23 This seems appropriate here. And it's about damn time. This is mainly for Vic. Third Circuit strips officers and prosecutors of qualified immunity for framing a guy for the rape, torture and murder of two children and sending him away for 22 years. http://bit.ly/1ksdkWe I breezed through the decision and holy hell the Court was *pissed*. I mean really really super pissed at everyone involved in this. In case you're hoping for the happy ending that the guy who tortured and killed the children was then caught and executed, nope. He was indicted but died in custody before trial. You know what this guy should get? Every single person involved's pensions. Hopefully that will drive home the point that you can't do this.

24 Copyright law (Congress) likewise has ignored the Copyright Clause’s requirement that these monopoly instruments be granted only for “limited times.” There are entirely too many laws already on the books that ignore the plain language of the Constitution. He then quoted them his price. Their response? Uh, speaking at a graduation ceremony is an honor - we don't pay people to do it. Bu-bye!

30 The union-owned Amalgamated Bank, which is still owed millions by the Democratic National Committee, was introduced as a new partner of the Democracy Alliance at its annual meeting in Chicago this week, according to Politico. Amalgamated Bank, often referred to as “America’s Labor Bank,” became the DNC’s “primary banking relationship” during the summer of 2012. The DNC took out two loans worth a total of $15 million from Amalgamated to support its campaign efforts leading into the 2012 elections. The DNC was unable to pay back those loans for months. The DNC is still in the hole for $8.5 million to Amalgamated, according to its most recent Federal Election Commission filing. Crooks dealing with crooks. More please.

77 I would urge to remember this: Nixon was forced to resign for much, much less criminal activity than has occurred under Obama. Clinton (and I typically have nothing good to say about Clinton) was impeached for crimes not even scratching the surface of what Obama and his administration have committed. But the reality is that in the grand scheme of things, relatively little - next to nothing in reality - has been done about abject criminal activity in this administration. I believe that the answer to why this is so is that it is because having Obama remain in power, in a raft of strange and incomprehensible ways, it serves the purposes of everyone in national politics that he remain in his position. With the entire world descending into, if not chaos, some form of pre-chaotic state and with this country more divided than at anytime that I remember in my life, nothing good appears to be in the cards for the prospects of 'average', non-ruling class Americans. Yet politics continues as usual. It appears almost a certainty at this point that absolutely nothing will change in the next election with respect to changing the trajectory of this country. If what is happening to this country is not an urgent issue for the electorate of this country than how is it even possible for hope even cross our minds as even a fleeting thought? If nothing is going to be done than the debate over whether the 'let it burn' stream of thought is really moot. It will burn. "Letting it" become idle words.

There was some blowhard on CNN earlier this week saying this was a *good* thing, that we all need to be more careful about what we say in private.

Remember, after 9/11, Ari Fleischer noted that people needed to be careful of what they said, and every asshole leftist in America (BIRM) went apeshit?

Good times, good times.

87 Was out the other day and heard an anthem for AoS...

Ellie Goulding. "Burn". Mostly for the chorus.

-------------------------------
We, we don't have to worry 'bout nothing
'Cause we got the fire, and we're burning one hell of a something
They, they gonna see us from outer space, outer space
Light it up, like we're the stars of the human race, human race

When the light started out they donÂ’t know what they heard
Strike the match, play it loud, giving love to the world
We'll be raising our hands, shining up to the sky
'Cause we got the fire, fire, fire
Yeah we got the fire, fire, fire

And we gonna let it burn, burn, burn, burn
We gonna let it burn, burn, burn, burn
Gonna let it burn, burn, burn, burn
We gonna let it burn, burn, burn, burn

98 Does this surprise anyone? "For the Obama White House, tweets from reporters are a kind of early warning system. It’s up to Jessica Allen, 24, to sound the alarm. Allen, whose official title is “media monitor,” tracks journalists’ tweets and flags them in mass emails that land in the in-boxes of more than 80 Obama aides, including chief of staff Denis McDonough, White House counsel Kathy Ruemmler, press secretary Jay Carney and senior adviser Dan Pfeiffer. The result? Reporters who regularly cover Obama have become familiar with seemingly out-of-the-blue emails or telephone calls from officials taking issue with their tweets — often thoughtfully and constructively, sometimes with obscenity-laced yelps of outrage."

