Is Straw Buying a Gun Actually Legal?
Well I always just assumed not since there's a question about it right on the ATF form 4473 and answering yes to buying a gun intended for someone else (a 'straw purchase') will get your transaction refused at a minimum and might result in your prosecution.
But there's a case now before the Supreme Court, Abramski v. United States, that questions whether or not 'straw purchases' really are illegal based on the 2009 arrest of Bruce Abramski for buying a Glock 19 and then immediately selling it to his uncle.
Bruce Abramski is a former cop who is legally allowed to buy firearms. His uncle Angel Alvarez, can also legally buy firearms. Abramski purchased a Glock 19 pistol from a dealer using his law enforcement discount to get a better price, then sold the gun to his uncle. Both transfers-from the Virginia FFL to Abramski, then from Abramski through another FFL to Alvarez in Pennsylvania-followed the law.
The ATF then charged Abramski for perjuring himself on the ATF's form 4473 for saying he was the "actual buyer.
But it turns out that the ATF basically decided on their own that 'straw purchasing' must be illegal and added the above question to the 4473 form back in 1995 and started enforcing it as a law. But no where in any federal statute is there a reference to straw purchases much less a prohibition against them. Even the ATF admits that they're off in penumbra-land when it comes to this rule:
The assistant to the solicitor general, Joseph Palmore, admitted to the court that the ATF was "interpreting" the will of Congress when it added the "actual buyer" question in 1995 on the background form.
And during oral arguments before the court both Roberts and Scalia were highly skeptical of the government's arguments that the 1968 GCA somehow implies that straw purchases are illegal without ever actually mentioning them.
Chief Justice John G. Roberts Jr. seemed to side with the plaintiff's position that the ATF had overstepped into trying to create criminal law. Referring to the Gun Control Act, the chief justice said, "This language is fought over tooth and nail by people on the gun-control side and the gun-ownership side."
He called it "very problematic" for the government to cite going after law abiding people who resell firearms as a purpose of the law since "there are no words in the statute that have anything to do with straw purchasers."
There's interpreting the will of Congress by government agencies and then there's just making up laws you'd like to enforce. In a reasonable country this kind of overreach would be quickly struck down.
And only a heart beat away from President Joe Biden.
The Lone Survivor Controversies
So there seems to be a simmering debate among the services over the performance and planning of the SEAL mission recounted in Luttrell's book, Lone Survivor - particularly between Marines and the special forces community.
Daniel Smith, the son of blogger Herschel Smith of the Captain's Journal offers the Marine view here - A Marine Corps View of Tactics in Operation Red Wings.
And Hognose of WeaponsMan presents the special forces view here - About some Lone Survivor controversies.
Both are well worth reading and in agreement on some of the mistakes made. I think Hognose makes a good point when he points out that Marines and SEALS do fundamentally different types of missions and that the high risk/high reward style of the SEALS lets them do things that the Marines don't - along with a correspondingly greater chance of having a deadly day at the office.
Daniel, in his personal experience, does not understand the difference between recon and long-range recon, which the Army and SF have called things like LRR, LRP, LRRP, SICTA, and SR over the years. The principal difference, in tactical terms, is that a Marine unit like Daniel's, like any combat unit, normally pushes ground recon patrols only to within its area of influence. A commander may push them out to his whole area of interest, but he's accepting that they're beyond the reach of his fires if they get into the $#!+.
In the interests of force protection, the commander may enlarge that patrol, but there's a tradeoff: a larger recon patrol brings back less ground truth than a smaller one. A platoon patrol is thirty-plus guys with heavy packs, machine guns, and maybe even an attached mortar or two. They can fight if they're seen and engaged; what they can't do is hide.
