— Gabriel Malor Happy Tuesday.
Andy spotted this bit of fun, and there's your daily reminder that journalists don't know anything about anything.
Another day, another part of Obamacare delayed until after the elections in 2014.
Oklahoma's challenge to Obamacare survived the government's motion to dismiss. You'll want to keep your eyes on this one.

My idea for the Supreme Court:
50 Justices, each State appoints one in what ever manner they see fit. (no Senate concurrence)
All Justices are subject to recall based on either (1) A simple majority vote by their appointing State or (2) A vote for recall by 2/3 of the State legislatures in the country.
Any justice who reaches the age of 70 while on the bench must retire.
I would not have a term limit (other than age) or a congressional override as that would defeat the purpose of the court and also keep too much power in the hands of congress.

California has once again found itself in the national headlines -- this time for a new law involving transgender students.
Gov. Jerry Brown on Monday signed a bill allowing "students in California schools to compete on sports teams and use facilities, including restrooms and showers, based on their gender identity, regardless of whether they are listed as male or female in official campus records."

Morning, ‘rons and ‘ronettes. Thanks for the morning briefing, Gabe and Vic. Hope you had no problems with your blood work yesterday, Vic.
Here’s a Sam Goldwyn story while we munch on our coffee and pastries: when the Sinclair Lewis novel Dodsworth came out in 1929, writer Sidney Howard told the producer that it would make a great movie. “And,” he pressed, “you can buy it for twenty thousand dollars.” Goldwyn looked into the deal, but he wasn’t interested. Howard, however, felt the property had legs. “If you don’t make this picture,” he warned, “I’m going to make a play from it.” Goldwyn shrugged and told him to do what he wanted.
So Howard wrote the play, which ended up being a 1934 Broadway smash. It was then that Goldwyn stepped in and paid Howard $165,000 for the rights. “See, I told you,” Howard gloated as he pocketed Goldwyn’s check. “You could have bought it for twenty thousand dollars.”
Goldwyn didn’t care. “I’d rather pay a hundred and sixty-five thousand for a successful play than twenty thousand for a novel that I don’t know what it’s going to be like.”
Hope you all have a wonderful day.

One other thing about Oprah and St. Trayvon -- notice the extremes -- one runs from a white store clerk, one confronts and beats the crap out of a white person.
As well, one is a wannabe gangsta and the other a sour racist with a chip on her shoulder about imagined grievances. Both examples of why real Africans as well as immigrants from Jamaica or Bermuda loathe American blacks.

Mentioned this yesterday, and I'm sure most here would not be surprised to learn that this whole Oprah thing is a HOAX.
Publicity stunts sure have come a long way, haven't they? Back in the day, when Francis X. Bushman's agent wanted to impress a studio with how popular he was, the agent dropped a trail of nickels behind him as he and Bushman walked to the studio, creating a big crowd to follow them. Charming and nobody's hurt.

More than half of women offer to pay the bill on a date - but most still hope the man turns them down, a study has found. Fifty seven per cent said they volunteered to pay their share, although 44 per cent preferred not to.
More than a third, 39 per cent, admitted that any offer they made was empty and they hoped their date would reject it.
Researchers at Chapman University, New York, found men still covered the lionÂ’s share of dating costs, despite the breadwinning burden being shared in eight out of ten marriages.
Daily Mail

Gee -- how surprising.
[Soapbox]
Back in the day, men paid for going out dates. Dinner and a movie was on the guy's tab.
Women then eased that financial burden by suggesting free dates, like a picnic where they brought the food, or Sunday dinner with her family.
Unfortunately, that cost sharing went to hell when families got smaller, dissolved more often, and domestic skills like cooking became a hated symbol of the patriarchy.

An al-Qaida-inspired militant group based in Egypt's Sinai Peninsula, Ansar Jerusalem, claimed responsibility for launching the rocket in an email to The Associated Press.

Good morning, all! I'm furious!
"Why are you furious, MWR?" you ask.
I'm furious because of this local news story:
Concord (NH) armored vehicle application draws protest
WMUR: http://tiny.cc/gd8q1w
"Why does this local news story make you furious, MWR?" you ask.
Because of two things.
1) It is a further militarization of civilian police forces, and
2) More gallingly, because of this:
Police Chief John Duval's application referenced homeland security concerns, saying in part: "Terrorism slants primarily toward the domestic type.”
But the request drew criticism for mentioning specific groups in New Hampshire. It reads: "Groups such as the Sovereign Citizens, Free Staters and Occupy New Hampshire are active and present daily challenges."
Yes folks. According to Police Chief John Duval of the Concord Police Department, members of the Free State Project (http://freestateproject.org/) -- a unified effort to create a libertarian stronghold here in NH -- are now domestic terrorists. Congratulations!
Remember after the last election how I told y'all that the two parties - Dems and Pubbies -- both hate the Free Staters, because the Free Staters aren't a guaranteed vote for either side? Well here's your proof.
"Why would you be against armored vehicles for the police, MWR?" you ask.
"Why would I want to militarize a police force that views people like Free Staters as terrorists?" I respond.
I am so spitting mad about this I can't even...

Chances are that they made the rocket themselves.
https://en.wikipedia.org/wiki/Qassam_rocket
Those 400 rockets that went astray in Libya are purported to be man portable antiaircraft missiles. It would be stupid to waste one shooting blindly into Eilat from Sinai. It is far more likely that these missiles will be used to bring down airliners. Stand in the bushes near the end of a runway and shoot one into the engine of a jumbo jet that is taking off or landing and see how well the pilot copes with having one of his engines suddenly non functional and possibly missing. Some pilots will probably handle it better than others.

