Italian Court Finds Amanda Knox and Rafael Solecitto Guilty, Again
— Ace

Amanda Knox is in America and she's not going back to Italy.

However, Rafael Solecitto -- every bit as innocent -- is an Italian citizen, and they're determined to jail Amanda Knox, but they can't, so they'll jail the guy no one cares about, Rafael.

The Italian judicial system has a quirk unlike ours. When a trial court pronounces you culpable, you're not actually convicted of the crime -- not yet. The actual conviction only occurs when a court, sitting in review, confirms the conviction.

I believe I read that Italy considers this trial finding of culpability less seriously than our own countrymen would find a jury verdict, because it's not actually yet a verdict.

Thus, Rafael is in this odd twilight, again, where he stands to be convicted of murder, and yet is not actually convicted of murderer, while the actual murderer, a drifter and repeat burglar named Rudy Guede, whose DNA was found all over the crime scene (and yet none of Rafael's or Amanda's-- the prosecutors wisely explained that they had cleaned the crime scene of their own DNA, while managing to leave behind a great deal of Guede's; the prosecutors have never explained what type of bleach could permit this selective removal of genetic material), remains in jail, but with a reduced sentence in exchange for implicating Knox and Solecitto, because all he did was burglarize, sexually violate, and then slaughter Meredith Kercher, whereas Rafael Solecitto and especially Amanda Knox provided the inspiration and stage direction for this crime, even though they weren't even there, but who cares, it's Italy, and she's a Foreign Whore, and Foreign Whores must pay.

Oh by the way: Rudy Guede fled the country the day after the murder, and he had committed a series of burglaries, armed with a knife of the exact same size as used to slaughter Meredith Kercher, with which he threatened one victim. Because he burglarized the home when the occupant was in residence. Because he was a stupid, low-impulse control, rapist, burglar, and idiot thug.

The fact that he did the same thing to another victim (without proceeding to the sexual violation and rage slaughter phase) just a month before he murdered Meredith Kercher is taken as some kind odd, but ultimately unimportant, coincidence by Perugia's All Star Prosecution Squad.

Anyone Interested in a Great True Crime Book About Italy's Own Jack the Ripper... ... should read Monster of Florence, by Douglas Preston and Mario Spezzi.

There is a strong connection to Amanda Knox, though the book is not about her.

If you want to read about this case specifically, the Hellman-Zanetti Report (the official report of the court of appeals that freed Knox and Solecitto) is great. But it is a court document, not a novelistic narrative.

But it is great reading.

Yes, but the deal here is that she was found guilty... then innocent... and now guilty again.   Here in the states, when you're found "not guilty" they can't re-try you.   Not so in Italy.

There's a possibility that the conviction later gets overturned on appeal, but in the meantime you are a convict.

The university had nothing to do with the house. I'm not even sure that European schools have much official campus housing. I think the normal practice is to just go to a college near your home -- I know that's the case in France, where most college students actually just live with their folks. It was just a house rented, every year, to the newest crop of students. The top and bottom floors were separate apartments but of course the boys and girls met each other. i believe the boys were all italian. I note this because it seems more likely that the italian girl roommates would have interacted with them, not the english speakers (Meredith and Amanda). One of the italian girls was dating one of the downstairs boys. This has little to do with meredith or Amanda, of course. Apart from a couple of hang-outs in the bottom apartment, their lives weren't exactly tightly intersecting.

Actually, so does Italy.  According to Wiki (I just checked), ever member of the European Community (with five exceptions - and Italy is not one of them) has signed a treaty that forbids, among other things, double jeopardy.

 

Of course, you can sign all the treaties you want, and they won't mean a thing if you don't also have a certain degree of Rule of Law in place.

In the original trial it was contended that the knife seized from Sollecito's apartment had Knox's DNA on the handle and Kercher's on the blade.  It was the only piece of forensic evidence linking Knox to the brutal murder of British student Meredith Kercher on November 1, 2007 in Perugia Italy.  In the appeal it was found during retesting that there was no DNA belonging to Kercher on the blade; today the re-trial confirmed this finding ruling the knife out as evidence.