In SOF doctrine, a strategic reconnaissance patrol goes deep, alone, and fundamentally unsupported. SF, SEALs, and other sophisticated US SOF are accustomed to going 1000 kilometers or more into a denied area or, if you will, "behind enemy lines." If they get into a fight, their tactic is to call for extraction, run, and engage the enemy to delay his pursuit.
...Remember: these small teams are what brings the commander the ground truth, a substance rarer than diamonds and worth more than gold. There are lessons to be learned from this operation, but "don't send out patrols lest they be eaten" is not one of them.
Herschel Smith has a rebuttal here.
Patterico Reviews His Sous-Vide Experience So Far
When I had tonight's tri-tip, things were quite different. This was a delicious meal that distinctly surpassed the results I have gotten from the same cut of meat on the grill. I tossed it in the Sous Vide Supreme for eight hours at 135 degrees, and at the end of the process, fired up my gas grill good and hot, to 600 degrees. Tossed it on there for one minute each side, and the results were amazing.
...This was very, very good. Very tender, but not mushy; juicy, and done perfectly to my taste. This is the only way to do tri-tip.
And here are some examples of how to make your own sous vide machines.
The reality of contract killing in Britain tended to be striking only in its mundanity, according to David Wilson, the university's professor of criminology. He said: "Far from the media portrayal of hits being conducted inside smoky rooms, frequented by members of an organised crime gang, British hits were more usually carried out in the open, on pavements, sometimes as the target was out walking their dog, or going shopping, with passersby watching on in horror."
Researchers found that the average cost of a hit was £15,180 [$25,132 USD], with £100,000 being the highest and £200 the lowest amount paid. The average age of a hitman was 38 with the youngest aged 15 and the oldest 63.
Okay it's Britain but still $25K isn't that much and probably swingable if you really need to have someone whacked.
Because they're likely to be disease super-spreaders.
Wonder who will be first to die in a massive killer pandemic or perhaps in a zombie apocalypse? Those who have an especially large web of contacts. At least the authorities in Singapore are going to know who these people are. As soon as some of them start acting like zombies all of them should be hunted down in order to save the city. That much is clear. Other parts of the world face a grimmer prospect.
Who Says Roman Tactics Are Dead?
They've just been resting and hanging out in Kiev during the recent riots.
In the early morning of Aug. 9, 1976, the bodies of a young man and woman were found on a secluded dirt road in Sumter County, S.C. Each had been shot in the throat, chest, and back. Both were white and in their mid-20s. They bore no identification, but there were signs that they were wealthy: He wore an expensive Bulova watch and had had specialized dental work, and she wore a jade ring.
"They were clean, neat," remembered county coroner Verna Moore. "She was beautiful, real pretty girl. He was also."
In the 38 years since they were found no one has ever come forward and identified them.
Repairing a Plane in Antarctica
What do you do when your 1940s era DC-3 crash-lands in Antarctica? Well in this case they came back with tools and parts and a team to fix it up enough to fly it back out.
On December 20, 2012 a Basler BT-67 Turbo 67 (DC-3T) - named Lidia - went down in Antarctica. Thankfully out of its 15 passengers there were no fatalities. For full details on the crash you can check out the accident description on the Aviation Safety Network.Lidia was built back in the 1940's, with its wings apparently put together by Rosie the Riveter herself in 1943. Its virgin flight was in 1944. Today, it is operate(d) as a tour plane, and before the accident it was conducting a tour of the Holtanna Glacier in Antarctica.
The plane sat in the snow for almost a year, before a team came back to repair it and bring it home. The expedition lasted two months, and they brought with them two new engines, a new cockpit, landing gear, and fuselage repair supplies.
25 Things You May Not Know About RoboCop
Such as it was actually filmed in Dallas and was written as the inverse plot of BladeRunner.
Quite possibly. But then maybe there was a period in the 70s when knitted Tin Man masks and quiches were fashionable which fits into my theory that everything was fashionable at some point in the 1970s.

