Update on Deming, NM Police Rapists
— Ace

Just an absolutely horrifying story. Be sure to watch the video.

n the search warrant affidavit that sought permission for an anal cavity probe, one police officer said he asked Eckert for permission to physically search him after the minor traffic stop. When Eckert refused...

As suspected: He exercised his rights to decline the search.

And then what did the cops do? They raped him for 12 hours.

...the document says, a police K-9 dog alerted them to the side of his car. Kennedy alleges the dog is not certified to search for drugs and may actually be a pet.

That's the lawyer making this allegation, but given these cops' behavior, I'm not dismissing that out of hand.

A judge granted the search warrant for the anal cavity probe, but not necessarily a colonoscopy.

Which they did anyway. What the hell, why not? The warrant was bogus anyway.

Officers then transported Eckert to the Gila Regional Medical Center after an emergency room doctor at a Deming, N.M., hospital told them "this is unethical," Kennedy said. The doctor who refused to comply with police is willing to testify if the lawsuit goes to trial, according to Kennedy.

After arriving at the Gila facility, doctors examined Eckert's anal cavity twice with their fingers, put him through an x-ray scan and then inserted three rounds of enemas into his anus. After each enema, doctors examined the stool sample produced. Eckert was then given a second x-ray scan and forced to undergo a colonoscopy with anesthesia.

It's unclear why the colonoscopy was necessary after enemas and x-rays did not reveal hidden drugs. Eckert was sent a $6,000 bill for the medical procedures he involuntarily underwent, his lawyer says.

And then they gave him a bill.

The business with the warrant is pretty bad. Not only is absurd on the face of it to get a warrant for an anal probe based on "clenched buttocks," but the warrant was only good in the jurisdiction in which it was written. Because the cops could not get the doctor in that county to agree to their plan to rape the man, they had all this done in the next county over. Where the warrant had no force.

Well I'd say there's an American Citizen who now Understands Better than to Exercise His Rights when the Police Come Calling.

Louima's subsequent civil suit represented by attorney Sanford Rubenstein against the City of New York ended in a settlement of $8.75 million on July 30, 2001, the largest police brutality settlement in New York City history. After legal fees, Louima collected approximately $5.8 million.

121 98 I guess the argument can be made that if you had a good faith belief that some one had drugs up his tushie, for their own health, the drugs would have to be removed. However, if the guy denies it and nothing has even shown up on an xray, why not let him go? --- They MIGHT have been able to justify the X-ray and possibly the first enema or cavity search under probable cause, claiming that they were following up on the drug dog's hit of him. Once they turned up nothing, they were proceeding into very dangerous waters as far as liability is concerned.

Yes way  over the line as an x ray would have been sufficient but I think the outrage is  enhanced because of the location of the search.   X rays and forced vomiting have been done more frequently then you know when  dealers try to swallow there stash.    If they don't get the drugs to come up,  unfortunately they have to wait until they shit them out.

Again,  there was no reason in the world they had to be this invasive.  Absolutely none.

Yes, I have seen xrays where they have all the condoms stuffed with drugs they swallowed but you can't not see that shit on an xray or probably even palpate it but that might be dangerous if you bust one of the condoms open. So, even if they guy does have some drugs in him, why not let him go? It's not the drug bust of the century. You can arrest every drug trafficker. It seems like an awlful lot of man power and expense for what would only turn out to be a smal amount of drugs if that at all.

140 The affidavit for the search warrant says that he was known to hide drugs up his butt. He was discovered to have drugs up his butt on a prior occasion when he was in jail.  Further, he has a prior felony conviction for drugs and was arrested for possession of meth in 2012.

Hiding stuff up your butt is a fairly common practice in jails and prisons and is referred to as "keistering".  A couple of years ago we had a guy keister a cell phone when he was booked into the jail.  (Interesting trivia: several weeks ago I posted that I was amused when a guy pleaded guilty to menacing with a crossbow.  That's the same guy who keistered his cell phone. We depend on repeat customers for our business.)

I don't know what the right and wrong here is, although I'm leaning toward wrong, but like all else in life, it is not a simple as it seems,.

Apparently, the cops claim he has been found to have drugs stashed up his ass before, but The Blaze was NOT able to verify that in official records. Even so I can see that justifying maybe one probe and the first x-Ray. But no way does that come close to them continuing on and on and on with multiple robes, x-rays, enemas and a damn colonoscopy. No way at all.

