Yuval Levin on Confirmation Bias and Human Nature
A longish but worthwhile read.
American progressives have long contended that as social science enables us to overcome some of the limits of what we know, it should also be permitted to overcome the constitutional limits on what government may do. They take themselves to be an exception to the rule that all parties see only parts of the whole, and therefore an exception also to the ubiquity of confirmation bias, and so they demand an exception to the rule that no party should have too much raw power.
...But understanding human limitations does not mean we can overcome them. It only means we can't pretend they don't exist. It should point us toward humility, not hubris. And in politics and policy, understanding the limitation that Klein highlights should point us away from technocratic overconfidence and toward an idea of a government that enables society to address its problems through incremental, local, trial-and-error learning processes rather than centrally managed wholesale transformations of large systems.
The New Progressive Aristocracy
At least the old aristocracy had actual titles and were bound by rules and legal obligations.
Stop the Party: Powdered Alcohol Maybe Not Approved After All
A product called "Palcohol" gained widespread attention online in recent days after it was reported that the Alcohol and Tobacco Tax and Trade Bureau approved the powdered alcohol, including vodka and rum varieties. But a representative for the federal bureau, Tom Hogue, said in an email to The Associated Press late Monday that the approvals were issued in error.
"An oversight of this nature does not ring true to me," [lawyer Robert] Lehrman said in a phone interview. He suggested that the bureau may have heard back from lawmakers wanting more information on the powdered alcohols.
And here's the science behind the currently forbidden Palcohol.
Byron Smith, 65, is being tried for killing two teenagers who broke into his home - Haile Kifer, 18, and Nick Brady, 17 - on Thanksgiving Day in 2012. That would have been defensible but then after shooting and disabling them he proceeded to execute them with finishing shots all the while recording the entire incident. So I'm thinking crazy and dumb with crazy having majority voting rights.
Oprah and Her Family Drama Mess
Or why you wouldn't want Oprah as a step-daughter. The fact that Oprah kept everything in her own name instead of just giving it to her father is telling.
The World's Most Jealous Woman
There's a lid for every pot and so I guess every Jabba has a Leia as well.
42 year-old Debbi is so paranoid that partner Steve Wood, 30, will play away from home that she also checks his phone, email accounts and bank statements several times a day. Steve - who started started dating Debbi in 2011 - is even banned from watching women on television or looking at pictures of them in magazines as Debbi has installed childproof filters on his laptop and mobile phone.
Doctors have diagnosed Debbi with Othello Syndrome - a rare psychiatric disorder which causes sufferers to believe their partners have cheated - even if they have little or no evidence. Debbi, of Leicester, admitted: 'Even if Steve pops out for 15 minutes to buy a pint of milk, I make him take a lie detector test as soon as he gets home.'
2048: The Animated Beyonce Edition

For My Next Defense Witness I'd Like to Call Miss America to the Stand
From 1969 so forgive the annoying groovy 60s effects. Roy was (and is) more than just Hee Haw - he was pretty much a master of anything with strings. And a pretty good comedic musical actor as you can see in his version of Dueling Banjos.
The AoSHQ group. Yeah.

Here is a fun trick to play on your liberal friends, everytime I do it they are shocked. Ask them "just who are the 1%?" Some say billionairs, of course they get shocked the most, but even the ones that say millionairs are shocked to learn that a married couple earning $325,000 is in the 1%, per IRS stats from 2009.
They get so upset that they start toquestion the 'experts' they listen to for advice.
Try it!

The background: Youngest Son's teacher is as close as family, Laura adopted her (because she did that sort of thing) which is why I have a black sister in law who is fifteen years older than me.
She's the one that has had to put everything together because of course her daughter is a wreck, she's just gotten over breast cancer treatments (successful treatments, I might add...one bright spot) and of course this week she's been running to and fro which means she hasn't been resting.
Her name is Lenora Allen.
Youngest Son was his little buddy, so Youngest Son has been taking it pretty badly, too.
Thanks!

Final advice for Steve.
Debbi is a bear-trap date. You wake up the next morning to find your arm trapped under her. So you chew your arm off to escape without waking her.
Flee! Run away brave Sir Robin!

