— Gabriel Malor Happy Friday.
Sen. Coburn called for a constitutional convention to consider amendments to the U.S. Constitution a la Mark Levin's Liberty Amendments, which are described here. Sounds good to me, though I prefer (mostly) Randy Barnett's proposed Bill of Federalism than Levin's version. There's some overlap between the two, but Barnett's better on several important things.
Obama's college proposals won't do a thing to control costs.
Have a great weekend.
Oh, the cobs are going to cover the morning post for two weeks. I'll be at the American Legion convention next week, and I'll have some posts about that, but not the morning post. The week after that, I'm on vacation. Ya'll be good.

And nothing at all to say about the Huguenins, Gabe? Too busy smugly chuckling "Suck it, h8ers?"
We told you this would happen. We predicted it. But you just skipped on by, insisting that all you needed was the official recognition of "gay marriage" and all would be happy ever after, really, swearsies, and you'd never, ever force people to choose between their livelihood or their religion.
Fuck this "gay marriage" crap. But do enjoy your whip hand while it lasts.
If anyone wants today's story, e-mail me. I'm too pissed off to be here today.

Hemingway and Faulkner and Shakespeare spelled it "ya'll." Probably because contractions generally fall on the final word or phoneme being contracted. "Do not" becomes "Don't." "You are" becomes "You're" not "Y'are." Etc. The reason for this is that contractions are a written expression for a form of speech, not the other way around.
Of course, prescriptivists who insist that this contraction be spelled "y'all" vastly outweigh traditionalists like myself. That's fine, but since English is prescriptive, I'll stick with "ya'll."

The key part of the Barnett link. A conservative organization that would 1.) ensure good primary candidates were standing by in Red districts, and 2) put a common Art5 Convention legislation in the process nationwide - would be awesome. But we need amnesty - sequester - shutdown - squirrel!

Your problem is you argue like a lawyer. Regular humans see your way of arguing, and it looks an awful lot like lying and deceit.
This isn't a personal criticism of you, it's a condemnation of your profession.
I could argue with you that just now you sent links where you say you didn't say what it plainly seems to the rest of us, you DID say! But you would never concede the point, so it's useless to try to argue with you.
Which again, is how your profession operates. And it's one of the fundamental reasons why our society is in such terrible shape.
But otherwise, I'm sure you really are a nice person, when people get to know you.

Supposedly -- if you believe Our Betters at NRO, which I do with less and less frequency -- Coburn was also making noises about the possibility of Choom Boy facing impeachment.
I see that happening at about the same time Poppin' Fresh grows a beard, grabs a rifle and ambles off to the jungle to emulate his hero, Che Guevara.
It should, of course. But in a proper world that would punish the Prophets of Choom for endangering the country, judges would be thrown off the bench instantly for forcing citizens to violate their religious beliefs just so some Special Snowflakes wouldn't get butthurt because they were denied more than equal treatment.

I couldn't make it through the first of Randy Barnett's "Bill of Federalism" without identifying a very grave error.
Congress doesn't get the power to tax incomes from the 16th Amendment. It gets the power to tax incomes as part of the general taxing power granted to the Congress. All the 16th Amendment does is remove the apportionment requirement of a tax on incomes derived from property, in response to a (boneheaded) SCOTUS decision. That decision said a tax on the income from property (rents, dividends, etc) is the same as taxing the property itself and therefore must be apportioned. This decision, incidentally, was seriously at odds with previous decisions.
So this idea would leave in place the income tax AND a national sales tax.

I'm not enthusiastic about a sales tax either - to me, it seems to further hide what money is being taken from you. At least with the income tax, we (or at least 40% of the country) has to go through the exercise of filling out the 1040 form or derivatives, and we have to pencil into the form exactly how much money was taken from us.
I fear with a sales tax the amount will just be baked into the cost of something from the consumers perspective. Plus I think it unfairly places the burden of tax collection onto retailers instead of where it belongs.

Captain James Lawrence is credited with the battle-cry "Don't Give Up The Ship" (but it was, after a brutal fight with HMS Shannon).
Oliver Hazard Perry commanded the USN's Lake Erie squadron. After the Battle of Lake Erie, he sent the following dispatch to William Henry Harrison: "We have met the enemy and they are ours; two ships, two brigs, one schooner and one sloop."

Of course, prescriptivists who insist that this contraction be spelled "y'all" vastly outweigh traditionalists like myself. That's fine, but since English is prescriptive, I'll stick with "ya'll."
----------
If a prescriptivist says "y'all," and English is prescriptive, then "y'all" is correct.

Now that I realize it, not only do I either avoid using the word, or intentionally use it to deceive the other person. What I've also noticed is that when other people say they are fine, now my first reaction is to think "he's not fine."

Defining the Commerce Clause: Levin writes an amendment that, while technically unnecessary, is practically an imperative to restoring the original intent of the Commerce Clause. The amendment would make it clear that the commerce clause grants not power to actively regulate and control activity; rather to prevent states from impeding commerce among other states, as Madison originally intended
http://preview.tinyurl.com/7dstl6m (goes to redstate.com)
"Technically unnecessary" yet it's needed because technically the federal government doesn't really follow the constitutions so in order to get the federal government to follow the constitution we need a new constitution.