The Smith jarhead critique says:
"Alternatively, since you knew comms was going to be bad on the other side of that mountain, you could have set down another team of four SEALs on top of the mountain or near it, who could have then relayed comms to the FOB from the recon team."
It's been known pretty much since the SOG era in Vietnam that small elite recce units (of any service) who insert long distances into Injun country can and do get in serious trouble on occasion, when discovered by larger units they can't fight off and can't exfiltrate away from.
The only options then are to extract the unit or reinforce them, and both rely on rock solid reliable communications. When comms go out, outcomes for such trapped outnumbered units become ugly.
From an engineering perspective, the services spent shit-tons of money on various whiz-bang speculative technology tools for Iraq and Afghanistan, much of which never really worked. (JIEDDO comes to mind.) Whereas drone relays for guaranteeing reliable comms in bad topography are a known problem with a known solution requiring only modest funding, which was never forthcoming.

In 1987, I had a beautiful Korean girlfriend....neither here nor there. That year, we went to RoboCop at the local theatre.... with her mom. The mom laughed through the entire movie ... she thought it was a comedy. To her... the violence was cartoonish ... far different than the realities of Korea in the 40s and 50s.

I recommend against the Ruger .380 LCP, myself. Hit or miss on reliability based on the two I've bought: one--the one my girlfriend owns--works great, the other doesn't (or didn't, since I got rid of it).
Bought an ancient, 100-year-old Colt Army Special .41 Long Colt revolver on GunsAmerica the day before yesterday: http://tinyurl.com/ldx39ux
It arrives next Monday. It's an old (but still functional) beater of a gun that uses a near-obsolete and incredibly expensive cartridge, so I'll be doing the bullet casting and reloading myself. Can't wait.

I don't get HBO here per se. It's some other channel that shows that stuff as well as other newtork's stuff. I think showtime has a devoted channel, though. "Trailer Park Boys" will probably be on that when it comes on again. I'm just digging the reruns of "Batman" and "Lost in Space" that are on now.

The awesome taste of icy hot hate sandwiches:
A number of motorists who had to abandon their vehicles in the snow on Highway 280 outside of Birmingham, Ala. were able to find shelter in the storm thanks to the kindness and generosity of Chick-fil-A restaurant employees and the restaurantÂ’s owner, Mark Meadows.
The snow started falling and accumulating, and pretty soon people were stranded. They sought shelter at the nearby Chick-fil-A.
Some of the drivers had been stuck in their cars for nearly seven hours without any food or water. So the staff of the Chick-fil-A decided to lend a helping hand.
“We cooked several hundred sandwiches and stood out on both sides of 280 and handed out the sandwiches to anyone we could get to – as long as we had food to give out.”
The staffers braved the falling snow and ice and Chick-fil-A refused to take a single penny for their sandwiches.

The problem with sous vides is not only the price - it's that they're massive. I have a small kitchen and not enough counter space.
If it's really useful and good, the same thing will happen that happened with microwaves - the first ones were very expensive for the time, clunky and not very powerful - now, they're cheaper, smaller and better. The first rule of electronics (everything from microwaves to cell phones) - first ones to hit the market are expensive and not that good. Hold off on buying one and the price will go down and the quality will go up.

When my first grand-daughter was born and Son In Law was holding her for the first time, he got the funniest look on his face, then looked up at me and said "I understand now."

When "30 Rock" was still on the air, Alec Baldwin was begging New York not to stop giving them tax breaks for filming in NYC. He said that it would too expensive to film there without the tax breaks. This was shortly after a rant about the rich not paying their fair share.

Right, Pgis.
There is another brother, Allen, I think is his name...and he is a preacher.

My girlfriend more or less laid claim to my stainless Taurus M85 .38 SPL snubnose. She loves it, shoots like Annie Oakley with it even though snubbies can be notoriously difficult for beginners to shoot. It has a surprisingly good double-action trigger for a lower-end price point revolver. It's a quality piece and--when loaded with +P rounds--of power approaching .40 Smith and Wesson.