His dad was a gamekeeper in (obviously) Scotland so Jackie said he was raised with a shotgun and a fishing-pole in his hands. In 1960 he won the UK trap shooting award but missed the Olympics spot because the team was only two-man instead of the (apparently) more-usual four-man and I guess he didn't have enough points to make the top two nationally although he was around as a substitute.
He had his German Grand Prix trophy with him as well as his shooting cup and told the anecdote that I also found on his Wiki page...
His last (and then record-setting) 27th victory came at the Nürburgring with a convincing 1-2 for Tyrrell. "Nothing gave me more satisfaction than to win at the Nürburgring and yet, I was always afraid." Stewart later said. "When I left home for the German Grand Prix I always used to pause at the end of the driveway and take a long look back. I was never sure I'd come home again."
He said two out of three of his buddies died race-car driving that saw him decide to work on track safety after he retired.
His Wiki page is pretty interesting so, here you have it:

She mortgaged HER house that her daughter & grandkid were living in to renovate papa winfrey's barber shop, caught him cheating & moved into a separate bedroom in their shared house. He then moved out & filed for divorce and left her hanging on the loans, which Oprah moved in and bought from the bank. She then sold off step Mom's house and told her to gtfo of the shared marital home. Oprah is a scrunt. Hope this woman makes some $$ off this to recoup her losses.

One of the takeaways from the article is that Oprah doesn't *give* anybody anything - everything stays in her name and will be taken away if you displease her.

Just looked it up. For the original car giveaway of the Pontiac G6 they did not cover the tax cost so the people had to claim it as income and pay the tax on it. Apparently when she did it next time they did try to estimate the tax burden the cars would cause and covered it.

Before I go into why, I'd like to share my pet peeve with adventure flicks like the Bond films. There's always this deal where the hero and his girl are tooling along in a boat. A team of bad guys boards the boat and takes over, re-routing it to some nefarious port -- maybe the hero and his girl are in a stateroom, and the gang kills the captain and first mate and takes over. So the hero goes sneaking off and finds a bad guy alone -- and captures him, ties him up, and stuffs him into the stateroom closet. Then he sneaks around some more, gets the drop on another bad guy, and stuffs him into the stateroom closet. He does this, one after the other, until he goes up to the bridge to confront the gang leader, and the whole gang is there -- either they escaped by themselves, or the gang leader went and found them.
And here's the peeve -- why did the hero stuff the bad guys in the stateroom closet instead of chuckin' 'em overboard? Would have been very embarrassing for the gang leader to dramatically open the closet door and -- "WTF? Sixteen pairs of dress shoes?" Even if the minions survived, they'd be several miles behind the boat and no threat to anyone.
And here's why this is relevant....did the homeowner know there were only two when he executed 'em? He shot the first one, dragged him down the stairs, and killed him....then went back to lying in wait. Shot the second one, dragged her down the stairs, and killed her.....did he go back to lying in wait?
'Cause if he did, I could see that he might have felt under siege by a group of predators -- and premeditated murder one would look like a whole bunch of over-charging.

Then.....then one fateful day as debbi ate dallas was channeling her inner Mengele and administering her lie detector test, a sub par chinese electrical component of typical inferior quality had failed and sent an electrical charge down the leads that were attached to steve's nads. The resulting shock had awakened Steve from his apparent 3 year walking coma. One cthulhu, they weren't armed IIRC. Two, they have the 911 tape where he executed them. Three, he admitted firing the coup de grace shots into them both.
The law allows self defense, but doesn't expand that definition to 'they were still breathing'.
I think he is going down hard, and I think he did serious harm to the argument about self defense in general.
Now we wait and see who is right.

Yep, that's my understanding for pretty much anywhere.....but with multiple assailants, how do you know that someone has been rendered incapable of triggering further harm? If someone is wounded on the floor and incapable of attacking you, but may yet gasp "hiding under stairs" to a confederate -- putting your life in danger.....isn't he still a threat? It's not like you can anesthetize him.
Gloating, recording, being pissed off are just revving up emotions -- the same as posting high-school pictures. He thought he was being attacked by a gang.
Thought experiment -- what if he'd done this nine times? Shot someone, dragged 'em into the basement, finished 'em. Lather, rinse, repeat. He'd be a hero, yes? Old guy assaulted by a gang of NINE thugs, "disappears" them to basement one-at-a-time.... It's not like he could have wounded one, then walked out onto his driveway to get jumped by the other eight.

A famous example that everyone has seen is the Endor scene in Return of the Jedi, where Leia and Solo are stuck with an unopenable door at the bunker, and stick their hands up. They surrender, before then blasting their 'captors'.
Tuco had the right of it in The Good The Bad And The Ugly when he shoots the bounty hunter, saying "If you have to shoot, shoot. Don't talk."
The usual plot device used is for the bad guy leader to tell his minions "bring them (or him) to me, alive." So he can talk them to death, apparently. James is still alive because of this device at least in half the Bond movies.

