RT @NBCSports: BREAKING: Clippers owner Donald Sterling receives lifetime suspension from NBA commissioner Adam Silver.
— slone (@slone) April 29, 2014I'm not sure what this means, and I will find out in the next few minutes. (I thought it was more important to get breaking news up.)
My guess is that this is a ban on his day-to-day participation in the club. He won't be permitted to make decisions for his own business. He's being forced into a completely passive ownership role. He'll still own the team, technically, but someone else will run it, and he'll be banned fro interfering.
Who the heck gets to pick the new team caretaker is beyond me.
Hmm: Maybe the league's power is less well defined than I thought:
Q: What penalties can Silver issue?A: Under the provisions of the bylaws, Silver has two sets of powers that he may use. Under either, he can issue a lifetime suspension and a substantial fine. Under Paragraph 24(l) of the constitution that was adopted by the NBA owners on Oct. 26, 2005, he can issue a fine of up to $2.5 million, can suspend an owner indefinitely and can order the forfeiture of draft picks. This provision applies to situations that are not covered by specific rules within the constitution.
In another provision, Paragraph 35(A)(c), Silver can issue an indefinite suspension and a fine of $1 million to any owner who "makes ... a statement having or designed to have an effect prejudicial or detrimental to the best interests of basketball."
If Silver wants to hammer Sterling, he can assert that Sterling's statements are so
egregious that they go beyond the misconduct contemplated in Paragraph 35 and allow Silver to assess the greater penalties found in Paragraph 24. Sterling can argue that he merely made a statement, but the statement at a minimum allows a lifetime suspension and a $1 million fine.Q: Is it possible for Silver and the NBA to terminate Sterling's franchise ownership?
A: Yes. Under the terms of Paragraph 13 of the constitution, the owners can terminate another owner's franchise with a vote of three-fourths of the NBA Board of Governors, which is composed of all 30 owners. The power to terminate is limited to things like gambling and fraud in the application for ownership, but it also includes a provision for termination when an owner "fails to fulfill" a "contractual obligation" in "such a way as to affect the [NBA] or its members adversely." Silver and the owners could assert that Sterling's statements violated the constitution's requirements to conduct business on a "reasonable" and "ethical" level.
Thanks to Brian in New Orleans.
Corrected: I wrote, at first, that the commissioner only had the power to institute a 1-year suspension, because that's what I... well, heard from another commentator (Earl Ofari Hutchinson). But Brian's link seems to indicate the commissioner has more power than that.
I retract my claim. I don't know the actual powers of the commissioner either way-- but certainly it seems I cannot rely on my previous hearsay belief that only a 1-year suspension was permitted.

Q: What penalties can Silver issue?
A: Under the provisions of the bylaws, Silver has two sets of powers that he may use. In another provision, Paragraph 35(A)(c), Silver can issue an indefinite suspension and a fine of $1 million to any owner who "makes ... a statement having or designed to have an effect prejudicial or detrimental to the best interests of basketball." If Silver wants to hammer Sterling, he can assert that Sterling's statements are so egregious that they go beyond the misconduct contemplated in Paragraph 35 and allow Silver to assess the greater penalties found in Paragraph 24. Sterling can argue that he merely made a statement, but the statement at a minimum allows a lifetime suspension and a $1 million fine.
Q: Is it possible for Silver and the NBA to terminate Sterling's franchise ownership?
Any owner or Silver can initiate the termination procedure with a written charge describing the violation. Sterling would have five days to respond to the charge with a written answer. The commissioner would then schedule a special meeting of the NBA Board of Governors within 10 days. Both sides would have a chance to present their evidence, and then the board would vote. If three-fourths of the board members vote to terminate, then Sterling would face termination of his ownership. It would require a vote of two-thirds of the board to reduce the termination to a fine. Terminating a franchise would obviously be a drastic remedy, but the potential of the termination procedure gives Silver and the other owners vast leverage in any discussion with Sterling about an involuntary sale of his team.

