Here's a good piece from David Freddoso, who'll be our podcast guest this week, on congressional authority over declarations of war.

This quote from Madison seems particularly relevant:

In no part of the constitution is more wisdom to be found, than in the clause which confides the question of war or peace to the legislature, and not to the executive department. Beside the objection to such a mixture to heterogeneous powers, the trust and the temptation would be too great for any one manÂ…

... particularly for as small a man as the current occupant of the White House.

9 Good Morning Morons.  Today is Thursday, August 29, 2013.  On this day in 1922  the first radio advertisement was broadcast on WEAF-AM in New York City.  This set the stage for what we have now, continuous advertisements with a little programming in between.  This is needed to pay the exorbitant salaries of TV stars and union technicians.   This is one of the many reasons the audience share for TV is in the crapper.

11 We are building up the Navy around Syria.  So are the Russians.

On Thursday, the Russian news agency Interfax, citing a source in that country's armed forces, reported that Russia would send an anti-submarine ship and missile cruiser to the Mediterranean.

So Russia is preparing a military response or is it a bluff?  With the sackless asshole in the WH I somehow doubt that it is a bluff.

“If we are saying in a clear and decisive but very limited way, we send a shot across the bow saying, ‘stop doing this,’ that can have a positive impact on our national security over the long term,” Obama said.

So, the only reason we are going into a possible WWIII scenario is for Dictator Choom to "make a point" by fire and forget.

A bipartisan group of 116 members of Congress sent Obama a letter Wednesday urging the administration to seek CongressÂ’ approval before taking any action, saying to do otherwise would be unconstitutional.

Why is this not > 500 members and why doesn't it have the threat of impeachment?  It is rapidly going towards "too late" in this absolute insanity and unless you assholes in Congress are willing to impeach him he will not stop.

20 OH appeals court says Amish girl MUST resume chemo treatments for leukemia.  The hospital says she will die without them.  No report on the fact that she will may die with them as well.  For children with acute lymphoblastic leukemia the five-year survival rate is around 80%, while adults have a lower survival rate of around 40%.   Meanwhile the treatments are a miserable existence in of themselves.

If I were her parent I would have the treatments done, especially since I have undergone chemo myself.  But how is it up to the government to force treatment?  I know that they consider the girl unable to make this decision, but how does that jive with the ruling that girls of any age can decide to use the "morning after" pill without a doctor's advice or parental knowledge?  I suspect that Thomas Jefferson's bones are spinning like a Sharpless Lube Oil Purifier at Monticello.

47 I have no doubt that AQ rebels and their ilk would not hesitate to deploy chem/bio, or for that matter nukes (if they ever get them) against their opponents. The fact that Assad had his own arsenal, plus spares exported from Sadaam before the Gulf War, yet failed to use them as the fighting escalated is indicative of some self-control. The documented barbarism on display by AQ and AQ supported groups is nothing short of enlightening. Whether it is eating the heart of a slain enemy or killing/mutilating women and children, one thing is certain: AQ has no regard for human life be it their own or their enemy.

Bottom line:  Obama is a screw-up leftist with a narcissistic complex.  He's going to screw up policy decisions at every turn because that's what screw-ups do.  Get used to it; it's going to be a looooong 3 years, four months, and 22 days.

65 Regarding the 16 year old who killed herself, after having been statutorily  raped by the teacher two years earlier, I can understand the outrage people feel about the light sentence, and the ill-conceived statements of the judge.

One of the problems is, we  are talking  about a complicated issue here, and expecting a judge (read lawyer) to be able to adequately explain it is unrealistic.  The law is the law, morality is morality,  and the psychology of human behavior is something else too.  I don't think it is all that surprising that this judge gets the latter two wrong.  I'll let the lawyers decide whether he was wrong on the law.

We've had this conversation here before too.  There is something not quite the same, when a 14 year old is stating that he or she wants to have sex with someone, from the situation where the other person forces it.  It's different.  I'm not saying it's better or worse or anything else, just that it's different.

Posted by: BurtTC at August 29, 2013 03:18 AM (BeSEI)

66 #62  I would say probably 80% of Americans are totally indifferent to foreign policy.