The older I get, the more I've come to believe that almost all of the major problems which occur on a local level happen because of the actions of crooked prosecutors.  In addition to cases where they decline to share evidence that would exonerate the perp, I know of some cases that they decline to take to trial because it deals with somebody with political juice.  There should be no immunity from prosecution if you knowingly railroad somebody.  And the punishment should be severe.

118 77 I would urge to remember this: Nixon was forced to resign for much, much less criminal activity than has occurred under Obama. Clinton (and I typically have nothing good to say about Clinton) was impeached for crimes not even scratching the surface of what Obama and his administration have committed. Posted by: LoneStarHeeb at May 01, 2014 09:22 AM (BZAd3) The media was beating the drum to ostracize Nixon back in the 1970s. I would suggest that they were more concerned with criminality and outrage back then because the press at that time had more integrity and a sense of decency, but I have long ago come to the conclusion that their outrage has always been highly dependent upon which party is being Skewered by their power. There is no Objective Press willing to beat the drum regarding Obama's criminality. I have come to realize that the existing One Party press represents the enabler for tyrannical/criminal behavior so long as it comes from their preferred party. Therefore, the most dire threat this nation has been facing has long been the Monolithic Socialist minded Media industry. It is a greater threat than terrorists, because while terrorist groups may blow up buildings and kill thousands, the Media distortion of information, which is necessary for the public to make informed decisions regarding the direction of it's governance, is bringing "The Terror" to us all.

One of the best features of such a system of taxes is that, from my limited exposure to the drug culture, most of the taxes would be paid by Democrats.

Right, and unlike criminal law where you have a (theoretical) presumption of innocence, under asset forfeiture laws the burden is on you to prove that your property is not guilty.  So, you win at trial and you still don't get your shit back.

And many police departments get 1/3 or more of their funding from the proceeds of asset forfeiture.  It is inherently corrupt.

The union-owned Amalgamated Bank, which is still owed millions by the Democratic National Committee, was introduced as a new partner of the Democracy Alliance at its annual meeting in Chicago this week, according to Politico.

I noted that Amalgamated bank is a state chartered (NY) commercial bank, which is not a member of the Federal Reserve.  That means it's supervised by the FDIC.

This highlights a very real issue in bank regulation...this bank is very politically connected with the Democratic Party, which just so happens to be at the levers of regulatory power.  In a just world, those DNC loans would be classified as problem assets and the FDIC would force AB to reserve against them.  For some reason I'm not all that confident that such a thing is really happening.

Obviously there's no good solution...you can't tell a bank that they can't lend to an entity if it's in their business strategy, so a law saying a bank cannot make a loan to a political party is a non-starter.  But the entire regulatory apparatus here relies on good faith, which this Administration has carelessly frittered away.  That's why I keep saying the GOPe and the Dems don't really understand the kind of fire they are playing with when it comes to things like this.

183 The MRAPs for cops are dumb, but they aren't building them for the the cops, right? My understanding is that it's war surplus. Maybe it's better to have the MRAPs just rust in a warehouse somewhere instead, but a lot of it is just trying to get some value out of the tens of billions we spent building them in a crash program -- and many never even made it to Iraq. We have huge #s of these. Many at the time said it would be wasteful to ramp up production as the war itself was being ramped down.

I put forth an argument that I don't believe most people have ever considered. The war on drugs is necessary, because without it Addiction would climb to a level such that the Nation would collapse. And what evidence do I have for this assertion? It's already happened once before, and we can learn from the mistakes of the Past. China legalized drugs back in the 19th century. By the end of the Century, China had a 50% addiction rate in Manchuria, and had become so weak that it couldn't even stop an invasion from the much smaller Japan. Drugs wiped out China, and very likely paved the way for Mao. A Nation that does not have a "War on Drugs", dies.

I would think of 'war' as cruise missiles aimed at a few coca fields somewhere in central America, and utilization of some of that impressive data-mining available to the Fed in landing a few not-so-pretty assassinations of known Cartel affiliates; and by 'a few', I mean, slash and burn every house and man involved from the bottom up.  Fear of retribution will do a good job in crippling the structure of those organizations.

What we're doing?  Not a war.  Cannot even be qualified as a skirmish.  If we were to actually throw down the gauntlet and tell Central America get your shit together and stop wrecking our citizenry or we will do it for you, things would change drastically.

That will not happen, though, far too much corruption in the system and way too many people in the States eager to defend any and all illicit substances, and all, disgustingly, in the name of "liberty".