Well, he's like 107 so life isn't too long. That said I guess there are by laws and such for the league but apparently this may just be a made up penalty.
I also don't get that someone can lose property for being a racist. Can you lose property for being against gay marriage? or amnesty? or let's say you don't believe islam is a religion but a socio-fanatical-fascist movement?
But I won't lose any sleep of this guy, a really strange kind of racist though isn't he?

I suspect they are going way overboard just to make a point and be able to say they really hit him hard for being an idiot. Once this blows over his lawyers and the NBA lawyers will get together and quietly hash this out.
This is all smack talk right now and the NBA will be forced to walk most of it back in the near future. They just want to appear strong and forceful right now.

This.
I get that the NBA is a private organization with its own rules and bylaws. Fine. Whatever. If Sterling had said what he said in a public space, at an event or in an interview or somewhere else where he had no expectation of privacy, then yeah, I wouldn't really care what they do. But that they're levying this sanction against him based on something he said in what he BELIEVED was a private conversation leaves a bad taste in my mouth. Tastes like tyranny, where you can't trust a g-ddamn person because absolutely anyone could be taping you or recording you or transcribing your words in order to turn you in to the Stasi KGB Gestapo the guys in power.
Get some recordings of private conversations between the players, or other team owners, or coaches, or members of the NBA administration, and we'll see if they should be so damn eager to cast the first stone.

Oh, and the lifetime suspension thing? Presumably he bought the team with his eyes open. I don't like how this happened and I think the punishment is disproportionate but he did accept the owners' rules when he signed the dotted line.
Oh, one further lesson: If you're anything even close to a public figure, encrypt all communications and choose your whores wisely.

Sigh...
So, the league and the owners will now vote to have Sterling sell the team. I will be interested to see what his estranged wife's reaction to all of this will be. By the way, EVERYONE in Southern California that has heard of Donald Sterling, was very aware of his racist behavior over the years. So Magic Johnson and others feigning shock and horror over his comments are full of shit. It was well known among the league that this guy was an asshole. Someone needs to go find the former commissioner David Stern and ask his ass why he allowed for this to exist under his 30 year tenure. I mean, if we are all suppose to be "wee wee'd up" about this, then let's go back and address the long history of this man and the racist behavior of Charles Barkley and others.
By the way, the NAACP, the Urban League, 100 Black Men and other left-wing groups were fine with him and his past as long as the money was rolling into their coffers. But now that he has been exposed via some tape recordings by his trashy ass jump-off...shock and horror! And both Jesse Jackson and Al Sharpton need to keep their racist and anti-Semitic asses out of it. Hey Al! Why don't you pay the IRS the back taxes you owe? I am so fucking tired of the hypocrites. I made a comment on Facebook about how before blacks lecture whites about the speck in their eye, they (blacks) might want to address the beam in their own eye. Yeah...that didn't go over too well.
Anyway...I denounce myself for being an Uncle Tom and traitor to the race. Oh and Larry Johnson...go fuck yourself!

She was bringing her boy toys to the games. He told her to knock it off. So she leaks the private conversation to the media. And voila they are trying to make him sell the team.
I still think she was sent in as a Mata Hari by Magic Johnson. All she has done was at Magic's behest so he can buy the team for a cheaper price.

That was his slutwhoregirlfriendfuckbuddy whatever her name is. SHE should be the one getting fined and banned, not him. Sterling may be an asshole, but if we're going to fine and ban people for being assholes in private then the HQ is going to go really quiet pretty damn quick.

Yes, but speech that damages the other owners financially. Just one example: the Clippers local TV contract is up right now. The precedent set on that contract effects the negotiations of the other markets, etc. Advertisers are fleeing.
This is a very nuanced issue. Bottom line to me is that they all agreed to their league constitution.

Then I would sell the team to a Saudi sheik. That would turn the conversation to misogyny.
Everybody wins!