In ROTJ, Han put his hands up when ordered to surrendur by the stormtroopers, but Leia never did, and blasted both of them as soon as Han was clear from her line of fire. One can argue that Han helped to deceive them because he knew Leia would not surrendur, but I don't think you could say it was a violation of the rules of war. So this is actually a bad example of the phenomenon you're describing, though I know exactly what you are trying to describe. A better example would be the final confrontation in US Marshals, but that was the bad guy, and Tommy Lee blew him away before he could pull it off.

justifying self-defense renders the attacker incapable of attacking
further injuries, the law of self-defense ceases and no further
force may be used.

Ironically enough, in California you actually have a limited right to persue and continue attacking someone even if they disengage. You have to show that the initial attacker continues to be a threat even though they are no longer attacking.
A clear-cut example is if you were camping alone in the woods and someone tries to kill/rape you. Even if they disengage and run off, they are still a clear threat since there is no one else around and the attacker could always come back.
Probably not the case here, but I did want to clarify on that point. Posted by: The Gun Hat at April 23, 2014 01:45 AM (AymDN) Hide posts from (AymDN)
Common sense still the law, even in California.
The thing that gets me in this situation is that there seems to be a huge open door here. I mean: "he shot the guy, dragged him downstairs, and executed him" / "he thought there might be more" / "ha, ha, ha -- how ridiculous that there might be more than one -- he executed the kid in cold blood" is a reason to go for murder one.
"He shot the guy, dragged him downstairs, and executed him" / "he thought there might be more" / "ha, ha, ha -- how ridiculous that there might be more than one -- he executed the kid in cold blood" / "turns out there was more than one" kind o' puts a hole in that.
And, just like mathematical proofs -- once you grant "for anything that is true for n, it is likewise true for n+1", it's a done deal. If there had not been a second intruder, they could ridicule the possibility that there was more than one.....but once you have a second intruder, how can you argue against a third?

The Nazis took plenty of POWs, and didn't even torture all of them. Unintended by Lucas I'm sure, but the Empire of the original 3 movies closely mirrors the US under Obama--an evil leader who centralizes power, and most of the citizens are not aware of the extent of the evil at the top, and are hostile to the political opposition because of a compliant press.
Han was under no obligation to let the stormtroopers shoot him in the back if Leia could ambush them. If an Afghani corners an American scout and orders him to put his hands up, does he let the Afghani blow him away if he knows his sniper buddy is lining up the shot? Is he obligated to tell the Afghani? I'd say the answer to both questions is no. Han didn't shoot, and never did he say to them "we surrender". C3PO with the Ewok ambush of the stormtroopers is a more accurate example where an ambush was set that depended upon a fake surrender from the outset. Leia could have blown away the stormtroopers from cover whether or not Han had been there.

I guess that where I'm going is that I don't know squat....but the original article's assumption that it's a done-deal and the guy deserves to hang appears to be less than fully certain.....and with that level of uncertainty, the prosecution seems to have grandstanded by going for a murder one premeditated.
It really seems like the criminal justice system has been replaced by a series of reality-TV shows. "Who is cuter -- the shooter or the shot?" "Is the shooter or the shot a minority?" "Who has the better narrative?" "How much can we escalate the charges to get him to plead out?" "Deal or No Deal?"

She has no reason to feel insecure. An F5 tornado wouldn't budge her off the couch.

Before he got famous, Glen Campbell was member of the Wrecking Crew:

You had to be a serious player for that.

An upbeat favorite.
The hubby puts it in the 'self indulgent live jazz' category ...
oh well ...
Night all. Enjoy the music.

I do miss Robert. I hope he's doing well, and that he makes it back to let us know not to fret.

There has been so much sadness on ONTs. Can't someone welcome a new relation or report a successful treatment?

From Drudge: Kerry: 'It was easier' in Cold War...
Because you were the opposition, jackass. Real men with names like Kissenger and Reagan had the stones to do what it took to keep this country safe while mewling liberal Commie sympathizers like you could get away with nothing but critique. Now that flowery speeches and strong words that sound good at a faculty debate or while sipping mimosas on your yacht aren't enough when you hold the reins of power, you realize this sh*t is hard.
Impeachments. Trials. Humiliation. Incarceration. The whole lot of this corrupt administration.

I was actually a little proud of that one. Shame I didn't troll Drudge earlier for the headline that inspired it.
