Happy Friday.

The Daily Beast has a noteworthy post on the coup in Egypt. Oh, and whether it even is a coup is a pretty important question.

Washington Redskins fullback Eric Kettani, an officer in the Navy Reserve, has been getting hate mail on account of his situation.

Justice Ginsburg says she's not interested in quitting the high court, no matter how much liberals push her on it.

There's a real live Third Amendment case going on right now, after police officers arrested a Nevada family for refusing to let the police department use the family home as a base for a domestic violence investigation of the neighbors.

16 Gabe that Henderson police abuse case has a lot more going down than just the 3rd amendment.  In fact, it is such agregious police malfeasance that I am surprised only a local rag is covering it.

If it is true then not only do some cops need to be fired, but they need to go to jail as well.  But if it goes like it normally does, they will continue to be on the force and the only ones held accountable will be the taxpayers of Henderson.

Maybe if the affected family sues hard enough they will bankrupt the city and the entire government will be fired.

38 Vatican news:

Pope John Paul II and Pope John XXIII cleared for sainthood.

Pope Francis has released his first encylical, "Lumen Fidei," (The Light of Faith).  In the introduction he says that Pope Benedict had been working on it and he added to it,  making it,  I believe,  the only encyclical done by two popes.

I wonder who wrote this line:

" The explanation of the connection between faith and certainty put forward by the philosopher Ludwig Wittgenstein is well known."

That sort of made me chuckle.

Inre the Mitchells/3A case, I note that the charges against both sets of folks were dropped.  Makes me think that the police trumped up charges that they knew wouldn't hold up, but gave them a way to go Stasi on them long enough to get their way.

In the meantime, if you are a LEO and you are looking to investigate someone for domestic violence on the QT, I'd think planning on battering down the door of an adjacent house and shooting pepper rounds all over the place would be pretty bad planning.  Or did they think the person they were ostensibly investigating wouldn't notice the police frog-marching their neighbor out the door...?

77 There is so much misconduct going on in that trial that even if convicted by an overly biased jury it should be easy for Zimmerman to get a mistrial declaration from any appeals court.

80 I'm not a lawyer, but it seems to me that Traytable's mother could appropriately testify during GZ's sentencing hearing, but not during the trial. She has no material knowledge to add.

Since the judge has made her biases clear, I'm surprised the prosecution hasn't called Fitty Cent and Al Sharpton to give their views.

Supposedly St. Trayvon's Mother will testify the scream on the 911 recording is Trayvon's.  It is my understanding the Father said the voice was not Trayvon's and then later changed his story.  Experts have already stated no one can determine who was screaming.

As for the Zimmerman thing, I also cannot think of a legal basis to have TW's mother "testify."  She wasn't there.  She has no personal knowledge of the defendant.  What can she offer that is relevant?

I'm starting to think that, maybe, the Judge and the Prosecution are intentionally throwing these kinds of things into the mix.  If Zimmerman gets acquitted, they can (credibly) say the deck was stacked and they did everything they could to throw him in jail.  If he gets convicted, presumably the threatened riots won't happen but there's a path for Z to get the conviction overturned based on the conduct of the Judge and the Prosecution...and gives the Powers That Be a face-saving way out of this.

However, either way it makes a mockery of the concept of a dispassionate legal system.  This never should have made it to trial.

Posted by: @JohnTant at July 05, 2013 03:58 AM (eytER)

87 Hearing GZ's voice on tape it definitely sounds like him screaming. Plus, he was the one who was being attacked and would be screaming. It's always a hoot to see what the trayvonites are spinning. Seriously, low IQs.

Posted by: Vic at July 05, 2013 07:53 AM (lZvxr) There has been uninformed speculation from the peanut gallery that the State may be going overboard to try for an "acquittal by rabid zeal," so they can both keep the conviction from happening and claim to be on the side of the Angel Martin. Presumably so they can get riots (as a Crisis Which Will Not Be Let Go To Waste) and not be the particular target of the riots themselves. Personally I think the **** stirring by the MFM is almost more offensive than the grotesque abuse by the court. Almost.

90 Horrifying as the Henderson, Nevada case is, it's really pretty weak as a Third Amendment claim.

Civilian cops are not "Soldiers", no matter how much they like to dress up and play Army men.  The "quartering" element is probably lacking too.  They weren't looking to sleep, bathe, eat and keep their toothbrushes and footlockers there which are all the things that go into being "quartered".

But the guy probably has a decent temporary "taking" claim under the Fifth Amendment.  The cops definitely took his house for a public purpose and did it without due process or paying just compensation.

I see it from a slightly different angle.  When you go to a military academy (I am a graduate of West Point), you agree to spending a total of 8 years in the military with a minimum of 5 of those being on active duty.  In exchange, you get one of the finest educations in the world.  When I attended a million years ago, it was estimated to be worth about $250,000.  Through the years, the Navy (and the Air Force to a lesser extent) have been notorious for waiving the rules for athletes with a chance to be pro athletes.  They view it as good publicity for the Navy.