War on Drugs, indeed... what a pretty little farce.

That isn't the case; the war is over, and the government and police lost. Drugs are everywhere, and easily available. The War on Drugs is exactly analogous in every way to the War on Poverty. It failed its fundamental goal spectacularly, yet instead of questioning the validity or practicality of said goal, the government simply invests more resources into the program while it steadily undergoes mission creep. To win the War on Poverty we need more taxes, more spending, more government programs, more everything government and more private citizens being picked clean for money. To win the War on Drugs we need more police, more military gadgets, more SWAT, broader police powers, more botched raids on houses.

When the communists came to power in 1949 they shot the opium addicts.  I don't believe that was 50% of the population but something less than 10%.  Still it was a lot of people they executed.

There are really only two approaches to drugs that seem to avoid the problems of having large and rich criminal organizations operating outside the law while courts, police and government are distorted by the drug trade.  You can make drugs illegal or you can execute everybody involved in buying, selling or consuming drugs.

Given the hysteria over executing mass murderers, my guess is that the United States is not yet ready to start executing junkies.

So Sterling bought his girlfriend all this stuff, including real estate that technically then belonged to the wife also, who wanted it back and out of the hands of the girlfriend. Posted by: Roadrunner at May 01, 2014 10:16 AM (7M8hQ) About this, you are very much mistaken. The war on drugs has been quite successful, because the normal evolution of drugs in a society is increasing addiction following a logistic growth pattern. That Addiction was 2% 100 years ago, and is still 2% today, is the result of interdiction. Had there been no war on drugs, addiction would be north of 30% of the population, just as had occurred in the past history in China. Now you can argue that "drugs are everywhere" but this is a simpleminded understanding of the larger picture. They are everywhere sufficient to supply a 2% piece of the population, they are not "everywhere" sufficient to supply a larger demand than that. If we wanted to get rid of that 2% of drug usage, we could do so, but I think most people look at the cost vs benefit equation and decide it is not worth it. We are willing to put up with this small percentage of addiction, because the costs of pushing that number to zero is simply too great to be worth it. (Both in dollars and in Social upheaval.) Do not mistake what a "Success" in the "War on Drugs" is supposed to look like. Not having a steadily increasing addiction rate *IS* a success.

Had there been no war on drugs, addiction would be north of 30% of the population, just as had occurred in the past history in China. " About this War on Poverty you are very much mistaken. If not for the War on Poverty and massive government spending, then unemployment and poverty would be much higher than it is currently. That unemployment and poverty has remain frozen in the face of massively escalating government spending is in fact a testament to the profound success of the War on Poverty. The same could be said about our wonderful Public Schools. Sure we've been spending more and more while the kids get dumber; but they would have been even dumber without the Public Schools. Big Gov for the win!

Beyond that, the addiction rate in 1900 was 50%. Of course by 1949, there were a lot fewer addicts. China took steps to reduce their numbers for decades leading up to 1949, but it still remains that were it not for massive addiction, Japan would have been unlikely to invade China, and much of the subsequent misery and death would likely have never happened. I would advise you to read up on the subject. China had legalized drugs imposed upon it by England, and it wasn't until after 1900 that they began to start ameliorating the disaster that had been caused by massive opium addiction.

I think it was Larry Niven and Jerry Pournelle who wrote science fiction stories win which "wireheading" addiction was common.  Cheap computers, cat scans and robotics made it possible for people to have wires implanted into the pleasure centers of their brains and then stay blissed out for a few cents worth of electricity until the timer turned off so that they could feed themselves and rehydrate before turning the electricity back on.

They postulated that eventually, people with a genetic predisposition to that sort of thing eventually removed themselves from the gene pool.

The current population of China may be far less prone to addiction than the Chinese population of 1949.

It's well established that the PDB is sent to his iPad, 'cause he's so smart and stuff that he doesn't need to ask questions of a live person. In other words, his day starts at 12:30- Lunch with Biden. Prior Presidents used to get the PDB early in the AM, often before or during breakfast, thus preparing them for the day and setting an agenda for stuff to follow up on. In the case of TFG, this alone explains why he's always the last to know anything and has used the excuse about getting his updates from CNN like everybody else. Remember when the President used to know about stuff, then would instruct the Press Secretary to inform the media/ public at the Daily Press Briefing? Yeah... it's the other way around now... except the press doesn't actually inform anyone of anything except the latest news about Justin Bieber.