This is a good ruling (if 15 years too late). Maybe a bit harsh - a multi-year ban would have been more fair with the understanding that he's got one strike left, but he's been a bad guy with a history of poor behavior for a long time, and it seems Silver is making up for past transgressions for which Sterling was never punished, as well. Stuff like this is damaging to the league as a whole, and I doubt this could have happened without the blessing of the other owners. If he's so toxic they don't want to associate with him, then that's their prerogative.
Hopefully it'll placate all the idiots who thought it meant they should or even could forcibly take the team away from him. I can't imagine he'd want to keep the team now, and this is the right way to force him out without confiscation of property.

One they focused on was Edith Stein. Seventh child of a pious Jewish family born in Breslau. Of how she went to the university and got her degree while losing her faith. Then after randomly picking up a book on Theresa of Avilar she spent the night reading. When finished she said 'This is truth.'
She immediately wanted to become a nun of the Carmel Order. But she was advised to wait and from 1922 to 1933 she taught at a Dominican school where she adopted many of their aesthetic ways. In 1933 she did become a Carmelite nun in Cologne. Then Kristalnacht in 1938 saw her being transferred to Holland at Echt in an attempt to protect her.
When Holland fell, the Bishop of Ultrech ordered all sermons to be directed against the rounding up of the Jews. In response, the Germans arrested all the Jews who had converted to Catholicism. So the Germans came for her at Echt. Also seeking refuge there was her sister Rosa. Stein said, "Come Rosa we go East to save our people." She willingly went into captivity.
She was taken to Auschwitz in one of the cattle cars. And immediately sent to a gas chamber, her body cremated, and ashes scattered to the wind.

My understanding is that recording a conversation in California without the permission of both parties is illegal. I could be mistaken about that.
The real travesty here, though, is that the guy should have been strung up as a racist ages ago. Kareem Abdul Jabaar's op piece in Time contains a few choice items from the last several years. Sterling's a dick, yes, but if this is allowed to go through unimpeded then no one -- absolutely no one, but especially anyone with a little coin in their pocket -- will be able to speak freely in private ever again without fear of having their private words publicized and used against them.

Well, two points...
1) The question isn't if they *can*, the question is if they *should.* Should we just sit back quietly as the thought police, in whatever area, do their purges?
2) As for the NBA being a private organization, I wonder just how many tax breaks, incentives, and kickbacks the Association has been beneficiary of. There's more than a little government involvement in the NBA, and I figure that makes it at least some of my business.

Sterling's trashy ass jump-off seems to have followed the playbook of Mel Gibson's baby momma when it dawned on her that the funds were going to be cut off.
And if the league wants to address "racism", then they need to do something about Charles Barkley, Michael Wilbon and all the players who yell "n*gger" and "fag" or "faggot" during the game. And yes, the microphones pick that crap up. But honestly, the NBA is nothing but a snapshot of all that is wrong in the black community. Just can't talk about it because then you are being racist.

Speak without political correctness or just speaking honestly about the truth as one sees it, will bring on the wrath of the leftists. "I retract my claim. I don't know the actual powers of the commissioner either way-- but certainly it seems I cannot rely on my previous hearsay belief that only a 1-year suspension was permitted."
I am glad that no one went off into wild speculation and waited until they had the facts regarding the contracts that were signed between the league and the franchise holder. Little things like those can really alter the relationship between parties, including defining what a breach of the franchise agreement is and who gets to make that determination, and what can be done in event of a breach. wild emotional claims about the death of the Republic have no place where one considers that both the League and the franchise holder are sophisticated business interests well represented by counsel when they entered into these agreements; sophisticated enough to afford hiring the best legal talent available at the beginning of the business relationship and in the event that the relationship goes sour.

Rumor has it that the owners wanted Stern to push Sterling out years ago but he was so sick at the time they thought he would die soon and pretended he wasn't there. He didn't.

If you are in an NBA market, yes. If you are in 95% of the rest of the country. You are not being "taxed" for an NBA team.
-That was my point.
---------
So in other words, people don't have standing.
Funny how that dodge gets used.
OTOH, the NBA broadcasts all over the place, so presumably its customer base...eg the viewing public...would also have a valid opinion. The customers are stakeholders, after all....

The vote will be unanimous. The other owners want him gone.
Then the other owners are clearly saints who need never fear something like this happening to THEM.