166 Some cop in Arkansas tasered a woman after she refused his request to show him her breasts. A man who wanted to stop his son from buying cigarettes called the cops and reported the truck his son was driving as stolen. The cops chased the son in the "stolen" truck and then shot him dead. Cops entered the home of an elderly man because they suspected he was making meth in his home. They found no meth, but killed the old man anyway. A man tries to enter his burning home to rescue his 3-year old stepson, and cops taser him repeatedly. And those (plus the TWO stories about illegal anal searches of traffic stop suspects in New Mexico) are just from this week.

189 49 How much drugs did they expect to find in this man's anal orifice? Good G_d, man, it's not like he was going to put a dent in the local cartels' business.

From a LE perspective, I can't justify this.  Absent some out of left field set of facts that somehow changes the fact pattern, this is bad.

Even if they found a quantity of drugs, 14 hours tying up God knows how many cops and medical personnel (not to mention the suspect) is not an efficient use of resources.  I think these guys reached a point where they realized they had gone too far, and doubled down, thinking that was the only way to justify what they did.  At some point, competent leadership should have pulled the plug on this.

I don't know how much the colon will hold (drug couriers from other countries have occasionally smuggled heroin that way), but frankly, if I reached the point where I had PC to believe something was in there, an x-ray is as far as I would go (followed by a period of waiting, if something showed up, while he poops it out).

If you are clever enough to conceal balloons of dope up your ass in such a way that you beat an x ray, well, you won today, pal.

208 Another law geek interesting thing about this is the operation of the fourth amendment remedy of suppression of evidence.  Since this guy was innocent and was not charged, the fourth amendment doesn't help him a bit.  If they had found drugs up his squeakhole and it was determined to be a search in violation of the fourth amendment, evidence would be suppressed and he would walk.  So for fourth amendment purposes it is better to be guilty becuase then there is some remedy.

South FL circa late 1970's, early 1980's.  Lotta cops got arrested back then for acting as enforcers and protecting loads coming in.

When that route eventually wound down, the action moved towards the border.  The players still operate pretty much the same.

229 "According to the affidavit for the search warrant, police were told that Eckert was “known to insert drugs into his anal cavity and had been caught in Hidalgo County with drugs in his anal cavity.”

If he did not have a criminal record that he hid drugs up his butt before they would have not have done any of it. All it takes is the name entered into the computer and that came up. If he was let go after the X-ray and dies from a drug overdose in the parking lot, the police would have been responsible. If they did find any drugs they would not have been allowed as evidence based on not having a valid warrant to obtain it. The search was not to charge him but make sure he did not die from having the meth rock the size of grain of rice absorbed direct into his blood via the colon. It was not the dog hit that made it happen it was his history.

Still does not explain why when it happened in January, it should not take until the lawsuit is filed to tell the world about it. Cops don't get fired from a lawsuit 11 months after the event, only after an internal investigation when it happened do they get fired. How many other people did they do this too but they did find drugs up their butt that sent them to jail.

If he gets the millions minus the millions to the lawyers he will be broke again in 2 years or less.

People who tinfoil hat the legalization of pot (at any rate) as the agenda monopolized ONLY by pot-heads are idjits at best. Prisons are over crowded, and early release isn't something "saved" for minimum-quantity pothead prisoners; violent offenders make their way out early, too. It's one thing to not arrest for possession of minimal quantities. Another to require employers to allow employees to work while under the influence. And from retired federal agent accounts given in sworn testimony, even the Gipper was authorizing the massive purchases of the hard shit imported stateside for gun running corporatist profiteering. 245 I am a Deputy Sheriff, and I do not understand. Admittedly, I have not read the affidavit for the warrant and am just taking what I've read here at face value, but where is the probable cause for a search warrant to invade someones body cavity? How does a judge sign off on that? And then (assuming probable cause did exist, and not even examining the jurisdictional issue) how do you make the leap from that to sedating the person and then searching several feet deep into his colon? If the alleged contraband is concealed deep inside his abdominal cavity then the justification for the search (clenched butt cheeks) has no relative application. There is no part of this story that seems to meet even the loosest test of reasonableness. This was a systemic failure at every possible level.
