Two Americas - being wealthy is now a quasi-disability that can get you off the hook for homicide
— Purple Avenger

It works like this - you're a wealthy young punk with no restraint or ability to see consequences, but see -- its your parents who did that to you so its not really your fault that 4 people are dead because you stole beer, got drunk and mowed them down, so we're gonna give you probation.

...CouchÂ’s attorneys argued his parents were responsible for the teenÂ’s actions that night because of the way he had been raised. Defense attorneys put a psychologist on the stand who testified Couch was a product of wealth and got whatever he wanted. The psychologist also testified the teen was allowed to drink at a very young age and began driving at 13 years old. Defense attorneys argued Couch needed treatment, not jail and suggested a facility that costs almost half a million dollars a year...
So, the reward for living a life of no consequences and leaving a trail of dead bodies in your wake is to reinforce the attitude that there are no consequences.

If anyone thinks a poor kid with meth head parents, who provided an equally irresponsible upbringing, who did the same thing would be getting off with probation and a posh $500,000/yr treatment facility, raise your hand. Anyone?

The prosecutors wanted 20 years in prison, but 5 probably would have gotten the point across to this kid, and his parents. Now, both the kid and parents are walking away believing they can literally buy their way out of almost any crime. THAT is a lesson they will probably take to heart.

Can I play the race card here, as well? Just because someone will. This *will* be revisited due to public outrage.

That said, this goes on all the time, but for the most part it's finessed in a way that's not quite so likely to raise hackles. The accused "comes from a good family", with good support networks. Active in the church, made a terrible mistake and so forth. The judges are so grateful to see someone slightly less likely to be a filthy recidivist that they cut a deal. Over crowding and bad press for putting "youths" in jail makes it easier.

I can't blame his family for doing what it took. I'm just amazed that they were so cack handed about it. There are ways to do this without making onlookers feel stabby. That said, families with the ability to do that (and, just as importantly, to see the need to do so) tend to not end up with their scions in that position to start with.

Posted by: Lizzie at December 12, 2013 12:26 AM (3hJcU)

18 Re: lowering the DUI level to less than 0.08 -- it is a scam. That's essentially saying that 1 pint of beer makes you unable to safely operate a vehicle. First, that's nonsense, but 2, if it's true, then make the level 0.0 -- you do not drive if you have been drinking within the last 6 hours (minimum). The reality is that true drunk drivers -- the blitzed ones, not the ones that would have misjudged something were they sober anyway -- are well above 0.08 and 1.0 for that matter. Lowering it to 0.06 is simply: 1) a revenue raiser; and 2) a way to inflict more control over otherwise law-abiding people.

21 Kentucky Republicans picked up a seat in the state House Tuesday in a special election. Republican Suzanne Miles edged Democrat Kim Humphrey to capture a seat that had been held by Democrats for decades. Trailing late in the race, Miles made the race a referendum on ObamaCare. Her success in using a federal issue to capture a seat in the state legislature could be a harbinger for 2014.

I suspect that the prosecutors may have overdone things. There is a sense of queasiness at sending minors to adult jails, especially for 20 years. Yes, we can talk about the messed up mindset that says a 16 y/o is adult enough to get an abortion on her own but not to go to grown up jail or be sentenced to death. But the fact is that it evinces a visceral reaction in lots of people to see a 16 y/o being put in with hardened criminals. (Read "The Righteous Mind", by Jonathan Haidt, for why you have to take that visceral reaction into account.)

They would have been better charging him as a minor and putting him in the toughest juvie possible until he was 21. (At which point I'd be spitting at the leniency, but never mind.) The fact remains that the court saw the possibility of ruining someone's life, possibly turning them into a hardened criminal and became incredibly receptive to whatever the defense was proposing. Add in the worst sob story his family could come up with, and he's not being punished.

I dunno. The Scandi style idiocies don't work too badly with a Scandi style population. Look at Iceland, with the police shooting and killing someone for the first time in its history recently. That kind of "justice", while it sticks in my vengeful little craw, might not work too badly with well off whites. It's just that there's a, uh, vibrant population and it rightly violates all sense of justice to have different justice.

36 In many areas in the US, going to jail/prison (yes there's a difference) is like going on vacation.

A lot of their friends/acquaintances/crime partners are there, they have the same level of respect and associations as they would on the outside, they don't have to provide for themselves or worry as much about a drive by/rip off. They can get pretty much any drug or recreation they want to pay for and they get other freebies they wouldn't have on the outside.

It's a win win win win.

