— andy Here's a good piece from David Freddoso, who'll be our podcast guest this week, on congressional authority over declarations of war.
This quote from Madison seems particularly relevant:
In no part of the constitution is more wisdom to be found, than in the clause which confides the question of war or peace to the legislature, and not to the executive department. Beside the objection to such a mixture to heterogeneous powers, the trust and the temptation would be too great for any one manÂ…
... particularly for as small a man as the current occupant of the White House.

On Thursday, the Russian news agency Interfax, citing a source in that country's armed forces, reported that Russia would send an anti-submarine ship and missile cruiser to the Mediterranean.
So Russia is preparing a military response or is it a bluff? With the sackless asshole in the WH I somehow doubt that it is a bluff.
“If we are saying in a clear and decisive but very limited way, we send a shot across the bow saying, ‘stop doing this,’ that can have a positive impact on our national security over the long term,” Obama said.
So, the only reason we are going into a possible WWIII scenario is for Dictator Choom to "make a point" by fire and forget.
A bipartisan group of 116 members of Congress sent Obama a letter Wednesday urging the administration to seek CongressÂ’ approval before taking any action, saying to do otherwise would be unconstitutional.
Why is this not > 500 members and why doesn't it have the threat of impeachment? It is rapidly going towards "too late" in this absolute insanity and unless you assholes in Congress are willing to impeach him he will not stop.

If I were her parent I would have the treatments done, especially since I have undergone chemo myself. But how is it up to the government to force treatment? I know that they consider the girl unable to make this decision, but how does that jive with the ruling that girls of any age can decide to use the "morning after" pill without a doctor's advice or parental knowledge? I suspect that Thomas Jefferson's bones are spinning like a Sharpless Lube Oil Purifier at Monticello.

Police said Slepski was savagely beaten after the girls threw a bottle at her car on Concord Street and she stopped to confront them.
This is not a good idea. Better idea is to hang a gun out the window and shoot about 15 of them (assuming you have a 15 round clip).

What did you think would happen?
Bottom line: Obama is a screw-up leftist with a narcissistic complex. He's going to screw up policy decisions at every turn because that's what screw-ups do. Get used to it; it's going to be a looooong 3 years, four months, and 22 days.

One of the problems is, we are talking about a complicated issue here, and expecting a judge (read lawyer) to be able to adequately explain it is unrealistic. The law is the law, morality is morality, and the psychology of human behavior is something else too. I don't think it is all that surprising that this judge gets the latter two wrong. I'll let the lawyers decide whether he was wrong on the law.
We've had this conversation here before too. There is something not quite the same, when a 14 year old is stating that he or she wants to have sex with someone, from the situation where the other person forces it. It's different. I'm not saying it's better or worse or anything else, just that it's different.

My sister's best friend in high school once asked why I wasn't taking the train to Europe. (This was back in the late 60's before education had completely fallen apart.)
And I worked for a store manager in the 1980's who didn't know Switzerland was in Europe.
I have no reason to believe that conditions have improved in the last 20 years. There are millions of people in large cities who have never been out of the city, let alone to another state. They don't care about Syria. They don't even know what it is, nevermind where.

The judge did say something about that, indicating that "of course" a 14 year old cannot consent, but that this was not a case where he forced himself on her, she wanted it too.
This is a bigger and different problem our society is having. 14 year old are out there, having sex, because they want to, and there isn't enough structure in our society to keep them from doing so.

The Daily Mail has a much more in depth article about this case. Shocking, I know. Here are some missing parts. he and her mom turned the teacher in and he was charged with 3 counts of statutory rape, but before he went to trial she killed herself after being shunned at school.
So I guess the DA felt that he couldn't get a conviction without her testimony, so he offered a (pretty fucking lenient imho) deal that got a guilty plea out of him, but which would be dismissed if he completed sex offender therapy etc.
He violated a several of the agreements, including getting kicked out of the therapy program, being with underage minors, and failing to report that he was having sex with a woman.
He did complete some other sex offender program, and this is where judge GimmeABreak comes into the picture, with his 31 day sentence. There's a petition to have him recalled now with lots of sigs.

Cameron in Britain is suddenly getting cold feet about Syria. Probably because the Labor PM's are against it. And Parliament will not approve it. If only we had an organization like a parliament that had responsibility for debating and approving Acts of War?
France is getting cold feet too. Hollande sounded a more cautious note than earlier in the week, when he said France stood ready to punish those behind the apparent poison gas attack that killed hundreds of civilians in Damascus.
Will Obama slow down? Will Congress grow a pair? Will they fulfill my prediction that Obama will cause a nuclear exchange before his term ends?