 

It is worth mentioning that the knife in question never fitted all of  Kercher's wounds and this meant one of two things:

1)It was not the murder weapon as a smaller knife could have made the wounds in question;

2) It was one of two murder weapons.

I asked Moore if there were any credible witnesses who could be called.

 

Moore: "The only witness who hasn't been proved insane or irrelevant is Rudy Guede's cellmate, who testified that Rudy told him that he alone killed Meredith.  All the witnesses from the original trial have been discredited."

 

In the trial of Rudy Guede, found guilty for his involvement in a fast track trial in 2008, the judge stated that more than one person was involved, how do you address that, I asked Moore?

 

"The evidence absolutely rules out more than one killer. This is no longer a judgement call. This is a fact.  There is no physical way for more than one person to be involved in a bloody murder and its aftermath, and have the physical evidence of only one of the killers (in this case Guede) show up, with the complete exclusion of the other or others. It is impossible. Purely and simply impossible."

That window as high above the ground and an illogical path of entry as there were other windows lower down and one was not visible from the road. The grass was not trampled, the wall had scuff marks, there was no glass on the ground as should have been as he would have knocked some off as he kneeled on the ground. The glass was also found on top of the clothes which doesn't make sense if the room was ransacked by Guede. NOthing was stolen in the room or the rest of the house so it was a staging. The boyfriend's DNA was found on the victim's bra clasp. His bloody footprint was found on the mat in the bathroom. Knox's blood was mixed with Meredith's in several spots which means they were bleeding at same time. One of these spots was in the room where the staged burglary was and neither of them should have been in this bedroom especially while bleeding at the same time.

If the plan was to intimidate into a confession, why didn't they call her in? She just panicked when her boyfriend broke her alibi. She had drug dealer phone numbers in her cell phone and one of them went to prison for drug dealing later on. The two had clashed over Knox bringining strange men to the cottage all the time and the victim probably called her a slut at some point.

534 Victim DNA on the blade in a scatch. It was a new sample tested in the recent trial in a different location on the blade right at the handle. Knox's DNA in abundance. Keep in mind the other Knox DNA on the handle was where you would grip a knife for a stabbing action rather than a cutting action for food preparation.

There's also evidence she was doing drugs, most likely cocaine. She had drug dealer phone numbers in her cell phone and one of them went to prison for drug dealing later on.

The two had clashed over Knox bringining strange men to the cottage all the time and the victim probably called her a slut at some point.

540 Another big lie Knox told is she took a shower that morning after the murder. In photos you can see her hair is dirty and the police said she smelled like BO. She also told one of the roomates she didn't take a shower. It would have been weird if she had taken a shower b/c she came home and the door was opened and the victim's bedroom door was locked. She said she saw the blood in the bathroom at the point but she then takes a shower? lol

547 Forced confessions are usually done by really dumb people. Knox is an aggressive girl and not one that is easily scared into something. She isn't the shrinking violet she wants to be portayed as. Consider this: She shows up in court in one of the first hearings 6 years ago wearing a beatles All YOu Need Is Love. lol that doesn't seem like she's real scared of Italian justice. I would have been in Sunday best if I was scared and even if I wasn't b/c it is a serious matter.

The boyfriend broke her alibi and said she wasn't there. If she wasn't there, where was she? She had a key to her cottage, obviously so reasonable to assume she was there. She still claims she was at the cottage. Why would the boyfriend say otherwise.

556 Why do I need to lie about it? She was found guilty today. SHe's lost 2 out of 3 trials. In Italy you get an automatic appeal trial even if first trial was conducted correctly. So she can't complain about Italian justice. the first appeal trial was annulled by their Supreme Court because it was not conducted correctly or even legally. Annulled means the whole thing was thrown as garbage. In that trial an experienced criminal casel judge was mysteriously replaced by a civil court judge at less second who had no murder trial experience. The criminal case judge resigned as result of that because it was an insult. Knox's boyfriend rich daddy bought a fixed trial in the 1st appeal. That judge was forced to retire after the trial.