All right, Vic, maybe I was a little out of line. But my point stands. Gabe was told repeatedly that the outline of a slippery slope leading from the recognition of "gay marriage" could be seen. And it has. Not only with the Huguenins, but the baker in Colorado and the whiny child in the UK who doesn't feel he's really "married" until it's performed in a church. If he ever acknowledged that yes, it's possible, then I admit I missed it.
But the Huguenins are being told, in effect, "Fuck your Messiah. Take the pictures you're ordered to or go to jail." Gabe's response is, "well, that's going to happen, I told you." Rather weak water from someone who took time to front-page his own "told you so" when Prop 8 was killed.

And I see I've offended AtC as well. I'm going to sign off before my fingers really get me in trouble.
Here's a story:
As anyone who knew him would tell you, W.C. Fields was a difficult, self-destructive man. Sometime around 1938, Fields hired a doctor to help him stop drinking, but at the same time, he did everything he could to outwit the doctor. It took a while, but the doctor managed to track down nearly all of FieldsÂ’ stashes of booze and block off his private suppliers. He was so successful, in fact, that the great comedian found himself face to face with the dreadful prospect of sobriety.
The doctor expected a sober Fields to be irritable and tetchy; instead, he was surprised when W.C. approached him one day and offered to teach him how to golf. “That’s fine,” the doctor said. “Both of us should be out in the open air.”
Came the morning of the first lesson. The doctor was dressed in comfortable plus-fours, while Fields’ outfit was a baggy tweed suit. As they walked to the first tee, Fields emphasized that the main point about golf was to watch the ball intently before swinging. “You can’t stare at it too long,” Fields emphasized. “Before you take a cut at it, count to ten slowly.” At the tee, Fields arranged the doctor in a proper stance and then stepped directly behind him. “Now count,” he ordered.
Obediently, the doctor counted. “One – two - ” “Slower!” Fields commanded. “One. . .two. . .” “Even slower,” said Fields. “And don’t take your eye off the ball!” As the doctor stared and counted, Fields took a small bottle out of his suit and drained it. And for the rest of the round, while the doctor concentrated on the ball, Fields concentrated on his suit, where he had stashed little bottles of whisky.
For eight days, Fields gave the doctor “golf lessons.” Finally, the doctor told him, “Now, you see? You’ve been eight days without a drink and you’re looking better already!”
Hope you all have a great weekend.

The Legal Profession as a whole is rotten. That there are decent lawyers is not in issue. That the profession is a cancer on the Republic is also not in my opinion arguable.
We could have a terrabyte length argument about whether that is the lawyer's fault, the voter's fault for electing asshole politicians who are lawyers, or the system's fault but the legal profession spends its time undermining the will of the people when it happily attacks law. Couple this paradigm with the grotesque spectacle of EPA cheerfully owngoaling cases to pet law firms to use federal funding as "judgements" to fund NGOs (heh at which point they are not NGOs IMHO) to attack industry and business and you have the Midgard Serpent eating its tail. The machine being rotten does not mean you are, not the lawyers spouse worked for(in the main) being so.
My issue with Malor is not his sexual predillictions, my issue with Malor is not his profession per se, my issue with Malor is his constant drumbeat of stating why the GOP must become the Democrat party and then simply not defending it here but instead doing so on Twitter.
I've now spent about 20 lines explaining away something that is not worth 5.

The strategy here was never to make college accessible. They purposely made it so expensive that no one can access college without going through government.
In Florida, the government imposes all sorts of restrictions on housing developers, as part of Florida's general plan to maximize cronyism.
One of the more corrupt elements of these restrictions is to require developers to set aside certain units as "Affordable Housing." This means that, for some amount of time (10 years, or so), the sale price of that unit cannot increase more than some fixed percentage every year. Politicians then congratulate themselves profusely for How Much They Care About The Poor.
In practice, what Affordable Housing (price caps) means is that the person who wants to sell such a unit, but the legal price limit is below the actual market price, has 3 options --
1. Sell the unit for an amount below the market price, thus taking it in the ass;
2. Sell the unit at a price above the legal limit, usually by some under-the-table deal, off the books, to pay the difference, usually in cash (i.e., a partial black-market transaction); or
3. Don't sell it, and just wait for the 10 year price limit to expire.
No one chooses Option 1.
So, the result is that the price cap is completely ineffective. No "Affordable Housing" actually exists in the housing market. Either the real (under-the-table) price is the true market price anyway, or the unit is just pulled from the market and can't be bought at all.
This sort of thing will happen with colleges, too.

Reuters had an article about the cost of congressional travel. If they adopted my plan, this wouldn't be an issue.
Increase congressional pay to $500,000 per year plus a $500,000 bonus if they keep the budget 18% of the previous year's GDP. Each would have light jet hours proportional to the location of their districts, from 20 hours per year for D.C. based Elenore Holmes Norton to 200 hours for an Alaska based representative.
Senators would receive $750,000 plus a matching bonus with unlimited medium jet hours.

