American progressives have long contended that as social science enables us to overcome some of the limits of what we know, it should also be permitted to overcome the constitutional limits on what government may do. They take themselves to be an exception to the rule that all parties see only parts of the whole, and therefore an exception also to the ubiquity of confirmation bias, and so they demand an exception to the rule that no party should have too much raw power.

...But understanding human limitations does not mean we can overcome them. It only means we can't pretend they don't exist. It should point us toward humility, not hubris. And in politics and policy, understanding the limitation that Klein highlights should point us away from technocratic overconfidence and toward an idea of a government that enables society to address its problems through incremental, local, trial-and-error learning processes rather than centrally managed wholesale transformations of large systems.

Stop the Party: Powdered Alcohol Maybe Not Approved After All

A product called "Palcohol" gained widespread attention online in recent days after it was reported that the Alcohol and Tobacco Tax and Trade Bureau approved the powdered alcohol, including vodka and rum varieties. But a representative for the federal bureau, Tom Hogue, said in an email to The Associated Press late Monday that the approvals were issued in error.

"An oversight of this nature does not ring true to me," [lawyer Robert] Lehrman said in a phone interview. He suggested that the bureau may have heard back from lawmakers wanting more information on the powdered alcohols.

The background: Youngest Son's teacher is as close as family, Laura adopted her (because she did that sort of thing) which is why I have a black sister in law who is fifteen years older than me. Anyway, last Thursday she got hit with some bad news, her grandson was shot and killed in Winston-Salem. He was 22.


She's the one that has had to put everything together because of course her daughter is a wreck, she's just gotten over breast cancer treatments (successful treatments, I might add...one bright spot) and of course this week she's been running to and fro which means she hasn't been resting.


Her name is Lenora Allen.


Youngest Son was his little buddy, so Youngest Son has been taking it pretty badly, too.

139 I watched an episode of the UK Antiques Roadshow tonight and it had Formula One race-car driver Jackie Stewart on it for a brief appearance. His voice is the same and you can still see the younger man in his now-old face.

His dad was a gamekeeper in (obviously) Scotland so Jackie said he was raised with a shotgun and a fishing-pole in his hands. He had his German Grand Prix trophy with him as well as his shooting cup and told the anecdote that I also found on his Wiki page...

His last (and then record-setting) 27th victory came at the Nürburgring with a convincing 1-2 for Tyrrell. "Nothing gave me more satisfaction than to win at the Nürburgring and yet, I was always afraid." Stewart later said. "When I left home for the German Grand Prix I always used to pause at the end of the driveway and take a long look back. I was never sure I'd come home again."

He said two out of three of his buddies died race-car driving that saw him decide to work on track safety after he retired.

Having visited Canada many times I've come to really like Tim Horton's. Their coffee is less bitter than Starbucks and their sandwichy snack foods are tasty and cheap.

Just looked it up.  For the original car giveaway of the Pontiac G6 they did not cover the tax cost so the people had to claim it as income and pay the tax on it.  Apparently when she did it next time they did try to estimate the tax burden the cars would cause and covered it.

Who knew it was so hard to find a rifle range with decent range length?  In Ohio, the eastern half of the state, I have found exactly 1 public range that has lanes as long as 200 yards.  The southeast corner of the state is right up against Appalachia, I suppose everyone there just shoots on their cousin's farm?

Half the males had been in the system, and about a quarter of the women. At our 30th reunion last fall, I found out about 80 of the class of 500 were dead. Over 15% of the class died before 50. For comparison, I moved my senior year to another city, went to the schools in the surrounding county, and out of a class of 250, about 10 have died.

If only it were that easy. What I always find shocking about stories such as his are the number of people willing to accommodate the monsters. Worse, those who are willing to do the deed themselves out of loyalty. Gaddafi used to visit schools, patting girls on the head as a signal to his team those whom he wanted to be taken to his home. They would then wait and capture the girls on their way home and hold them prisoner.

