Regarding Sen. Cruz's eligibility, both Ace and Allah gave pragmatic, policy reasons why he'd be considered constitutionally eligible. I vastly prefer Drew's short and sweet examination of whether he'd be legally eligible, which (spoiler) he is.
Speaking of birthers, it occurs to me that one reason GOP Congressmen would avoid town halls is to avoid embarrassing viral videos where they get confronted by birthers. This has happened twice in the past two weeks.
Also, recall that Congressfolk are generally motivated by one thing: getting reelected. If town halls make it harder for them to get reelected then of course they're going to avoid town halls. And that's what's really going on here. You don't hold a town hall to win voters. It's not your average voter that attends anyway. And, despite the rosy view of 2009, the town halls that made news were the Democratic and squishy town halls, where tea party activists embarrassed incumbents right out of office. The town halls were a vehicle, not to empower Congressmen, but to attack them. Of course Congressfolk are avoiding them now.
Just look back at the article that Ace cited to see who is demanding town halls. A "conservative grass-roots volunteer." And "Matt Kibbe, the president of FreedomWorks." From Pennsylvania, "a Tea Party group." These people aren't pushing for town halls because they like their representatives. They're pushing for town halls to make a scene. Good for them. But I don't see why their representatives would agree to that. Particularly when these activists have come right out and stated their motives.
In case you missed it, National Review has a solid piece on how the House leadership is shutting down the shutdown talk.
Also, both Ed and Guy are writing about the delay tactic as opposed to the defund demands, something I talked about in our last podcast. Though this is a debate of tactics, it is predictably being portrayed as a debate of principles. Which, keep on keeping on that dream of Obama signing repeal of his signature legislation, I guess. Gosh, wouldn't that be more likely if we took back the Senate, though, wouldn't it?

Maybe because their fucking job isn't to get re-elected but to represent their constituents. And doing that means listening to them once in a while. And if they can't be assed to do that, then what good are they? Look folks, democracy (and lets just go with that pedants and not go into the whole republic thing) isn't the right choice because there's some cosmic Sid Meier out there that set up the rules such that it's the objective truth, it's so the citizen has some buy in to the game. I don't have to do that. My Congress Critter and both my Senators (Coburn and Inhofe) are worth my vote, but, the top of the ticket--that is a toss up. It's Oklahoma and it will go for the Republican.
Any nonsense that anyone wants to spout about the people that we send to DC being above the questions and the demands of the great unwashed is just so very much twaddle. It is their job to discuss and yes, defend the life and death questions that they voted upon during their time in DC. The insurance/investment globalists have far too much influence and most certainly do NOT have the best interest of policy holders at heart v. PROFITS.
Gee.. no shit, Sherlock. It's a business. Insurance is the business of risk... gambling if you will. But since they are "the house", they get to make up the rules. So insurers of all kinds have always made the rules in their favor... deductible, co-pays, pre-existing conditions, yearly caps, etc.
But sometimes insurers still lose. Take 2005 for instance with all the hurricanes. The big guys got fucked big-time on payouts, and some even got out of the homeowner's insurance business. Others jacked up rates on their other products.
I'm not blaming hospitals or physicians, mere "middle men" where the treatments occur, the place/circumstances that patients/voters MEANT to address by involving government to "help". But by joining in with the insurance-industry/government, physicians and hospitals are caught between the rock and hard spot in a much tighter fix. Bad move.
Insurers are taking a big risk getting involved with Obamacare. No more pre-existing conditions. They must accept all applicants. No more being able to charge much higher rates for elderly sick people. So, they will need to sign up a whole shitload of young people who don't have the money for a full-service health policy. If that demographic decides to pay the fines, the insurers are fucked again.

Just look back at the article that Ace cited to see who is demanding town halls. A "conservative grass-roots volunteer." And "Matt Kibbe, the president of FreedomWorks." From Pennsylvania, "a Tea Party group." These people aren't pushing for town halls because they like their representatives. They're pushing for town halls to make a scene. Good for them. But I don't see why their representatives would agree to that. Particularly when these activists have come right out and stated their motives.
You mean people that are demanding the townhalls are those that are pissed that the Republicans in Congress are just doing whatever the fuck they want and not listening to their constituents and don't want that exposed. Yeah damn those activists.

