didn't have some sort of system like this.
I'm certain there aren't sufficient safeguards in place for court oversight of some agency wishing to run a profile on an individual's communications, and that is a big problem.

Private companies collect data all the time which we voluntarily give them. They use it for marketing purposes. It's information which we freely give them and, if we don't like the idea of doing so, can choose not to give it to them or conduct any business with them. The feds don't give us that opportunity.

(To me) The reason why they asked for the warrants for the information they already had is so that they did not reveal that the program exists. They can go to the judge and express they have reasonable suspicion that the person did it, obtain their warrant, go get the information they already had and knew about, and then get to state "hey, we had suspicions - and look here's the proof." If the existence of the program became known, then even the dim-witted lawyers would be able to argue to have the evidence thrown out.
Similar to Holder yesterday noting that he wouldn't answer the question in an "open forum". The answer was an obvious yes, but he is still bound by the top secret nature of the orders. As such, he could not say "yes" without violating that order due to all the "unauthorized" people who would hear the answer.

That is a worthy boycott. Mine is simpler, not a dime to any national organization, contributions only to individual candidates vetted by me (and not just in my state).
For example, I will contribute to any opposition to Lindsay Graham in the primary or general. Even a lying Democrat would at least be a known PoS as opposed to Miss Lindsay who is a stealth PoS.

All of which is utter balderdash, but that's what he says, and we've been told not to criticize the Preezy because RAAAACISSSS'! So why the need for continued surveillance?
3) They claim this is necessary for counterterrorism purposes. Okay. But why? Why, when repeated requests for increased security in Benghazi, based on genuine threats, were ignored? Why, when the Tsarnaevs were allowed to flit back and forth to Shitholeistan with nary a care in the world despite having been granted asylum here in the States to ESCAPE their home country? Why, when Russian warnings about Tamerlan went unheeded? Why, when Obammy is still so intent on closing Gitmo and releasing all of those known terrorists back into terrorist hotbeds like Yemen? Terrorists who, if interrogated properly, could provide genuine, solid intel on terrorist operations in the mideast and, perhaps, here at home?
In other words, why continue this invasive surveillance of otherwise law-abiding Americans in pursuit of some kind of counterterrorism panacea when Obammy and his cohorts have shown they're perfectly happy to ignore genuine threats and sources of solid, actionable intel that would serve actual counterterrorism goals and save lives? Why continue surveilling otherwise law-abiding Americans unless the whole POINT is to surveil law-abiding Americans?

I completely agree. Despite the excuses and demurrals from both parties, this is a very clear violation of the Fourth Amendment. That the government and a FISA judge so blatantly violated the Constitution is absolutely breathtaking.
We now have an administration that has used the IRS to suppress free speech to advance their electoral interests, spied on the press in order to manage and influence news releases, used the NSA/DOJ to spy on everyday American's activities and lied about the events in Benghazi to advance their political interests.
Not only have they lost all credibility, but they are actively using our government to work against the American people.
There has never been such a despotic, imperial and quite likely illegitimate administration in our history.

Having said that, been thinking about Mario Puzo and his comments about coordinating his book, The Godfather, with the mafia prior to going to print. He wanted to make sure he did not offend the mob. To his surprise, the mob made no changes but were actually elated with his work. As Puzo tells it the mafia liked the book because it gave them an increased intimidation factor through the accurate portrayal of them as powerful and ruthless. Perhaps this is why the commies are releasing this information, so the American public falls in line more easily.

Interesting point, but no - "we" decided that this kind of mass invasion of privacy was not a good idea (absent particularized suspicion and legitimate justification/warrant), and thus not Constitutional, way back when the document was first written. Even if it is a "good idea", that doesn't make it Constitutional - I can order you to peddle bike to work each morning for your health, and that may be a good idea, but it violates your liberty.
Also, your gun example, that the gun itself isn't "bad" because it is up to the user, relies on "all persons" conceivably having access to firearms to balance out the use of power. The flip side of that is that only allowing govt. to have weapons is bad because our DEFAULT position is that consolidated power in the fed and weak/no power in the states/individual is bad. That's what we have here with PRISM, etc.
I COULD have entertained this idea if it was discussed, evaluated and examined for Constitutionality, PUBLICLY before it was implemented. It wasn't - they preferred to ask forgiveness, not permission, and worry about that bridge when they came to it (when/if it leaked).
The asserted reason for this data collection is national security, to "focus" and clarify threats, but they already refuse to properly identify the current threats, say radical Islam, or even acknowledge wars we engage in (overseas contingency operations). That and the fact that the IRS/AG scandals have eliminated any sense that we can trust this Admin, or any Admin, to not abuse this "grant" of power that we never "granted".

The only reason for the act is to define when it is acceptable to spy on US citizens. FISA is about spying on agents of foreign powers, including those in the US who are citizens. The government doesn't need shit for laws to spy on foreigners outside the United States. They have no constitutional protections.
And yes, I agree that their reach was far to broad in this case. This is simply another example of technocrats with fascist leanings worshipping at the altar of "big data".
"Give them a big enough database, and they'll predict the world" seems to be the promise.

President Obama, a very liberal Democrat that promised never to spy on Americans and bashed Bush for it at every turn is now using the tools you biatched about even more expansively. So, ya blame the right (justly) for passing the legislation (with the left's support) but the left is now actively using it, not revealing it and shutting it down.
The LEFT is carrying out the nightmare scenario "you" warned about, not stopping it. So how serious were their objections back then? They didn't oppose that power, they were just upset they didn't have control of it.
So, now what? Blaming Bush doesn't get rid of it. Why not blame/harass those in power NOW to do it?

in the 'olden days' the writ of NSA was quite clear; obtaining intel from foreign sources (details classified). nice people could and would argue about the appropriateness of some details, but there were clear bright red lines that forbid applying those techniques against Americans.
This is a terrible awful indictment against the forsaken goodwill of this administration.