I have said repeatedly, and meant it that my grief is not with gays enjoying the civic benefits of marriage it is with precisely the theatrics and performance art writ large WRT to the Church.
They engage in lawfare to get their way rather than accepting the happily offered bite of the apple and letting time find the proper equilibrium.
I have been rather scarce, and will in fact resume being so rather than belabor the issue again in offering a genuine fig leaf to a writer I respect.

Alex I have just moved to Columbia SC and will be taking quarters and setting up household, this last week and a half I have been on the run getting my son enrolled, clothed, and settled in at school being forced to use mechanisms for the homeless as it turns out.
Add in trying to get a feel for the employment prospects in a metro area that very much runs on a version of the good old boy network suffering a slight recession despite the rest of the state's growth.
Not being passive-aggressive in this particular post in all sincerity I am if nothing else far too voluminous at times when I am able. I have been gone and as always the HQ rolls on. I am if anything at all an odd marble amongst the MANY marbles we the commentariat represent.
I have admired, adored, and venerated you when lurking or when offering my frequently vapid and infrequently cogent points on this blog.
Gabe is a cob, and I have deep qualms about the ethics of the field you happen to earn a living at ma'am.
If it is any solace I have deep ethical qualms about my preferred field I alluded to as the other half of the midgard serpent equation ma'am.
I am busy, rather busy and since I do not have the oceans of time I wasted here the last 9-18 months I cannot undig holes I dig with people I do in fact deeply respect here with the clarity I can summon when needed.
It'd be best for everyone if I simply did not dig the holes in the first place by doing hit and run posting.
I had thought I offered some good mirth last evening in the Affleck thread, I am not doing so well in the AM threads.
I again apologize for swinging the hammer widely, but ma'am much as I love you(in the platonic brotherly/sisterly sense)I cannot love as a whole your profession as I've seen it played the last ten years or so.
I mean no direct personal dig at you, since I am not able to glean your ethical output.
As a final explanation before I tackle my day navigating the maze of this State Capital may I offer that if a person wanted to attack my field as a bunch of lobbying for kajillions cocksuckers I would honestly have to say "as a whole guilty as charged sadly?"
You are not running me off, I bear you no ire I simply would not want to waste the horde's time with my presence if my presence is not filling any need.
Evidently attacking a self-professed "guiding light of what the GOP should be" who refuses to stand the blows and engage is simply a waste of time and breaks comity.

Obviously, they didn't read the story.
In 1969 I flew home on a charter plane from Europe. The company mainly flew military dependents (which tells you how many troops we had in Europe at that time). Anyway, the name of the company was "Atlantis."
All I could think of on the miserable, bumpy flight home was that Atlantis sunk beneath the waves, never to be seen again.

Calling Gabe out for NOT mentioning a gay rights issue is unfair, though understandable.
Gabe's contempt for the commenters is annoying.
The argument that the trend to gay marriage nationwide has zero to do with the NM case ignores the judicial practice of applying trends to decisions. Sort of a penumbra of a precedent if you will.

Nice cafe by my house, owned and frequented by gays who "don't approve" of Christians, much less them taking their icky sky god into public; Tuesdays are their slow nights and they have a little alcove in the back away from the door.
I'm a married couple looking for a nice place for our couples' Bible study group to have a piece of pie and a cup of coffee while we discuss the passage of the week.
I can use the public accommodation laws to force them to sell us coffee and pie every Tuesday night?

289 Typo Dynamofo,
TD part of my apology/explanation to AtC about my taking myself out of the game metaphorically speaking and part of why I should have offered something beyond my pithy "outpoping the Pope" routine or nothing at all is the brevity of my time here.
TD this has been a social issue of mine for a long time until the people I spent the early days working on it with decided "marriage or else" and indulged in getting wehat they wanted by any means necessary.
I opined along with others that the objective was attacking the Church in a way these same people would not tolerate Islam getting dictated to, and lawfare. Gabe was being reminded things are unfolding precisely as we warned.
My heart is broken on the issue, and my wit sparse though it may be is not served by a broken heart or rage.

In case no one else mentioned this upthread...
Y'all is a contraction of...Ye + all.
It was brought over with our Scots-Irish immigrants in the 1700's.
Since many of these immigrants were shunned by the British colonist society...they kept on moving west and south, and settled there.
Their use of the contraction "Y'all" became embedded in their culture.

Y-not,
The problem is that easy govt money creates artificial demand, which makes a college education more expensive.
The bigger problem is that our universities are NOT turning out well educated people with useful degrees, despite what you assert. I would venture a guess that college grads being paid more than non-college grads is heavily weighted to technical type degrees.
No manager in the world is impressed with a grads Women's Studies" degree. I know....I have hired people for the last twenty years and I can tell you that a liberal arts degree might as well go in the trash for the most part.