563 BTW Italy has 1/7th the incarceration rate than America. Their sentences are also much more leniet. Knox gets life and possibly the death penalty in the states. This was a heinous murder and she only got 28.5 years.

You can recognize them because they always show up enmasse late in a thread, they have terrible spelling and grammar, the unending lists of made up "evidence" mostly gleaned from Italian tabloids.

They know that 90% of the "evidence" they post is pure tabloid bullshit. They know it because they respond to people that post primary sources PROVING that it's tabloid bullshit, like the underwear thing or the bloody footprints that Amanda Knox supposedly left all over the house.

But they just ignore when they're proven wrong, and spam the same crap in comments on another website. It's actually pretty funny. They've been at it for years now.

581 I have no dog in this fight, but . . . It is no surprise that Amanda Knox was found guilty, again. Why ? Because the Italian police caught her and her boyfriend in a lengthy series of lies from their very first encounter. Case in point: A cellphone taken from the house had been discovered thrown into the yard of a woman who called the police. The police found that it belonged to one of Knox´s roommates, and went to the house to investigate *before* Kercher had been found/reported. Knox and boyfriend were there, standing outside the house. They told the police they had just called them because they were concerned about why Kercher couldn't be contacted. The police checked the call records and recordings of emergency calls received, and found there had been NO CALL from them that morning. Other important evidence: Police described a broken window as a staged, would-be point of entry for a staged "burglary." Nothing of significance was stolen but the roommate's cellphone, which was thrown into the woman's yard just blocks away. Cellphone "theft" appears to be part of a staged burglary. Boyfriend said they tried but were unable to break into Kerchner's room - though he had studied karate/tae kwon do - and police easily broke through the door. Police said a child could have easily broken through the door if they tried. Boyfriend was on his computer when he said he was sleeping with Knox. Boyfriend withdrew his alibi for Knox. Knox had a history in Seattle including getting into a fight, and encouraging vandalism and attacks on bystanders during an illegal party she threw there. Knox, unlike all the other girls, showed NO sorrow or concern about Kerchner´s death, which the police also observed. Knox was turning cartwheels in the police station while waiting (Just like Jodi Arias did, coincidentally, for what it´s worth - though that is not dispositive). Knox accused her boss, a black club owner, of the murder for two weeks before admitting she had falsely accused him of the murder. That was BEFORE anyone suspected Rudy Guede - or any black man - was involved in the case. Knox changed her story several times, and finally admitted she was in the house when Kerchner was killed. Knox provided a written confession to the police. Knox's testimony was generally regarded as contradictory and very unconvincing, in either Italian or English. I wanted to believe Knox didn't have any involvement, but I heard her testimony, and she did not make any credible or impassioned claims of innocence. She sounded like so many other guilty defendants we've all heard before. And yes, the former chief prosecutor was a nutjob - but that does not mean that defendants who had been properly investigated, arrested and charged were therefore somehow innocent. Finally, the Knox family has employed publicists, marketing experts and paid spokespeople to promote their claims of her innocence. They have demonstrably ignored testimony and evidence, and have frequently provided false and misleading statements to the press. *Some* of the people posting comments in support of her innocence, or writing articles and phony "news" stories, are being paid by the family to do so. So, caveat emptor, morons of the horde . . .

582 The prosecutor was not a nutjob.  He is an anti-mafia lawyer which means he is one of the best lawyers in Italy.  He obtained an 8-0 conviction in the original trial.  That trial was conducted fairly and properly but Italy gives an automatic appeals trial if requested.

583 So, I've finished reading Murder in Italy by Candace Dempsey, which I purchased because it was recommended here. Dempsey is based in Seattle, home of Amanda Knox. I've read that Knox's mother and sister came out to support Dempsey at a book signing. Dempsey seems to be saying that if you have any doubts about Knox's innocence, it must be because you cannot deal with normal, non-violent college students who have sex and smoke dope. I can deal with it. Also, I'm an attorney, and the total bias of this book set off my BS detector. I haven't paid much attention to this case since 2007, but now I'd like to read a more objective account of the investigation and court proceedings.