So, they don't want to do town halls because of the possibility of embarrassing video clips. This just proves what I have said about a bunch of them: they are cowards.
So what's stopping them from doing 3 hours on a local talk radio show, answering caller's questions or listening to complaints? My congressman talks to a local guy once a week and could easily do 3 hours. Of course, he's also got a couple of town halls scheduled, and is pretty conservative.

They have thousands of expert staff and hundreds upon hundreds of millions invested in being a health insurance provider. The home/auto/life insurance business space is saturated. My firm is not publicly traded, but, if it were, it is the size of Coca Cola. Corporations that large just can't change overnight. If someone said tomorrow to Coca Cola, because the laws are now very difficult for you, don't make ANY more beverages, do something else with your time and money, how would that work? Sure, they have some subsidary businesses, we do too, but, their main product stream, their reason for being, is to produce soft drinks, bottle them, and sell them at a profit.

Text provides no tone, other than to say this: I think DC is getting to our illustrious CoB, after all, even without town it sorta rings with the "this is obvious, why don't you Plebs get it."
Of course we don't get it because we're naïve and think our Reps still care I guess.
I think it was Milton Friedman who said you could never incentivize good people to run for office, so what you had to do was incentivize bad people to do the right thing in office. We've clearly fucked that up, and incentivized bad people to do bad things once in office. We need to fix that.
At the very least, new residency requirements need to be put in place I think, requiring congressmen to return home more often than a college student. That'd be a start.

I hate to be a bitch, but, when I built my home to be completely handicapped accessible, I did not want that detectable from the outside. There is no ramp, the front sidewalk gently rises to the level of the front door. In the garage, there is a tiny ramp area at the back door where that 4 inch high 3 foot area in most garages separates the garage floor from the outer edge of the house. So just maybe, not saying he does, but, maybe the neighbor has a point. People never notice that my home is handicap accessible until I point out the 3 foot doors, the shower in the master bath designed to allow a wheelchair into it, etc.

Once upon a time in Clarinda Iowa, right across the street from the Glenn Miller house, was a Pepto Bismol pink house. Everyone in town knew it as the Peptol Bismol house. It got sold and the new owners painted it a different color quite some years ago, but it is still known as the Peptol Bismol house.

HARARE, Zimbabwe (AP) -- Zimbabwe's longtime President Robert Mugabe said Tuesday his party won "a resounding mandate" from voters to complete a sweeping black empowerment program to take over foreign and white-owned assets.
Mugabe said the program in Zimbabwe, widely criticized by Western countries, will be "pursued to its successful conclusion."
Mugabe said the vote showed confidence in his party and its drive for "total economic emancipation" for prosperity and jobs.

Mine is delightful. The neighborhood's public spaces are immaculately maintained. The fees have not changed in three years. The gates work. I don't get any nastygrams. When my roof was being replaced after a hail storm and the roofer put up a sign, I got a very gentle note reminding me that the only signs allowed were realtor signs, signs about a party or celebration, and that was that.

My HOA is neglected and uncared for. So technically I have one, as long as I don't submit a request to bulldoze my house and replace it with a penis sculpture I think I'll be OK.
As a side note, it's hard to find a house without some HOA here. The county mandates certain common ground levels for storm water run off, and that common ground has to be maintained, thus HOAs abound.
But aside for just restating the county rules, they really don't have power over much else. Fences apparently.
Although arguably putting a fence on the property line does affect my neighbors directly, so I suppose they have a certain say in it.

Basically in my own case the HOA is a con ran by a developer that left topsoil better measured in millimeters when he converted one of his cornfields into "housing" exerting financial pressure from beyond the grave on "his" neighborhood in the form of "holy covenant" and such...I've had to buy the same damn tree every year like clockwork to meet the "37th commandment" on number of trees in the front yard....
I'll be doing it while I am not occupying the place and far from "home."
I know this is hard to believe but I am less than impressed that some wizened magician is scrying the portents and omens of valuation witchery and that the devaluation of the spread was a result of some failure of Feng Shui based Geomancy in horticulture....
at any rate I adhere to the fucktardery...I honor contracts but the day I divest and relocate to an area where *I* am in fact the owner will be a happy one.

The covenants that went with the property are the things that draw the HOA and irate neighbors in. For example, sheds may be no larger than a certain dimension. This may sound draconian, but we have had instances over the last 20 years where people wanted to put pole barns in their back yards. Since this is not a subdivision with huge lots, said pole barn could diminish sunlight in a neighbor's back yard.

