On The Unjust, Illiberal, Innumerate, And Darn Near Illiterate Case For Socialized Law
— Gabriel Malor

Last week, Noam Scheiber wrote at the New Republic a column advocating for the socialization of law so as to prevent the wealthy from "buying justice." His column was explicitly founded in the claim that "the 99 percent" had a right to the same quality of legal representation as the wealthy. Recognizing that it would be impossible to provide expensive legal aid to every litigant, Scheiber proposed the obvious, but atrocious alternative: if we can't give top tier legal representation to the 99 percent, we should simply deprive the 1 percent of top tier legal representation.

Scheiber employed the rhetoric of rights to suggest that depriving the wealthy of legal representation somehow makes everyone more of a citizen. This was semantic gobbledygook, envy simply re-dressed in the language of liberty. This strikes me as deeply wrong, as I explained over at the Federalist this morning.

A taste:

“Too long, didn’t read” is an entirely reasonable response to such rubbish, relying, as it does, on a sketchy recitation of history, a steaming pile of class resentment, a fundamental misapprehension of the purpose for and effect of a legal system—not to mention the constitutional distinction between civil and criminal proceedings—and a shamelessly flippant redefinition of the word “liberalism.”

However, having thought it over for a few days more, I have to confess I was wrong. ScheiberÂ’s article can be quite succinctly summarized: Scheiber doesnÂ’t care a damn thing about justice in this country at all.

Throughout the ages, most religions have rightly condemned envy as a terribly destructive motivator, harmful both to the individual and to the community. The Bible warns of it repeatedly and the thinkers of the Middle Ages elevated (lowered?) it to be one of the Seven Deadly Sins. And yet the modern leftists' embrace of class resentment is nothing more than envy dressed up in the language of virtue.

Little help from any morons what's learned to read?  I remember a George Orwell (I'm pretty sure) piece about a couple whose kid was a good athlete, so the school made him wear a sack of weights, and then when he did well on tests they made him wear glasses that made writing fuzzy or something.

 

The whole thing is narrated deadpan, about how to heap restrictions on the functional to ensure that everyone achieves equally.  I haven't been able to find it googling, but it seems on point here.

Blind, yes. Equal? I'm not sure what that means. When mandatory sentencing became the law of the land, those who should have had lenience could not get it, and those who should have been put on death row did not.

Once upon a time, Lawyers (actually: "advocates" at the time- it's the same word in Greek that Jesus uses for the Holy Spirit during the Last Supper) were not people who actually necessarily knew the law any better than you (because the law tended to be fairly straight-forward), but people with enough separation from the situation to help you argue your side logically and persuasively.

49 I think there could be an argument to make that a system that depends heavily on the "quality of legal representation" to determine outcomes can't really be called a justice system in any appreciable way. I think Scheiber's coming from more of a typical socialist direction where anyone having more resources than anyone else is terrible, hence the occutard rhetoric and retarded solution to a half-thought through problem. I won't make the argument because I can't immediately think of a better system, but I feel like there's definitely something there.

As we already know,Benghazi is a dangerous place to have an embassy. It's not the first time a US embassy has been attacked and it likely won't be the last. We don't have the resources to ensure absolute safety to every US citizen in a foreign land. The administration response was appropriate. The US should not be in the business of occupying countries because of the actions of an unauthorized militia. To blame the President and Mrs. Clinton for it is just wrong!