"As a dad, I can pretty much guess that your problem with their choice in men is that no man is good enough for your little girl."
A woman in the comments section of the WSJ was saying tonight that the Planned Parenthood in her city was telling teenage boys to bring their girlfriends into PP offices for contraceptives. So that way, the girl couldn't use pregnancy as an excuse not to have sex.
I can just imagine how my dad would have reacted if a high school boyfriend who was pressuring me to have sex with him took me to PP and he found out about it. He not only would have killed the boy, he would have burned the PP office to the fucking ground.
But isn't it nice how PP helps horny teenage boys pressure their girlfriends into having sex? Hey, don't criticize them, you anti-women ha8ers!

I have had same problem with push/pull. Right hand severely injured years ago; strength training as done some, not much.
Weak right (strong) hand. Not comfortable with semi's. They seem so popular; I was only one on CCW class with revolver. But I learned to use it effectively and for me it is (corny) a friend. I know everything about it and can maintain it easily. No safety to worry about; I fire it single-action and i am good to go.

I don't think I'd carry a .22, but it has taken out a goblin or two (I can think of one right off the top of my head, a hotel clerk in SC, who used one to...discourage...a would-be rapist. Permanently). Nothing wrong with a 9mm using hollowpoints, they do with velocity what a .45 does with mass.
As far as the caliber wars, I ask them if they think a 30 caliber is a big rifle round (they say yes) and I point out that 7.62 is smaller than 9mm, and the most popular sporting rifle in the US today (AR-15) is a .22 caliber (.223 is a .22).

smller calibers, from .22- 9mm, whp present all sorts of data in>>
In the end any gun you are willing/comfortable/good at shooting/carrying is the gun you should carry. Since there will be a bang and pain that will stop most attacks (or slow it to where you can escape). Odds are that will do for 99% of perps, the guy on crank that will keep coming after the first shot is not the norm.

Reading the supporting links in the debate about Lone Survivor. Small units being pursued by much larger enemy units like the story here, used land mines to discourage pursuit.
Now, do you remember all the hollywood celebrities campaigning against land mines? So land mines are now recognized as inhumane, and we don't use them any more. Rules of Engagement.

1) Daniel Smith's comments are correct. You're doing a helo insert, that's a big footprint, at least run a full squad in, displace by team and/or during low vis to minimize footprint, do some route planning, establish an ORP, emplace a couple crew serves, delegate comms and EPW handling... then push up the team in charge of recon/HVT. It's bullshit to say you can't hide a squad a terrain feature behind the tip of your spear in rugged terrain - if you can't hide a squad dispersed in defilade and veg, you most likely can't hide more than a buddy pair. In some ways the SOF sales pitch requires this type of employment, but the reality is they could've brought a few more teams and detection risk would have remained exclusively a product of bad luck rather than footprint - but that risk would've been mitigated by mutual support and redundancy. Not always true - if we ever fight a conventional enemy with aerial FLIR or GBOSS on post, sure, maybe we need a smaller thermal signature. But that's not the fight right now. Still great men, still a well-planned op, still a great story to remember. But you will die when you fail to apply brilliance in the basics, to include not just small unit tactics but the MOOSEMUSS - which commanders tend to ignore when they're talking SOF. MARSOC, SEALs, SF can all do a lot of really fancy technical shit that it makes no sense to train a line platoon on, but that fancy shit in no way backfills a want for sound fundamentals.
2) The more I think about it, JWF can EAD over shitting on Grimm. We've got another bullshit SOTU to choke down, and rather than pushing tough questions on the friends of the guy who just dropped that steaming turd, the media's interested in diverting attention from their failking to a congressman of virtually no concern in relative terms. "Oh but integrity!" Yeah, this whole eating our own thing is working out great, it's really showing so much character to insist a republican resign over rhetorical flourish, and it's clearly gotten us traction with the left in the past 5 years. Psych. Let him throw that twat off the balc, then we can laugh and say "Yeah, his career's probably over." But unless he does that, JWF should put on some big boy pants and stop acting like such an easily offended pansy. Douche reporter went to 7000RPM for the spin machine, Grimm said what we all want to say, no harm no foul.