People in Los Angeles have known for a LONG time that Magic went both ways. That's his business and all, but the lying and false image he put up was and continues to be unreal. Notice how the media doesn't cover his younger son and said son's boyfriend. Once the media found out his son was gay, they ran a few pictures and then there was a media blackout. Magic Johnson is full of shit.

It's true, some men get HIV from having sex with women.
It's also true there are countries in Africa where it is even greater taboo to have gay sex than it is here. And leaders of said African countries where they pretend gay sex is non-existent within their borders.
About 70% of all HIV transmissions are from male on male sex. Over 20% are IV needle use. Something less than 10% are females who acquire it from their male partners or IV needles.
That leaves a very very tiny fraction of males acquiring it from females.
Very tiny fraction, and I could explain the circumstances under which it occurs, but you probably don't want to hear it. Especially if you plan to eat sometime this week.

There really isn't anything to defend. Sterling is a very wealthy sophisticated businessman well represented by very able counsel. The NBA as an organization exists solely to market entertainment. The NBA is very responsive to anything that lessens the market for their entertainment.*
Both the NBA and Sterling were represented by good, expensive counsel during the franchis purchase negotiations and over the years since. The terms of the agreement were very well-explained to both parties. The NBA is acting under what it believes are its rights under the contracts it and Sterling agreed to. If the NBA is wrong there will be a court to tell them that.**
*I am certain the NBA can determine what it is in its best interests or not.
**Sterling can more than afford the legal talent to make the NBA regret making a mistake, the NBA knows that, and I would guess the NBA considered everything very carefully before acting.

Do you not understand how a free market works? If someone wants to buy from someone who isn't much interested in selling, they will have to pay more then in a situation when it is known that the owner is required to sell. It really isn't a difficult concept to understand.

The Clippers are worth well over a billion dollars. There's going to be a bidding war. Owning an NBA team is the new chic thing for billionaires and an amazing investment. Sterling originally paid $12 million.
The Milwaukee Bucks just sold for $550 million. It was valued at $400 million. That's Milwaukee.
Posted by: Brian in New Orleans at April 29, 2014 11:49 AM (3AsfL)
Yes. A private conversation that was made public, resulting in a public outcry that the NBA can't reasonably ignore without a public backlash that would cost them financially.

It might well end up in the courts, or they may come to some kind of agreement where he leaves on his own. But, if it does end up in the courts, that does not mean that Sterling will be in the drivers seat. If the NBA pulls the franchise and awards it to someone else, he could sue. But, unless he can get a court to issue a temporary injunction against the NBA, the NBA team known as the Clippers will be operating under someone else. He can spend years going through all the courts, but as long as the NBA gets to have someone else running the team, it is just news, and not even front page news. Would he win in his initial attempt to get an injunction? I wouldn't count on it. He is not a sympathetic figure, and as much money he has behind him, the NBA has much more.

The public - or "the mob" as many here have called them - can decide to boycott his particular entertainment. The NBA does not want a boycott, so the NBA is acting in what they perceive as their best business interests. Since I support the right of the public to undertake boycotts and the right of businesses to take steps to prevent potential boycotts my outrage meter is not pegging at all.
What can the NBA legally do? Can they force him to sell? Beats me - I haven't read the contracts that Sterling and the NBA entered into. The NBA may have every legal right to do what it is doing with Sterling agreeing to that. This is another reason why my outrage meter is not pegging at all - in fact it is barely moving.
This is a dumb sordid tale and no one comes out looking good, but considering that (with the exception of the mistress*) all of the players are sophisticated well-funded business interests I am not caring too much at all.

From what I gathered from the audio
1. His girl friend is allowed to have sex with a lot of black dudes
2. Sterling is fine with this cuz he is old and cant get it up anyway
3. Part of the deal is that she is discrete about it
4. She is not discrete about it.
5. Sterling uses the term "black people" to mean the "guys you are having sex with"
6. The conversation barely makes sense because she is trying so hard to get him to say something racist
7. She and some 3rd party are clearly setting him up. Otherwise they wouldn't be recording it in the first place.