Fifty years ago, Roger Staubach attended Annapolis and won the Heisman trophy.  He went on to serve his full term (at the time 4 years), part of which was in Vietnam, before going on to the NFL.  He used his leave time to work out with the Cowboys and spent his free time working out on his own.  He had the same dream this guy did, but he lived up to his commitment first.

Well, if burning a flag is free speech, I say a police officer demanding the free use of your home  so as to effect surveillance on someone  is quartering.

I think you touch on something interesting though...I don't know that the 3A was ever incorporated.

I tend to agree that throwing the 3A in there is probably the well-known legal tactic of throwing a bunch of stuff against the wall to see what sticks.

If it brings national attention on the case, it won't matter if that part is dismissed.

There has to be more to this than what has been revealed thus far. This is amazingly over the top behavior for cops looking at a domestic violence situation involving strangers. Either there is some relation between the cops and the person they wanted under observation or bigger stakes are involved. This seems more like the behavior of a rival gang than some overzealous pursuit of arresting a wife beater. As worthy a goal that may be, utterly brutalizing a complete innocent, and his dog no less, makes you wonder what the real stakes were. That a PD in a city bordering on a major location like Las Vegas didn't have proper means at their disposal for conducting observation beggars belief.

Posted by: Leichendeiner at July 05, 2013 07:59 AM (u3N3z) Oh I think it's a weak claim as well but it is at least arguable. There are allegations that they left a fridge door open and food out and there's an allegation that they drank water. As far as sleeping, there was no indication to the two sets of people as to how long it was that the cops were going to be staying in their homes. Note also the claims that the cupboards were open and the cops went rummaging around. Good thing no one was on prescription pain killers and/or that the cops didn't find them because I bet some illegal narcotics possession claims would have been added. This is why the whole oh surveillance doesn't matter if you've done nothing wrong argument is so naive as to call into question people's ability to breathe without flash cards. If a LEO wants to arrest you, you're getting arrested. Note that once again it was obstruction aka rude to a cop and/or not letting a cop do what s/he wants. Where was it that the cop shot the dog so that it wouldn't bark while they were tromping all over people's backyards to get to where they were going? That still infuriates me.

The father can't testify since he already told police he wasn't sure it was Tra-Tray.

148 Who has standing to claim standing? Posted by: Hrothgar at July 05, 2013 08:33 AM (Cnqmv) That's exactly my point. I barely even skimmed the opinion so this is even more talking out my ass than usual but Our Betters may have just created a scenario where there is no one to claim standing on either side of an issue. Now, I'm sure that some rationale would be found to give someone fighting said referendum standing but there is at least the possibility that no one does on either side at the moment, given the scenario I outlined.

151 It's a miracle that Isaac Newton wasn't burned at the stake. He was a secret alchemist, a heretic, and pervy. For a little historical accuracy in your morning: Alchemy was seen as "the cool" science back then. Think of it as the "Quantum Physics" of its period. Indeed, Newton was an alchemist (not secret at all- he got paid for it), and was ALSO one of the people who set us on the path to proving that Alchemy will never work. As for heretic... um, how? Nothing he said was heretical, that I know of, and he was as observant as custom demanded. Pervy? Yeah, add me to the list of people wanting some proof on that one.

Apparently, in the Mandela clan, nobody kept it in their pants: http://goo.gl/5KYGY Decades ago, after apartheid became a big issue, my brother rented a video and caught the strangest movie trailer in his life. He surmises some Bircher (or the like) recorded it at the end of the tape. Anyways, it was scary-evil-true. The trailer opened with a close up of the Reverend Desmond Tutu inciting his followers from behind a podium. Then the camera zoomed out, showing the backdrop for Tutu was a huge red hammer and sickle communist flag. It then zoomed out a little further and in the foreground some teenager, screaming in agony, had a blazing motorcycle tire filled with gasoline pulled down around his elbows. Most of the crowd was focused on Tutu; the necklacing and assorted other other acts of violence going on were a mere sideshow. These were the moral, righteous people who, according to the worldwide media, who must rule South Africa in order to end apartheid.

182 It also helps that Newton wasn't the attention-seeking sort and wasn't especially famous outside of intellectual circles. I recall reading that Newton spoke in Parliament exactly once, to request a window be opened.

Secondly "But what has just taken place in Egypt doesn't really fit any existing language or political template."

It was a military coup. The generals using the force of the army, 'arrested' the leaders of a political party who had taken control of the government. There is no other word for it.