My sister's best friend in high school once asked why I wasn't taking the train to Europe. (This was back in the late 60's before education had completely fallen apart.)

And I worked for a store manager in the 1980's who didn't know Switzerland was in Europe.

I have no reason to believe that conditions have improved in the last 20 years. There are millions of people in large cities who have never been out of the city,  let alone to another state.  They don't care about Syria.  They don't even know what it is,  nevermind where.

The judge did say something about that, indicating that "of course" a 14 year old cannot consent, but that this was not a case where he forced himself on her, she wanted it too.

This is a bigger and different problem our society is having.  14 year old are out there, having sex,  because they want to, and there  isn't enough structure in our society to  keep them from doing so.

81 Morning. A couple of years back I had a car full of girls--black like me--chase me down after I had the nerve to honk at them when they cut me off. They were a ways behind me tapping on their horn. I didn't notice at first, but when I did, I slowed way down so they could see the NRA banner in my back window. They turned at the next intersection.

And to make it worse,  instead of doing like Petraeus and simply quitting and leaving town,  these people are using their political skills to craft BS explanations on why they cannot do what they ought to be doing, in order to keep on the government gravy train.

The Daily Mail has a much more in depth article about this case. Shocking, I know. Here are some missing parts. he and her mom turned the teacher in and he was charged with 3 counts of statutory rape, but before he went to trial she killed herself after being shunned at school.

So I guess the DA felt that he couldn't get a conviction without her testimony, so he offered a (pretty fucking lenient imho) deal that got a guilty plea out of him, but which would be dismissed if he completed sex offender therapy etc.

He violated a several of the agreements, including getting kicked out of the therapy program, being with underage minors, and failing to report that he was having sex with a woman.

He did complete some other sex offender program, and this is where judge GimmeABreak comes into the picture, with his 31 day sentence. There's a petition to have him recalled now with lots of sigs.

Cameron in Britain is suddenly getting cold feet about Syria.  Probably because the Labor PM's are against it.  And Parliament will not approve it.  If only we had an organization like a parliament that had responsibility for debating and approving Acts of War?

I  think there might still be a missing part of this.  First of all, if there was an agreement in place already, why did the second judge need to re-sentence  him?

It almost sounds to me like there was no  judgement in place, only a set of conditions the prosecutors were requiring for THEM to go along with the deal they were offering.

Which probably means, this was THEIR deal, not the judge's.  I don't know enough about  how the courts work to know whether the judge had an option to alter the deal, but if he didn't, then  clearly some of the blame resides with prosecutors who couldn't or wouldn't pull the trigger on going after a stronger deal.

163 #160  Was listening on-line with some friends and we thought in spots he was trying to imitate MLK's speaking style and tone.

Then he got overcome with his anger and arrogance and went into that angry preacher mode.  That's the one where I think his eyes are going to completely roll back in his head.

The Lord must believe we haven't been properly chastised yet,  because there were no lightning strikes.

164 Un- oops! We have the fast food strikers being interviewed on the news. My dad would make my sis leave her Mc Donald's uniform in the garage because if the grease smell. These people sure have set their sights low, to plan on earning a living in fast food. This should be a teenybopper job to keep 'em busy and put a few bucks in their pockets while getting an education to get a real career.

167 From Vic's Weiner article:

Some of the gung-ho Weiner crowds, including at the Aug. 11 Dominican Day Parade in Manhattan, were really actors who were paid $15 an hour by the California firm Crowds on Demand, according to a source with direct knowledge of the deal.

I find this hilariously funny and sad, all at the same time.  Nothing is real anymore in politics.  Everything is a big, fat lying illusion.

But the middle class jobs didn't come back after the recession, so we have to MAKE middle class jobs out of what's left.

