Happy Friday.

Sen. Coburn called for a constitutional convention to consider amendments to the U.S. Constitution a la Mark Levin's Liberty Amendments, which are described here. Sounds good to me, though I prefer (mostly) Randy Barnett's proposed Bill of Federalism than Levin's version. There's some overlap between the two, but Barnett's better on several important things.

Obama's college proposals won't do a thing to control costs.

And, another movie trailer.

Have a great weekend.

Oh, the cobs are going to cover the morning post for two weeks. I'll be at the American Legion convention next week, and I'll have some posts about that, but not the morning post. The week after that, I'm on vacation. Ya'll be good.

43 Levin's list of amendments is good - but I think you need some more political red meat in there to get it started - an amendment that limited the Fed's power to push down unfunded mandates on the States would have broad appeal in State capitals, a clarification of the 2nd Amendment - simply deleting the militia reference, would fire up a big base of support, birthright citizenship needs a fix at the Constitutional level, and you might as well define Natural Born Citizen while you are at it.

 I would sacrifice the possibility of a President Cruz - if it brought a purple State or two onto the slate.  He would be better on the SCOTUS.

I couldn't make it through the first of Randy Barnett's "Bill of Federalism" without identifying a very grave error.

 

Congress doesn't get  the  power to tax incomes from the 16th Amendment.  It gets the power to tax incomes as part of the general taxing power granted to the Congress.  All the 16th Amendment does is remove the apportionment requirement of a tax on incomes derived from property, in response to a (boneheaded) SCOTUS decision.  That decision said a tax on the income from property (rents, dividends, etc) is the same as taxing the property itself and therefore must be apportioned.  This decision, incidentally, was seriously at odds with previous decisions.

 

So this idea would leave in place the income tax AND a national sales tax.

I'm not enthusiastic about a sales tax either - to me, it seems to further hide what money is being taken from you.  At least with the income tax, we (or at least 40% of the country) has to go through the exercise of filling out the 1040 form or derivatives, and we have to pencil into the form exactly how much money was taken from us.

 

I fear with a sales tax the amount will just be baked into the cost of something from the consumers perspective.  Plus I think it unfairly places the burden of tax collection onto retailers instead of where it belongs.

All right, Vic, maybe I was a little out of line.  But my point stands.  Gabe was told repeatedly that the outline of a slippery slope leading from the recognition of "gay marriage" could be seen.  And it has.  Not only with the Huguenins, but the baker in Colorado and the whiny child in the UK who doesn't feel he's really "married" until it's performed in a church.  If he ever acknowledged that yes, it's possible, then I admit I missed it.

 

But the Huguenins are being told, in effect, "Fuck your Messiah.  Take the pictures you're ordered to or go to jail."  Gabe's response is, "well, that's going to happen, I told you."  Rather weak water from someone who took time to front-page his own "told you so" when Prop 8 was killed.

So she said she'll come in on Monday to look through our catalogs. We have an employee who is a twenty-something woman who is a huge Lady Gaga fan, and thinks that Gay Rights is the most important cause evah. As anyone who knew him would tell you, W.C. Fields was a difficult, self-destructive man.  Sometime around 1938, Fields hired a doctor to help him stop drinking, but at the same time, he did everything he could to outwit the doctor.  It took a while, but the doctor managed to track down nearly all of FieldsÂ’ stashes of booze and block off his private suppliers.  He was so successful, in fact, that the great comedian found himself face to face with the dreadful prospect of sobriety.

 

 

The doctor expected a sober Fields to be irritable and tetchy; instead, he was surprised when W.C. approached him one day and offered to teach him how to golf.  “ThatÂ’s fine,” the doctor said.  “Both of us should be out in the open air.”

 

 

Came the morning of the first lesson.  The doctor was dressed in comfortable plus-fours, while FieldsÂ’ outfit was a baggy tweed suit.  As they walked to the first tee, Fields emphasized that the main point about golf was to watch the ball intently before swinging.  “You canÂ’t stare at it too long,” Fields emphasized.  “Before you take a cut at it, count to ten slowly.”  At the tee, Fields arranged the doctor in a proper stance and then stepped directly behind him.  “Now count,” he ordered.

The Legal Profession as a whole is rotten.  That there are decent lawyers is not in issue.  That the profession is a cancer on the Republic is also not in my opinion arguable.

We could have a terrabyte length argument about whether that is the lawyer's fault, the voter's fault for electing asshole politicians who are lawyers, or the system's fault but the legal profession spends its time undermining the will of the people when it happily attacks law.  Couple this paradigm with the grotesque spectacle of EPA cheerfully owngoaling cases to pet law firms to use federal funding as "judgements" to fund NGOs (heh at which point they are not NGOs IMHO) to attack industry and business and you have the Midgard Serpent eating its tail.  The machine being rotten does not mean you are, not the lawyers spouse worked for(in the main) being so.

My issue with Malor is not his sexual predillictions, my issue with Malor is not his profession per se, my issue with Malor is his constant drumbeat of stating why the GOP must become the Democrat party and then simply not defending it here but instead doing so on Twitter.

I've now spent about 20 lines explaining away something that is not worth 5.