There's a book called First Off the Tee which talks about various presidents' golf games (the writer, Dale Van Atter, ends up playing a round with a cheating Clinton, but, like all good MFM slurpers, doesn't call him on it). I don't know if it was in that book or somewhere else where I read that Ike was playing a game one day and ended up about three feet short of the hole. He suggested to his partner that it was a gimmee, but the partner refused.
"Oh, come on!" Ike supposedly said. "You're going to make the president take that shot?"
"For my money, yeah, you better take that shot," the partner answered. Ike missed and was furious for the rest of the day (he hated to lose at golf and really hated to lose a golf bet).

I see your problem right there. That coke has phosphoric acid which will irritate the lining of your stomach and your whole digestive track. Morning drinking requires something a bit more soothing to those delicate linings.
I recommend bourbon punch. Ice, bourbon, a dash of vanilla and fill the glass with heavy whipping cream. Not only is it delicious, it is nutritious as well. You have to keep up your strength in these sorts of events, and face it, you are not twenty years old any more.

House of Reps and senate- 12 years and out.
I would even extend term limits to federal government employment. 20 and out.
And the President cannot create any executive position that is not subject to the Senate's advice and consent. No more 'czars'.
And Executive Orders shall be limited to proclamations.
Also, the President is limited to 4 weeks vacation per year, just like real Americans.
Members of Congress must put in 40 hours work per week or they don't get paid. Just like real Americans.
Members of Congress, their staff and families, are subject to any law passed by Congress.
No new department or agency may be created by Congress without corresponding personnel cuts in the federal workforce at large.

"In 1963, in Jackson, Mississippi, John stepped between angry protesters and armed police to prevent a potential massacre after the murder of Medgar Evans," said Clinton, who was referring to Medgar Evers, a civil rights activist who was murdered while walking into his home on June 12, 1963.

I used to be against term limits, on the theory that it robs the voters of the freedom to choose who they want.
Then I started reading about the 14th century peerage system in England and rethought my position. Thing is, many titles in England were originated by the first guy getting "lucrative offices" and using the swag received from those posts to buy influence. Thus started a system where you didn't earn privilege and authority - you were born into it.
The Congress, Judiciary, and Presidency has turned into similar "lucrative offices," access to which must be limited for the good of our Republic.

Nope. They are "this" close to saying it's because of racism. Family says it is because of him taking drugs, family friends say that "they don't want to" because he has had trouble with the law.
So, pretty soon there will be a story about how he didn't get a heart because "racism." And then his family will be on national TV like the girl with the lung transplant, only more loud and demanding.
Then Al Sharpton will get involved.
This is SUCH a good idea. So glad you shared how this local death panel is doing such a swell job. And how well the patients's family is taking it.

The man who misled Congress on spying will pick Obama's intelligence review panel
WaPo: http://tiny.cc/gd8q1w
On Friday, President Obama promised to appoint an “independent group” of “outside experts” to review the government’s surveillance programs.
Today, the president formally ordered the formation of this group, giving us a sense for just how independent the group would be. The announcement doesnÂ’t inspire confidence that the president is interested in truly independent scrutiny of the nationÂ’s surveillance programs.
The panel will be chosen by, and report to, Director of National Intelligence James Clapper. Clapper famously answered “no sir” when Sen. Ron Wyden (D-Ore.) asked whether the NSA collects information about millions of Americans. Clapper has since conceded that this answer was “clearly erroneous.”...

Here's a good example of a Death Panel working for you...
15 year old denied a heart transplant because they know he isn't going to stop taking drugs (the wrong ones) or take drugs (the right ones) or come to follow-up visits.
Why waste a heart and hundreds of thousands of dollars when you know it's going to be wasted?

Nice strawman. Every economy is about allocation of finite resources. My objection to IPAB is based on a long track record of proven failure of central economic planning at the federal level to efficiently allocate resources. In addition, the IPAB as currently conceived will have tremendous power, not through individual treatment decisions, but through so-called "best practices" (substitute "cheapest practices" because ultimately cost-containment will come into play). Individuals are mandated to participate in a one-size-fits-all healthcare scheme in which goods and services are ultimately controlled at the federal level. Your strawman built out of this local treatment decision only becomes marginally plausible if we agree that healthcare should be provided for from a single federal pool of money. I, for one, reject that premise as inherently unworkable in a nation this size.

1. Hillary is incompetent.
2. She was under direct orders from the president, in which case she needs to speak up.
Now, in instance #1 she will be vulnerable, as she will have to explain why she refused security, didn't get the people some help, why they were even there, etc.
In instance #2 she either has to go with instance #1 OR she will have to blame Obama, which will cause dissension.
Frankly, I think that she will NOT run, making the decision fairly late. And I still think that Michelle Obama is being groomed to be the candidate. Her appearances have been more serious lately, and she seems to be not as highly visible, perhaps studying up on issues.
Valerie Jarrett is not going to go quietly and TFG doesn't want to give up the perks and being the center of attention (which he would be even if Michelle were the candidate).
So there you are. Discuss.

Um, is there a third option, maybe a SMOD wipes out the planet?
Because the only thing worse than Hillary is more Obama.