Interesting, also, that the Berkut (pictured above and deployed as "riot control", are really spec ops Ukrainian military) utilized snipers atop government buildings to take out Ukrainian protesters who are staking their lives for freedom from Russian control. Been following this for a time.

wow, reading the comments means you can't really engage in time to matter - no, not the first time I noticed this
DC-3s - fascinating, should read the link; perhaps it's one of those that I rode on from South Africa to another southern African country to remain nameless lo those many years ago - was very nice inside, completely updated - pilot flew low to avoid radar and so that we could see the wildlife, but mostly to avoid radar (though there were actually animals to see, too)
PJ O'Rourke - his Lebanon "travel article" in 1985 was sheer brilliance, from conception to execution; too many outstanding moments to recall - hilarious account of being the only outsider, not to mention tourist, in Baalbek (site of wonderful Roman ruins), where he shared drinks with the Syrian officer in the hotel bar, while outside the Pasdaran and hashish traders plied their respective trades
Lone Survivor/Marines/SEALs - Yoshi, if you're still here, I attended a SEAL Qualification Training graduation two years ago in Coronado, two Marines sat in front of me, one of their buddies was among those having the Trident pinned on that morning - I still recall, when the Naval Spec. Warfare commander who was presiding described how the 61 or so grads before him had fired more than 1,000,000 rounds of ammuntion in the preceding year of SQT, the Marines just sighed and looked at each other (I shook my head and sighed a bit in envy and admiration as well)

So the DNI (post that shouldn't exist) says that Iran is a "turn of the screwdriver" away from nukes. Shocking!
Let us all recall way back when Dubya was president, and the *ridiculous* National Intelligence Estimate was issued claiming that Iran had abandoned its nuke program/ambitions.
Lack of intellectual heft and integrity in the intel community - check.
So what does Dubya do? Instead of (as in the Hamdan "ruling" from the SCOTUS on military tribunals) advancing the national interest, and essentially calling "bullshit" on the hijacking of serious national institutions and missions by unserious and unfit people, he just goes along.
The institutions are probably beyond redemption, but Dubya might have helped the country start the rebuilding process if he'd only stated the obvious and used his office to challenge, expose, humiliate, and diminism the incredibly sub-mediocre people who either dominate or have a large presence in the national security/foreign policy bureaucracy.

When the gods decided to wipe out mankind with a flood, the god Enki, who had a sense of humour, leaked the news to a man called Atra-hasis, the ‘Babylonian Noah,’ who was to build the Ark. Atra-hasis’s Ark, however was round. To my knowledge, no one has ever thought of that possibility. The new tablet also describes the materials and the measurements to build it: quantities of palm-fibre rope, wooden ribs and bathfuls of hot bitumen to waterproof the finished vessel. The result was a traditional coracle, but the largest the world had ever dreamed of, with an area of 3,600 sq. metres (equivalent to two-thirds the area of a football pitch), and six-metre high walls. The amount of rope prescribed, stretched out in a line, would reach from London to Edinburgh!

Vasiliy (One Ping Only), as I added later, 1 million rounds does sound too high, but I know the total was expressed as (at least) some fraction of a million. A half million would be 1,300 rounds per day; half that sounds plausible at 600 rounds/day. Considering weapons and marksmanship are just one of their training areas (don't recall exactly, think they include underwater/scuba of course, parachute/airborne, medical, navigation/maps/planning, something like that). Attended as the guest of an old friend and 25 year+ SEAL who was an SQT instructor for that class.
Best part was another class (could have been a BUD/S class) standing to the side at attention the entire time, in their fatigues/boots, and then after they'd all received their Trident pins the top member of the SQT class said to his brothers something like "now we get to give the order!" and all the guys in their whites stood and shouted at the other class "wet and sandy!" while pointing towards the beach just behind the walls in front of us. The other class runs out, and returns a few minutes later, resuming their position, dripping with seawater and with sand all over their fatigues.