172 106. Case Admittedly or not, W.E.B. Du Bois' NAACP was established to advance only the top 10% of black Americans. And of that "talented tenth" elitism, the intent was to keep the mass population of American blacks in servitude, but to their black masters rather than to whitey (fascistic Pan-Africanist). Keep the masses angry, and feed off that anger. Parasites. New guard v. Old guard -- in too many revolutions -- the only thing that changes is WHO plays the authoritarian King of the Mtn. Whereas the effort to educate the masses of black Americans AND to train them for the current economic/industrial employment opportunities was led by Booker T. Washington, so as to provide the strength of black families to advance together in educational and professional opportunities through the natural process of succeeding generations, seen by W.E.B. Du Bois as "appeasing" "compromise". Well, Du Bois stood to "own" black America with his "talented tenth" directing his NAACP. From what I remember of MLK, Jr.'s leadership through civility, the "Dream" he shared, to be judged by quality of a person's character, was no appeasement or compromise with the devil, as Du Bois had propagandized v. Brooker T. Washington. By their fruits you will know them. Obama has nothing to do with MLK Jr. or Brooker T. Washington whose lives were dedicated to enabling the inalienable rights of all American citizens, to be responsible and accountable for our own lives, and for us all to know each other by our character and what works we produce, BY WHAT WE BUILD. The proof's in the pudding. Obama, Du Bois, "talented tenth" playing the feudal lords over the slaves. For your own good, of course.

197 173. Our national leadership, whether government or employment/corporations including Union leadership, are all bought. THEIR retirement will be grandiose, the gilded lily parachutes, the bulk of funds stolen from the membership and Middle Class citizens. During Orrin Hatch's tenure in the Senate, the American Middle Class has incrementally been replaced in the workforce stateside by immigrants, legal and now illegal (bipartisan McAsses for amnesty). Also Sprach Corporatism: trust us, no matter how, Profits Are Good. Remember while you can. What thieves steal is their profit. At what cost to you? Too Big To Fail, Too Big To Jail: GLOBAL Corporatist financial investments AND bail-outs are funded by US MIDDLE CLASS Tax Payers. When the working professional class of US employees and the highly skilled labor union members lose their jobs to the current illegal aliens (soon to be whitewashed as US citizens via amnesty)? The weeping wailing and gnashing of teeth will have an ObamaCare pill and vaccine to forgetaboutit, and electro-shock therapy for the discontents who just can't shake their depression. Temporary memory loss ... recurring "fix". The point of global corporatism is, at best, to only favor the "talented tenth" at the immense cost of everyone else. Inalienable Rights as if Extremism to be denied.

198 It is for the legislature to decide who, why and what should be attacked. The generalities of the when and where might also be decided there, but the specifics must be left to the generals. The how is also most properly in the sphere of the generals, with the specific exception of first-strike nuclear release. That one has to be owned at the highest level, and publicly declared as such as soon as the bomb goes off.

Best Picture of the year alert!

Have y'all seen the picture from yesterday, of the Obama's standing at the Lincoln Memorial with Jimmah and Bill Clinton?  It's the single most revealing photo ever.  It was in Jim Geraghty's emailed newsletter this morning, but its widely available. In it Carter looks like the doddering old fool he is, but that's just the beginning and he certainly isn't the main character to watch.

The President is waving, limp wristed, and hugging Jimmah for all he is worth.  The picture just shouts "Ghey!"  He is sort of smirking too, as if he is glad to be outside campaigning with nothing to worry about.  No Syria, no Putin, no English war support or CIA analysis holes.

Billy C., on the other hand, is firmly gripping Michelle Obama's tail end and she is grinning for all she's worth.  It's as if to say "Finally!  Someone wants me!"

Interestingly, Queen Hillary is nowhere to be seen.  Not in the photo.  Not welcome in the group.

It is, as I said, an incredibly revealing photo.  Best of the year.

The problem, Burt, is that there are men out there who don't seem to think maybe they shouldn't be having sex with someone barely past puberty.

The problem is, we have parents out there who are unable to explain to their children why having sex at age 14 is a really horrible idea.

The problem is, we have parents out there, fathers out there who are either not around or are so pussified that they cannot put the fear of God into their daughters that, if they have sex, they will slaughter the other party.

The problem is, we have parents out there who are so afraid of not being their kid's friend that they won't stick their noses way, way into the kid's business so they might know if their little girl is having sex with a disgrace of a man.

Who the hell do you think has been filling his head with narcissitic crap for the past 5 years?  Obama's only saving grace is that left to his own devices, he would just play golf.  With the cadre of academic America-haters around him giving "advice", he becomes a danger to us all.  Who do you think gave him the idea to publicly and personally insult Putin?
