Argument Follow-up In The Contraception Mandate Cases
— Gabriel Malor

Ilya Shapiro seems optimistic.

Washington Post has a fairly neutral write-up. It appears that some of the justices were hung up on the "Parade of Horribles." That would be Lie 2 on my list.

The transcript should be up this afternoon.

Consider this an open thread.

34 What I don't understand about the super hip Left who just adores everything gay is how will they deal with this:

"If abortion on demand is the highest good and being gay is also a good thing.  If the gay gene is isolated, is it just as OK for parents to abort a baby who would be born gay as it would be to abort it for some other gene related issue?"

In other words, is the Left going to be 1000% behind aborting babies who will grow up to be homosexuals because Mama does not want a gay child?

Not sure which ranks higher, abortion or gay rights.
The head of the UK version of Planned Parenthood, Ann Furedi, recently affirmed that she is A-OK with sex-selective abortions.

So apparently abortion *does* trump female genocide.

But, my question remains.  Will parents keep a gay fetus?  I think some will, but, I also think many, many more will not.   Will the Left be A-OK with that the way they are with Black babies being aborted?

101 An advocacy group co-founded by Facebook creator Mark Zuckerberg is using the story of labor organizer Cesar Chavez to help revive momentum behind an immigration overhaul in Congress. The advocacy group FWD.us is teaming up with the United Farmworkers of America (UFW), which Chavez founded in the 1960s, to hold screenings of a new film about his life this week in four cities across the U.S. Organizers said they hope the screenings show that a broad coalition from different backgrounds remains united behind an urging Congress to pass a major immigration overhaul. Such a stance could be necessary at a time when the push for legislation has become stalled and some activists have shifted their focus toward pressuring President Obama to act. "[Chavez’s] story is such a powerful tool of organizing, bringing people together and humanizing this really important issue,” FWD.us founder and president Joe Green said in an interview. Ah let me think about that for a moment. Ah NO> Go fuck yourselves

It has three parts. "First, the statute must have a secular legislative purpose; second, its principal or primary effect must be one that neither advances nor inhibits religion; finally, the statute must not foster "an excessive government entanglement with religion." ===========
Here's how it will shake out, if there is ever a "gay gene" found:

The evil, hateful, intolerant Christians will keep the baby. Nearly every single one. Most won't even test for that. Life is too important.

The good, loving, tolerant leftists will quietly continue their genocide, now with additional reason. They want designer props of convenience--not real humans with real-life problems.

But they will--to a man--rant and rave all day long about the evil, hateful, intolerant Christians who might abort a gay baby.

They will continue to blame the Christians for all the world's problems and hate them for living up to the ideals they never will meet.

171 I reject the premise that a state does not have a right to establish a religion if it wishes. Established state religions existed after the ratification of the constitution and persisted until the 1830s in some cases. That business of claiming the 14th amendment precludes state religions is just sophistic bullshit. Posted by: D-Lamp at March 25, 2014 02:30 PM (bb5+k) The S/state has no business "establishing" a religion. None. Zilch. Nada. As soon as the state establishes one, it will discriminate against the others. It will promote the one, while casting aspersions on the others. The Constitution is clear and there's good reason for it.

That is my take.  As for the gay gene, the LGBQT community pretty much insists on it with the Born This Way meme, but, I do wonder if they really truly want the cause whatever it is to be actually found--because it opens up a whole can of worms.  Such as testing in discrimination or sexual abuse cases, abortion, etc.

Posted by: BCochran1981 - Credible Hulk at March 25, 2014 02:32 PM (da5Wo) I think your opinion is contradicted by the reality of our history. There WERE official state religions AFTER the constitution was ratified. Yes, the states gave them up, but that is irrelevant to the point. They were CONSTITUTIONAL. Where is the constitution clear about prohibiting state religion? I know it precludes religious tests for office, but that isn't the same thing.

185 90 Will parents keep a gay fetus? I think some will, but, I also think many, many more will not. Will the Left be A-OK with that the way they are with Black babies being aborted? Posted by: Sherry McEvil, Stiletto Corsettes, We Be Bossy at March 25, 2014 02:05 PM (kXoT0) ------------------------------ Abortion trumps all else. The "right" of the State to deny protection of the law to the unwanted is paramount. Thus the Left, which cares sooo deeply about blacks, has no problem with the black abortion rate. Likewise the Left, soooo sensitive to the "differently abled," applauds the extermination of the handicapped. After the Almighty State successfully takes over healthcare, the Left, which cares sooooo much about the elderly, will go back to its campaign for the "right to die." (Right now they have to put that one on the back burner since people like that stupid snowbilly keep bringing up "death panels.")

Posted by: Shoey at March 25, 2014 02:37 PM (Y7jCH) And this is my understanding as well. It's axiomatic that the Federal government couldn't have an official religion. It would have blown apart the coalition of the original colonies, all of which would have objected to being dominated by a different Christian Doctrine. The Union had to be doctrine neutral, but individual states could do as they wished, and they did.

187 I'm actually hoping the mandate is upheld.

The states need to step up and protect their citizens--I'm looking at you future-Governor Abbott.

The need to say "This law is unconstitutional--no one in our state will be required to follow it. It is simply not a law in our state. No state resources nor the resources of any private person or entity shall be used to enforce this law against the citizens or businesses of this state. Anyone found doing so will be personally liable for all economic losses they have caused."

We are long past the point were the courts will protect our rights--they merely exist to rubber stamp the relentless whims of the federal bureaucracy, which they sooner or later will.

192 Ugh. I'm in the kind of mood today that I want to see the Cascadia fault and the San Andreas both go at the same time. 9.5 on the Richter scale Baby! And then that triggers the Yellowstone Caldera to blow. And from all that shaking I want the mountain on Las Palmas to calve and send a 100 to 150 foot high tsunami impacting the entire east coast from Florida to Nova Scotia. Global Warming that Bitchez! (No offense to any of the Moron Horde located on the left coast and the other left coast, Minn, Wis, Mich. and/or Canada.) I would miss VDH though. And one other thing...a giant SMOD lands in the middle of Afghanistan and takes Pakistan and Iran with it.
I feel better now.