Before I go into why, I'd like to share my pet peeve with adventure flicks like the Bond films. There's always this deal where the hero and his girl are tooling along in a boat. A team of bad guys boards the boat and takes over, re-routing it to some nefarious port -- maybe the hero and his girl are in a stateroom, and the gang kills the captain and first mate and takes over. So the hero goes sneaking off and finds a bad guy alone -- and captures him, ties him up, and stuffs him into the stateroom closet. Then he sneaks around some more, gets the drop on another bad guy, and stuffs him into the stateroom closet. He does this, one after the other, until he goes up to the bridge to confront the gang leader, and the whole gang is there -- either they escaped by themselves, or the gang leader went and found them.



And here's the peeve -- why did the hero stuff the bad guys in the stateroom closet instead of chuckin' 'em overboard? Would have been very embarrassing for the gang leader to dramatically open the closet door and -- "WTF? Sixteen pairs of dress shoes?" Even if the minions survived, they'd be several miles behind the boat and no threat to anyone.



And here's why this is relevant....did the homeowner know there were only two when he executed 'em? He shot the first one, dragged him down the stairs, and killed him....then went back to lying in wait. Shot the second one, dragged her down the stairs, and killed her.....did he go back to lying in wait?



'Cause if he did, I could see that he might have felt under siege by a group of predators -- and premeditated murder one would look like a whole bunch of over-charging.

Dave Thomas was a stickler for quality, a stickler. He could go into any store and get behind the grill and churn out burgers as fast or faster than the best guy in the store. He knew what every temperature should be, and the cooking times down pat. The guys today have probably never been behind the counter in their lives, and that is true of all food companies.

The usual plot device used is for the bad guy leader to tell his minions "bring them (or him) to me, alive." So he can talk them to death, apparently. James is still alive because of this device at least in half the Bond movies.

You have to show that the initial attacker continues to be a threat even though they are no longer attacking. A clear-cut example is if you were camping alone in the woods and someone tries to kill/rape you. Even if they disengage and run off, they are still a clear threat since there is no one else around and the attacker could always come back. Probably not the case here, but I did want to clarify on that point.

In ROTJ, Han put his hands up when ordered to surrendur by the stormtroopers, but Leia never did, and blasted both  of them as soon as Han was clear from her line of fire.  One can argue that Han helped to deceive them because he knew Leia would not surrendur, but I don't think you could say it was a violation of the rules of war.  So this is actually a bad example of the phenomenon you're describing, though I know exactly what you are trying to describe.  A better example would be the final confrontation in US Marshals, but that was the bad guy, and Tommy Lee blew him away before he could pull it off.

Ironically enough, in California you actually have a limited right to persue and continue attacking someone even if they disengage. You have to show that the initial attacker continues to be a threat even though they are no longer attacking.

Han was under no obligation to let the stormtroopers shoot him in the back if Leia could ambush them.  If an Afghani corners an American scout and orders him to put his hands up, does he let the Afghani blow him away if he knows his sniper buddy is lining up the shot?  Is he obligated to tell the Afghani?  I'd say the answer to both questions is no.  Han didn't shoot, and never did he say to them "we surrender".  C3PO with the Ewok ambush of the stormtroopers is a more accurate example where an ambush was set that depended upon a fake surrender from the outset.  Leia could have blown away the stormtroopers from cover whether or not Han had been there.

I guess that where I'm going is that I don't know squat....but the original article's assumption that it's a done-deal and the guy deserves to hang appears to be less than fully certain.....and with that level of uncertainty, the prosecution seems to have grandstanded by going for a murder one premeditated.



It really seems like the criminal justice system has been replaced by a series of reality-TV shows. "Who is cuter -- the shooter or the shot?" "Is the shooter or the shot a minority?" "Who has the better narrative?" "How much can we escalate the charges to get him to plead out?" "Deal or No Deal?"
