House GOP Leadership Finds Getting A Majority Of Votes To Difficult So They Hold A Sham Voice Vote Instead

Remember when Republicans complained about Obama's lawlessness? Good times my friends. Good times.

The GOP wants to spend more money on the "Doc Fix", which would raise the amount paid to doctors for Medicare patients. The thing that needs to be "fixed" is that current law was put into place during the Clinton administration to save money and reduce the deficit. But cuts can never actually happen so when it looks like they will, they have to be "fixed".

Conservatives weren't thrilled with spending more money especially since the Democrats swore ObamaCare would save money by assuming the "doc fix" would never happen even though we all knew it would.

So today Boehner and Cantor found out they couldn't get their way so they simply held a sham vote to ram it through and prevent conservatives from calling them out on it.

House Republican leaders had planned to bring up the “doc fix” under a procedure requiring a two-thirds majority to pass, but after a series of closed-door meetings on Thursday morning, they determined they didn’t have the votes to meet that threshold and didn’t want to stay in session long enough to set up a simple majority vote.

So with just a few members on the House floor before a scheduled vote on an unrelated Ukraine measure, Republicans brought up the Medicare bill by voice vote. When no one in the chamber objected, the measure passed.

“Bullshit,” said a visibly annoyed Rep. Mick Mulvaney (R-S.C.) as he emerged from the floor following the Ukraine vote. When Mulvaney was asked to comment about the upcoming GOP budget, he replied: “I can’t talk about the budget because I’m so pissed about the [doc fix].”

GOP leadership "didnÂ’t want to stay in session long enough to set up a simple majority vote". I'm sorry if doing their damn job is too inconvenient for them.

But hey...bi-partisanship!

Republican leadership worked with their Democratic counterparts to orchestrate the ploy. As members returned to the floor when the House came into session, they discovered that the bill had already passed. Nearly all of them were surprised.

No one had the chance to vote no, no one had a chance to vote yes.

Boehner likes to talk about the House of Representatives being "The People's House". Well today he and his leadership team broke in and trashed the place. Remember this the next time he or Cantor complain out how Obama is lawless.

But yay GOP, right?

All they have to do is to post a sign in their lobby saying they wont be taking Medicare patients if this goes through. Seniors vote. The bright side to this bit of lawlessness is that it takes another issue off of the table for R's to hang themselves with. If you think the shutdown didnt look good. 78 Why am I not surprised that DrewM is misrepresenting the circumstances here? 1. It wasn't a question of not wanting to stay in session long longer. It was due to the fact that the current "doc fix" was set to expire April 1st, and under normal rules they couldn't passed it on a simple majority vote before then. 2. Likewise, objections to the current doc fix vote weren't about "spending more money". Opponents acknowledged they didn't want to see the reduced payments enacted.

I don't know where this idea that medical reimbursements never get cut has taken hold.  That's a complete fiction.

EG, medicare reimbursement for anatomic pathology lab services was cut 50% last year.  This wasn't specifically related to the "doc fix", but it did knock a number of private path labs out of business, leaving a bunch of pathologists and techs out of work and driving a big wave of lab consolidation.

At the time the CBO officially "scored" Obamacare for deficit performance, and ranked it a "net deficit reducer", a few hardy souls pointed out that this was because (among other thumbs on the scale) the CBO included the hypothecated Medicare reimbursement cuts and presumed them to be a real thing that would actually happen.

Cynic that I am, I predicted that it would not even be six months after Obamacare was enacted that Dingy Harry would be stuffing "doc fix" bills into the Senate pipeline, and hey presto, that's precisely what happened.

Of course, those doc fix bills mean that the CBO's deficit scoring of Obamacare is rendered completely fictional.

Someone noted in passing that the CBO are actually required by law to score these bills based on the budget premises contained in the bills, even though the CBO themselves probably privately assume those premises are total bunk.

The Congress literally could pass a bill which says it has no net fiscal impact because little green men from Mars will land with flying saucers in the next fiscal year and bring the money with them to pay for it, and CBO would be forced, again by law, to consider that bill to be deficit-neutral.

That at least should be amenable to legislative correction. Force the CBO to produce multiple scores for each big bill, which clearly identify the assumed spending premises Congress has included (such as doc-fixes), and which produce a series of different scores with and without each of the premises.

Or, just tar and feather every single goddamned person in D.C. Faster, simpler.

Back in the late 70s and early 80s, the world (and Congress) were unrecognizably different, and the mandate to follow legislative assumptions did not regularly produce outlandish distortions.  Of course back then "continuing resolutions" were quite literally very short-term bridges used until real appropriations deals could be finalized, usually around holiday season/sine die adjournment.

For example, in my last post I billed roughly $150 for a complete exam of a brand new diabetic patient for about an hour. That included a multi-system physical (by me) and blood work with history and then Tx plan. State paid something like $47.50. Some tests and exams actually were not reimbursed at all. Zero. Now imagine most OCare policies are being reimbursed in the same way and how many doctors are super excited to go with Medicaid. Now imagine that the Medicaid system is not going under already and the ACA is not a badly crafted expansion of it with plans built in to take over the healthcare professionals and force them into Federal employment. If the GOP would get rid of the ACA and reform the whole of Medicaid grants there would not be a need for a fix.

Especially amidst what is truly unprecedented lawlessness from almost all sides, I don't think this (procedurally) qualifies as "lawless", however.  The House is always a dictatorship - more or less benign, depending on party and leadership.  But unlike the Senate, which literally operates by unanimous consent of 100 members, the House rules do not give a minority the power to stop the trains (note that aside from what are now exceptionally rare - and demonized - temporary speed bumps in the Senate, such as the mini-filibusters recently, even the Senate seems to have lost its essential nature, and senators rarely use their power to hold up business).

 

Now, the shit they were talking back when O-care was passed ("deeming" something passed, for example), that WAS lawless stuff.  In fact the "shell bill" issue and the use of reconciliation with O-care were both arguably lawless.

 

But today's shit?  Not lawless.  Which doesn't go to the substance, political or otherwise, of the maneuver.  I don't know the House that well, but it smells like a significant if not outrageous or unheard of bit of chicanery and cowardice by leadership.  Those speculating kabuki theater all-around may be right, but it doesn't smell like that to me.

286 The reason the "doc fix" is done every two years is that the cuts weren't reasonable.  They lower fees to the point NO DOCTOR would accept Medicare.

Now if your object as a burn-it-all-down nutbar is to sabotage Medicare, no fix is needed.