Guns are a good example in my mind, even though guns are legal here, the cartel is doing a bang up job of gun trafficking, and not just the oooo scary illegal ones. Cartels gotta cart...

Once they've tasted those sweet sweet black market profits, they won't give it up." A Cartel only exists because of government enforced monopoly on the commodity. How many cell phone and computer cartels are there right now? If marijuana was legalized why would any pot head pay more money to buy pot from a long chain of distributors coming from cartels in other countries if he can grow it himself or buy directly from a gardener across the street. Would this person inexplicably continue to buy from a more expensive and remote and violent source rather than direct from a gardener he knows? 449 Respectfully disagree with D-Lamp #198, "The war on drugs is necessary." Appreciate your concerns, but... ((dusts off soapbox, straightens tie)) Any prohibitionism is tyranny. All the temperance, Putritan, Muslim, and Communist 'morals' laws, regarding drugs, sex, gambling, dancing, eating, and other 'vice' habits collectively known as the AoSHQ lifestyle. No. Real, legally-enforceable transgressions will occur soon enough if someone has a problem, with booze, drugs, shopping, whatever. Traffic hazard, threat to children, public nuisance, all involve transgressive behavior. Possessing or using substances, not. (Manufacturing meth? Well, if you are safely away from everyone and have toxic waste cleanup insurance....) Every life is interconnected, as is well discussed in suicide threads. Abuse is not a victimless crime. Social and familial support is supposed to precede and, one hopes, obviate involving the law — to help people before their problems become truly criminal. Therefore, better to do away with all the un-Constitutuonal, selectively-enforced, and corruption-riddled class 'war' on some politically-incorrect behaviors-of the-week, and instead turn our guns (metaphorically speaking of courssssse) on that infinitely more destructive addiction, pluralist-socialist thinking — manifest in the maze of laws, regulations, taxes, and welfare which discourages individual initiative, achievement, and responsibility, and which punishes, hobbles, and undermines good social organizations, congregations, communities and families who would otherwise stave off the culture of indulgence and despair which foments self-destructive pursuits. One does not have to endure the streetwalker plying her trade on main street, the needle addict shooting up in the public park, the pot peddler in the schoolyard, or the drunk drooling on your shoes at the mall, to permit them individual liberty in their own spheres - the right to do even things we might find distasteful. Your right to smoke your cigar does end where my nose begins, depending heavily on where I stick my nose, of course. Just FTR. When my great-aunt caught the clap, her husband and the entire crew of the whore house were put on the next train out of town. My grandfathers were likely involved in this act of community vigilantism. Possibly had sanction of some with badges. Note that what had been tolerated had its threshholds. But, enforcing community standards by whatever means does presume a preponderance of the community has standards, which gets us to moral and spiritual education.... If I want a beer, or the right to have a beer even if I never have one again (mmmm... beer....), I must extend that potentially self-destructive alcoholic right to others. I don't have any interest in renting sex, and I would not recommend it to my sons, and would do whatever I could to help any woman out of the life as if she were my own daughter, but if some old widower geezer can afford to spend his casino winnings on gifts for that lady who doesn't go to church, well, if they just don't make me watch, endorse, clean up after, or pay for it, then I guess it's just none if my business. 462 Washington (AFP) - New claims for US unemployment insurance benefits rose last week but remained on a downward trend as the job market slowly improves, government data released Thursday showed.

No matter how bad the news is it's always good news comrades.

Claims last week were at their highest level since late February.

Most analysts expected claims to fall to 315,000. But they cautioned that weekly volatility was particularly difficult to assess because of the Easter holiday and school break periods.

Oh I see, now Easter and spring break are to blame for increasing unemployment

Well, you seem to feel that approach works and that the current situation with rich and powerful criminal organizations twisting our legal and political system as well as the countries where drugs are produced and transported is a reasonable price to pay for a limited success.

My opinion is that what we are doing and have been doing for decades is not working very well and that we should try a different approach.  For myself, I don't really care whether we go the legalization or mass execution route.  However, I can guess which would be more likely to happen in present day America.

Will there be additional addiction? Yes.  As you point out, it is a trade off between costs and benefits.  In order to make the drugs available without encouraging use, I would push for government operated drug distribution centers modeled on state liquor stores and off track betting parlors since government is not particularly good at providing services.  I would require registration of drug users with the information available to employers, lenders and pretty much anybody else.  I would not be adverse to having drug use be a bar to firearms ownership, piloting an airplane or driving a truck.