In Florida, the government imposes all sorts of restrictions on housing developers, as part of Florida's general plan to maximize cronyism.

One of the more corrupt elements of these restrictions is to require developers to set aside certain units as "Affordable Housing."  This means that, for some amount of time (10 years, or so), the sale price of that unit cannot increase more than some fixed percentage every year.  Politicians then congratulate themselves profusely for How Much They Care About The Poor. 

In practice, what Affordable Housing (price caps) means is that the person who wants to sell such a unit, but the legal price limit is below the actual market price, has 3 options --

1.  Sell the unit for an amount below the market price, thus taking it in the ass;

2. Sell the unit at a price above the legal limit, usually by some under-the-table deal, off the books, to pay the difference, usually in cash (i.e., a partial black-market transaction); or

3. Don't sell it, and just wait for the 10 year price limit to expire. 

No one chooses Option 1.

So, the result is that the price cap is completely ineffective.  No "Affordable Housing" actually exists in the housing market.  Either the real (under-the-table) price is the true market price anyway, or the unit is just pulled from the market and can't be bought at all. 

This sort of thing will happen with colleges, too.

I have admired, adored, and venerated you when lurking or when offering my frequently vapid and infrequently cogent points on this blog.

Gabe is a cob, and I have deep qualms about the ethics of the field you happen to earn a living at ma'am.

If it is any solace I have deep ethical qualms about my preferred field I alluded to as the other half of the midgard serpent equation ma'am.

I am busy, rather busy and since I do not have the oceans of time I wasted here the last 9-18 months I cannot undig holes I dig with people I do in fact deeply respect here with the clarity I can summon when needed.

It'd be best for everyone if I simply did not dig the holes in the first place by doing hit and run posting.

I had thought I offered some good mirth last evening in the Affleck thread, I am not doing so well in the AM threads.

I again apologize for swinging the hammer widely, but ma'am much as I love you(in the platonic brotherly/sisterly sense)I cannot love as a whole your profession as I've seen it played the last ten years or so.

I mean no direct personal dig at you, since I am not able to glean your ethical output.

Nice cafe by my house, owned and frequented by gays who "don't approve" of Christians, much less them taking their icky sky god into public; Tuesdays are their slow nights and they have a little alcove in the back away from the door.

I'm a married couple looking for a nice place for our couples' Bible study group  to have a piece of pie and a cup of coffee while we discuss the passage of the week.

TD part of my apology/explanation to AtC about my taking myself out of the game metaphorically speaking and part of why I should have offered something beyond my pithy "outpoping the Pope" routine or nothing at all is the brevity of my time here.

TD this has been a social issue of mine for a long time until the people I spent the early days working on it with decided "marriage or else" and indulged in getting wehat they wanted by any means necessary.

I opined along with others that the objective was attacking the Church in a way these same people would not tolerate Islam getting dictated to, and lawfare.  Gabe was being reminded things are unfolding precisely as we warned.

My heart is broken on the issue, and my wit sparse though it may be is not served by a broken heart or rage.

385 Yeah, something weird happened with Jane D'oh's son over in Japan.  She didn't elaborate, or maybe I missed it last night after I went to bed, but it sounds like her son was a victim of a cell phone scam, and lost most if not all of his money he saved.  His JAG officer even says there's nothing he can do.

Sounds horrible.

Y'all is a contraction of...Ye + all.

It was brought over with our Scots-Irish immigrants in the 1700's.

 

Since many of these immigrants were shunned by the British colonist society...they kept on moving west and south, and settled there.

Their use of the contraction "Y'all" became embedded in their culture.

But go ahead and wish for a return to an ill-educated population who earn their livings with their backs instead of their brains. It's my own fault for choosing to major in communications, but on that score I will plead the ignorance of youth. In my own small experience, I've met countless people who had no need to be at college. They weren't learning any measurable skills. They weren't becoming sharper thinkers. They were just putting in their time and money at the diploma mill, regurgitating what they'd been told, and moving on. Any halfway-competent jackass can write a history thesis denouncing the evils of colonialism and walk out with a degree. Sure, people with degrees make more money. For evidence, I submit Barack Obama, super-credentialed Ivy Leaguer and distinguished occasional guest lecturer, a man whose intellectual development ends with the warmed-over marxism of the 1960s, and a man who has never held an actual job or produced a tangible product or result. On the other hand, you have scads of famous college dropouts from Jobs to Gates to Thiel to even Mark Steyn proving that an agile mind is an agile mind, credentials be damned.

College is a "sorting" mechanism for management.  If you complete a degree it shows that you will more likely work harder than someone who dropped out or who did not go at all.


And it decreases the likelihood of being sued by the racial exploiters.

The problem is that easy govt money creates artificial demand, which makes a college education more expensive.

 

The bigger problem is that our universities are NOT turning out well educated people with useful degrees, despite what you assert.  I would venture a guess that college grads being paid more than non-college grads is heavily weighted to technical type degrees.

 

No manager in the world is impressed with a grads Women's Studies" degree.  I know....I have hired people for the last twenty years and I can tell you that a liberal arts degree might as well go in the trash for the most part.