I think there might still be a missing part of this. First of all, if there was an agreement in place already, why did the second judge need to re-sentence him?
It almost sounds to me like there was no judgement in place, only a set of conditions the prosecutors were requiring for THEM to go along with the deal they were offering.
Which probably means, this was THEIR deal, not the judge's. I don't know enough about how the courts work to know whether the judge had an option to alter the deal, but if he didn't, then clearly some of the blame resides with prosecutors who couldn't or wouldn't pull the trigger on going after a stronger deal.

It doesn't Vic. The courts carved out a "sex exception" to the normal rules on children's consent.
It's weird and entirely inconsistent.
I don't have much to say on the Chemo itself. I'm on both sides. I get the whole "parental rights" thing, but OTOH, having a kid die for religious beliefs they may or may not hold doesn't seem right either. These cases are a PITA.
Unrelatedly, I'd cut the school official some slack. He did refuse to give out the clown's name for the longest time (until the clown came forward) and took the brunt of it himself.

Optics. Obama thumps his chest in front of the world about his red line being crossed.
Drags his feet on going to the UN or Congress.
Russia and Iran sabre rattle.
Obama backs down and makes his saturday 10AM tee time.

Then he got overcome with his anger and arrogance and went into that angry preacher mode. That's the one where I think his eyes are going to completely roll back in his head.

Some of the gung-ho Weiner crowds, including at the Aug. 11 Dominican Day Parade in Manhattan, were really actors who were paid $15 an hour by the California firm Crowds on Demand, according to a source with direct knowledge of the deal.

I find this hilariously funny and sad, all at the same time. Nothing is real anymore in politics. Everything is a big, fat lying illusion.

But the middle class jobs didn't come back after the recession, so we have to MAKE middle class jobs out of what's left.
Economics be damned! (I actually heard a union boss say the first part, I added the economics part.)

In the CBS story about the spy satellite launch there is this gem:
"Once it reaches orbit in about two days, the classified payload is expected to be able to distinguish details back on Earth as minute as the make and model of an automobile."

Kim Jong-un's ex-girlfriend was among a dozen well-known North Korean
performers who were executed by firing squad nine days ago, according to
South Korean reports.

I find the whole idea pathetic.
And Anthony Wiener is leading that parade. Amazing....the guy couldn't keep is zipper up long enough to salvage his own career. Equally pathetic is Weiner pretending he's still in the race.

Best Picture of the year alert!
Have y'all seen the picture from yesterday, of the Obama's standing at the Lincoln Memorial with Jimmah and Bill Clinton? It's the single most revealing photo ever. It was in Jim Geraghty's emailed newsletter this morning, but its widely available. In it Carter looks like the doddering old fool he is, but that's just the beginning and he certainly isn't the main character to watch.
The President is waving, limp wristed, and hugging Jimmah for all he is worth. The picture just shouts "Ghey!" He is sort of smirking too, as if he is glad to be outside campaigning with nothing to worry about. No Syria, no Putin, no English war support or CIA analysis holes.
Billy C., on the other hand, is firmly gripping Michelle Obama's tail end and she is grinning for all she's worth. It's as if to say "Finally! Someone wants me!"
Interestingly, Queen Hillary is nowhere to be seen. Not in the photo. Not welcome in the group.
It is, as I said, an incredibly revealing photo. Best of the year.

Obama has already chosen your cabinets for you. Section 24.6067.345 of the ACA. You will need a kitchen of 9000 square feet to house them. The IRS will be by to collect your donation. Did I mention they dond't have any doors?

The problem, Burt, is that there are men out there who don't seem to think maybe they shouldn't be having sex with someone barely past puberty.
The problem is, we have parents out there who are unable to explain to their children why having sex at age 14 is a really horrible idea.
The problem is, we have parents out there, fathers out there who are either not around or are so pussified that they cannot put the fear of God into their daughters that, if they have sex, they will slaughter the other party.
The problem is, we have parents out there who are so afraid of not being their kid's friend that they won't stick their noses way, way into the kid's business so they might know if their little girl is having sex with a disgrace of a man.

"Listen to your advisors...?"
Who the hell do you think has been filling his head with narcissitic crap for the past 5 years? Obama's only saving grace is that left to his own devices, he would just play golf. With the cadre of academic America-haters around him giving "advice", he becomes a danger to us all. Who do you think gave him the idea to publicly and personally insult Putin?