188 I don't think there's any proof Newton was gay. He's used as figurehead for people pushing an agenda such as the people who assert Lincoln was gay. People in earlier centuries related to each other differently than we do today. An example of this is the romantic sounding language that Emily Dickinson wrote to her sister-in-law. Does that mean she was gay? No, it probably means means that language between Victorian women tended to be more flowery and overtly affectionate than we'd expect between two straight women. Newton was an odd man. It's more likely he might have had Asbergers than that he was gay, the Asbergers making it more difficult to have any close relationships.

What they've admitted is that their models are fatally flawed under those circumstances, not the theory itself. This weaseling will simply mean a lot more money is needed to fund the development of better models. The gravy train rolls on.

I wouldn't mind so much if the scam was to hide some useful research and development they don't want known to the public. (The standby joke being the Stargate project.) 255 AGW has always been a scam that can be easily put to bed with four simple questions.

What is the optimal global temperature?

At what time in earths history was this optimal global temperature?

How much does Co2 production have to be cut back in order to return us to this optimum global temperature?

How long do we have to cut back Co2 production in order to achieve this optimum temperature?

These are very basic, germane questions the fact that no one has bothered to demand these answers before we upend our whole way of life speaks volumes.

Secretary of State in these interesting times should be prepared to burn the candle at both ends and the middle for four years.

300 I think Kerry was a very poor choice for SOS but as it was an entirely politically motivated pick, I'm not surprised he's a poor choice. Obama's picks are either crooks or incompetent or both. I just don't expect him to be right in the middle of a revolution in Egypt

311 John Kerry on a yacht in Nantucket bay.

Before the event, Obama said that a military coup in Egypt would threaten the continuation of US aid to the military.

After the event Obama said that it wasn't a coup
but the US will review it's aid to Egypt.
So...
...just as soon as government experts complete that review, and it gets published in the NYTimes, Then Obama will know what to do. . . if he ever finds the time to read the papers. But, as always, Obama is fighting the government for us, to see that the right things get done.

So I guess we're waiting on media reporters to cultivate their highly placed sources inside the government who have knowledge of the situation but are not authorized to speak to the media.

313 My point was that even the climate "scientists" (or, at least, some of them) have admitted that their entire theory is falsified if we get to 16 years with no warming. If we've made that mark, we need to hold them to it. A few days ago there was an article linked to here about that. Some scientist said that 2% of the global warming models allowed for a 15 year hiatus in increasing temperatures so We're still not out of the woods yet. He also said, however, that zero models allowed for a 20 year stop in rising temperatures, so we have five more years to find out if the models are correct. Although the guy was pulling the eternal environmentalist trick of moving the goalposts at least he said there was a limit as to how far they could be moved.

317 Abolition of slavery
Under increasing pressure from the British abolitionist movement, the British government enacted the Slave Trade Act in 1807 which abolished the slave trade in the empire. In 1808, Sierra Leone was designated an official British colony for freed slaves.[81] The Slavery Abolition Act passed in 1833 abolished slavery in the British Empire on 1 August 1834 (with the exception of St. Helena, Ceylon and the territories administered by the East India Company, though these exclusions were later repealed). Under the Act, slaves were granted full emancipation after a period of 4 to 6 years of "apprenticeship".[82]

Different non-Wiki source with more-detailed information relating to Jamaica but I'm guessing similar for all the British colonies with slavery:
jamaica-guide.info/past.and.present/history/slavery.emancipation/

And from the colony that went on to become Ontario (founded by Loyalists after the American Revolution)...
1793 Lieutenant Governor John Graves Simcoe passes anti-slavery legislation. The Upper Canada Act Against Slaves allows slave owners to keep slaves but any slave who crosses into Canada will be free and the children of slaves will be free at age 25

1819 Declaration by Attorney General of Upper Canada, John Beverley Robinson, that Blacks residing in Canada be free and protected by British law

318 He also said, however, that zero models allowed for a 20 year stop in rising temperatures, so we have five more years to find out if the models are correct. Ah, that was it. So 20 years is the magic number. I wonder if God loves me enough to let that happen? Please, God? I'll (try to) be good. I promise.

335 If the 3rd Amendment applies to the states via the 14th (and I'm surmising), it may be that in this day and age, the police are the functional state equivalent of the military.  I know we have the N.G., but that's formalistic reasoning.  Moreover, there's probably some kind of tie-in with the posse comitatus act.  Still, it's weak, but mirthful.

I've always been a strong supporter of law enforcement but if this is true, then this was outrageous and inexcusable conduct. Every single officer involved, including the chief, should be fired.

I think it would fall more under the category of the State Seizing property without just compensation... or due process...

Note that it does not say that the State must seize property PERMANENTLY for those prohibitions to be in effect...

But hey.... that's just that Pesky Highest Law in the Land thing... and is trumped by the Police State.

340 Maybe the Henderson Police only need a waiver from our King to seize what they need. This now seems an accepted work-around for our other "laws".