42 When I was in grad school, our departmental secretary was killed on the freeway in a head-on collision with a 26-year-old wrong-way driver. He was stinking drunk and doing 70 mph. He'd had his license taken away a few weeks earlier and was on probation for doing the same thing (except that he hadn't hit anyone). His public defender pleaded with the judge for probation again, saying he'd "learned his lesson." We suspect the judge would have gone along with it, but we packed the courtroom and made sure that a reporter from the local newspaper was there, too. He was sentenced to five years. I heard later (but can't verify) that he was out in two years.

I really do think that if our admin hadn't had any friends, the bastard really would have been given probation again.

45 Ohio Focus Group: Obama a ‘Disappointment’

'HeÂ’s not focused on creating more jobs'

Once staunch supporters of the President, former Obama voters are now expressing their disappointment in him, MSNBCÂ’s Chuck Todd reported.

A focus group conducted by Peter Hart, a Democratic Pollster, found that President Obama is losing credibility with his faithful allies.

Eight of the eleven participants in the Ohio group- independents or independent leaners- voted for President Obama in 2012, but not one of them described themselves as “proud” or “satisfied” with him. Instead, they said that they were ‘disappointed’ with him, and used words like “inexperienced,” “powerless,” “cautious,” “timid,” and “overwhelmed” to describe him.

One participant told Hart: “I was really excited going into his first term. His first term was certainly a disappointment.” one focus group participant shared.”

54 The bureaucracy tasked with Obamacare implementation may be violating a law that requires government agencies to keep private information safe.

Under the the Federal Information Security Management Act (FISMA), the Department of Health and Human Services’ Center for Medicare and Medicaid Services (CMS) is required to have an “Authority to Operate,” or ATO. In order to receive an ATO, new information tech systems must perform a set of tests, including “Security Control Assessments” (SCA).

But according to CMS’s 2014 budget request, no such security assessment took place. The Federal Healthcare Marketplace website was rolled out without full end-to-end testing.

NASA scientists have revealed the inner workings of the ozone hole that forms annually over Antarctica and found that declining chlorine in the stratosphere has not yet caused a recovery of the ozone hole.

More than 20 years after the Montreal Protocol agreement limited human emissions of ozone-depleting substances, satellites have monitored the area of the annual ozone hole and watched it essentially stabilize, ceasing to grow substantially larger. However, two new studies show that signs of recovery are not yet present, and that temperature and winds are still driving any annual changes in ozone hole size.

80 I saw a program eons ago, where a guy who killed somebody when he was driving drunk, the judge fined him some amount that came to $10 a month for, I think every year the person who died had been alive (I think it was a teenager who was the victim).

The perp was required to WRITE A CHECK every month, for $10, and send it to the family.

When they talked to him he was broken up about it, said it was the hardest thing to do every month.

Now, some of that strikes me as cruel, but then, so is life. He's never going to forget what he did. So yeah, if you don't want to throw these punks in jail, find another way to make them pay.

Purp,

Interesting possibly true side note to this case: posted by a guy claiming to be a Texas attorney.

"This was not a criminal case

In Texas JUVENILE CASES are tried under Civil Court Rules. Not criminal.

The theory in juvenile cases is "What's in the best interest of the CHILD."

The Judge found that the sentence she gave was.

He's also on 10 years probation. You can bet the probation officers will keep a microscope on him. There are always 'terms and conditions', e.g., refrain from using alcohol. That means even once. "Break no laws of Texas or any other State." Once is enough to yo-yo him back to Texas, there is usually no bond before a probation hearing.

The Judge then has the power to set aside the probation, give him the full 10 years in the State Pen. That's what the DA said was going to happen. And you can damn well bet the Judge WILL throw his young ass in the pen for 10 years. The time he served on probation doesn't count against the 10.

He either gets his head straight and has what's called a "come to Jesus" discussion with himself, or he's on the barred window bus to Huntsville.

Although, it's interesting the Judge delayed the Hearing to 16 hours after the deadline for anybody to file to run against her in next year's election."

120 In my house, the cardinal rule is: actions equal consequences.

If you make straight A's you get money so you don't have to work to play, because school is your work.

If you violate a punishment, like no computer and I catch you? The computer goes out the effing window, literally (Oh yes, I. did.) and then you will be supervised when school dictates you need the computer because it's mine you must use.
I do not want to hear the words akin to "boo-hoo. woe is me. I'm a bad person, I fucked up. Feel sorry for me." Nope. I want you to own it, and never make the same mistake, er, bad choice again. Is it too much to ask? No.