Zimmerman's successful defense depended on getting jurors to focus on the fight that occurred just before he shot the 17-year-old, unarmed Trayvon Martin, and not on the events that preceded it. The lawyers established doubt about which man screamed for help, as well as other details of the confrontation — holes that invited an acquittal under Florida's laws.
But the fact remains that Zimmerman, a neighborhood watch volunteer and cop wanna-be, instantly identified Trayvon Martin as a "(expletive) punk" who "looks like he's up to no good." The fact remains that Trayvon Martin was doing nothing wrong; he was returning from a snack run at a convenience store, heading for the house of his father's girlfriend. And the fact remains that had Zimmerman stayed in his truck, as advised by the police, Martin would be alive today.
Those facts — and the authorities' initial failure to charge Zimmerman — inflamed the black community. African Americans saw the case in a way that the jury of six women, five of them white and the other of uncertain ethnicity, probably couldn't. Despite all the nation's progress in burying its racist past, minorities are commonly stopped by authorities — or viewed by strangers as "up to no good" — for no other reason than the color of their skin.
Consider New York City's "stop and frisk" policy, which allows officers to search anyone they see as suspicious: In 2011, 87% of those stopped were minorities. Or the shooting of three black men who did nothing more than venture into a white New Orleans community days after Hurricane Katrina. Or try to find an African-American man who hasn't been stopped for "driving while black" or eyed suspiciously in a department store.
Yes, Trayvon Martin's story was UN-told. THAT IS THE INJUSTICE!

I would not begrudge anyone the highest quality of representation that they can afford.

 

However I do believe that Public Defenders should at least be of the same qulaity as the DA, and have the same resources available for the defense.

 

As a guy who can't afford the Johnny Cochrans of the world with their Chewbacca Defense, I shudder at being at the mercy of the Angela Coreys and Mike Nifongs out there.

I think they're examples of 'violence and the threat of violence preventing justice'.

And even in these cases, I'd prefer to see the guilty go free dozens of times (OJ, Casey Anthony) than to see a single guilty person imprisoned.

Little help from any morons what's learned to read? I remember a George Orwell (I'm pretty sure) piece about a couple whose kid was a good athlete, so the school made him wear a sack of weights, and then when he did well on tests they made him wear glasses that made writing fuzzy or something.

The whole thing is narrated deadpan, about how to heap restrictions on the functional to ensure that everyone achieves equally. I haven't been able to find it googling, but it seems on point here.

 

I remember a Kurt Vonnegut novella with that plotline.

It does guarantee equal protection of the laws. This being the case, before we socialize medicine, we ought to socialize the legal system. If all lawyers work for a government check, there will be fewer interested in litigating, and the rich will get the same quality of legal representation as the poor.

331 312 Is that an argument for socializing the legal profession or really about the issue that one profession dominates our political class. When one profession (Lawyers) so dominates a nominally open job (politicians) it makes you wonder how it got that way. Is it because lawyers (trial at least) are taught to argue their points and can easily slide into the campaign mode? However, I would guess, as I have not looked it up, that most representatives are not lawyers of the trial variety. Is it a synergy that successful lawyers often have more financial resources, plus a network of people, in addition to the first? The first two could be something they have in common with doctors, for instance. When there is such a dominance like this (another example would be liberals in the media) you have to start wondering why it is.

332 As a libertarian and minarchist I'm a bit conflicted on this.

On the one hand, the government really should not set anyone's pay.

On the other hand, lawyers exist primarily to direct Leviathan's wrath on behalf of their clients' interests.

So lawyering is really the one, and only, profession that probably should be pay-capped by law.  We don't need John Edwards, we don't need David Boies, we don't need three-thousand page laws that only lawyers understand.

Or even better yet, dispense with the lawyers and the courtrooms, and just have corporations, doctors (and whomever else is being sued) just hand over a "reasonable" amount of money to the perceived "injured"--you know, to be fair and all. Your outrage over Zimmerman speaking to a dispatcher and referring to Martin as a "f--king punk" -- like Martin's own presumed annoyance at being eyed suspiciously by Zimmerman that night -- are irrelevant. Martin simply had no legal right to physically assault and batter Zimmerman just because Martin didn't like the way Zimmerman was looking at him, or didn't like something he said. And Zimmerman, once under the legally unjustified assault from Martin, had the legal right to defend his life with deadly force.

345 Socialized law doesn't sound like the worst idea in the world, and all the high-minded talk about 'envy' sounds bizarrely like someone who is trying to speak the language of Christians despite it clearly being a foreign tongue to them. Railing against the idea of socialized law, but talking up 'funding for legal aid'? Oh, so socialism and law mix just fine, but only so long as more money is being funneled to the lawyers? Fuck the lawyers, and to the extent that wealthy people rely on sheer power of assets and connections to alter the course of justice, fuck them too.