FWIW, AllenG, many subdivisions here formed prior to their annexing by the incorporated cities.
And so were actually responsible for their own sidewalks. (That changed some point later when the county took over the sidewalks for unincorporated areas.)
In any case my indentures still note that sidewalks are part of the HOA's job. (Even though we were annexed in the 90s.)
Before you ask, it's not worth complaining the HOA is slacking on it's duty. The city takes fine care of the sidewalks and the HOA fee is still what it was in 1965, not inflation adjusted, in real dollars. In fact since it requires 2/3 of houses to approve, I doubt it'll ever go up (not 2/3 present, 2/3 of houses, you'd never get that as a meeting.)

My HOA gave up and hired an outside firm to collect fees and manage money.
And as I noted special assessments aren't allowed, (prohibited in the bylaws) and the fee is unlikely to be raised due to the extreme vote it'd require.
I know it can go south, my dad was chair of an HOA when it sued a member of the subdivision for putting up an illegal fence.
Of course the fence was ugly, poorly built, and the neighbors complained (and in fairness, it does sit on the property line so, contra AllenG, it has a direct effect on the neighbor's property value.)
I think my dad would have rather not gotten into it, but what are you going to do when the people are fighting you on it. He resigned the next year (didn't run for re-election.)

The first thing I did after becoming president of the HOA was to assess every homeowner $10,000 (due immediately) and raise the dues from $30 per quarter to $120 per month.
It didn't go over to well, but in the end, I got it.
The big question was what to do with people who had two lots, with their house on one and the other as just extra land. Do you whack them double for everything or cut them slack?
We ended up with a small surcharge for the extra lot.

Anyway, the folks were down over the winter and the rest of them wanted to watch a movie. They settled on The Help. I said, "F that noise" and went and watched football.
It had the effect they wanted it to have on my dad. Until I told him it was unrefined bullshit through and through. Had to explain to him the reality of race relations in the South--being that I live here--are nowhere near the portrayal by the fucks on the West Coast. That the whole point of the movie was to try and make you feel bad for something you didn't do, would never have done, to people you don't know and that there is nothing to "fix."

The previous leadership of the HOA didn't make any provisions to repave the private road we live on. It needed replacement so everyone needed to pony up the cash. On top of that, people needed to start contributing to a fund to replace it next time.
Ignoring responsibilities and giving everyone happy talk is what liberals do. Facing up to the realities of the situation is what conservatives do.

The PROPER way to do this is what happened on my sister's street: call a meeting, explain the problem, point out that it has to be done or people will get dmaage to their cars and the road will be impassible in bad weather.
Then you give people time to get the money ogether. You ask if there is a financial hardship and they need more time.
I would not be surprised to find out that you own the paving company as well.

Special assessments in our HOA require a majority vote, but the 10K assessment I gave everyone was an executive directive that didn't require any vote.
The maintenance and replacement of the road was outlined in the original HOA charter.

I am so glad that I live in a deep rural area, with no HOA, and in fact no town to deal with. I pay my taxes to the county, and the county pretty much leaves me alone. My next door neighbour is field of barley, and barley is an ingredient of beer. Life is good. I have three acres, a house and 3 outbuildings, and my taxes are $1600 annually.

I think Gabe (in his discussion of Obamacare) just managed to rather perfectly capture the lax, smug, obviously clueless mindset of "smart" Beltway folks, which is one factor that has brought us all to this point. It's this sub-mediocrity, with pernicious consequences, that has made me unable to even return to that place for years, after most of a life there. And the "right" is full of effectively clueless (note every word) "smart" people like Gabe, and they feature prominently in the commentariat.

Playing the game Gabe's way, and concentrating purely on tactics, has lost us two presidential elections and failed to win us the Congress. The voters are hungry for an ideological GOP, and that's what's missing from this debate-- however the tactics play out.
Senator Lee is able to articulate an ideology. Gabe's champions, the faceless GOP "establishment" (presumably Boehner, McConnell and the rest), cannot. They have no discernable ideology.
Insofar as they are concerned I can't understand why anyone pays any attention at all to their advice. Gabe, you and your leaders are merely advocating one big rear-guard action, leading nowhere but to the next election. Am I missing something?