.

.

.We did a reverse sting at our VFW when I lived in Connecticut. They local cops were constantly setting up traps for people leaving the bar and popping them for DUI. The cops there didn't have dash cams so they would roll up on someone leaving the place with their bright lights on and claimed they crossed the yellow center line.

So one Friday night they sent out a guy who does not drink first and sure enough the cops were all up in his stuff accusing him of crossing the line refusing a breathalyzer, etc. He demanded to be taken to give a blood sample and told the cops he doesn't drink. They got pissed and let him go, meanwhile everyone else had already left the bar.

DUI for most small towns is nothing but a money maker. They split the fines with the State in CT and they are encouraged to make as many DUI arrests as they can. An average person is going to blow .08 if they have two beers or a shot within an hour or so.

157 I caught five minutes of Morning Joe today and watched Ryan on to publicize his rick-rolling. They have some guy on the panel whose name I can't recall but who was once an advertising person and that guy asked Ryan if this deal "means you are finally sticking it to" the fiscal cons, are you "repudiating" the right? Ryan might have responded with an "are you nuts?" line of his own, but he didn't. He merely said this was out of his purview, or beyond his pay grade or something. Sad to watch.

Maybe it's just the photographer angle, but that pose looks uncomfortable to hold for a painting.

It's a publicity shot. You can tell by the way the "artist" has basically nothing in the way of paint. Sorry - should have mentioned that.

As far as "bummed" - it's OK. The anti-depressants just haven't kicked in yet, so I'm a little slow off the mark today.

160 Oh, this mixed-up, crazy world. Where multiple homicides by car are just a slight misstep, and shooting the guy who is pounding the back of your head into jelly is the worst crime ever.

161 159...the artist is using pastel paints or crayons...pigment mixed with a binder formed into sticks. Link in my nick.

163 Our civil society was created, in part, to ensure criminal acts were punished by the state and not vigilantism. When the state begins to regularly abdicate its role, perhaps it is time for the families of the 4 killed by this punk to ensure justice is served.

Teen who hit 66-year-old pizza man with baseball bat won't stand trial as an adult (Ft Worth TX )
STAR-TELEGRAM ^ | DEANNA BOYD

FORT WORTH — Fred Rein used the tips he earned delivering pizzas to help people, whether paying for a pizza for a financially strapped family or a young mother’s electricity bill.

But on Oct. 3, authorities say the 66-year-old Fort Worth man encountered a 16-year-old boy intent on stealing money from Rein.

On a friendÂ’s phone, the teen later told police, he called DominoÂ’s Pizza, gave the false name Joseph and placed an order for four pizzas, cheesy sticks and two bottles of soda. He provided an address on Bessie Street, a house where he used to live and now knew to be vacant. Then he and three friends walked to a park across the street from the house and watched and waited.

When the deliveryman arrived, the teens approached and demanded the pizza. When Rein laughed, the teen later told investigators, he hit the man with an aluminum baseball bat.

Prosecutors Amy Mills and Tim Bednarz sought to have the teen certified as an adult, pointing to his lack of remorse for the attack, which left Rein with a permanent brain injury. He is still hospitalized in a rehabilitation facility.

"He may be 16 but this was a cold, calculated, premeditated attack on an innocent victim," Mills told state District Judge Jean Boyd.

Boyd, however, denied prosecutorsÂ’ request, siding with defense attorneys Chad Lee and Jonathan Simpson, who had argued that the teen had not yet been afforded the counseling services and treatment programs that are available in the juvenile system. They had also pointed out that a psychological exam raised concerns about the teenÂ’s maturity and sophistication.

165 If my family had been the one killed in the accident, and this ruling were presented to me, I would be fully justified in the eyes of a just God to kill his remaining family members. Let the prosecutor take that one to trial. There is such a thing as "righteousness," to serve the will of God.

169 Our drunk driving laws are not the problem, if anything, .08 has gone overboard. The ones that cause the accidents are the ones that are really trashed like this piece of shit. I have no problem throwing the book at someone that's 3 times the legal limit.

And something tells me this kid is going to wind up "missing" some day.

170 The justice system is a farce. You have people serving 20 years for "Crimes" where nobody is even hurt, and then you have rapists and killers out in 7 to kill and rape again, or they get off scot free like in this case.

171 If one of the survivors or next of kin hunted this lot down and stuck their heads on pikes, I'd probably have to vote "give that person a medal" if I'm stuck on their jury...