China was not able to resist the Japanese because it had been in a state of political chaos since early in the 20th century with a shooting war between the KMT and Communists and a whole lot of local warlords carving out little fiefdoms.  I doubt that drug addiction contributed that much to their national weakness.

The thing is that it requires an enormous amount of effort to prevent people from buying things that they want from people who want to sell those things to them and you need to be willing to pay the price that is required to prevent those sales before you agree to prohibit selling something.  Sometimes the cost of enforcement is greater than the harm done by the activity.

Yes, he grew hemp, along with a thousand other farmers.  It was a popular money crop because it was used for rope at the time.  In fact, when I was a kid hemp rope was still popular because it was much cheaper than cotton or nylon.  In Washington's day it was called "naval stores".

Posted by: D-Lamp at May 01, 2014 11:22 AM (bb5+k)

The act was created in 1906 primarily because the interstate shipment of beef and other commodities was unsanitary.  It originally had nothing to do with narcotics. It was primarily a "labeling" act requiring any subject that was deemed as harmful to be listed on the package.  Yes narcotics were included in that but they were not prohibited. You just had to label it.

560 China was not able to resist the Japanese because it had been in a state of political chaos since early in the 20th century with a shooting war between the KMT and Communists and a whole lot of local warlords carving out little fiefdoms. I doubt that drug addiction contributed that much to their national weakness. Posted by: Obnoxious A-hole at May 01, 2014 11:08 AM (PD6iL) A form of government several thousand years old, suffering from a 50% addiction rate among it's male populace gets overthrown, and you don't think drugs had anything to do with it? With such a huge quantity of people impaired in their production of goods and services, and you don't think this created massive social upheaval and chaos? Well what do you think did it then?

561 So every 'commodity/product' should be legal to sale or exchange ? You sure about that? Posted by: polynikes at May 01, 2014 11:12 AM (m2CN7) One of the characteristics of Libertarian philosophy is that it's consistent, right down to the bare insanity.

Posted by: D-Lamp at May 01, 2014 07:43 AM (bb5+k)

562 "So every 'commodity/product' should be legal to sale or exchange ? You sure about that?" It's already for sale; you can either let the blackmarket handle it with all its associated crime and violent, illegal behavior, or you can legalize it and let the market handle it in a safer, less destructive way. Think about prostitution. Prostitution is never going away, ever. It's the most timeless universal trade in human culture. The women who want to engage in this sad trade will do so regardless of whether it's legal or illegal. The difference though is: if it's illegal she will do it on shady street corners in dangerous conditions. If it's legal she can at least work in a clean brothel where there could be attention for security and medical hygiene. A seedy underground activity would be brought into the light of day and made at least somewhat civilized. And spare the silly straw man arguments about selling "human meat", which would necessarily involve butchering human beings and therefore violating their individual rights. If you want to be consistent about liberty, then there's no reason the government should be concerned with what mutually consenting adults do with their lives.

Posted by: Roadrunner at May 01, 2014 08:19 AM (7M8hQ)

You are simply looking at the problem down at the very small scale. Gain some altitude and look at the bigger picture. A nation which tolerates drugs, will die." Alcohol and caffeine are both addictive mind altering drugs. There is no objective line in the sand that you can draw which separates meth from caffeine or alcohol. They are fundamentally stimulating or depressing chemical agents, and the only separating issue is gradation of power. This is an extremely narrow and subjective way to interpret why some civilizations fall and while others remain free and prosperous. In fact, you could equally well argue that pornography is addictive, destroys the nuclear family, and therefore is an even greater than to civilization than drugs; therefore the government should ban marijuana. I'm sure inevitably we could cherry-pick some data to prove this point, just like anyone can with gun-control or drugs.

568 562 D-Lamp The Qing Dynasty lost the Mandate of Heaven. That is kind of flip but China has experienced a number of changes of dynasty over its long history. They are almost always traumatic and they have often been characterized by chaotic and sometimes rather long periods of transition. The Tai Ping Rebellion in the 1860s was an indication that all was not well in the Chinese governing system. A significant part of the problem was that the Chinese leadership did not want to acknowledge that events could be initiated by barbarians from outside of China. Chinese today accept that this is true but they seem pretty unhappy about it.