My girlfriend (fiancé--its complicated) has a tumor in her brain that the doctors told her was cancer. I don't know what type or anything. Its hard to get more information from her...
Posted by: Joffen, fucking sunshine patriot at January 30, 2014 03:24 AM (+w1hQ)
Cancer, in general, is an incredibly complicated subject. Consider, for example, that a huge proportion of men will develop prostate cancer if they live long enough (1 out of 10 guys who hit 70 will develop it in the next 20 years http://www.cdc.gov/cancer/prostate/statistics/age.htm ) -- but few of them will need to treat it (frequently causes urinary incontinence and impotence) because it's growing slowly and they're busy dying of something else.
It's made more complicated because the phenomenon of cancer (human cells becoming immortal) is almost just a symptom, like "fever". There are all sorts of immortal cells -- any amoeba, for instance -- and that's perfectly normal.
If you're looking for more info, see if there's anything around her that says "-oma", as in melanoma, glioma, carcinoma, etc. That'll get you a rough idea as to flavor. Then, you'll be wanting to know if they'll try surgery, chemotherapy, or radiation. Around here (Silicon Valley), one of the interesting technologies being used is to project a beam of energy smaller than a pencil through a patient's head while clamped, but move the emitter rapidly around the patient in 3D so that the cancer gets cooked while the rest of the brain is merely warmed slightly.

There are all sorts of surprising things in medicine. One that I'm particularly fond of is the story that the French polymath Blaise Pascal -- the guy who formalized probability, invented projective geometry, came up with the first mechanical calculators, inventor of the hydraulic press and the syringe, among other things -- died at the age of 39....and, upon autopsy, had significant physical brain damage that rendered 40% of his brain useless during his most productive period.

Not sure. I'm in finance, and I heard about it from someone who was in inventory control......evidently, this technology is very promising and very effective, and the company that is making it into a product is headed by a CEO who is absolutely, passionately committed to making it work.
But who is, perhaps, a titch too tightly wound......because when the movement thing cut out with the beam still operating, he went down into the stockroom and accused the folks who may have pulled the wrong parts to put on control boards of murdering the patient. Without, mind you, an analysis of whether the patient's death was inevitable before treatment; or whether the treatment made things worse; or what was at fault for the misbehavior of the apparatus; or what part of the system failed to allow for the apparatus to fail, etc. Instead of software engineers who didn't code for "am I still moving?", the CEO made a very emotional speech about "zero tolerance for failure" in the stockroom, which led (as you might imagine) to a mass exodus from the stockroom.
It is a great pity -- the company does real good, has an innovative product, is the best there is at it and is getting better......but can't keep some of its best people because they're held to impossibly high standards. The guy I knew was top-notch, but was working in cable TV instead of medical devices.

Regarding RoboCop, if you want to know just how awful Dallas was during the mid-80s, watch the scene early on when Boddicker and gang are escaping in their van (which is where they throw Bobby out the back). It cuts to a wider shot where they are moving next to a highway. That's I-35 and on the far side is where the American Airlines Center now stands. At that point it was a cement plant, and the surrounding area was hell.
There's more, but I could go on forever about how awesome that flick is.

How in the world can a gun that was processed by an FFL for...wait for it...TWO TRANSACTIONS...ever be considered a straw purchase. The whole idea of straw purchasing is the avoidance of the background check system. Thats the reason its "illegal". There is no straw purchase here...there are TWO PURCHASES with TWO RUNs thru the background system. One guy bought the gun...had an FFL process it...then sold it to his friend (Which incidently does not require a background check) and ran it thru an FFL again.
What a stupid case this is...and they wonder why those of us for gun rights do not support the dumb laws these idiots propose.
